J MINUTES OF THE REGULAR SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN March 23, 1995 The City Council of the City of Baytown, Texas, met in regular session on March 23, 1995, at 6:30 p.m. in the Council Chamber of the Baytown City Hall with the following in attendance: Eva Benavides Council Member David Byford Council Member Stephen DonCarlos Council Member Manuel Escontrias Council Member E. Hall City Clerk The meeting was opened with a quorum present, and Council Member DonCarlos offered the invocation, after which the following business was conducted: Consider Approval of the Minutes for the Regular Meeting Held on March 9, 1995 Council Member Escontrias moved for approval of the minutes for the regular meeting held on March 9, 1995. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None °' 950323 - 2 Minutes for Regular Session - March 23, 1995 Consider Proposed Ordinance No. 950323 -1, Approving the Proposed Rate Order Related to the City of Baytown's Section 42 Proceeding with HL &P Initiated on November 11, 1994, and Authorizing the City to Become a Signatory to the Proposed Stipulation and Agreement which would Resolve the City's Section 42 Proceeding and PUC Docket Numbers The proposed rate order and the proposed agreement provide that electric bills will be reduced by $612.7 Million (15.5 %) in 1995. The average residential ratepayer will see a reduction of $227 (or 18.3 %) in 1995. It is currently estimated that electric bills will be reduced by $434.7 Million (11 %) per year in 1996 and 1997. The average residential ratepayer will see a reduction of $129 (10.4 %) per year in 1996 -97. However, the estimated reductions for 1996 -97 could fluctuate up or down as fuel prices change. This is the same stipulation and agreement recently entered into by the City of Houston. Council Member Pruett moved for adoption of the ordinance. Council Member DonCarlos seconded the motion. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None ORDINANCE NO. 7260 AN ORDINANCE APPROVING A STIPULATION AND AGREEMENT RELATING TO THE RATES OF HOUSTON LIGHTING AND POWER COMPANY; DETERMINING JUST AND REASONABLE RATES TO BE OBSERVED AND IN FORCE WITHIN THE CITY OF BAYTOWN; ORDERING RATE REDUCTIONS AND CREDITS TO RATEPAYERS' BILLS; FIXING THE RATES THAT SHALL CONSTITUTE THE LEGAL RATES OF HOUSTON LIGHTING AND POWER COMPANY UNTIL CHANGED AS PROVIDED BY THE PUBLIC UTILITY REGULATORY ACT; PROVIDING FOR THE FILING OF RATE SCHEDULES AND TARIFFS AND THE APPROVAL OR MODIFICATION OF SAME; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; CONTAINING FINDINGS AND OTHER PROVISIONS RELATING TO THE FOREGOING SUBJECT; PROVIDING FOR SEVERABILITY; DECLARING AN EMERGENCY; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 950323 - 3 Minutes for Regular Session - March 23, 1995 Consider Proposed Ordinance No. 950323 -2, Authorizing the Assignment and Assumption of the Agreement for Operation of Sanitary Landfill from Hazelwood Enterprises, Incorporated, to Sanifill of Texas, Inc. and Consider Proposed Ordinance No. 950323 -4, Authorizing Renewal of Annual Solid Waste Collection and Disposal Service Contract and Consider Proposed Ordinance No. 950323 -3, Approving Renewal of Sanitary Landfill Contract with Sanifill of Texas, Inc. The City Manager complimented Herb Thomas and Jim Sanders for the excellent job in negotiating renewal of the sanitary landfill contract and renewal of the contract with BFI based on consumer price index for urban consumers. The administration is recommending assignment of the Hazelwood Sanitary Landfill contract to Sanifill along with the two renewals. Plans are to bid both services next year which will give the City several options. Sanifill has agreed to a renewal for a one -year period in the amount of $284,400. The compensation is adjusted to reflect the consumer price index for urban consumers. The annual solid waste collection and disposal contract will be renewed for the amount of $820,704.60. BFI has agreed to renew the current contract under the same terms and conditions for the same compensation with the addition of the consumer price index for urban consumers which has been granted to Sanifill, Inc. BFI has indicated an interest in entering the landfill business while Sanifill has indicated an interest in entering the solid waste collection and disposal business. Therefore, the City of Baytown should have two companies bidding on these services next year. The administration recommended approval. Council Member Hinds moved for adoption of the ordinance authorizing the assignment and assumption of agreement for operation of sanitary landfill from Hazelwood Enterprises, Inc. to Sanifill of Texas, Inc.; the ordinance approving renewal of the sanitary landfill contract and the ordinance authorizing renewal of the annual solid waste collection and disposal service contract with BFI. Council Member Pruett seconded the motion. In response to an inquiry from Council, Council Member Hinds stated that 950323 - 4 Minutes for Regular Session - March 23, 1995 the request of Sanifill to expand its current site had been approved through H -GAC on Tuesday. Mayor Alfaro noted that the City of Baytown had forwarded one