Hall City Clerk The meeting was opened with a quorum present, and Council Member Benavides offered the invocation, after which the following business was conducted: Hold Public Hearing on the Referendum Draft of the Neighborhood Protection Ordinance and Map Atlas, along with the Final Report Prepared and Submitted by the Zoning Commission of the City of Baytown (6:35 p.m.) Mayor Alfaro called to order the public hearing concerning the Referendum Draft of the Neighborhood Protection Ordinance along with the Map Atlas and the Final Report prepared and submitted by the Zoning Commission of the City of Baytown at 6:35 p.m. and asked those present desiring to speak to register on the list provided in the lobby which would provide the speaking order for the hearing. He stated that the hearing was for the purpose of receiving public input and everyone desiring to present information at the hearing would be given ample opportunity to do so. However, he encouraged each speaker to be as brief and to the point as possible, noting that the hearing was not an adversarial type 950727 -2 Minutes for Regular Session -July 27, 1996 proceeding, but an opportunity for all interested persons to be heard on the subject. He asked that all questions be directed to him, and with the aid of City staff, he would attempt to answer such questions. Bobby Rountree, City Manager, explained that the proposed ordinance contains all the revisions presented in the final report of the Zoning Commission on July 10, 1995. With regard to the atlas, two zoning designation changes include: (1) The property at the corner of Cynda Brooke and Baker Road is designated "mixed use" rather than "neighborhood conservation "; and (2) The property near the intersection of Kilgore Road and Bayou Avenue is designated "urban neighborhood" rather than "neighborhood conservation." The commission's recommendation was based upon the City's consultant acknowledging that both properties were inadvertently misclassified. The proposed ordinance contains the following changes: (1) Change No. 1, page 14, Section 3E, Use Table, shall read, "Home Occupations shall be permitted with conditions in MU districts." (2) Change No. 2, page 15, Section 3F -5a, Supplementary Use Standards, shall read, "A home occupation must be conducted within a dwelling which is a bonafide residence of the principal practitioner." (3) Change No. 3, page 16, Section 3F5f, shall read, "Persons other than a member of the immediate family occupying such a dwelling may be employees." (4) Change No. 4, page 26, article 5, "Administration and procedures, the Board of Adjustment," shall read, "There is hereby created a Board of Adjustment for the purposes of this zoning ordinance consisting of five regular members each appointed by the city council." Included in this ordinance is a section on the fee schedule. The fee structure proposed for amendments is $150; for a variance request, $100; and for an 950727 -3 Minutes for Regular Session - July 27, 1995 exception request, $100. These fees will offset the cost of mailings and publications required by the zoning code. This concluded the City Manager's comments. Mayor Alfaro recognized Mr. Don Plank. Don Plank, One Thunderbird, Country Club Oaks, Section VI, spoke as a Country Club Oaks Civic Association board member. He addressed the classification of the parcel of property at the corner of Baker Road and Cynda Brooke for mixed use. He felt since adjoining lots are residential, this parcel should be classified as residential. The residents of the area are fearful of what might go in at this location if the mixed use designation remains. He emphasized that the purpose of the zoning ordinance is to protect the neighborhoods. He requested Council keep the residential neighborhood intact by voting to zone this parcel as residential. Dennis Winham, 4811 Saint Andrews, requested that Council vote to keep the parcel at Cynda Brooke and Baker as residential. He expressed concern that the mixed use designation would result in more traffic in the neighborhood and would devalue the homes in that area. Bob Clair, 4502 Alamance, stated that there are residences to the west and to the south of the parcel at Cynda Brooke and Baker; therefore, that parcel should be classified residential. This would keep the residential area together. Francis House, 4607 Saint Andrews, referred to the proposed ordinance as primarily an ordinance to protect the residential neighborhood and the substantial investment one has in their home. She asked Council to consider that prior to voting on the issue. Craig Camp, 4510 Alamance, noted that zoning works if made to work and requested that the parcel be designated residential. Martha H. Hester, 4811 Country Club View, expressed the desire to have Cynda Brooke at Baker remain residential and to keep commercial development out of the neighborhood. Kathleen Hanna, 4820 Country Club View, supported keeping the designation of Cynda Brooke at Baker as residential. 