City Manager City Attorney City Clerk The meeting was opened with a quorum present, and Council Member DonCarlos offered the invocation, after which the following business was conducted: Consider Approval of the Regular Session Held on January 27, 1994 Council Member DonCarlos moved for approval of the minutes for the regular session held on January 27, 1994. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, DonCarlos and Pruett Mayor Alfaro Nays: None *Council Member Hinds Present 940210 -2 Minutes of the Regular Session - February 10, 1994 Consider Proposed Resolution No. 1205, Naming Walkway on Perry Simmons Bridge in Memory of Former Councilman Ted L. Kloesel Mr. Kloesel was on council for three terms, from 1968 to 1972 and 1978 to 1980. His persistence concerning the need of a walkway across the bridge is one of the main reasons it was included in the project. Council Member Pruett moved for adoption of the resolution. Council Member Hinds seconded the motion. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos and Pruett Mayor Alfaro Nays: None RESOLUTION NO. 1205 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, THAT THE WALKWAY ON THE PERRY SIMMONS BRIDGE, LOCATED ON WEST MAIN STREET, BE NAMED IN HONOR OF FORMER COUNCILMAN TED L. KLOESEL; THAT A SIGN IN HONOR OF MR. KLOESEL BE PLACED IN A PROMINENT LOCATION AT OR NEAR SAID BRIDGE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance Repealing Chapter 29, "Taxicabs," of the Code of Ordinances and Replacing It With A New Chapter 29, "Taxicabs," Which Establishes A New Procedure for the Granting of Taxicab Permits and Requires a More Extensive Application Process Since the taxicab ordinance was last amended in 1957, City Council requested that the administration look at taxicab ordinances in other cities and bring recommended changes to council. Council met in several work sessions to consider possible changes in the taxicab ordinance. The major change in the ordinance eliminates the need for city council to find that public convenience and necessity demand the proposed taxicab service. Instead, the ordinance allows anyone who completes an application for a license for taxicab service within the city and meets all the requirements of the ordinance to be granted taxicab permit. The administration recommended approval of the proposed ordinance. 940210 -3 Minutes of the Regular Session - February 10, 1994 Mayor Alfaro recognized Joy Alford Hart and Tommy Bright. Ms. Hart stated that she and her late husband had purchased the business twenty -four years ago. They worked very hard to develop a good reputation in the community and to assist the City of Baytown in its Senior Citizens' Taxi Program. The money made by the company goes back into the company and into the City of Baytown. Some of the drivers have been with the company for ten years or longer. Ms. Hart supported the existing provision of council determining public convenience and necessity. Tommy Bright, son -in -law of Ms. Hart and Manager of the company, also felt the existing provision of council determining public convenience and necessity should be maintained. Council Member Escontrias moved for the adoption of the ordinance. Council Member Benavides seconded the motion. Council Member Hinds felt that taxi service is much like a public utility, and for this reason he favored determination of public convenience and necessity. Council Member Escontrias commented that from the remarks of Mr. Bright and Ms. Hart, the company should still be the lead company or main stay. Adoption of the proposed ordinance will only allow the market to determine. Council Member Benavides stressed that no one questioned the capability of the current holder of taxicab permits. However, this area should be open to competition. Mayor Alfaro agreed that Baytown needs to maintain a good taxicab service. However, the key issue is whether council should determine public convenience and necessity or allow the market place to prevail. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, and DonCarlos Mayor Alfaro Nays: Council Members Hinds and Pruett ORDINANCE NO. 6926 AN ORDINANCE REPEALING CHAPTER 29, "TAXICABS," OF THE CODE OF ORDINANCES, CITY OF BAYTOWN, TEXAS, AND REPLACING IT WITH A NEW CHAPTER 29, "TAXICABS;" PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. 