The City Council of the City of Baytown, Texas, met in special session on
December 13, 1994, at 5:00 p.m. in the Conference Room of the Baytown City Hall
with the following in attendance:

The meeting was opened with a quorum present, after which the following
business was conducted:
Recess into Executive Session to Discuss Contemplated Litigation
Mayor Alfaro recessed the open meeting into executive session to discuss
contemplated litigation. When the open meeting reconvened, Mayor Alfaro
announced that no action was necessary as a result of the executive session.
Adjourn
As there was no further business to be transacted, the special session was
adjourned.

December 13, 1994, at 5:25 p.m. in the Council Chambers of the Baytown City Hall

The meeting was opened with a quorum present, and Council Member
DonCarlos offered the invocation, after which the following business was conducted:
Consider Proposed Ordinance No. 941213 -1, Second and Final Reading on Proposed
Annexation of Municipal Utility District No. 3
In a work session prior to the council meeting, the City Manager reviewed the
financials with Council as well as other obligations. The administration recommended
adoption of the ordinance on second and final reading.
Council Member Byford moved to adopt the proposed ordinance. Council
Member Escontrias seconded the motion. The vote follows:

ORDINANCE NO. 7156
AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN
BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE
ANNEXATION OF THE MUNICIPAL UTILITY DISTRICT #3 LOCATED
NORTH OF INTERSTATE 10 AT GARTH ROAD; WHICH SAID TERRITORY
LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS
FOR THE CITY OF BAYTOWN, TEXAS.
Consent Agenda
Council considered the consent agenda as follows:
a. Proposed Ordinance No. 941213 -2, places MUD No. 3 in the proper
Council District. Upon annexation of Municipal Utility District No. 3, the
City Council must place the site in the proper council district. Based on
the location of this area, Municipal Utility District No. 3, the logical
placement is in Council District No. 4, and the proposed ordinance places
the subject site in Council District 4.
We recommend approval.
b. Proposed Ordinance No. 941213 -3, second and final reading on
proposed annexation of Pilot Travel Center. In accordance with state
law and the Charter of the City of Baytown, the first reading on
annexation was held not more than 40 nor less than 20 days after the
public hearings. Public hearings on the proposed annexation of Pilot
Travel Center were held on October 13, 1994. The ordinance was
published on first reading and at least thirty days have elapsed since the
publication. Therefore, City Council may cause the ordinance to be
adopted on second and final reading.
We recommend approval.
C. Proposed Ordinance No. 941213 -4 places Pilot Travel Center in the
proper Council District. Upon annexation of the Pilot Travel Center, the

City Council must place the site in its proper council district. Based on
the location of this area, the logical placement is in Council District
No. 4.
We recommend approval.
d. Proposed Ordinance No. 941213 -5 authorizes Change Order No. 4 in the
amount of $ 14,701.88 to Craig, Sheffield, and Austin for the
Enlargement of West District Wastewater Treatment Plant. The original
contract amount was $5,037,800.00, with Change Order No.'s 1 and
2 for no amount of money, and Change Order No. 3 in the amount of
$45,744.68. The amended contract amount is $5,098,246.56, less
than 1 %. This change order consists of additional paving at the plant to
provide parking for city vehicles and other vehicles that service the plant.
The additional space became available when the old headworks were
removed as part of Change Order No. 3. Langford Engineering is the
engineer for this project and recommends approval of the change order.
We recommend approval.
e. Proposed Ordinance No. 941213 -6 approves the sole source purchase
of a computer backup system for the Police Department and Municipal
Court in the amount of $163,801. The system is a sole source purchase
from IBM which will provide for continuous computer operation of the
Police Department and Municipal Court computers. Presently, when
there is a need for repairs or maintenance to the Risc 6000, the Police
and Municipal Court computers may be down for extended periods. This
backup system will completely alleviate computer downtime.
We recommend approval.
Council Member Hinds moved for adoption of the consent agenda items "a"
through "e." Council Member DonCarlos seconded the motion. The vote follows:
The City Manager explained that the budgeted amount for the purchase of a
computer backup system for the Police Department and Municipal Court is $113,667,
but the bid price is $163,801, resulting in a funding shortfall of $50,124. The City
had budgeted $10,000 for maintenance for the system purchased, but IBM presented
an option of paying $31,000 up front for a five -year maintenance program rather than

paying $ 10,000 per year which would result in a $19,000 savings to the City. The
other major component to the cost overrun is $13,376 to allow the CPU's to run
simultaneously. This feature was not available when the original cost was estimated.
IBM has agreed to allow the City to pay $110,000 now and the remaining 553,801
from the 1995196 budget. The administration recommended approval. The vote
follows:

SHEFFIELD, AND AUSTIN FOR THE ENLARGEMENT OF THE WEST
DISTRICT WASTEWATER TREATMENT PLANT PROJECT; AUTHORIZING
PAYMENT BY THE CITY OF BAYTOWN, THE SUM OF FOURTEEN
THOUSAND SEVEN HUNDRED ONE AND 881100 DOLLARS

City Manager's Report
Texas Department of Transportation
TxDot has notified the administration that a sidewalk will be constructed along
both sides of Highway 146 from near Horace Mann Junior School to Loop 201. The
State plans to fund a total of thirteen projects.
TexPool
Monte Mercer, Finance Director, has been in constant contact with TexPool as
well as other contacts in the state. The TexPool portfolio has no high -risk mortgage
securities common to the Orange County situation. About fifteen percent of the
City's funds are in TexPool.
