1992 05 26 CC MinutesMINUTES OF THE REGULAR SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN May 26, 1992 The City Council of the City of Baytown, Texas, met in regular session on Tuesday, May 26, 1992, at 6:30 p.m. in the Council Chamber of the Baytown City Hall with the following in attendance: Eva Benavides Don M. City Manager City Attorney City Clerk The meeting was called to order with a quorum present, and Council member Benavides offered the invocation, after which the following business was conducted: Consider Approval of the Minutes for the Regular and Special Sessions Held on May 14, 1992 Council member Alfaro moved for approval of the minutes of the regular and special sessions held on May 14, 1992. Council member Hullum seconded the motion. The vote follows: Ayes: Council members Benavides, Hullum, Alfaro and Pruett Mayor Credille Nays: None Abstained: Council member Swofford Special Presentations Preston Pendergrass, Aide to Senator Gene Green, and Mayor Credille presented proclamations to Allison R. Peirce for his service to this community as the Director of Harris County Pollution Control Department. 920526 -2 Minutes of the Regular Session - May 26, 1992 Citizen's Communications: a. Mackey Beers, 5404 Vae Drive, will discuss McElroy Park. Mr. Beers stated that he had moved to Baytown in 1977 and had purchased his home at 5404 Vae Drive because of the neighborhood and the fact that the home was located in close proximity to McElroy Park which contained a public swimming area. Mr. Beers stated that he now has two small children along with a graduate student. He felt that while the pool remained opened, attendance was good and that the pool should be reopened for the summer. Mr. Beers presented a petition dated July 1, 1991 requesting that McElroy Pool be reopened. The petition stated that the pool and park were given to the City of Baytown by the citizens of Craigmont and the builder, with the understanding that it would be open the same hours as Roseland Park. The petition further noted that the young people in the area needed a place to swim. When opened, McElroy Park is used by more young people than any other for its size. The city manager explained that the closing of McElroy Pool was a budgetary decision. The cost to maintain the pool per year is approximately $14,000. John Priddy, resident of Craigmont, pointed to the fact that there are two apartment complexes in the area that are low income. He too felt that the pool would be utilized if opened to the public. He supported the two days per week free swimming, but by age sixteen, he felt the youngsters should work for the privilege to swim. Council member Alfaro suggested that the residents submit an updated petition in order for council to consider this matter at budget time. He emphasized that there is no money in the budget to open the pool at this time. However, Mr. Beers and Mr. Priddy stressed that they would like to have the pool opened for this summer. Council member Benavides suggested that the residents need to become involved and provide input to council. She pointed to the fact that in District 1, citizens attend parks board meetings and provide input. 920526 -3 Minutes of the Regular Session - May 26, 1992 The matter was referred to the administration with emphasis to representatives of Craigmont that they needed to get a petition together and get involved with the parks board. Consider Proposed Resolution No. 1149, Authorizing the City of Baytown to Establish an Account with TexPool for the Purpose of Transmitting Local Funds for Investment by the Trust Company TexPool and Consider Proposed Ordinance Entering Into a Contract with the Texas State Treasurer for Services Provided by TexPool Tex Pool is an investment service for public funds. In 1989, the Texas legislature expanded local government investment authority and, at the same time, authorized the pooling of public funds for more efficient and profitable funds management. TexPool offers local governments the opportunity to join with other public entities to get the highest earnings possible on public funds under the safest financial conditions. More than 800 Texas counties, cities, school districts, municipal utility districts, transit authorities and other local public entities participate in TexPool. Council members Hullum and Alfaro, along with the city manager, have looked into what TexPool offers and recommend participation. Council member Swofford moved to approve adoption of the proposed resolution and the proposed ordinance (Items 5 and 6 on the agenda). Council member Hullum seconded the motion. Council member Hullum pointed to the fact that the funds invested in TexPool are fully insured. The money can be moved on a daily basis, and over a period of time, probably the interest rate will double on money available for investment. Council member Alfaro pointed out that the city would benefit by investment in TexPool through safety of the funds, liquidity of the funds, and yield on the funds. Funds are insured by the State of Texas. The funds may be moved on a daily basis and currently the yield is 4.3 - 4.35 %. Since the existing investment policy must be modified to include investment in TexPool, no monies will be transferred until after June 11 council meeting. The administration checked