The City Council of the City of Baytown, Texas, met in regular session on
June 13, 1996, at 6:30 p.m., in the Council Chamber of the Baytown City Hall, with
the following in attendance:

The meeting was opened with a quorum present, and Council Member
DonCarlos offered the invocation, after which the following business was conducted:

Council Member Pruett moved for approval of the minutes for the regular
session held on May 23, 1996. Council Member Escontrias seconded the motion.

Hold Public Hearing on Proposed Annexation of 2.408 -Acre Tract in
Independence Bend Subdivision at 6:31 p.m.
Mayor Alfaro called to order the public hearing concerning the 2.408 -acre
tract in Independence Bend Subdivision at 6:31 p.m., and asked those present
desiring to speak to register on the list provided in the lobby as that list would
provide the speaking order for the hearing. He stated that the hearing was for the
purpose of receiving public input with regard to the proposed annexation, and
everyone desiring to present information at the hearing would be given ample
opportunity to do so. However, he encouraged each speaker to be as brief and to
the point as possible, noting that the hearing was not an adversarial type
proceeding, but an opportunity for all interested persons to be heard. He asked that
all questions be directed to him, and he stated that, with the aid of City staff, he
would attempt to answer the questions.
Independence Bend Subdivision is in the northern part of the community
near Interstate 10. The total tract is 15.5 acres of which 13 acres have been
annexed by the City. The annexation of the 2.408 acres will square the property.
The tract will contain approximately fifty -six homes in a price range of $90,000 to
$130,000. The service plan has been developed and indicates there is no
additional cost or staff required.
Since no one had registered to speak, the Mayor closed the public hearing.
Consider Proposed Resolution No. 1280, Naming the Fire Station to be
Located at 3311 Massey Tompkins the V. H. "Buddy" McBride Fire Station
No. 3
Baytown Fire & Rescue has requested that this fire station be named the V.
H. "Buddy" McBride Fire Station No. 3. One of the criteria for naming a facility after
an individual is service to the community. Buddy McBride dedicated his life to
serving the citizens of Baytown in the Fire Department for thirty -six years and as
Fire Chief for sixteen years. He supported youth through various little leagues,
S.A. L.T., and the Youth Fair.
Council Member Byford moved to adopt the resolution. Council Member
Pruett seconded the motion. The vote follows:

SAID FIRE STATION; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
Consider Proposed Ordinance No. 960613 -2, Setting Time, Place, and Date for
Public Hearings on Proposed Annexation of 9.8099 -Acre Tract out of the Clyde
McConnell Harper Estate, East of Thompson Road and South of Interstate 10
(Near Truckstops of America)
The ordinance sets the time, place, and date for the public hearings on the
proposed annexation of a 9.8099 -acre tract out of the Clyde McConnell Harper
Estate east of Thompson Road and south of Interstate 10. Humble Truck and
Trailer Repair, Inc. plans to construct a truck repair and custom paint facility at this
location. Council Member Hinds moved to adopt the ordinance. Council Member
Benavides seconded the motion. The vote follows:

Adoption of the ordinances will annex the future site of Ron Craft Chrysler

This ordinance provides the same authority for code enforcement to all of
our code enforcement officers to allow them to work all of the violations at one

Consider Proposed Ordinance No. 960613 -6, Authorizing Purchase of Program
Vehicles from Houston - Galveston Area Council
This ordinance authorizes the purchase of thirteen program cars from
Houston - Galveston Area Council for the Police Department. These are not the
police - package vehicles, and they will be used for non - pursuit, non - patrol
assignments. The cost is about $7,000 less than a regular patrol car. Council
Member Hinds moved to adopt the ordinance. Council Member Pruett seconded
the motion. The vote follows:

ORDINANCE NO. 7718
AN ORDINANCE OF THE CITY COUNCIL, CITY OF BAYTOWN,

SIXTY -EIGHT THOUSAND NINE HUNDRED NINETY -NINE AND
95/100 DOLLARS ($168,999.95) TO HOUSTON - GALVESTON
AREA COUNCIL FOR THE PURCHASE OF PROGRAM VEHICLES;
MAKING OTHER PROVISIONS RELATED THERETO; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
Hold Public Hearing on the Proposed Amendment to the Official Zoning Map
of the City of Baytown, Reclassifying Property Located at 3605 -112 Pineville
Drive from a Neighborhood Conservation District to a Mixed Use District at
6:40 p.m.
The Mayor called to order the public hearing concerning the zoning map
amendment application of J. Alton Enloe concerning property located at 3605 -112
Pineville Drive, Baytown, Texas, and asked those present desiring to speak to
register on the list provided in the lobby as that list would provide the speaking order
for the hearing. He stated that the hearing was for the purpose of receiving public
input from the citizens of Baytown with regard to the requested zoning map
amendment which, if approved, would change the zoning district of the property
located at 3605 -112 Pineville Drive from Neighborhood Conservation to a Mixed Use
District and stated that everyone desiring to present information would be given

ample opportunity to do so. However, he encouraged each speaker to be as brief
and to the point as possible, noting that the hearing was not an adversarial type
proceeding but an opportunity for all interested persons to be heard. He asked that
all questions be directed to him, and he stated that, with the aid of City staff, he
would attempt to answer the questions.
The City Manager stated that the Zoning Commission had held one public
hearing regarding this matter. Notice of the public hearing was published injj]e
Baytown Sun, posted, and mailed to adjacent property owners.
The City Manager stated that Council should consider six factors in
determining whether to adopt or disapprove the amendment of the zoning map
proposed by Mr. Enloe.
Changes must be consistent with the zoning ordinance.
The purpose of the Neighborhood Conservation (NC) District is to
preserve and reinforce existing low- density, residential land -use
patterns, promote high - quality living environments, ensure the
provision of adequate light, air, privacy, and open space to serve the
needs of the residents, ensure land use compatibility, and protect
residential users from adverse land use impacts which can occur
when high- density residential or non - residential development is
located near residential uses.
The purpose of the Mixed Use (MU) District is to accommodate a wide
variety of land uses with minimum development standards to provide
development opportunities that will strength the city's economic base.
The subject property is surrounded by property zoned NC. It is
grandfathered as its current use is a real estate office. However, to
zone it MU would create a variety of opportunities for its future use
that might be neither compatible with the surrounding area nor
consistent with the zoning ordinance.
2. Compatibility with the surrounding area.
The proposed classification is not compatible with the surrounding
area as the subject property is surrounded by an area that is zoned
NC.

3. Changed conditions.
The zoning ordinance was adopted in July 1995. There are no
changed conditions that affect the subject property to warrant
reclassification.
4. The effect on the natural environment.
There could be effects on the natural environment if the property is
reclassified. The MU District allows for a wide variety of land uses
with minimum development standards.
5. Community need.
There is no community need for additional MU zoned property since
more than seventy percent of the property in the city is zoned as MU.
6. Development patterns.
The request would not result in a logical and orderly development
pattern. The surrounding property is zoned NC. The subject property
is not adjacent to a MU boundary line. Granting the request could
constitute spot zoning which is defined as awarding a use
classification to an isolated parcel of land which is detrimental or
incompatible to the surrounding area. To the extent that spot zoning
reflects discriminatory or unreasonable action, spot zoning violates
the constitution and is an invalid exercise of the City's police powers
under State statutes.
Mr. J. Alton Enloe, 3605 -112 Pineville Drive, stated that he had sold a portion
of his property with the understanding that it was unrestricted, and he did not
believe designating the property as MU would equate to spot zoning but would more
realistically zone the property.
Mr. Bob Parks, President, Trailwood Home Owners Association, 3605
Trailwood, stated that the home owners in Trailwood Subdivision objected to the
zoning change as it would affect the quality of residential life and property values.