letter to H -GAC and one letter to TNRCC in favor of the expanded facility, and Deer Park and LaPorte had also forwarded letters to both entities. Consider Proposed Ordinance No. 950323 -5, Awarding Contract for the Huggins Street Sanitary Sewer Project The administration recommended award of the contract for the Huggins Street Sanitary Sewer Project to Horseshoe Construction, Inc. in the amount of $148,208.20. The bid came in higher than the engineering estimate because more stabilized material will be needed for the project due to soil conditions in that area. The project includes installation of approximately 2,200 feet of twelve -inch sewer line along Huggins Street from Wisconsin to Missouri. Council Member Byford moved for adoption of the ordinance. Council Member Benavides seconded the motion. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None ORDINANCE NO. 7264 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AND ATTEST TO A CONTRACT WITH HORSESHOE CONSTRUCTION, INC., FOR THE HUGGINS STREET SANITARY SEWER PROJECT; AUTHORIZING PAYMENT OF THE SUM OF ONE HUNDRED FORTY -EIGHT THOUSAND TWO HUNDRED EIGHT AND 201100 DOLLARS ($148,208.20); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. For bid tabulations, see Attachment "A." 950323 - 6 Minutes for Regular Session - March 23, 1995 Consider Proposed Ordinance No. 950323 -6, Awarding Contract for Massey - Tompkins Phase III Project The proposed ordinance awards the contract for Massey- Tompkins Phase III Project to Angel Brothers Enterprises, Inc. in the amount of $2,266,148.00. The engineering construction estimate was $2,374,925.00. Six contractors bid on this project. The project includes utilities and a five -lane, concrete, curb and gutter street from the railroad tracks west to Main Street. The project is scheduled to be complete by October, 1995. Council Member Byford moved for adoption of the ordinance. Council Member Escontrias seconded the motion. In response to inquiry from Council, the City Manager stated that upon completion of the roadway, traffic studies would be performed to determine if a traffic light would be needed at the Chaparral intersection. Phases I, II, and III of the Massey- Tompkins Road Project cost a total of $7,700,000.00. He stated that the administration will be getting back to Council soon with an update on the bond program, because monies have dwindled and it may be time to discuss another bond program. Regarding change orders, the City Manager stated that lines of communication will be kept open during the construction process, and if the work has to be halted to bid a change, that will be done. Al Busch, representing the consulting engineers on the project, stated that the consulting engineers had an independent party review the plans and specifications as well as the roadway to insure the plans and specifications contained proper quantities. Consider Proposed Ordinance No. 950323 -7, Awarding Marina Infrastructure Construction Contract The proposed ordinance awards Marina infrastructure construction contract to Angel Brothers Enterprises, Inc. in the amount of $1,012,966.50. The engineering estimate was $1,160,000.00. This contract includes parking, roadways, utilities, drainage, and fueling facilities at the Marina site. Three bids were received. The project should be completed by August 1995. Council Member Byford moved for adoption of the ordinance. Council Member DonCarlos seconded the motion. Consider Proposed Ordinance No. 950323 -8, First Reading on Proposed Annexation of 13.9511 -Acre Tract at the Northeast Corner of Garth Road and Cedar Bayou- Lynchburg Road (Lowes Site) In accordance with state law and the Charter of the City of Baytown, the first reading must be held not more than forty nor less than twenty days after the public hearings. Public hearings on the proposed annexation of this tract were held at the Council meeting on February 23, 1995. All procedures prescribed by state law and charter have been met to allow Council to proceed on first reading. Council Member Escontrias moved for adoption of the ordinance. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None ORDINANCE NO. 7269 AN ORDINANCE AUTHORIZING FINAL PAYMENT OF THE SUM OF TWENTY -TWO THOUSAND SEVEN HUNDRED TWENTY AND NO1100 DOLLARS ($22,720.00) TO F & E ERECTION CO. FOR THE BAYLAND PARK MARINA DREDGING AND EXCAVATION PROJECT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance No. 950323 -11, Authorizing Payment to Insituform Gulf South, Inc. for Baker Road Sanitary Sewer Repair On March 11, 1995, a major sewer line failure of approximately 2,600 linear feet occurred between Quail Hollow Drive and Coachman Drive. This concrete sanitary sewer line, consisting of various ten -inch, twelve -inch, and fifteen -inch sections, interrupts the flow from Country Club I. Plans are to use cured -in -place pipe repair procedures to rectify this problem because it is under Baker Road. The City has an annual contract with Gulf South for this type work. Bond funds will be used for this project. The administration recommended approval. Council Member Escontrias moved for adoption of the ordinance. Council Member Pruett seconded the motion. 