The vote follows: Ayes: Council members Benavides, Byford, Swofford, Alfaro, DonCarlos and Pruett Mayor Credille Nays: None 921123 -3 Minutes of the Regular Session - Nov. 23, 1992 Consider Proposed Ordinance, Amending the Code of Ordinances of the City of Baytown, Texas, Chapter 2, "Administration ", by Combining Divisions 4 and 6 to Form a Growth Management and Development Advisory Commission Adoption of the proposed ordinance will result in the merging of the Planning and Traffic Commissions into a nine member Growth Management and Development Advisory Commission. The commission shall be demographically and geographically representative of the city. Five members shall be appointed during odd numbered years and four members shall be appointed during even numbered years, with at least one member appointed from each city council district and one to be appointed from the city's extra - territorial jurisdiction. The city council shall appoint seven of the commission members while the city manager shall nominate, subject to city council confirmation, the remaining two members. In making the initial appointments, the city council shall designate four of their appointees to serve two year terms and three of their appointees to serve one year. The city manager shall designate which of his initial nominees are to serve for a two year term and which shall serve for a one year term. Thereafter, all appointments shall be for two years. Section 2 -51 of the ordinance provides that any commissioner who misses three consecutive regular meetings without valid reason shall be deemed no longer interested in serving and the commission shall ask the city council to appoint a new member to fill the interim vacancy. The city manager highlighted Powers and duties of the commission as follows: 1. Review and recommend to the City Council proposed changes in all land development ordinances. 2. Study plans and plats of proposed developments and approve such that meet all standards and laws. 3. Recommend to city council for its action changes in the city's motor vehicle code. 4. Recommend to city council short -range transportation facility improvement projects. 5. Advise the city council on Land Use and Land Development issues and concerns. 6. Make an annual report in January of each year as to the committees activities. 921123 -4 Minutes of the Regular Session - Nov. 23, 1992 The effective clause in the ordinance indicates the ordinance shall take effect on January 14, 1993. The proposed ordinance is a result of a recommendation by the Comprehensive Planning Commission and was reviewed by City Council in a work session. Persons who have indicated an interest in being appointed to the Growth Management and Development Advisory Commission include Wayne Smith, Barry Bobbitt, Frank Hinds, Glen Angel, Linda Cottar, and Sherril Bates. Appointments are to be made at the January 14, 1993 council meeting. The administration recommended approval of the ordinance. Council member Alfaro moved for adoption of the ordinance. Council member Benavides seconded the motion. Council member Alfaro suggested that the commission be given some guidance as to the annual report. He felt that the commission should concentrate on and include: 1. What has been some of the accomplishments; 2. What are some of the upcoming issues; 3. What are some areas of improvement (how can they improve as a commission and what are some other areas that we can be looking at); 4. State how the commission will be working with the Long Range Planning Commission. He also felt that the commission should be advised as to the meaning of the term "short range" under Powers and Duties, Item 6. The city manager responded that the term would mean two years or less. The city manager inquired whether Council member Alfaro felt the ordinance should be changed or if what should be in the annual report could be communicated from the city manager to Richard Harris, Director of Planning and Traffic. Council member Alfaro felt the matter could be handled administratively. Council emphasized that any person interested in an appointment to the commission should submit a letter of interest to the mayor, city manager or council member between now and January 14. As letters are submitted the administration will provide copies to council. 