Ordinances by Adding Chapter 3 % "Alarms"
This ordinance will require permits for alarm systems and allow recovery of
$50.00 per call for every false alarm in excess of five in a twelve -month period. This
will assist the Police and Fire departments in reducing the number of false alarms.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES BY

Consider Proposed Ordinance No. 960523 -2, Setting Public Hearings on
Proposed Annexation of a 2.408 -Acre Tract in Independence Bend Subdivision
The City of Baytown has received a request to annex a 2.408 -acre tract of
Independence Bend Subdivision. The subdivision consists of 15.5 acres of which
13 acres are within the city limits of Baytown. The ordinance schedules the public
hearings for June 13, 1996, at 6:31 p.m. and 6:35 p.m. Council Member Escontrias
moved to adopt the ordinance. Council Member DonCarlos seconded the motion.
In response to inquiry from Council, the City Manager replied that the property is
undeveloped but plans are to construct 56 homes, and the developers will install
streets and sewers at no cost to the city. The vote follows:

Consider Proposed Ordinance No. 960523 -3, Setting a Date, Time, and Place
for the Public Hearing on the Proposed Amendment to the Official Zoning Map
of the City of Baytown, Reclassifying Property Located at 3605-% Pineville
Drive, from a Neighborhood Conservation District to a Mixed Use District
Mr. J. Alton Enloe has submitted an application for an amendment to the
Official Zoning Map of the City of Baytown to have property at 3605 '/ Pineville
Drive, Baytown, Texas, reclassified from a Neighborhood Conservation District to
a Mixed Use District. This ordinance sets the date, time, and place of the public
hearing for June 13, 1996, at 6:40 p.m. in the Council Chamber. Council Member
Pruett moved to adopt the ordinance. Council Member Escontrias seconded the
motion. In response to inquiry from Council, the City Manager said that Mr. Enloe's
original place of business was in a Neighborhood Conservation District and was
"grandfathered" but the adjacent property was not "grandfathered." The location (a
real estate office) is east of Trailwood on the north side. The vote follows:

ORDINANCE NO. 7102
AN ORDINANCE SETTING A DATE, TIME, AND PLACE FOR THE
PUBLIC HEARING ON THE PROPOSED AMENDMENT TO THE
OFFICIAL ZONING MAP OF THE CITY OF BAYTOWN,
RECLASSIFYING PROPERTY LOCATED AT 3605 -112 PINEVILLE
DRIVE, BAYTOWN, TEXAS, FROM A NEIGHBORHOOD
CONSERVATION DISTRICT TO A MIXED USE DISTRICT;
AUTHORIZING AND DIRECTING THE CITY CLERK TO PUBLISH
NOTICE OF SUCH PUBLIC HEARING; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
Consider Proposed Ordinance No. 960523 -4, Amending Chapter 6, "Auto
Wreckers," of the Code of Ordinances, Section 6 -12(c) and Section 6- 17(c)(1)
and 2.02 of the Police Initiated Tow Agreement
The Texas Legislature passed Senate Bill No. 3 which provides that
municipalities may require a permit for operation of a tow truck but only on non -
consent tows in an amount not to exceed $15.00. The Auto Wrecker Committee
recommends amendment of Chapter 6 to provide for a $125 application fee for the
company and a $15 permit fee for each vehicle and to require a fire extinguisher
with a minimum of ten pounds of extinguishing agent. The auto wrecker
owners /operators requested a maximum rate increase for normal tow from $55 to
$65 and for storage from $7.50 per day to $10.50 per day. Council Member Pruett
moved to adopt the ordinance. Council Member Escontrias seconded the motion.