Consider Proposed Ordinance No. 960613 -1, Amending Official Zoning Map
of the City of Baytown, for Property Located at 3605 -112 Pineville Drive from
Neighborhood Conservation District to Mixed Use District
or
Consider Denial of Request for Reclassification of Property Located at 3605-
1/2 Pineville Drive from Neighborhood Conservation District to Mixed Use
District
Council Member Pruett moved that the request for reclassification of the
property located at 3605 -1/2 Pineville Drive be denied. Council Member Escontrias
seconded the motion. Council Member Benavides asked Mr. Enloe if he had
attended any of the public meetings prior to the zoning ordinance being passed.
Mr. Enloe responded that he had assumed his property was all grandfathered. In
response to inquiry from Council, the City Manager stated that the property to the
east of Trailwood Subdivision to Racoon Drive was zoned NC. The vote follows:

Accept Six -Month Audit Report for Fiscal Year 1995 -96 Prepared by Tiller and
Company to Evaluate Municipal Court Operations
Mr. Mark Tiller, Tiller and Company, stated that the City Charter called for a
six -month audit to review selected departments from an operational accounting
control perspective. Policies and procedures related to Municipal Court were
reviewed. Personnel were interviewed as to their job assignments, what procedures
and controls existed and were documented. Mr. Tiller reported that the review
found a good work force with good supervision and good leadership. No major
problems were found in the sample tests and adequate procedures and policies
were found to be in place. Some room for enhancement in terms of efficiency will
exist or may exist in the future as personnel and technology evolve as is typical in
most situations. The accountants' findings and the court's responses were

reviewed with Municipal Court personnel, Finance Office personnel, the City
Manager, and the Finance Committee. The Municipal Court personnel have begun
to address the suggestions and comments to the extent any action was necessary.

Consider Proposed Resolution No. 1281, Authorizing the City Manager to
Submit a Project to the Houston - Galveston Area Council for Consideration
under the Urban Street Program
This is an 80120 matching program with only $900,000 available for all of
Harris County and parts of Fort Bend and Brazoria counties. Market Street from
Wisconsin to West Main Street meets the program criteria and is the staffs
recommendation. Bond funds will be utilized to fund the City's portion of the cost.

RESOLUTION NO. 1281

SUBMIT A PROJECT TO THE HOUSTON - GALVESTON AREA
COUNCIL FOR CONSIDERATION FOR PARTICIPATION IN THE
URBAN STREET PROGRAM; PROVIDING FOR AN EFFECTIVE
DATE THEREOF.

Consider Approving Plans and Specifications for Landscaping of Bayland
Park and Authorize Advertisement for Bids
The landscaping plans include hydro mulching the sloped areas between the
land and the floating docks with weeping love grass. This is a low- maintenance
grass that will cover the ground but also clump and grow six to eight inches in
height. Other plants will include four (25 -30') date palms, pink oleanders, liriope,
society garlic, fig ivy, and Bermuda grass hydromulching. Estimated cost is
$35,225. Council Member DonCarlos moved to approve the plans and
specifications and authorize advertisement for bids. Council Member Benavides
seconded the motion. The vote follows:

Consent Agenda
Council considered the consent agenda items "a" through "o" as follows:
Items "a" and "b" are related to the Golf Course Water Line
a. Proposed Ordinance No. 960613 -7, authorizes acceptance of an
easement and an agreement with Hazelwood Enterprises
Incorporated regarding the purchase and installation of a 12 -inch
water line along Evergreen Road to the Golf Course. This project will
install approximately 3,000 LF of C -900 PVC piping. Because of
potential future growth and development, the City has elected to
oversize the 10 -inch water line to 12 -inch. The City will pay the
material's portion of the oversizing ($7,384.90). The utility easement
will be approximately 4,600 LF and will vary between 10 and 15 foot
widths. Funding will be from Water Revenue Bonds.
We recommend approval.
b. Proposed Ordinance No. 960613 -8, awards the bid for 12 -inch C -900
PVC pipe to Golden Triangle Pipe in the amount of $26,037.80. The

City's share of this cost is $7,384.90. Invitations to Bid were mailed
to six suppliers and five bids were received. This pipe will be used for
the water line project on Evergreen Road.