950323 - 11 Minutes for Regular Session - March 23,1995 In response to Council inquiry, the City Manager stated that infiltration is a major problem. Sliplining will not solve the infiltration problem upstream, and the City needs to continue to slipline to solve infiltration problems. Herb Thomas noted that the Central District diversion will provide relief in the Felton Street area. If a sliplined project has failed, usually the failure is where the sliplined pipe comes in contact with the manhole. If the seal is broken, this will cause a problem. The main trunkline from Baker Road down along Goose Creek to the hospital is in terrible condition as well as the distribution lines in Country Club I. The City Manager stated that the administration will have options for Council to consider during budget work sessions. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None ORDINANCE NO. 7270 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF ONE HUNDRED EIGHTY THOUSAND AND N01100 DOLLARS ($180,000.00) TO INSITUFORM GULF SOUTH, INC., FOR THE BAKER ROAD SANITARY SEWER REPAIR; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Approval of Plans and Specifications for the Wastewater Collection System and Lift Stations on State Highway 146 South of the Pipeline Corridor and Authorize Advertisement for Bids The project includes installation of lift stations and approximately 10,000 linear feet of sewer lines to route flow along Highway 146 north of the Cedar Bayou Bridge down to East District Wastewater Treatment Plant. The project begins at El Chaco Drive and will pick up Bayou Bend, Cedar Bend, and Lincoln Cedars, cross Cedar Bayou Bridge and tie into a large 21 -inch force main. The cost estimate is $1,750,000. In order to direct this flow to East District in a timely manner, this project is timed to be completed at the same time the East District Plant Expansion 950323 - 12 Minutes for Regular Session - March 23, 1995 is completed. Council Member Byford moved to approve the plans and specifications and to authorize the advertisement for bids. Council Member Escontrias seconded the motion. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None Consent Agenda Council considered the consent agenda as follows: a. Proposed Resolution No. 1242 authorizes additional time to make a final determination regarding the annual filing of FCC Form 1205 establishing regulated equipment and installation costs submitted by TCI Cablevision of Texas, Inc. ( "TCI ") in order to ascertain the reasonableness of the rates charged to subscribers for such equipment and services. On January 27, 1994, the City of Baytown, by Ordinance Number 6909, adopted regulations regarding the procedure the City of Baytown would utilize in analyzing costs of the regulated equipment and services of the franchised cable companies. Such ordinance allows council by resolution to invoke additional periods of time in order to make a final determination regarding the reasonableness of the submitted information. TCI submitted Form 1205 on March 2, 1995, however, the City of Baytown has been unable to review its submission; therefore, the additional ninety (90) days should give administration and council enough time to adequately review TCI's submission. We recommend approval. b. Proposed Ordinance No. 950323 -12 authorizes final payment to Iseler Demolition, Inc. for Cedar Bayou Water Tower Dismantling in the amount of $20,200. A Change Order in the amount of $1,500 was issued. All work has been completed and inspected. We recommend approval. 950323 - 13 Minutes for Regular Session - March 23, 1995 C. Proposed Ordinance No. 950323 -13 approves Change Order No. 3 for the housing rehabilitation project at 2012 Georgia in the amount of $1,464. Change Order No. 1 authorized the installation of 2,000 square feet of decking to the roof, and Change Order No. 2 facilitated the proper installation of sheetrock throughout the structure. Change Order Nos. 1 and 2 totaled $1,844.38. Change Order No. 3 will allow the contractor to install insulation throughout the attic, and allow the contractor to bring several other items in the dwelling up to code. Change Order No. 3 brings the total contract price to $22,691.90. We recommend approval. d. Proposed Ordinance No. 950323 -14 approves Change Order No. 2 for the housing rehabilitation project at 2203 Alabama in the amount of $1,472. The original contract amount was $18,275. Change Order No. 1 for the amount of $1,433.57 authorized the adaption from a non - handicap to a handicapped accessible home. The owner endured a severe stroke and will have special needs for the balance of her life. Change Order No. 2 will allow the contractor to install plywood decking for the roofing of the home, as well as approximately 1,800 square feet of attic insulation. Change Order No. 2 brings the contract price to $21,180.57. We recommend approval. e. Proposed Ordinance No. 950323 -15 authorizes payment to Texas Municipal League for deductibles on liability insurance coverage for $60,000. The ordinance will authorize additional payment to TML above the $36,000 budgeted to cover deductibles for the City's four policies, general liability and auto liability which have $10,000 deductible per claim, and law enforcement liability and errors and omissions liability that carry $25,000 deductible per claim. The past two budget years have not exceeded the deductible amount estimated. However, due to increases in claims which are to be partially processed or settled during this fiscal year, an additional $60,000 will be required. We recommend approval. 