with the Depository Bank, and the bank is in complete concurrence with this plan. 920526 -4 Minutes of the Regular Session - May 26, 1992 Council member Pruett suggested that the motion should be amended to include that no deposits may be made until June 12. Council member Swofford amended the motion to include that no deposits may be made until June 12. Council member Hullum seconded the amended motion. The vote follows: Ayes: Council members Benavides, Hullum, Swofford, Alfaro Mayor Credille Nays: None Abstained: Council member Pruett Resolution No. 1149 A RESOLUTION AUTHORIZING THE CITY OF BAYTOWN TO ESTABLISH AN ACCOUNT WITH TEXPOOL FOR THE PURPOSE OF TRANSMITTING LOCAL FUNDS FOR INVESTMENT BY THE TRUST COMPANY TEXPOOL; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Ordinance No. 6252 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST TO A PARTICIPATION AGREEMENT WITH THE TEXAS STATE TREASURER; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance Authorizing Refund of Taxes for 1984 Through 1989 to Williams Brothers Construction Company Adoption of the proposed ordinance will authorize a refund of taxes for 1989 in the amount of $3,861.45 to Williams Brothers Construction Company. The City of Baytown tax collector has received an application for a tax refund from Williams Brothers Construction Company for tax years 1984 -1989. Taxes paid during that period amount to $15,897.04. The Harris County Appraisal District made an error while matching the accounts of the three taxing jurisdictions and put Williams Brothers name on property that belonged to someone else. 920526 -5 Minutes of the Regular Session - May 26, 1992 Williams Brothers is requesting a refund under Section 31.11 of the Tax Code which applies in cases where the tax is correctly assessed but the taxpayer erred in paying it. Under Section 31.11(a), the City Council must make the determination as to whether an erroneous payment has been made. However, Section 31.11(b) specifies that the right of refund is waived unless application is made within three years of the date of payment. According to copies of the payment checks, only the check dated October 11, 1989 is within the three year limitation period. Therefore, only the last year taxes totaling $3,861.45 can legally be refunded. The city manager emphasized that the city will not collect twice on the account. Payment has been made by Williams Brothers who would have the option of filing action against the true owner of the property. The City of Baytown will bill the true owner for payment of the 1989 taxes. Council member Pruett moved for adoption of the ordinance. Council member Swofford seconded the motion. ON ACCOUNT NUMBER 1272 - 000 -007 -0 FOR THE TAX YEAR 1989 WAS ERRONEOUS; APPROVING A REFUND OF THE OVERPAYMENT OF THREE THOUSAND EIGHT HUNDRED SIXTY -ONE AND 45/100 ($3,861.45) DOLLARS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Discuss Council District Reports Council member Hullum stated that he had attended the retirement party for Chief Henscey where the city manager, the new police chief, and Council member Pruett had made comments. He felt this was an indication of both administration and council involvement. 920526 -6 Minutes of the Regular Session - May 26, 1992 Council member Hullum pointed to the fact that the City of Baytown is under a permanent six single member district Council Plan, with the mayor at- large. As a representative of a single member council district, he is accountable to the people in his district. He must be aware of their needs and the district's problems. However, there is a larger picture and responsibility and that is to the entire City of Baytown. Each council member must be aware of the other council members problems and must work with the other members of council to get things accomplished. In attempting to address these concerns, he stated that he had spoken with former Mayor, Seaborn Cravey, who advised him to take more time to communicate with one another. The City Attorney of Galveston, Gary Smith, former Assistant City Attorney for Baytown, advised him that the council would need to work more closely together and with the administration. Bob Herrera, City Manager of La Porte, advised that council needed to work more closely together and hold meetings to stay better informed. There must be better communication among members. Council member Hullum stated that he would like to see the City Council of the City of Baytown hold more work sessions or at least once a month talk about individual problems. Council member Benavides concurred that council should know the problems facing each district in order for council to work more effectively together. The city manager stated that he planned to have an orientation for council after the run -off election. This orientation could last for several days, since department heads would be asked to address council concerning their specific areas. He requested that council be prepared to schedule the orientation at the next meeting. Council member Pruett stated that District 2 has a lot of problems that may not be as prevalent in other areas of the city. He felt that that area has more abandoned vehicles than any other area of town. He stated he would like to see council receive copies of surveys made in each district. He felt council might be interested in seeing the districts utilized by the Police Department in patrolling. Also, he felt that moving trash collection to a six week schedule was a mistake. In District 2 the homes are older and more trash seems to accumulate. Council member Alfaro concurred that communication is very important and needed. He agreed that the orientation would be very helpful to council; however, he reminded council that council's primary responsibility is policy making and to develop long range goals which the administration would be responsible to carry through. He too felt that it was a good idea to learn about one another and what was going on in each district. 