C. Proposed Ordinance No. 960613 -9, repeals Chapter 28 "Swimming
Pools and Spas," of the Code of Ordinances and replaces the same
with a new Chapter 28 "Swimming Pools and Spas." This ordinance
repeals the current swimming pool and spa standards of the City
replacing those with state mandated requirements. The two major
changes are: (1) more stringent fencing requirements having to do
with height (fence height increases from 44" to 48 ") and placement,
and (2) the allowable fine per day with regard to fencing requirements
has decreased from $2,000 to $1,000 per day. State law provides
authority to assess $2,000 per day fine for health violations; however,
enclosure of pools /spas now holds a separate fine. Existing fences
will be grandfathered until replacement or change of ownership.
We recommend approval.
d. Proposed Ordinance No. 960613 -10, amends the Police- Initiated Tow
Agreement, Section 2.02(d), to provide for maximum charge. Section
2.02(d) of the Police Initiated Tow Agreement sets forth the maximum
charge for any and all tows from the scene of an accident in the city
limits. Since the standard charge has increased by $10.00, the
maximum charge will change from $95.00 to $105.00.
We recommend approval.
e. Proposed Ordinance No. 960613 -11, authorizes payment of
deductibles associated with Liability coverages for 1995 -96 in the
amount of $36,000 to Texas Municipal League. The General Liability
and Automotive Liability policies have a deductible of $10,000 per
occurrence, and the Law Enforcement Liability and Public Officials
Liability policies have deductibles of $25,000 per occurrence. The
original Purchase Order was for $75,000, but due to pending cases

from prior years and new cases in this fiscal year, it is necessary to
increase the amount by $36,000.

f. Proposed Ordinance No. 960613 -12, authorizes final payment in the
amount of $5,376.18 to D & W Contractors, Inc. for grading and
drainage improvements at Unidad Park and Eddie Huron Park. The
contract price was $53,173.76. Additional quantities of sand were
required causing the project to exceed the contract price by $588.
The revised contract price is $53,761.76. The work was completed
on May 24, 1996. The engineers and staff have reviewed the project
and recommend approval of final payment.

g. Proposed Ordinance No. 960613 -13, authorizes a Service Agreement
between the City of Baytown and Davenport Mammoet Heavy
Transport, Inc. Beginning in July 1996, Davenport will be transporting
heavy vessels for Exxon through the City of Baytown. This
agreement outlines the responsibilities of Davenport as to the
protection of City property along the transport route and outlines
compensation due the City for police, traffic services, fire, and rescue
safety services.
We recommend approval.
h. Proposed Ordinance No. 960613 -14, authorizes removal of the traffic
light at Old Highway 146 and Crosby Cedar Bayou Road and
placement of a stop sign for Crosby Cedar Bayou Road and Elvinta.
This location no longer meets the criteria established in the Texas
Uniform Manual for Traffic Control Devices. The Growth Management
and Development Advisory Commission recommends approval of the
request.

i. Proposed Ordinance No. 960613 -15, authorizes the sale of foreclosed
property to Milton Lee Jeffries and Rochelle Elouise Jeffries. This
proposed ordinance authorizes the sale of a parcel of foreclosed

Baytown. The Jeffries bid on this property at the City auction held on

on May 28, 1996, for the property described as West one -half of Lot
3, Block 3, Oakwood Annex Sec. 1, Baytown, Texas, also known as
1106 Carver Street.

j. Proposed Ordinance No. 960613 -16, renews our contract with Harris
County for bookmobile services. Harris County will contribute
$20,000 toward a shared bookmobile program which serves readers
both inside and outside the city limits. The funds are used to pay
salaries of bookmobile personnel. The extension service serves our
low- income and aged population. The 1995 -96 contract was for
$20,000. A map of the area served is enclosed in the packet.
We recommend approval.
k. Proposed Ordinance No. 960613 -17, awards the annual liquid
chlorine contract to Jones Chemicals, Inc. in the amount of $37,300.
Invitations to Bid were mailed to three suppliers and three bids were
received. This contract is used for chlorination in the wastewater
treatment plants.

I. Proposed Ordinance No. 960613 -18, awards the annual fittings,
valves, and sleeves contract to Industrial International in the amount
of $34,398.91. Invitations to Bid were mailed to six suppliers and four
bids were received. This contract is used by the Public Works
Department for water distribution and water rehabilitation projects.