921123 -5 Minutes of the Regular Session - Nov. 23, 1992 Those presently serving on both the Planning Commission and Traffic Commission will be notified that if they are interested in serving on the Growth Management and Development Advisory Commission, a letter of interest must be submitted. The vote follows: Ayes: Council members Benavides, Byford, Swofford, Alfaro, DonCarlos and Pruett Mayor Credille Nays: None Ordinance No. 6448 AN ORDINANCE AMENDING DIVISION 4 OF CHAPTER 2 (SECTIONS 2 -48 THROUGH 2 -56) "PLANNING COMMISSION" OF THE CODE OF ORDINANCES; CREATING THE GROWTH MANAGEMENT AND DEVELOPMENT ADVISORY COMMISSION; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE THEREOF. citizenses Communications: a. Mark Hall, 1501 Kilgore Road, will discuss dispute over legal fees, court costs, penalties and interest on property tax bill. Mr. Hall stated that he had purchased the property at 1501 Kilgore in October, 1990 from N.H. Conder. At the time he purchased two tracts, one tract where his home is located and the other is a pasture. Upon closing, all taxes were paid. At that time Mr. Hall received a letter from Reid Strickland telling him to notify Harris County Appraisal District of the new ownership. This was done but HCAD only picked up the main tract with the home on it. In 1991 when Mr. Hall received his tax statement, he was listed as owner and the tax statement showed what he thought were the two tracts; but, in fact, it represented an account for the city and an account for the school district. He paid what he thought were all taxes owed in January, 1992. In May, 1992 the city filed suit on the adjacent tract. The suit was filed in the name of the previous owner. 921123 -6 Minutes of the Regular Session - Nov. 23, 1992 In August, the previous owner came by and told Mr. Hall taxes were due on the property. Mr. Hall contacted the Legal Department and notified them that he was the owner of the property. He received notification that taxes together with penalties and interest and court costs were due on the property. Mr. Hall offered to pay the taxes owed on the property but not penalties and interest, nor court costs. Mr. Hall feels that since HCAD made the mistake originally, he should not be responsible for the other charges. The city attorney explained that in order for the taxpayer to be forgiven penalty and interest on a delinquent account, the city or HCAD must have made the mistake and the taxpayer must have paid the delinquency within 21 days of notice of the delinquency. Mr. Hall was aware of the delinquency in August. Mr. Hall replied that he had never received a bill. In fact, he still has not received a tax statement, nor the opportunity to argue the value of the property. However, he did make an offer to pay the taxes owed on the property which was refused. Council member Alfaro requested that the matter be referred to the administration and that an item be placed on the next council agenda for action. Mayor Credille suggested to Mr. Hall that he get a letter from Harris County Appraisal District verifying that only one property was added to the tax roll in Mr. Hall's name when in fact both parcels should have been added. In response to an inquiry from Mr. Hall, penalties and interest will continue to accrue on the property. Consider Proposed ordinance Amending the Code of ordinances Chapter 2, "Administration,, 11 to Establish Baytown Area Community Long - Range Planning Commission The creation of the Baytown Area Community Long -Range Planning Commission is also a recommendation of the Comprehensive Planning Commission. The commission shall consist of fifteen members. The makeup of the commission shall be demographically and geographically representative of the community. Eight members shall be appointed during odd numbered years and seven members shall be appointed during even numbered years. At least one member shall be appointed from each city council district and two members shall be appointed from the city's extra - territorial jurisdiction. 921123 -7 Minutes of the Regular Session - Nov. 23, 1992 Terms of such appointments shall began on the first day of the month of January and extend for four calendar years. City Council shall appoint ten of the commission members. The Lee College Board of Regents shall appoint one member from the current members of the Board of Regents. The Goose Creek Consolidated Independent School District Board of Trustees shall appoint one member from the current members of the Board of Trustees. The city manager shall nominate, subject to city council confirmation, three commission members. Any commission member who misses three consecutive regular meetings without valid reason shall be deemed no longer interested in serving and the commission shall ask the city council to appoint, or request the appointing board to