OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
December 19, 1995
The City Council of the City of Baytown, Texas, met in special session on
December 19, at 5:00 p.m., in the Don M. Hullum Conference Room of the Baytown
City Hall, with the following in attendance:

The meeting was opened with a quorum present, Council Member Pruett offered
the invocation, after which the following business was discussed:
Consider Rejecting all Bids Received for the Ship's Store Facility, Restaurant,
and Associated Infrastructure for the Bayland Park Marina Project
and
Consider Approval of Plans and Specifications for the Ship's Store Facility,
Restaurant, and Associated Infrastructure for the Bayland Park Marina Project
Two bids were received: one from Strata Build, Inc. and one from Turner
Construction Company. Strata Build's bid was $2,208,000; Turner's was
$2,332,000. The City has $1.8 Million available for this project. The administration
recommended rejection of the bids and authorization to re- advertise. From the
discussions with the two contractors and the Ninfa's group, a number of alternates
have been developed to allow more flexibility, i.e. roof construction, split -faced
block for the back portion of the restaurant as opposed to the ground -type, the

covered walkway, and the utility work that city crews can do. Ninfa's contract
requires 100 more parking spaces, and one of the alternates will be the use of
milled asphalt on the front portion. Lighting will be bid with different features, and
the concrete will be bid regular versus colored. However, the basic design and
appearance of the restaurant will remain unchanged.
Ninfa's wanted to cook at the Ship's Store, but the additional ventilation and
cooking area increased the price. The Ship's Store design will remain the same, but
the cooking area will be deleted providing more counter space and space for a small
office.
By providing the various options and making a few calls, the administration
feels that more bids will be received and that the City will be in a position to award
the contract within budget. Council Member Pruett moved to accept the
recommendation of the administration. Council Member Escontrias seconded the
motion.
In response to Council inquiry, the City Manager noted that should Ninfa's
object to any of the proposed alternates, the option of Ninfa paying for any resulting
overage would be discussed. The Ship's Store will open first. There have been
discussions about promotion to allow the rental of slips prior to the official opening.
The vote follows:

Consider Proposed Ordinance No. 951219 -1, Authorizing an Industrial District
Agreement between the City of Baytown and Natural Gas Odorizing, Inc.
Council Member Escontrias moved to adopt the ordinance authorizing an
Industrial District Agreement between the City of Baytown and Natural Gas
Odorizing, Inc. Council Member DonCarlos seconded the motion. The vote follows:
Ayes: Council Members Benavides, Escontrias,
Hinds, DonCarlos, and Pruett

ORDINANCE NO. 7594
AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE AND THE CITY CLERK TO ATTEST TO AN
INDUSTRIAL DISTRICT AGREEMENT WITH NATURAL GAS
ODORIZING, INC., AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.

Council was given a copy of the Edinburgh ordinance fixing rentals to be paid
by gas utilities, a copy of the partial summary judgement in that case, and a
memorandum on how Baytown Ordinance Nos. 852 and 6054 differ from the
Edinburgh ordinance.
Comments from Mayor
Mayor Alfaro stated that he and the City Manager had met with the TxDOT
District Engineer to discuss Spur 330, Loop 201, and other transportation issues.
He felt that it was a productive meeting.

There being no further business to be transacted, the meeting was
adjourned.