M. Proposed Ordinance No. 960613 -19, awards the bid for 4 -inch, 6 -inch
and 8 -inch C -900 PVC pipe to Golden Triangle Pipe in the amount of
$16,556. Invitations to Bid were mailed to six companies and five

has been executed for the past five years. The Parks and Recreation
Advisory Board recommends approval. The Lee College Board has
approved this agreement.

o. Proposed Ordinance No. 960613 -21, authorizes a contract with the
Baytown Family Y.M.C.A. for a Youth Summer Recreation Program
in the amount of $15,685. The last three years the City has had a
contract with the Y.M.C.A. for this program which has been very
successful. The Y.M.C.A. has the available resources including vans
for transporting participants and an outreach coordinator who will be
the front line supervisor of the programs. The agreement includes
three programs: Tennis Little League, A Day in the Park, and a
Special Population Program (working with physically challenged).

The Police Department received this award because Baytown was one of the
five most successful cities in decreasing its crime rate between 1990 and 1995.

The Civil Service Commission approved a fitness program for fire fighters
with three areas (1) medical evaluation (2) physical fitness assessment and
improvement and (3) physical performance standards. It provides education in area
such as nutrition, diet, weight control, smoking cessation, stress management, and
physical rehabilitation following injury or illness. The physical performance
standards utilizes a job - related fitness criteria by which physical job- readiness of the
employee can be assessed. A series of simulated, timed fire tasks are performed
to measure the physical ability required of those members hired after July 18, 1996.
For those members currently employed, the tasks are a goal one would work to
achieve, not mandatory. Nationally, over fifty percent of the line -of -duty deaths of
fire fighters are directly related to heart failure. Locally, we have lost three members
within the last two years to heart failure, and we have two on staff who have had
heart attacks. We think this is a positive step that will improve quality and longevity
of life for our active members and our prospective members. The City Manager
congratulated Chief Leiper and his staff for implementation of this program.
Gary Trietsch, District Engineer, will be the speaker at the Chamber of
Commerce meeting tomorrow. The staff is in the process of preparing information
to go to the State Highway Commission with requests for the completion of Spur
330. We have been told that there is not enough money in the current allocation to
fund Spur 330 because of its overall cost. A few years ago, the City staff put
together a booklet regarding Spur 201 as well as Spur 330, and Spur 201 was
completed quicker than it would have been if we had not made the trip to the State
Highway Commission. We are going to put similar information together regarding
traffic counts, traffic patterns, accidents, speeds, etc. on Decker Drive. Rather than
ask for total project funding, the staff will ask that the project be accomplished in
phases starting with the intersections where the most accidents have occurred. We
will try to visit the State Highway Commission in October.

The subcommittee working with the Parks and Recreation Advisory Board
is looking at expansion of the Nature Center by applying for grant monies from
ARCO. This is another example of what can happen through citizen participation.

The article "Building a Better Baytown ", in the Houston Business Journal. is
a result of Vollmer Public Relations and our committee. The group has conducted
interviews with a focus group of young professionals who work in Baytown. We are
attempting to develop a recognizable standard for Baytown. A home page or a web
page is being developed. We are continuing with our media relations. If you know
people in the Houston media from Baytown, let us know. We want to show them
the positive things and the changes in this community.
Over fifty Girls' Fast -Pitch Softball teams will be in Baytown next weekend.
The tournament begins at 6:00 p.m. Friday at the Sports Complex. There will be
1600 to 2000 visitors to Baytown. The tournament will continue through Sunday,
June 23.

OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
June 13, 1996
The City Council of the City of Baytown, Texas, met in special session on
June 13, 1996, at 6:15 p.m., in the Don M. Hullum Conference Room of the
Baytown City Hall, with the following in attendance:

The meeting was opened with a quorum present after which Mayor Alfaro
recessed into executive session pursuant to Section 551.071 of the Texas
Government Code to discuss pending litigation regarding franchise fees and
contemplated litigation.
When the open meeting reconvened, Mayor Alfaro announced that no action
was necessary as a result of the executive session.
Adjourn
There being no further business to be transacted, the meeting was
adjourned.