appoint, a new member to fill the interim vacancy. The city manager reviewed Section 2 -65.3, Powers and duties, of the commission and noted that the ordinance would take effect January 14, 1993. Council member Pruett moved for adoption of the ordinance. Council member Swofford seconded the motion. Council did express some concern with appointing elected official from the Lee College Board of Regents and the School District Board of Trustees since these people are already very busy. The city manager noted that if appointment of elected officials doesn't work out, the ordinance can be amended at a later date. Council member Alfaro suggested that the wording in Section 2 -65.1 - Attendance at Meetings - should be changed to read: Any commission member who misses three consecutive regular meetings shall be deemed no longer interested in serving. Both the council member that made the motion and the council member that seconded the motion agreed that the wording "without valid reason" should be eliminated from the ordinance. Therefore, council voted to adopt the proposed ordinance with the elimination of the wording "without valid reason." The vote follows: Ayes: Council members Benavides, Byford, Swofford, Alfaro, DonCarlos and Pruett Mayor Credille Nays: None 921123 -8 Minutes of the Regular Session - Nov. 23, 1992 Ordinance No. 6449 AN ORDINANCE AMENDING DIVISION 6 OF CHAPTER 2 (SECTIONS 2 -63 THROUGH 2 -65) "TRAFFIC COMMISSION" OF THE CODE OF ORDINANCES; CREATING THE BAYTOWN AREA COMMUNITY LONG -RANGE PLANNING COMMISSION; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE THEREOF. Consider Proposed Ordinance Authorising Contract with capital Assistance Group for Collection of Warrants The proposed ordinance authorizes a contract in the amount of $20,000 with Capital Assistance Group for collection of warrants. The contract period will cover November 1, 1992 through September 30, 1993. The group has guaranteed the collection of a minimum of $60,000 this first year. Under the contract the group will attempt collection of the existing 2,500 warrants, and after 30 days will attempt collection of current warrants. The Finance Committee reviewed the proposed contract and recommended approval. Council member DonCarlos moved for adoption of the ordinance. Council member Alfaro seconded the motion. Kenny Hansmier, President of Capital Assistance Group, was present to explain that his company currently represents the City of Fort Worth, along with others in the metroplex for an amount of about $58,000,000 or 294,000 defendants. The $20,000 represents a flat rate of $8.00 per warrant which fee is to be paid up front. The main advantage of using Mr. Hansmier's group is that they have national access to changes in addresses made by defendants on credit applications. Mr. Hansmier has guaranteed a return of three times the city's investment within 120 days, plus he will continue to collect warrants through September 30, 1993, along with ambulance delinquencies. 921123 -9 Minutes of the Regular Session - Nov. 23, 1992 Council member Pruett expressed concern with paying $20,000 up front. Mr. Hansmier explained that council would be paying up front for services that are to be rendered for which he will incur certain costs such as massive mail outs and checks for good addresses. The company will be receiving 2,500 warrants up front and in 30 days 500 more, plus ambulance accounts for a total of about 3,500 accounts within the first 30 days of the contract. The vote follows: Ayes: Council members Benavides, Byford, Swofford, Alfaro and DonCarlos Mayor Credille Nays: Council member Pruett Ordinance No. 6450 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST TO A CONTRACT WITH CAPITAL ASSISTANCE GROUP FOR THE COLLECTION OF OUTSTANDING CLASS C WARRANTS; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE SUM OF TWENTY THOUSAND AND N01100 DOLLARS ($20,000.