950727 -4 Minutes for Regular Session - July 27, 1995 Sylvia Williams, 4609 Saint Andrews, explained that she had purchased a home in Country Club Oaks because it was a deed restricted area; therefore, she requested that Council take that into account prior to voting on this matter. Maudine Chambers, Country Club Oaks, requested that Council vote residential for designation of the parcel at Cynda Brooke and Baker. George Saphos, 4611 Saint Andrews, pointed out that voters had recently approved zoning and to consider a change from the original designation would send a message to those voters that zoning does not mean anything. He maintained that the area is residential; therefore, anyone investing there would have been investing in the residential market, not in the commercial market. Paul Duplechan, Attorney, 100 Louisiana, Suite 1770, Houston, Texas, appeared on behalf of the owner of the parcel at Cynda Brooke and Baker to request that Council designate the parcel as MU. He stated that this particular parcel has been a reserve since 1977; and in fact, the Baytown Planning Commission had designated it as such through three separate designations -1977, 1990, and 1993. Directly across the street is an MRI office. He emphasized that when the city's zoning consultant developed the zoning plan and map, he had to obey the zoning law of the United States which says, "equal protection." Properties which are similarly situated must be treated the same. This is not part of the subdivision, it has never been part of the subdivision, nor represented as such. It has no restrictive covenants on it of any sort. It is simply a commercial reserve. Mr. Duncan has admitted that it was simply a scrivener's error. He made a mistake when he put it together. The other corners were treated in much the same manner. Because of that, it would be arbitrary for Council to deny what the Zoning Commission is recommending. It would come very close to a taking of that property in denying Mr. Hutto the reasonable use of the property. It would be burdensome and serve no public purpose. He emphasized that the proposed ordinance contains the following Protection Development Standards. Building setbacks are as much as 20 feet from the adjacent lot line of the party to the west. Parking and driveway setbacks are set to be more extraordinary upon those pieces next to NC. 950727 -5 Minutes for Regular Session - July 27, 1995 Building height is restricted on this particular piece because of its location next to an NC. Buffering screening standards Off street parking areas must be restricted from adjacent, single family and NC zoned properties by opaque fences, vegetative buffers, earthen berms, etc. These are the development standards on which this Council will vote on the recommendation of the commission to be part of the integrated plan for zoning. Therefore, Mr. Duplechan requested Council to accept the recommendation of the zoning consultant and the Zoning Commission to designate Baker Road and Cynda Brooke as MU. There being no one else registered to speak, Mayor Alfaro closed the public hearing concerning the Referendum Draft of the Neighborhood Protection Ordinance and map atlas along with the final report prepared and submitted by the Zoning Commission. The resolution speaks of Mrs. Roosa as being the driving force behind the Goose Creek Stream Greenbelt Project and of her hard work and dedication which led to the completion of Goose Creek Park on the Goose Creek Stream Greenbelt. It is befitting that the pavilion at Goose Creek Park on the Goose Creek Stream Greenbelt be named the Jo Roosa Pavilion in honor of the selfless community service of Mrs. Jo Roosa to the citizens of the City of Baytown. Council Member Benavides moved for adoption of the resolution. Council Member Escontrias second the motion. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None RESOLUTION NO. 1252 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, THAT THE PAVILION AT GOOSE CREEK PARK BE NAMED IN HONOR OF MRS. JO ROOSA AND THAT A SIGN IN HONOR OF MRS. ROOSA BE PLACED IN A PROMINENT LOCATION AT OR NEAR SAID PAVILION; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 950727 -7 Minutes for Regular Session - July 27, 1995 Consider Proposed Ordinance No. 950727 -1, Adopting Baytown Neighborhood Protection Ordinance and Official Zoning Map Council Member Byford moved for adoption of the ordinance. Council Member DonCarlos seconded the motion. Council Member Escontrias amended the motion to except the two proposed changes in designation and instead to have the parcel at Cynda Brook and Baker Road designated NC and the parcel along Kilgore Road designated as NC. Council Member Benavides seconded the motion. Council Member Escontrias explained he felt strongly that the parcels should be designated in the manner in which the electors voted on them. Council Member Benavides concurred. She felt the whole point of the ordinance is to protect the neighborhoods, not to promote commercial property. Devaluation starts with one block. What the people want should not be ignored. Council Member DonCarlos verified that the parcels had been mistakenly designated in the beginning by the city's consultant and that the parcel at the corner of Cynda Brook and Baker had originally been platted as acreage or land, not residential. Council Member Escontrias emphasized that one reason he put forth the amendment was because he felt more input should have been given concerning this parcel during the process prior to the vote by the people. The people voted on a map atlas which showed this parcel to be NC. Council Member Hinds noted that to keep the designation as NC would certainly be desirable to the residents of this area, but this is an error. The consultant has acknowledged