"APPLICATION FOR AUTO WRECKER PERMIT," SUBSECTION
(c) AND SECTION 6 -17 "SUSPENSION OF AUTO WRECKER
PERMIT," SUBSECTION (c)(1) OF THE CODE OF ORDINANCES,
CITY OF BAYTOWN, TEXAS; AMENDING SECTION 2.02(a) AND
SECTION 2.02(e) OF THE POLICE - INITIATED TOW AGREEMENT;
PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS
CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
Consider Proposed Ordinance No. 960523 -5, Awarding Bid for Marina
Restaurant/Ship's Store Food Service Equipment
The ordinance awards the bid to Turner Construction. The bid amount was
$398,000; however, with various adjustments and equipment reductions, the bid
was reduced to $354,600. This is the second time to bid the equipment. The first
bid totaled $425,000. Council Member Escontrias moved to adopt the ordinance.
Council Member Hinds seconded the motion.
In response to inquiry from Council, the City Manager stated that equipment
cut consisted of wall decorations, some of the stainless steel, and cash registers.
The allowance of $354,600 is about $14,000 over the original estimate of $340,000
which will come from funds allocated for landscaping and contingency. The facility
is within the overall budget. The vote follows:

Consider Proposed Ordinance No. 960523 -6, Accepting Proposal for Data
Communications Cables for Municipal Service Center
The ordinance accepts a proposal from Signatron, Inc., in the amount of
$18,033.62 for the cabling used at the new Municipal Service Center. Council
Member Benavides moved to adopt the ordinance. Council Member DonCarlos
seconded the motion. The vote follows:

AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE SUM
OF EIGHTEEN THOUSAND THIRTY -THREE AND 621100 DOLLARS
($18,033.62); MAKING OTHER PROVISIONS RELATED
THERETO; AND PROVIDING FOR THE EFFECTIVE DATE

Consider Approving Plans and Specifications for Plumwood Subdivision
Sanitary Sewer Rehabilitation Project and Authorizing Advertisement for Bids
This project is to rehabilitate approximately 2.3 miles of deteriorated 6, 8, and
10 -inch concrete sanitary sewer lines in the Plumwood Subdivision. The
engineering construction estimate for this project is $650,000. Project funding will
be from Sanitary Sewer Bonds. Council Member DonCarlos moved to approve the
plans and specifications and to authorize advertisements for bids. Council Member
Pruett seconded the motion. In response to inquiry from Council, the City Manager
said that the pipe bursting process would be employed using polyethylene and that
the area was in one of the subdivisions already approved by Council for
rehabilitation. The vote follows:

Consent Agenda
Council considered the consent agenda items "a" through "g" and 'T"
a. Proposed Ordinance No. 960523 -7, awards a housing rehabilitation
contract at 3313 Illinois to Colts Development, Inc. in the amount of
$18,722. Rehabilitation includes installing sheetrock, new windows,
new exterior and storm doors, floor coverings, electrical, plumbing and
HVAC systems, and a new roof with decking. Repairs include
paneling, rotted exterior, foundation work, and bracing ceiling joists.
Eight bids were picked up and five were submitted. The office
estimate was $20,886.47.
We recommend approval.
b. Proposed Ordinance No. 960523 -8, awards a housing rehabilitation
contract at 1227 Cypress to Palton Construction in the amount of
$17,440. Rehabilitation includes installing sheetrock in ceilings and
walls, closets in bath and bedroom #2, attic access in the hallway, an
exterior door in rear of home, floor covering, electrical, plumbing and
HVAC systems, and a new roof with decking. Repairs include
paneling, foundation work, rotted exterior, front and back porch, and