950323 - 14 Minutes for Regular Session - March 23, 1995 f. Proposed Ordinance No. 950323 -16 authorizes a lease purchase payment to IBM for hardware and software in the amount of $65,182.20. Hardware and software for the operating systems at City Hall and the Police Department were purchased in December 1990 and February 1991. This is a five -year lease /purchase from IBM. The price includes an on -site service plan for the term of the lease. We recommend approval. g. Proposed Ordinance No. 950323 -17 approves a contract with Thos. Y. Pickett and Company, Inc. in the amount of $20,000 for the Baytown Industrial District appraisals. The City of Baytown contracts with T.Y. Pickett to provide the valuations of properties in the City of Baytown Industrial Districts and provide general advice on the planning for the impact of any pollution control exemptions granted by TNRCC. This contract is for the calendar year beginning January 1, 1995. We recommend approval. h. Proposed Ordinance No. 950323 -18 amends Chapter 16, "Junk and Junkyards." This ordinance amends the Code of Ordinances Section 16 -15 "Definitions" Subsection (b), which defines automotive wrecking and salvage yards. Currently such definition only encompasses those lots or tracts of land within the city on which automotive vehicles are stored for the purpose of disassembling, dismantling or otherwise wrecking such automotive vehicles to extract parts therefrom for sale or for use in an automotive repair or rebuilding business. However, Chapter 16 of the Code of Ordinances has been consistently applied to more than just automotive repair or rebuilding businesses. The City requires every vehicle storage facility regardless of its purpose to be enclosed by a six foot opaque fence. This proposed ordinance will clarify any ambiguities contained in the present ordinance and is consistent with the current application of the existing ordinance. We recommend approval. ,, i. Proposed Ordinance No. 950323 -19 authorizes an agreement with the Baytown Family Y.M.C.A. for a Youth Summer Recreation Program in the amount of $14,910. The contractual agreement became necessary two years ago when a full -time city staff position 950323 - 15 Minutes for Regular Session - March 23, 1995 was eliminated. The last two years the City has had a contract with the YMCA for a summer recreation program which has been very successful. The YMCA has the available resources, including vans for transporting participants and an outreach coordinator, who will be the front line supervisor of the programs. The agreement includes three programs: Tennis Little League, A Day In The Park, and a Special Population Program (working with physically challenged). The Parks and Recreation Board reviewed the contract at their board meeting on March 16 and recommend approval. We recommend approval. j. Proposed Ordinance No. 950323 -20, amends Ordinance No. 6673 relating to the annexation of the Cracker Barrel Old Country Store on IH -10 to attach an additional exhibit of the metes and bounds description of the area annexed. The Cracker Barrel supplied the City with the metes and bounds description of the area to be annexed, which was incorporated into Ordinance No. 6673; however, such description only included the roadway around the restaurant and store, not the facility itself. The attachment to be included by this proposed ordinance is the metes and bounds description of the property on which the restaurant and store lie. The service plans, the minutes of the council meetings regarding the annexation of such area, as well as all maps included in the U.S. Department of Justice submission clearly indicate that at the time of the passage of Ordinance No. 6673, Council intended to annex the site of the Cracker Barrel Old Country Store. Furthermore, such was the intent of the Cracker Barrel. The attorney for Cracker Barrel has indicated that the company has no objection to this amendment or to the issuance of tax statements for the tax years 1994 and 1995, as the restaurant is receiving municipal services. Proposed Ordinance No. 950323 -22 repeals Section 3 of Ordinance No. 3727 relating to participation of the City of Baytown in the supplemental death benefits fund. Prior to Texas Municipal Retirement System providing the supplemental death benefit for retirees, the City carried insurance /death benefit for retirees in the amount of $3,000. When this benefit became part of the TMRS system, it provided a $2,500 death benefit for retirees. In order to maintain the existing level of coverage, the City elected by adoption of this ordinance to supplement the TMRS benefit by an additional $500. The TMRS death benefit for retirees has been increased to $5,000, thus eliminating the need for the City's additional contribution We recommend approval. M.
