1995 07 05 CC Minutes, SpecialMINUTES OF THE SPECIAL SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN July 5, 1995 The City Council of the City of Baytown, Texas, met in special session on July 5, 1995, at 8:00 a.m. in the Don M. Hullum Conference Room of the Baytown City Hall with the following in attendance: Eva Benavides Council Member Stephen DonCarlos Council Member Manuel Escontrias Council Member E. Frank Hinds, Jr. Council Member Rolland J. Pruett Council Member Pete C. Alfaro Mayor Bobby Rountree City Manager Ignacio Ramirez City Attorney Eileen P. Hall City Clerk Absent: David Byford Council Member The meeting was opened with a quorum present, after which the following business was transacted: Consider Proposed Ordinance No. 950705 -1, Authorizing Agreement with Texas Department of Transportation for Sewer Line Attachment to Cedar Bayou Bridge at State Highway 146, Chambers County Council Member Hinds moved for adoption of the ordinance. Council Member Escontrias seconded the motion. The vote follows: Ayes: Council Members Benavides, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None 950705-2- Minutes of the Special Session - July 5, 1995 ORDINANCE NO. 7339 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO AN AGREEMENT WITH TEXAS DEPARTMENT OF TRANSPORTATION OF THE SEWER LINE ATTACHMENT TO CEDAR BAYOU BRIDGE AT STATE HIGHWAY 146, CHAMBERS COUNTY; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance No. 950705 -2, Authorizing First Amended and Restated Industrial District Agreement between Heritage Inks International Corporation and the City of Baytown and the Second Amended and Restated Industrial District Agreement between Engineered Carbons, Inc. And the City of Baytown Two companies -- Engineered Carbons, Inc. and Heritage Inks International Corporation - -have purchased the J. M. Huber facilities. The proposed amended and resubmitted industrial district agreements will expire on the same date as the original agreement with J. M. Huber. The policy in the event of sale of portions of a facility is to have the new company or companies sign a separate contract for a seven -year term; however, if the entire facility is sold, the contract with the new company or companies is for the remainder of the original contract. A problem with the metes and bounds description of the facility has arisen; therefore, no action is required at this time. Pursuant to Section 551.071 of the Texas Government Code, Recess into Executive Session to Discuss Land Acquisition Mayor Alfaro recessed into executive session to discuss land acquisition.