940210 -4 Minutes of the Regular Session - February 10, 1994 Consider Proposed Ordinance, Amending Chapter 17, "Miscellaneous Provisions and Offenses" by Repealing Section 17 -15, "Fencing of Certain Man -Made Pits, Holes or Other Man -Made Excavations," and By Adding Sections 17 -24 through 17 -35. Mayor Alf aro stated that council, in work session, had decided that they needed to educate themselves on the proposed ordinance and provide input to the administration. Another work session will be held prior to the next council meeting. Any questions from council relating to the proposed ordinance should be given to the City Manager who will forward all questions to council members. Consider Proposed Ordinance, Ordering Municipal Election for May 7, 1994 Council Member Hinds moved for adoption of the ordinance. Council Member Escontrias seconded the motion. In response to council inquiry, Ms. Hall explained the reason for certain precinct boundary changes. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos and Pruett Mayor Alfaro Nays: None ORDINANCE NO. 6927 AN ORDINANCE ORDERING THE MUNICIPAL ELECTION TO BE HELD ON THE 7TH DAY OF MAY 1994, FOR THE PURPOSE OF ELECTING THREE (3) COUNCILMEMBERS FROM THE RESPECTIVE DISTRICT NOS. FOUR (4), FIVE (5), AND SIX (6); AND A MAYOR FROM THE CITY AT LARGE; PROVIDING FOR THE ELECTION OFFICERS; DESIGNATING THE PLACES AND MANNER OF HOLDING SAID ELECTION; PRESCRIBING THE HOURS; ESTABLISHING THE CENTRAL COUNTING STATION; PROVIDING FOR AN EARLY BALLOT BOARD FOR EARLY BALLOTS; AND PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE. Consider Proposed Ordinance, Awarding Contract for the Expansion of the East District Sewer Treatment Plant The City Manager explained that money is available for East District improvements, but the city is getting very close to the end of sewer dollars available for this year. Total costs for West District improvements is $4.468 million including engineering and inspection fees. Total costs for East District is $3.864 million, including engineering and inspection fees. A contingency of $203,000 is provided for the West District and a contingency of $217,000 on the East District. Two other projects that must be completed are the Sterling /Defee Project as well as the Mabry Road Project at a cost of $348,940. Therefore, out of next year's sewer rehab bonds assuming that the city needs to replace that contingency, we will have $955,000 rather than $1,304,000 in bonds to be sold. We have remaining in the contingency 940210 -5 Minutes of the Regular Session - February 10, 1994 for West District $28,000 and in contingency for East District $43,000. We still have approximately $1,000,000 to complete the Highway 146 Sewer Line that is to be constructed as soon as the East District Plant is completed or nears completion. The big dollar items are the Central and West District Plants. The diversion will cost about 2 million or 2.4 million dollars which will be sold next year; 1.3 million in sewer rehab will be sold next year and then the final year $700,000 in sewer rehab will be sold. He ended his presentation and called upon Wayne Smith, Consulting Engineer on the project. Mr. Smith stated that ten bids were received for the East District Expansion Project. Immediately after the bids were opened the apparent low bidder called to indicate that there was an error in that bid. The consulting engineers made inquiry concerning the second low bidder, Basic Constructors, receiving unfavorable response. Therefore, the consulting engineers recommended award of the contract to N & S Construction Co., Inc. The difference in cost between the two bidders is $14,000. The administration concurred with the recommendation. In response to inquiry from Council concerning the reason the bid is significantly higher than the estimate, Mr. Smith responded that the bid is about 15% higher. Engineers do not perform as detailed, nor elaborate analysis as contractors. One was done and that was compared to other sewer plants constructed in the area. The contractor looked at the project differently, possibly, due to past construction at the East District plant and the anticipation of uncovering some underground obstructions. The $14,000 different between the second and third bidder is minimal when one considers that on a project being performed by Basic Constructors, 120 change orders were requested and 16 of those were approved. On a project of this size it is not uncommon to have a change order or two, but not 120. The vote follows: Council Member Escontrias moved for adoption of the ordinance. FOR THE EXPANSION OF THE EAST DISTRICT SEWER TREATMENT PLANT; AUTHORIZING PAYMENT OF THE SUM OF THREE MILLION SEVEN HUNDRED FOUR THOUSAND SIX HUNDRED THIRTEEN AND 501100 DOLLARS ($3,704,613.50); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 940210 -6 Minutes of the Regular Session - February 10, 1994 For Bid Tabulation, See Attachment "A." Consider Reprogramming 1981 Bond Funds A total of $741,410 of 1981 Bond Funds are available for reprogramming. For recommended reprogramming, see Attachment "B." Council Member Byford moved to authorize reprogramming of 1981 Bond Funds as outlined by the City Manager. Council Member Hinds seconded the motion. The City Manager emphasized that each item will be brought back to council for approval as funds are expended. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos and Pruett Mayor Alfaro Nays: None Consider Plans and Specifications for Fire Station Roofs and Authorize Advertisement for Bids Trimco, Inc. has developed the specifications to renovate portions of the roofs on Fire Station No. One on Garth Road and Fire Station No. Four on Fayle. The work will consist of sealing leaks and gutters, roofs and walls, new flashing, coping and all related metal will be replaced. The existing brick and stucco will be waterproofed. Estimated cost is $120,000. Funds will come from the 1981 Bonds. The administration recommended approval. Council Member Byford moved to approve the plans and specifications for the fire station roofs and authorized advertisement for bids. Council Member Benavides seconded the motion. Since these roofs are only about seven years old, Council Member Pruett cautioned that there seemed to be a design flaw and therefore, this design should be avoided in the future. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos and Pruett Mayor Alfaro Nays: None 940210 -7 Minutes of the Regular Session - February 10, 1994 Consider Proposed Ordinance, Authorizing Payment to Insituform Gulf South, Inc. for Drainage Repair in Kingsbend Subdivision In recent weeks a problem has arisen with the storm drainage system between Canterbury Drive and Kingsway in the Kingsbend Subdivision. The twenty -four inch storm sewer has deteriorated and needs to be replaced. This pipe is located in an easement between two houses and in at least one location is directly beneath the edge of the house slab. Due to its location adjacent to the house, removal and replacement of the pipe is not practical. The recommended option is to line the storm sewer with the same liner used for sanitary sewer rehabilitation. The insituform process was specifically designed for such installation where digging can be detrimental and /or expensive. The line is approximately 250 feet long. This work would be performed under the annual rehab contract. Funds for this project are provided from the 1981 Bonds. Council Member Pruett moved for adoption of the ordinance. Council Member Benavides seconded the motion. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos and Pruett Mayor Alfaro Nays: None ORDINANCE NO. 6929 AN ORDINANCE AUTHORIZING PAYMENT UP TO THE AMOUNT OF TWENTY THOUSAND AND NO /100 DOLLARS ($20,000.00) TO INSITUFORM GULF SOUTH INC. AS THE COST FOR DRAINAGE REPAIR IN KINGSBEND SUBDIVISION; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consent Agenda Council considered the consent agenda as follows: a. Proposed Ordinance No. 940210 -6 awards the bid for installation of a two section interstater mowing system and repair of a Ford 5600 tractor to Landsdowne -Moody Co., Inc. in the amount of $19,264.82. Invitations to Bid were mailed to four suppliers and we received two bids. We recommend approval. 940210 -8 Minutes of the Regular Session - February 10, 1994 b. Proposed Ordinance No. 940210 -7 awards the annual pool supplies and services contract to Progressive Chemicals, Inc. in the amount of $12,655.00. Invitation to bids were mailed to three suppliers and we received one bid. These supplies and services are provided for our four City swimming pools. We received the other two bids in the mail on February 2, 1994. The scheduled opening date for this bid was on January 31, 1994. We recommend approval. C. Proposed Ordinance No. 940210 -8 awards the annual brass fittings contract to Golden Triangle Pipe in the amount of $27,460.25. Invitation to bids were mailed to nine suppliers and we received three bids and one no -bid. This contract will be used by the Public Works Department. The low bidder, Municipal Pipe, on Section II does not meet specifications. The supplier submitted their own terms and conditions to supersede the City of Baytown's. Their terms and conditions are unacceptable. We recommend approval. d. Proposed Ordinance No. 940210 -9 awards the bid for purchase of a flat bed truck with a hydraulic hoist to Knapp Chevrolet, Inc. in the amount of $37,443.00. Invitations to Bid were mailed to three suppliers and we received two bids and one no -bid. This flatbed truck with hydraulic hoist will be used by the Public Works Street Department for hauling materials