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed ordinance Awarding Contract for Alamo School Sidewalk Project and Sidewalk Rehabilitation Project Information provided council in the packet indicated adoption of the proposed ordinance would authorize a contract for Alamo School Sidewalk Project and Sidewalk Rehabilitation Project to BRH- Garver, Inc. in the amount of $244,194.20. Of that amount $35,221.28 would be the cost to install storm sewers in open ditches and install new sidewalks in the vicinity of Alamo School. The remaining portion of the contract is for replacing damaged sidewalks in the following subdivisions: Craigmont Place, Allenbrook, Whispering Pines, Britton Cravens, East Baytown, Kingsbend and Leger for a total of 23,400 feet of sidewalk. The amount bid for this part of the contract is $208,972.92. The administration recommended approval of the ordinance. Council member Pruett moved for adoption of the ordinance. The vote follows: Ayes: Council members Benavides, Byford, Swofford, Alfaro, DonCarlos and Pruett Mayor Credille Nays: None 921123 -10 Minutes of the Regular Session - Nov. 23, 1992 Ordinance No. 6451 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AND ATTEST TO A CONTRACT WITH BRH- GARVER, INC. FOR THE ALAMO SCHOOL SIDEWALK PROJECT AND THE SIDEWALK REHABILITATION PROJECT; AUTHORIZING PAYMENT OF THE SUM OF TWO HUNDRED FORTY -FOUR THOUSAND ONE HUNDRED NINETY -FOUR AND 20/100 DOLLARS ($244,194.20); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. For bid tabulation, see Attachment "A." Consider Approval of Specifications for Purchase of Two (2) 11500 GPM Pumping Engines and one Engine /Ladder combination (Quint) Council had been provided with a 17 page document on the specifications for two pumping engines and one engine /ladder combination (quint) . Proposed Ordinance No. 921123 -5 awards the annual water meter contract as follows: Sec. I Master Meter $ 48,038.00 Sec. II Industrial International S 19,067.26 $ 67,105.26 The City of Seabrook has an Interlocal Agreement with the city and will purchase approximately $14,533.06 from this contract. Invitations to bid were mailed to nine suppliers and we received five bids. We recommend approval. 921123 -11 Minutes of the Regular Session - Nov. 23, 1992 b. Proposed Ordinance No. 921123 -6 awards the bid for purchase of PVC pipe to Golden Triangle Pipe in the amount of $16,936.25. This pipe will be used by our Public Works Department who will be installing new water lines in the Fairpark Addition. Invitations to bid were mailed to four suppliers and we received four bids. We recommend approval. C. Proposed Ordinance No. 921123 -7 authorizes the renewal of the annual masonry, lumber, paint and construction materials contract Sections I,II,III and IV as follows: Deer Park Lumber Co., Inc. Sec. I $ 9,494.25 Deer Park Lumber Co., Inc. Sec. II 18,737.91 Deer Park Lumber Co., Inc. Sec. III 1,795.00 The Glidden Paint Co. Sec. IV 7,680.75 $37,707.91 Random items from last year's bid were priced from two other bidders for comparison purposes and the above bidders were lowest. The original contract terms are from Dec. 1, 1991 to November 30, 1992 with the option to renew for one additional one year period. This renewal will expire November 30, 1993. Both companies submitted their written request to renew for the same compensation as in the current contract. We recommend renewal of this contract. d. Proposed Ordinance No. 921123 -8 designates East James from SH 146 to Cedar Bayou as a two lane street; mandatory right turn lanes on East James at its intersection with Danubina Street and No Parking Zone along East James from SH 146 to Danubina, and at its intersection with Danubina. This item is in response to a request from the East James Civic Association. The Traffic Commission has recommended approval of this request. We recommend approval. 921123 -12 Minutes of the Regular Session - Nov. 23, 1992 e. Proposed Ordinance No. 921123 -9 designates a two way stop on North Third Street at its intersection with East Wright Street. This item is in response to a request from residents with homes at this intersection. Since East Wright has been reconstructed, this intersection and several others along East Wright have experienced substantial increases in accident incidences. During the calendar year to date, this intersection has been the site of 4 accidents compared to none in previous years. The Traffic Commission has recommended approval of this request. We recommend approval. f. Proposed Ordinance No. 921123 -10 renews the contracts for administration of medical and dental benefits program for the City of Baytown. This ordinance will approve the renewal contract for third party administration services with Alta Health Strategies for dental benefits, claims administration, and authorize payment for monthly claims as incurred. The city council adopted an ordinance establishing an internal risk pool to cover employees and dependents for medical, pharmaceutical, hospital and dental benefits. This benefits program has been self funded since 1989. Coverages are brokered through J.E. Stone & Associates. Alta is the third party administrator for benefit claims administration. Individual and Aggregate stop loss coverage is insured by Lloyds of London and written by Coxes Insurance and paid through J.E. Stone & Associates. The estimated cost to Alta is $89,229.60 and to J.E. Stone and Associates is $128,330.28. We recommend approval. g. Proposed Ordinance No. 921123 -11 authorizes and approves the expenditure of funds for the purchase of property along Massey Tompkins Road. This will be discussed in executive session. We recommend approval. 