the error. Growth Management and Development was charged with working with a consultant to develop an ordinance and map. They elected to use what the consultant had developed with certain adjustments. This is what the Growth Management and Development Commission has recommended to Council. With the two public hearings held by the commission and the public hearing held by Council, the procedure has been adequately handled as far as review. Council Member Benavides felt that if there was a problem with the designation, it should have been noted during the process. After the people have voted on the matter, it should not be changed. Council Member Escontrias pointed out that if the amendment passed, there would be a procedure in place for those two parcels to be reviewed upon proper filings by the owners. Consider Proposed Ordinance No. 950727 -2, Amending Chapter 2 "Administration," Article II 'Boards and Commissions" by Adding Division 11 "Board of Adjustment;" Section 2 -71.20 "Board Created;" Section 2 -71.21 "Makeup of Board;" Section 2 -71.22 "Removal of Board Members;" Section 2 -71.23 "Attendance at Meetings; Presiding Officer;" and Section 2 -71.24 "Rules of 2 -71.25 "Powers and Duties" Procedure" to the Code of Ordinances of the City of Baytown The proposed ordinance creates the Board of Adjustment consisting of five members to be appointed by City Council. Each board member is to serve a two- year term subject to removal by Council. Attendance requirements of the members promulgated by City Council for the Growth Management and Development 950727 -9 Minutes for Regular Session - July 27, 1995 Advisory Commission and the Zoning Commission shall apply to the board. The powers and duties of the board as specified in the Neighborhood Protection Ordinance include hearing and deciding (1) appeals where it is alleged that there is an error in any order or decision by city officials in the administration and enforcement of the zoning ordinance; (2) appeals of any interpretation of the text of the zoning ordinance made by the director of Planning and Community Development; and (3) requests for variances from the terms of the zoning ordinance. The ordinance sets forth requirement and establishes the procedures which shall govern the meetings of the board and requires that each case before the board be heard by at least four members. The voted follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None ORDINANCE NO. 7355 AN ORDINANCE OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 2 "ADMINISTRATION," ARTICLE II "BOARDS AND COMMISSIONS" BY ADDING DIVISION 11 "BOARD OF ADJUSTMENT;" SECTION 2 -71.20 "BOARD CREATED;" SECTION 2 -71.21 "MAKEUP OF BOARD;" SECTION 2 -71.22 "REMOVAL OF BOARD MEMBERS;" SECTION 2 -71.23 "ATTENDANCE AT MEETINGS; PRESIDING OFFICER;" SECTION 2 -71.24 "RULES OF PROCEDURE;" AND SECTION 2 -71.25 "POWERS AND DUTIES" TO THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND THE EFFECTIVE DATE THEREOF. 950727 -10 Minutes for Regular Session - July 27, 1995 Consider Proposed Resolution No. 1253, Repealing Resolution No. 1093 and Adopting a New Industrial District Policy of the City of Baytown The City of Baytown developed its industrial district policy in the late 1960's under the provisions of the Municipal Annexation Act passed by the state legislature in 1963. The first contract was signed with the Humble Oil & Refining Company. Industrial district contracts are for a period of seven years at which time they are reviewed. The Industrial District Policy Committee of City Council has reviewed the policy and is recommending a ten - percent phased increase and an abatement incentive for new expansion projects over $20 Million. The ten - percent phased payment will increase the payment from the current forty percent to fifty percent over a three -year period. All industrial district agreements beginning with Exxon will comply with this policy. The rate will be phased in by increasing it five percent the first year, three percent in year two, and two percent in year three. The fourth year of the agreement, the industry will be paying the full fifty percent. In the existing agreement there was no tax incentive for new construction. The committee added tax incentive for construction with a value of greater than $20 Million. The incentives will be given as follows: Zero incentive for years one and two; twenty percent for year three; thirty percent for year four; forty percent for year five; and fifty percent for year six. An important part of this equation is that the base appraisal must remain the same. Prior to the vote on the matter, Mayor Alfaro noted that the Industrial District Committee consisted of Council Members DonCarlos, Chairman, Pruett, and Byford, none of whom are employed by Exxon. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None 950727 -11 Minutes for Regular Session - July 27, 1995 RESOLUTION NO. 1253 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, REPEALING RESOLUTION NO. 1093 DULY ADOPTED ON JULY 26, 1990, BY THE CITY COUNCIL OF THE CITY OF BAYTOWN AND DECLARING SAID RESOLUTION TO HAVE NO FORCE AND EFFECT; FINDING, DECLARING, AND ESTABLISHING THAT MANUFACTURING INDUSTRIES NEAR THE CORPORATE LIMITS OF THE CITY OF BAYTOWN RARELY USE BAYTOWN'S MUNICIPAL SERVICES TO THE SAME EXTENT AS DO PRIVATE CITIZENS, AND CONSEQUENTLY, SUCH MANUFACTURING INDUSTRIES AS A WHOLE SHOULD COMPENSATE THE CITY OF BAYTOWN PROPORTIONATELY AS TO THEIR USE AND ENJOYMENT OF SUCH MUNICIPAL SERVICES; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance No. 950727 -3, Approving Industrial District Agreement with Exxon Corporation The City Manager announced that Mayor Alfaro along with Council Members Escontrias and Hinds would need to abstain from the vote on this matter due to their affiliation with Exxon. The contract is based on the policy adopted and contains a modification in regard to application of the City of Baytown's building code to areas of the industry within the city limits. The contract contains no arbitration language. The administration recommended approval of the ordinance. Council Member Benavides moved for adoption of the ordinance. The vote follows: Ayes: Council Members Benavides, Byford, DonCarlos, and Pruett Nays: None Abstained: Council Members Escontrias and Hinds Mayor Alfaro 950727 -12 Minutes for Regular Session - July 27, 1995 ORDINANCE NO. 7356 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO AN INDUSTRIAL DISTRICT AGREEMENT WITH EXXON CORPORATION; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance No. 950727 -4, Relocating the Britton Street/Loop 201 Frontage Road Entrance /Exit Adoption of the proposed ordinance will move the Britton Streeftoop 201 Frontage Road Entrance /Exit 100 feet north of its present location. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None ORDINANCE NO. 7357 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, PROVIDING FOR THE RELOCATION OF THE BRITTON STREET /LOOP 201 FRONTAGE ROAD ENTRANCE /EXIT; AND PROVIDING FOR EFFECTIVE DATE THEREOF. Consider Proposed Ordinance No. 950727 -5, Authorizing Agreement with U. S. Attorney's Office for High Intensity Drug Trafficking Area ( HIDTA) Program Since September, 1990, the City of Baytown has administered federal funds designated for operation of the HIDTA Major Offender Project. The success of this program has resulted in the U. S. Attorney's Office requesting a cooperative agreement with the City of Baytown to manage funding for the specific purpose of employing a deputy coordinator for the regional HIDTA initiatives. This individual 950727 -13 Minutes for Regular Session - July 27, 1995 will serve as a liaison between the United States Attorney's Office, the office of the National Drug Central Policy, other HIDTA's throughout the country, the various law enforcement agencies, and initiatives within the Houston HIDTA. Duties of this individual will include preparation and monitoring of the HIDTA budget and reports required by these agencies, development of specialized computer programs, purchase and inventory of specialized enforcement, and review and evaluate individual HIDTA funded initiatives to ensure compliance with the threat assessment and strategy developed for the overall HIDTA program. The contract totals $95,000. Under the agreement, the City of Baytown will furnish a vehicle, parking facilities, travel, and training for the deputy coordinator; however, all funds will be provided by the office of National Drug Control Policy through the U. S. Attorney's Office. The administration recommended approval. Council Member Byford moved for adoption of the ordinance. Council Member Hinds seconded the motion. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None ORDINANCE NO. 7358 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST TO A REIMBURSEMENT AGREEMENT WITH UNITED STATES DEPARTMENT OF JUSTICE FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA (HIDTA) PROGRAM; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Resolution No. 1253, Authorizing Harris County to Place Sections of Pruett Street, Park Street, and Bayway Drive on the Harris County Road Log Commissioner Fonteno has agreed to reconstruct Pruett Street from Lobit to Schilling; Park Street from Pruett to North Main; and Bayway Drive from Decker to , Baker Road. The estimated cost of these projects is $2.7 Million. All of the costs will be borne by the county except for the utilities. The estimated cost for the water 950727 -14 Minutes for Regular Session - July 27, 1995 and sewer work is $570,000. Water and sewer bonds will need to be sold next year for these projects. The Harris County Attorney's Office has ruled the county may not pay for the utility work. In order for Harris County to be in a position to effect these improvements, it is necessary to place the sections slated for repair on the Harris County Road Log. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None RESOLUTION NO. 1254 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING HARRIS COUNTY TO PLACE SECTIONS OF NORTH PRUETT, PARK, AND BAYWAY DRIVE ON THE HARRIS COUNTY ROAD LOG; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Resolution No. 1254, Approving the 1995 HUD /CDBG Consolidated Plan The consolidated plan is a comprehensive planning document that replaces the comprehensive housing affordability strategy as well as the final statement while combining the planning and application process of four major formula grant programs. Council held a work session on the consolidated plan prior to the council meeting. The administration recommended approval of the 1995 HUD /CDBG Consolidated Plan. Council Member Hinds moved for adoption of the resolution. Council Member Pruett seconded the motion. The engineering