used by the construction crew. We recommend approval. e. Proposed Ordinance No. 940210 -10 establishes speed limits during construction on the portion of Loop 201 from Spur 330 to east of North Main Street. The Texas Department of Transportation has requested this action. The Department intends to let a contract on the portion of Loop 201 from Spur 330 to east of North Main Street. Therefore, a construction speed zone is necessary for this project. A similar action was taken by the City Council in 1993 for the southern portion of Loop 201 from the Fred Hartman Bridge to Spur 330. Since this project will not involve construction work on the frontage roads, the ordinance provides for a 40 mph speed limit when so signed. We recommend approval. 940210 -9 Minutes of the Regular Session - February 10, 1994 f. The bids for police intermediate size cars came in higher than expected. We wish to reject the bids and rebid them. g. Proposed Ordinance No. 940210 -12 awards the bid for seven police full size cars to A.C. Collins Ford, Inc. in the amount of $94,808. Invitations to bid were mailed to five suppliers and we received three bids. We recommend approval. Council Member Escontrias moved for adoption of the consent agenda items "c" through "g." Council Member Hinds seconded the motion. In response to inquiry from council, the City Manager indicated that the administration had recommended rejection of bids for intermediate size vehicles because we feel that we can get a better price. The Texas Department of Transportation intends to let a contract on the portion of Loop 201 from Spur 330 to east of North Main Street in August of 1994. The ordinance establishes a temporary speed zone for construction period only and is only valid when the speed limits are posted. Consider Appointments to the Urban rehabilitation Board. Council Member Pruett moved to appoint Erwin W. Froehner, Francis Mookhoek, and Fritz Lanham to the Urban Rehabilitation Board. Council Member DonCarlos seconded the motion. Riser as Health Officer and Dr. Dan Ganzhorn as Alternate Health Officer for a term beginning March 25, 1994, to March 25, 1996. Council Member Hinds seconded the motion. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos and Pruett Mayor Alf aro Nays: None City Manager's Report The City Manager referred to a memo enclosed in the council packet which contained about six items of information attached. Included was a response from the administration to the Management Letter from Deloitte and Touche; a report from Barbara Kolaja, Youth Commission Coordinator; suggested road hump criteria; notification of the work session scheduled for Wednesday, February 16 at 4:00 p.m. to meet with the zoning consultants to discuss draft zoning map and compatibility standard; a memo from Ms. Hall concerning case flow at Municipal Court and a draft ordinance concerning a teen curfew. These are bond funds that are remaining after projects have been completed. All of the expenditures from these funds will be brought back for council approval at the appropriate time. We recommend reprogramming as follows: 1. Fire Station Renovation Roof renovation on Fire Station No. 1 and 4 $120,000 Station No. 1 is located on Garth Road and Station No. 4 is located on E. Fayle. Both stations have roof leaks that are damaging the building structures. 2. Baker Road Water Tower Renovation $185,000 There has been $125,000 allocated for this project; however, due to the new EPA / TNRCC regulations, the cost of this renovation has more than doubled. Containment and abatement of the lead paint removal process totals approximately $100,000. This has not been required in past years. We are under an enforcement order from the TNRCC to repaint this water tower. The last tower (Park Street) painted in 1990 cost $104,818.66. The estimated total cost of this project is $308,500. ATTACHMENT "B" 1981 Bond Funds Page 2 3. Traffic Humps $ 25,000 These funds could be reserved for the Traffic Hump Program as council studies this issue. If the program is not implemented, the funds would be reprogrammed. 4. Tompkins Road Drainage Project $ 35,000 This project consists of lining the existing outfall pipe that flows into Cary's Bayou. This work will be performed by city crews. It also includes insituforming approximately 250 feet of drainage pipe that has separated. 5. Street /Sanitary Sewer $376,410 The 1991 bonds funds for street renovation and sanitary sewer needs sold through this year, are spent or committed. These old bond funds will be designated for overruns on streets and sanitary sewer projects or unforeseen sewer projects. -,n crn cocncomemost1981BondFunds �.