921123 -13 Minutes of the Regular Session - Nov. 23, 1992 h. Proposed Ordinance No. 921123 -12 authorizes a contract with Lee College in the amount of $4,215 to teach the Emergency Medical Technician (EMT) Program to 30 of our firefighters. This will allow implementation of our Medical First Responder program. This program will maintain at least one EMT or Paramedic on each engine company. Upon dispatch of an ambulance to life threatening emergencies, the closest engine company will also respond, reducing response time by up to 50 %. This training will continue until all Fire and Rescue personnel are certified EMT's. Funds for this program were approved in this year's budget. We recommend approval. Council member DonCarlos commended the Bakers for their diligence and hard work to have a portion of East James designated as a two lane street, with mandatory right turn lanes on East James at its intersection with Danubina and No Parking zone along East James from State Highway 146 to Danubina. Item No. "h" had been discussed during the budget sessions. Chief Leiper has been working with Lee College to develop an EMT Program for approximately 30 firefighters. The vote follows: Ayes: Council members Benavides, Byford, Byford, Swofford, DonCarlos and Pruett Mayor Credille Nays: None City Manager's Report operation Bright Star - Included in the council packet was a memorandum of understanding, wherein the Baytown Police Department agreed to furnish four certified police officers to the Lee High School campus and two certified police officers to the Sterling High School campus each day beginning November 23, 1992 and ending December 18, 1992. These officers will devote their principal duties to the school campuses from 7:00 a.m. until 3:30 p.m. each school day. The agreement specifies that costs incurred by the Goose Creek Consolidated Independent School District shall not exceed $18,000 for the time and terms outlined. Channelview Assistance - In response to an inquiry from Commissioner Fonteno about the possibility of sending a brush truck to help with clearing of debris in the Channelview area. Two brush trucks along with city employees have been sent to help this week. Austin Trip - Council had been furnished a copy of the information that the City of La Porte plans to present to the Texas Highway Commission on November 24. The bus will be leaving for Austin from San Jacinto Mall at 4:45 a.m. Sign for New Fire Station Site - Chief Leiper would like to schedule a photo of the sign for the new fire station site at Highway 146 and Pinehurst. Therefore, council was asked to contact Chief Leiper's office to schedule a photo session. Assistant City Attorney Introduced - The city manager introduced Dean Johnson, the new Assistant City Attorney and Prosecutor. 921123 -17 Minutes of the Regular Session - Nov. 23, 1992 Mayoras Report to the citizens Mayor Credille emphasized the importance of combining of the Planning and Traffic Commissions and asked for help in getting the word out that those who are interested in applying should contact the mayor, their council member, or the administration by letter. Mayor Credille also commented on the meeting with parents at Robert E. Lee High School. There were from 150 to 200 people in attendance. Principal Hebert was present along with the Chief of Police and others from the Baytown Police Department. Mayor Credille felt that both students and parents went away from the meeting with an entirely different understanding of what was going on at the school. Many parents expressed a willingness to pay more taxes as well as work directly with the school district to make the schools a safe place. Council member Benavides commented on the mural that a group of young people have been working on in West Baytown. Mr. Fred Aguilar has headed up that project which has proven to be very successful. She invited everyone to drive by and look at the mural on Market Street. In response to an inquiry from Council member Alfaro, the city manager stated that the proposed street repair list would be presented to council either at the next meeting or the first meeting in January.
