Consider Proposed Ordinance Authorizing Contract with Langford Engineering for West District Wastewater Treatment Plant and Related Projects Since the city entered into the original agreement with Langford Engineering for the West District Wastewater District Treatment Plant and related projects, the city received a $1.5 million grant from the Economic Development Administration to assist the city in undertaking the plant expansion. EDA regulations and the grant's special conditions require that the engineering services fee be on a "Fixed Fee" basis. The existing agreement does not meet this requirement. Therefore, a new contract is required to comply with the EDA grant terms and conditions. EDA has approved the proposed contract and will participate in all the engineering costs. The administration recommended approval of the ordinance. Council Byford moved for adoption of the ordinance. Council member Pruett seconded the motion. The vote follows: 930608 -3 Minutes of the Special Session - June 8, 1993 In response to questions from council, Kent Laza, City Engineer, stated that this contract represents about 6% of the whole contract which is equal to slightly less than the original contract. FOR PROFESSIONAL ENGINEERING SERVICES RELATED TO THE DESIGN AND CONSTRUCTION OF THE EXPANSION OF THE WEST DISTRICT WASTEWATER TREATMENT PLANT; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE SUM OF FIVE HUNDRED TWELVE THOUSAND SEVEN HUNDRED AND NO /100 ($512,700.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance Authorizing Abandonment of 2.1' of Utility Easement Between Lots 28 and 29, Block 1, Ginger Creek, Section 2 (More Specifically the 2.1' Abutting 3403 Old Oaks Drive) Jeri D. Brooks has petitioned for the abandonment of 2.1' of the 10' easement between Lots 28 and 29, Block 1, Ginger Creek, Section 2 (more specifically, the 2.1' abutting 3403 Old Oaks Drive), because the Brooks' home encroaches onto the easement in varying degrees. HL &P has verified that it is necessary to abandon 2.1' of the easement. The fair market value of the easement has been determined to be $190.79 which the Brooks' have agreed to pay. Upon authorization to abandon the easement and payment by Ms. Brooks, the Legal Department will furnish a Quit Claim deed to that portion of the easement. The administration recommended approval. The vote follows: Ayes: Council members Benavides, Byford, Escontrias, DonCarlos and Pruett Mayor Alfaro Nays: None 930608 -4 Minutes of the Special Session - June 8, 1993 Ordinance No. 6661 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, PROVIDING THAT A PORTION OF A UTILITY EASEMENT BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE QUITCLAIMING OF THE CITY'S INTEREST IN SAID PROPERTY; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Consent Agenda Item "h" was removed from the Consent Agenda for separate consideration. Council then considered the Consent Agenda as follows: a. Proposed Ordinance No. 930608 -3, awards the bid for the annual ready - mix concrete contract to Excell Materials, Inc. in the amount of $61,250. Invitations to bid were mailed to three suppliers and we received two bids and one no bid. We recommend approval. b. Proposed Ordinance No. 930608 -4, awards the bid for the annual cast iron casting contract to Industrial International, Inc. in the amount of $14,246. The City of Seabrook will purchase approximately $1,747.50 of this contract. Invitations to bid were mailed to four suppliers and we received three bids. This contract is used for water valve boxes, wastewater cleanouts and drainage grates. We recommend approval. C. Proposed Ordinance No. 930608 -5 awards the bid for the annual diamond saw blade contract to Prime Equipment in the amount of $5,460. This contract is used by the Public Works Street Department for cutting concrete and asphalt streets. The City of Seabrook will purchase approximately $1,310 of this contract. Invitations to bid were mailed to five suppliers and we received one bid. We recommend approval. 930608 -5 Minutes of the Special Session - June 8, 1993 d. Proposed Ordinance No. 930608 -6 awards the bid for the annual fill sand contract to Smart Materials, Inc. in the amount of $20,025. The City of Seabrook will purchase approximately $900 of this contract. The low bidder, Bedrock Materials, Inc., has withdrawn their bid. Invitations to bid were mailed to four suppliers and we received four bids. We recommend approval. e. Proposed Ordinance No. 930608 -7 awards the bid for the annual fire protective clothing contract to Casco Industries, Inc. in the amount of $9,124.50. The lowest bidder for items 1, 2 and 5, Dooley Tackaberry, does not meet specifications. The award of the bid was based on the lowest total price per each section, per specifications. Samples of all items were examined by the user department. Invitations to bid were mailed