1993 06 10 CC MinutesMINUTES OF THE REGULAR SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN June 10, 1993 The City Council of the City of Baytown, Texas, met in regular session on June 10, 1993, at 2:45 p.m. in the Council Chamber of the Baytown City Hall with the following in attendance: Eva Benavides David Byford Manuel Escontrias * E. Frank Hinds, Jr. Stephen DonCarlos Rolland J. Pruett Pete C. Alfaro Bobby Rountree Norman Dykes Eileen P. Hall Council Member Council Member Council Member Council Member Council Member Council Member Mayor City Manager Asst. City Manager City Clerk The meeting was opened with a quorum present, and Council Member Byford offered the invocation, after which the following business was conducted: Consider Approval of the Minutes for the Regular Session Held on May 27, 1993 Council Member Pruett moved for approval of the minutes for the regular session held on May 27, 1993. Council member DonCarlos seconded the motion. The vote follows: Ayes: Council members Benavides, Byford, Escontrias, DonCarlos and Pruett Mayor Alfaro Nays: None Interview Candidates to Fill Council District No. 4 Vacancy Council interviewed four candidates to fill Council District No. 4 vacancy as follows: Donna Walker, E. Frank Hinds, Jr., William P. Cornelius, and James S. "Jim" Entringer. 930610 -2 Minutes of the Regular Session - June 10, 1993 Consider Appointment to Fill Council District No. 4 Vacancy (Statement of Appointed Officer to Secretary of State) Council member Pruett thanked all the candidates for offering to serve. He emphasized that this is not an easy job and stated that he felt that each candidate would be very capable. Council member DonCarlos stated that he had been through this process about a year ago in February. He noted that he had not only observed the presentations today, but he had spoken with many citizens of the community concerning the candidates. All are very reputable within the community, and he congratulated each of them on their presentation. Council member Escontrias thanked each for their participation and emphasized that this is a very tough decision. He thanked the group for their involvement in the community. Council member Byford stated that he too had gone through this process in November and understood what each candidate was experiencing. He emphasized that each was very talented and strongly recommended that all of the candidates file for election next term. Council member Benavides thanked all of the candidates. She felt that any of the candidates would be dedicated and would work hard for the community. However, only one could be appointed. She felt secure that whichever candidate was appointed would do a very good job. Mayor Alfaro stated that Baytown is very fortunate to have such qualified candidates. He emphasized the difficulty of the decision. Council member Escontrias moved to appoint Jim Entringer to fill Council District No. 4 vacancy. Council member Benavides seconded the motion. The vote follows: Ayes: Council members Benavides and Escontrias, Mayor Alfaro Nays: Council members Byford, DonCarlos and Pruett Council member Pruett moved for the appointment of Frank Hinds to fill the Council District No. 4 vacancy. Council member Byford seconded the motion. 930610 -3 Minutes of the Regular Session - June 10, 1993 Council member DonCarlos stated that he hated to vote "nay" on any of the candidates. However, through discussions with people in the community who have served with Mr. Hinds on various committees, including the Traffic Committee and the Growth Management Committee, he is known for his leadership on these committees and has a very good track record of service in the community. Mayor Alf aro added that he too had received several calls on all four candidates. Each have pluses and minus. Not one candidate was favored unanimously. The vote follows: Ayes: Council members Benavides, Byford, Escontrias, DonCarlos and Pruett Mayor Alfaro Nays: None Recess and Reconvene Mayor Alf aro recessed the open meeting to allow the city clerk time to have the Statement of Appointed Officer executed, fax a copy to the Secretary of State's Office, and receive verification of the filing. Administer Oath of Office to Newly Appointed Council Member When the open meeting reconvened, Eileen Hall, City Clerk, administered the Oath of Office to E. Frank Hinds, Jr. " Council member Hinds seated. Hear 1993 Affirmative Action Plan and Six -Month Progress Report The city manager explained that in an effort to enhance the city's overall business practices and meet commitments to the Economic Development Administration, the city has developed a formal Affirmative Action Plan. Currently, semi - annual progress reports regarding the Affirmative Action efforts attained are required. 