November 7, 1994
The City Council of the City of Baytown, Texas, met in emergency session on
November 7, 1994, at 8:00 a.m. in the Council Chambers of the Baytown City Hall
with the following in attendance:

The meeting was opened with a quorum present, after which the following
business was conducted:
Consider Proposed Ordinance No. 941107 -1, Awarding Bid on Emergency Basis to
Effect Repairs to Caldwell Sanitary Sewer Line.
Sanitary sewer lines in several areas of the City have collapsed because of the
heavy rains. This one is now in emergency status. It is in the easement between
Caldwell and Lazy Lane in Lakewood and involves 270 feet of 6 -inch concrete pipe.
The 6 -inch pipe is too small for Insituform which works on the larger diameter pipe,
and sliplining is not feasible in this case. Therefore, the recommendation is to use a
method known as "pipe bursting." This process pulls the liner through, with the
equipment acting as an auger breaking up any existing concrete pipe and making a
larger passage. The 6 -inch line will be retained with the "pipe bursting" method.
Out of four contractors, two bid on the project: PM Construction, in the
amount of Fifteen Thousand Five Hundred Sixty and No /100 Dollars ($15,560.00);
McLat Construction, Sixteen Thousand Two Hundred Fifty and No /100 Dollars
(516,250.00). Both contractors have looked at the project. The scope of the project
has been explained to each contractor, and the contractors have been on site. The

ordinance was written for up to Twenty -Five Thousand and No /100 Dollars
($25,000.00) because of the unknowns in this project.
The administration recommended approval. Council Member Byford moved for
adoption of the ordinance. Council Member DonCarlos seconded the motion. The
vote follows:
Ayes: Council Members Benavides, Byford, and DonCarlos
Mayor Alfaro
Nays: None
Absent: Council Members Escontrias, Hinds, and Pruett.
ORDINANCE NO. 7154
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS,
AUTHORIZING PAYMENT UP TO THE SUM OF TWENTY -FIVE THOUSAND AND
NO /100 DOLLARS ($25,000.00) TO PM CONSTRUCTION FOR THE CALDWELL
SANITARY SEWER REPLACEMENT; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
Adjourn
There being no other business to be transacted, the emergency session was
adjourned.

Mayor Alfaro recessed the open meeting into executive session to discuss land
acquisition in Brownwood and along Goose Creek Stream. When the open meeting
reconvened, Mayor Alfaro announced that no action was necessary as a result of the
executive session.