to five suppliers and we received three bids. We recommend approval. f. Proposed Ordinance No. 930608 -8 amends the Code of Ordinances, Chapter 34, "Waste Disposal," to clarify the definition of industrial waste and to establish time periods for permit application submission and sampling facility construction by changing the wording. The words that are underlined have been added. Section 34 -11. Definitions. (10) Industrial waste means waste resulting from any process of industry, manufacturing, trade, or business from the development of any natural resource, disposal garbage or any mixture of the waste with water or normal wastewater, or distinct from normal wastewater. Section 34 -56. Wastewater discharge permit application. (a) Wastewater Survey. All applications should complete a wastewater discharge permit application approved by the director within thirty (30) days of written instruction to do so by a city official. 930608 -6 Minutes of the Special Session - June 8, 1993 Sec. 34 -58. (16) Wastewater discharge permit application shall contain: (c) Requirements for installation and maintenance of inspection and sampling facilities, where the installation of a sampling facility is required the industrial user shall have ninety (90) days to install it from the date of the issuance of their permit; We recommend approval. g. Proposed Ordinance No. 930608 -9 authorizes payment in the amount of $4,985 from the High Intensive Drug Traffic Area account to Trammell Crow Company. In an effort to provide better security of its leased warehouse facility, HIDTA wants to install 188' of eight foot chain link fence with eight six foot gates. These warehouses are used to store vehicles and other items seized by HIDTA. As this will be a property improvement project, the lease provides that the leasing company will install the fence itself per HIDTA specifications. Expenditure of HIDTA funds for this project has been approved by the HIDTA Board of Directors. Our Organized Crime Unit works closely with this organization. We recommend approval. (Proposed Ordinance No. 930608- 9) Consider Proposed Ordinance, Authorizing Change Order No. 1 For the Cured -in -Place Sanitary Sewer Rehabilitation Contract In response to an inquiry from council as to the reason for a change in the scope of work which represents about 11 % of the total contract, the city manager explained that the city has an annual contract to rehabilitate sanitary sewer lines by cured -in- place or fold and form pipe referred to as insituform. This allows work to be performed without tearing up yards or roadways. The City of Baytown is under order to decrease infiltration in the East District. In performing this insituform work along Ward Road and Kilgore Road, other sections of deterioration were located. There are two sections of sewer pipe causing severe inflow infiltration problems located on Danubina - one at the intersection with Ward, and the other at the intersection with Texas. At each location, the lines have developed holes which will allow rainwater from nearby drainage systems to flow directly into them. Both lines flow into the newly rehabilitated line along Ward Road in route to the East District Sewer Plant. There is a third line located on Bayou Avenue and Cedar Avenue near Kilgore Road which the staff suspects is leaking. The proposal here is to clean and televise that line for evaluation. A problem has developed with the repairs to the 8" line on Cedar Bayou Road where it crosses the railroad tracks. The existing line has deteriorated to the point where cave -ins are encroaching onto railroad right of way near the tracks. It is necessary to install a steel casing across the railroad right of way before repairs to the sewer line are made. The change order represents changes in scope of work using the same unit prices originally bid. City Manager's Report INTERVIEW PROCESS - COUNCIL DISTRICT VACANCY - Council was provided with suggested procedures, as well as copies of resumes on the candidates for the Council District No. 4 vacancy. YOUTH COMMISSION - Included in the council packet was a memo from Richard Harris to the existing Youth Commission members indicating that council had taken action to create the Baytown Area Youth Commission and all those interested should notify the mayor, a council member, or the city manager by submitting a letter indicating that interest. ANNUAL HURRICANE MEETING - The Annual Hurricane Meeting is scheduled for 7:00 p.m. in the Community Building this evening. Dr. Neil Frank, Meteorologist with Channel 11 and Dave Schwartz, Hydrologist, Houston Area National Weather Service, will be the main speakers. RECOUNT - A recount of the votes cast in the Run -Off Election on June 5 was performed this afternoon by a Recount Committee. The city manager thanked Ms. Hall for accomplishing the recount prior to the canvass.