construction cost estimate for this project is $52,000. Funds for this work were budgeted. Proposed Resolution No. 1256, authorizes an application to the Texas Parks and Wildlife Department for a grant of up to $200,000 for construction of a two lane public boat ramp facility with related parking area and lighting on Cedar Bayou Stream, at Roseland Park. The submission deadline for the grant is July 31, 1995. Approval is expected in January of 1996, with construction and completion expected by the fall of 1996. We recommend approval. b. Proposed Resolution No. 1257, adopts the prevailing wage rate schedule for Public Works contracts. The current schedule in use was issued in August, 1986. The adoption of the prevailing wage rate schedule is required by state statute. The proposed schedule developed by the General Services Commission is currently utilized throughout Harris County by various governmental entities as the prevailing wage rate on Public Works contracts. The City Engineer has determined that the prevailing wage determinations made by the General Services Commission fairly and accurately reflect the prevailing wage rates within the City of Baytown. We recommend approval. C. Proposed Ordinance No. 950727 -6, approves a contract with Harris County for fire protection services in the unincorporated portion of Harris County for 1995 in the amount of $5,935. This contract, received in mid - April, covers the period from March 1, 1995 to March 3, 1996, a 13 -month period. This is a change in contract period, previously January 1 to December 31. The amount paid is based on 1994 actual calls for service as applied to a payment scale used county -wide. In 1994 we responded to 378 calls outside the city, up from 296 in 1993. The remainder of the payment is based on number and severity of responses. We recommend approval. d. Proposed Ordinance No. 950727 -7, authorizes Change Order No. 5 with N & S Construction Co., Inc. for the East District Wastewater Treatment Plant Expansion contract in the amount of $5,500. The original contract amount was $3,704,613.50. Change Order Nos. 1, 2 and 3 totaled $20,648. Those change orders included (1) replacement of a buried 30" air supply line, (2) installation of a 6" pipe to allow either treatment plant to feed both digesters, and (3) relocation of a drain line and replacement of a buried sludge line. With approval of this change order, the amended contract amount is $3,738,794.50. This Change Order is to clean the west re- aeration basin of approximately ten years of debris accumulation. Wayne Smith & Associates are the engineers for the project and recommend approval of the change order. We recommend approval. e. Proposed Ordinance No. 950727 -8, authorizes a housing rehabilitation contract for 724 Travis to New Innovations in the amount of $15,990. The office estimate was $12,985.39. Rehabilitation includes installation of new windows and exterior doors, new plumbing and electrical systems, new flooring and carpet, and a new garage door. Repairs will be made to the sheetrock, paneling and siding. We recommend approval. f. Proposed Ordinance No. 950727 -9, authorizes a housing rehabilitation contract for 104 East Nazro to New Innovations in the amount of $16,000. A significant portion of material being disposed of by burial in the landfill consists of yard waste including grass clippings, leaves, small branches, and discarded plants. This material, when enclosed in a plastic bag, does not compact and results in landfill disposal costs based on gross cubic yardage. If collected in paper bags, yard waste could be recycled through the City of Baytown chipper operation and applied along with other chipped material for ground cover or composting. The removal of this material from the waste stream will reduce landfill costs since it would represent a reduction in the total volume going to the landfill. In this program, paper bags would be furnished to those residents who participate in a segregation of yard waste program. The proposed program would initially target those areas observed to be depositing yard waste along with garbage and use neighborhood organizations to disseminate information on participation, The paper bags each represent one - eighth cubic yard of material at a cost of approximately eleven cents per bag, the cost of one cubic yard's worth 950727 -23 Minutes for Regular Session - July 27, 1995 of bags is 88 cents. The cost of landfill disposal of one cubic yard of waste is currently $4.95. Yard waste will be collected from curb side on the same day as the household garbage pick up. Routes will be developed for this service dependent on the participation. Residents desiring to utilize this service will sign up as they get their bags or call the Public Works Solid Waste Division with their addresses after they have procured the paper bags. This will provide information for pickup route development. The residents will be advised that paper bags will be used only for yard waste since this material will be recycled. Paper bags for this use will be available at the same locations that sell the city's plastic garbage bags. The program is set up to begin operation on August 1. TML Annual Conference Council was reminded that the TML Conference is scheduled for Dallas and that registration for this event must be made no later than August 11 through the City Manager's office.