water heater closet. The low bidder, Penaco, did not meet
specifications. Eight bids were picked up and five were submitted.
The office estimate was $20,702.82.
We recommend approval.
C. Proposed Ordinance No. 960523 -9, awards the annual installation of
traffic signal equipment to Southwest Signal Supply, Inc. in the
amount of $69,300. Invitations to Bid were mailed to five suppliers
and we received one bid and two no -bids. This annual contract is
used for installation of signal arms, concrete foundation for
controllers, conduits, loop detectors, etc. The Traffic Control Division
performs all necessary electrical connections after said installation.
We recommend approval.
d. Proposed Ordinance No. 960523 -10, authorizes a contract with Harris
County for fire protection in the unincorporated portion of Harris
County for 1996 in the amount of $5,725. This contract, received in
mid - April, covers the period April 1, 1996 to March 31, 1997, a 12-
month period. The amount paid is based on 1995 calls as applied to
a payment scale used county -wide. In 1995 we responded to 382
calls outside the city, up from 378 calls in 1994. The payment is
based on the number and severity of responses.
We recommend approval.
e. Proposed Ordinance No. 960523 -11, authorizes the sale of foreclosed
property to Debra C. Jacobs of Baytown. Ms. Jacobs bid on this
property at the City auction held on March 28. Once approved by
council, a Deed Without Warranty will be prepared and recorded for
the property. Ms. Jacobs paid $7,050 on May 14, 1996 for the
property described as Tract 7L, Abstract 69 C. Smith, Massey
Tompkins.
We recommend approval.
Proposed Ordinance No. 960523 -12, authorizes renewal of a contract
for sanitary sewer rehabilitation by cured -in -place pipe or fold and
form pipe for one year in the amount of $259,820.75. Our current
contract with Insituform Gulf South expires June 6, 1996. This
contract is primarily for emergency sewer repairs. The current

contract is for $259,820.75. We propose to renew the contract for the
same amount. The unit prices of the pay items will remain the same.
A revision to the contract was made to require approval of any
subcontractors to be used during the new contract term. The
contractor has agreed to this revision. Funds will come from sewer
bonds.
We recommend approval.
g. Proposed Ordinance No. 960523 -13, authorizes final payment to
Bean Construction Company for Bayland Park Boat Ramps and
Wetlands Creation Project in the amount of $46,717.45. This project
provided final grading and contouring of the entire marina site, as well
as, strategic placement of rip -rap to protect wetlands, tidal surge, and
the construction of three boat ramps, four piers and 66 parking
spaces and associated lighting. The original contract was for
$895,875.10. The final contract amount was $875,031.20, leaving a
project underrun of $20,843.90. Funding is from the 1991 Bond
Program.
We recommend approval.
Proposed Ordinance No. 960523 -15, authorizes an extension
agreement with Star Cable Associates allowing Star Cable to continue
its current operations. In 1992, the City entered into a franchise
agreement with Star Cable Associates which granted Star the
privilege to conduct a cable signal distribution system and business
within the City of Baytown. Such franchise agreement expires June
1, 1996. The City and Star have been working on a new franchise
agreement; however, the parties have not agreed to the terms of the
same as of this date. This proposed ordinance extends the current
franchise agreement with Star for a period of six months, therefore,
enabling the parties more time to finalize the agreement while
ensuring that the citizens who enjoy Star's services may continue to
do so. This is the same agreement entered into with TCI Cable.
We recommend approval.
Council Member Hinds moved to adopt the consent agenda items "a" through
"g" and "i." Council Member Escontrias seconded the motion. In response to
inquiry from Council, the City Manager responded that the planting of the cord grass
had a success rate guarantee within one year. The vote follows:

Proposed Ordinance No. 960523 -14, Authorizes an Extension of the Service
Agreement with Anytime Security and Investigations for Security Services at
Bayland Park
The original contract was for $23,850 and is actually a four -month contract.
This month -to -month extension is allowed by the terms and conditions of the
existing contract. A preliminary cost estimate for this extension is $17,000. Council
Member Pruett moved to adopt the ordinance. Council Member Hinds seconded

City Manager's Report
City of Baytown applied for and received $170,000 in solid waste grants from
H -GAC which will be used in the area of enforcement, Household Hazardous Waste
Day, and the yard- trimming collection program.
A Memorial Day celebration will be held Monday at 11:00 a.m. at the
Bicentennial Park, and City Hall will be closed Monday.