930610 -4 Minutes of the Regular Session - June 10, 1993 The Affirmative Action Plan for the City of Baytown is a detailed, action - oriented, program specific, document that has been designed to be utilized as a working tool to provide guidance to the users with systematic measurements for effectiveness. It has been developed to assist the Human Resources Department in identifying areas requiring additional focus in order to assist the city in meeting its goals and commitments. The analysis and the plan serves as a monitoring device utilized to develop goals and action - oriented programs. He emphasized that the plan is not all inclusive and revisions, amendments, and updates will be made as necessary. Council was provided with a summary of the Affirmative Action Plan, Section 1 and 2. The city manager briefly reviewed that information for council and mentioned that the complete report was on hand for council review. Ann Malkie, projected a copy of the Summary Utilization Status Report and explained that the shaded areas in the report reflected changes. The Summary Utilization Status Report reflects data from January 1, 1993 through June 2, 1993. Council was very complimentary of the work performed by Ms. Malkie and the strides that the city is making in the affirmative action area. Ms. Malkie stated that presently the city must report twice a year but with this report she is hopeful that the city will be able to report once a year. A copy of the information presented to council is attached to the minutes as Attachment "A." Elect Mayor Pro Tempore It is customary for council to elect a Mayor Pro Tempore each year after the canvass of the run -off election if one is necessary. Council member Byford moved for the election of Council member Stephen DonCarlos as Mayor Pro Tempore. Council member Benavides seconded the motion. The vote follows: Ayes: Council members Benavides, Byford, Escontrias, Hinds, DonCarlos and Pruett Mayor Alf aro Nays: None 930610 -5 Minutes of the Regular Session - June 10, 1993 Consider Proposed Ordinance Amending the Code of Ordinances, Chapter 2, "Administration," Article II, "Boards and Commissions," Division 7, "Baytown Cultural Arts Council," to Reduce the Number of Members and Update Responsibilities The proposed ordinance reduces the number of Cultural Arts council positions from seven to five. The proposed change will make it easier to obtain a quorum and handle official business, as well as authorize the Cultural Arts Council to have the official authority to present and sponsor cultural arts activities and performances to the citizens of Baytown. The administration recommended approval. Council member Escontrias moved for adoption of the ordinance. Council member DonCarlos seconded the motion. The vote follows: Ayes: Council members Benavides, Byford, Escontrias, Hinds, DonCarlos and Pruett Mayor Alfaro Nays: None Ordinance No. 6670 AN ORDINANCE AMENDING CHAPTER 2 "ADMINISTRATION," ARTICLE II "BOARDS AND COMMISSIONS," DIVISION 7 "BAYTOWN CULTURAL ARTS COUNCIL," SECTION 2 -66 "CREATION OF CULTURAL ARTS COUNCIL," SECTION 2 -67 "APPOINTMENT OF COUNCIL; QUALIFICATIONS," AND SECTION 2 -67.1 "TERMS OF COUNCILMEMBERS," OF THE CODE OF ORDINANCES, CITY OF BAYTOWN, TEXAS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance Authorizing Renewal of a Lease for the Harris County Organized Crime Narcotics Task Force The proposed ordinance authorizes the renewal of a lease agreement in the amount of $ 16,800 for the Harris County Organized Crime Narcotics Task Force to lease warehouse space. The cost will be $ 1,400 per month and will be provided by grant funding. The vote follows: Ayes: Council members Benavides, Byford, Escontrias, Hinds, DonCarlos and Pruett Mayor Alfaro Nays: None Ordinance No. 6671 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AUTHORIZING RENEWAL OF THE LEASE AGREEMENT ON BEHALF OF THE CITY OF BAYTOWN FOR OFFICE /WAREHOUSE SPACE FOR THE TIME PERIOD OF JUNE 1, 1993 THROUGH MAY 31, 1994; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Appointments to Cultural Arts Council Council member Byford moved to appoint David Black, Lynn Foley, Nancy Hefner Hawks, Linda Shelby and Robert McElroy to the Cultural Arts Council. Council member Pruett seconded the motion. The vote follows: Ayes: Council members Benavides, Byford, Escontrias, Hinds, DonCarlos and Pruett Mayor Alfaro Nays: None Since council had adopted a new ordinance, it was necessary to establish terms of office for the appointments under that office. Ms. Hall drew for terms of office as follows: David Black - 3 years; Lynn Foley - 3 years; Nancy Hefner Hawks - 1 year; Robert McElroy - 2 years; Linda Shelby - 3 years. Consider Appointments to Baytown Housing Finance Corporation Board Mayor Alfaro reminded council that the mayor makes appointments to the Baytown Housing Authority Board, while council makes appointments to Baytown Housing Finance Corporation Board. Usually the appointments made by the mayor to the Baytown Housing Authority Board are the same appointments made by council to the Baytown Housing Finance Corporation Board. Mayor Alfaro appointed O.J. "Dixie" Howell, Marie Auzenne and Lamar Kelley to serve two year terms on the Baytown Housing Authority Board. 930610 -7 Minutes of the Regular Session - June 10, 1993 Council member DonCarlos moved to appoint O.J. "Dixie" Howell, Marie Auzenne and Lamar Kelley to the Baytown Housing Finance Corporation Board. Council member Pruett seconded the motion.