920526 -7 Minutes of the Regular Session - May 26, 1992 Council member Benavides made the point that council acts as a liaison between the community and the city manager. Citizens call council about their problems and council in turn calls the city manager. She also liked the idea of getting schedules and information on a monthly basis. Council member Pruett pointed out that to receive a report indicating 113 abandoned cars have been removed doesn't reflect the number of abandoned cars in the city. The city manager mentioned that the West Baytown Civic Association had discussed forming an F- Troop, whose role is identifying abandoned vehicles, buildings in a state of disrepair, yards with trash, etc. He felt that the formation of such troops could be beneficial in other areas of the city to help the administration pinpoint problem areas. Consent Agenda: The Consent Agenda follows: a. Proposed Ordinance No. 920526 -4 awards the annual semi - automatic pistol program contract (five pistols) to Gulf States Distributors, Inc. in the amount of $2,147.50. Last year the Police Department began supplying pistols for all of the officers. These are for the five new officers approved in this year's budget. Invitations to bid were mailed to five suppliers and we received one bid and one no -bid. We recommend approval. 920526 -8 Minutes of the Regular Session - May 26, 1992 C. Proposed Ordinance No. 920526 -5 awards the bid for anti - freeze recycler to Ogburn's Brake of Houston in the amount of $3,596.43. The bid of Pragmatronics, Inc. did not meet specifications because their tank capacity was only eleven gallons rather than 20 gallons. Invitations to bid were mailed to four bidders and we received three bids. The specifications required the bidder to bid his cost of filters and additives so that the best low bid could be determined. Even though Ogburn's initial cost is higher than B.C. & T. Filtrations, the cost after one year of operation considering the additives and filters used is the lowest. We recommend approval. d. Proposed Ordinance No. 920526 -6 authorizes payment to Houston Lighting & Power Company in the amount of $5,763 for three phase electrical service to the lift station at the UPS site on the IH -10 Feeder Road. Single phase service is available, but we experience high maintenance costs with single phase. Both the annual operating cost of electricity and motor maintenance are reduced by using three phase service rather than single phase. Also, for future expansion, three phase service will be necessary. We recommend approval. e. Proposed Ordinance No. 920526 -7 authorizes payment to Harris County Treasurer, on sole source basis, for rental of election equipment. Harris County Election Services Department has billed the city for the following election equipment for the May 2, 1992 Election: 58 Votomatics $1,450.00 36 Ballot Boxes 144.00 36 Transfer Cases 108.00 3 Precinct Counters 570.00 16 Stops 448.80 Total $2,720.80 920526 -9 Minutes of the Regular Session - May 26, 1992 The Municipal Election required the rental of the above referenced equipment. The county is the sole provider of election equipment to the various entities in Harris County. We recommend approval. f. Proposed Ordinance No. 920526 -8 authorizes a refund of taxes to Daniel M. and Nancy Mundinger. HCAD granted a late filing for an over 65 exemption for a homestead thus creating a refund of taxes paid in the amount of $537.18. We recommend approval. g. Proposed Ordinance No. 920526 -9 authorizes a refund of taxes to Bix Testing Laboratories in the amount of $3,337.37. Harris County Central Appraisal District deleted the account for the tax years 1989 and 1990 under a substantial error protest hearing. The taxpayer was required to make a payment in order to be allowed this hearing. We recommend approval. h. Proposed Ordinance No. 920526 -10 authorizes final payment to Lewis F. McLain, Jr. for consulting services. Work included the selection of an accounting firm (Deloitte & Touche), reporting to the city manager and city council, recruitment and interviewing of a finance director candidate. Final payment totals $4,684.50 which is $684.50 over the contract amount. Attached is a letter and statement of the work performed. We recommend approval. Consider Appointment to Auto Wrecker Committee This appointment will be made at a future meeting. 920526 -12 Minutes of the Regular Session - May 26, 1992 Consider Confirming City Manager's Appointment of Finance Director The city manager requested confirmation of the appointment of Monte Mercer as finance director effective June 1, 1992 at a salary of $53,800 and a car allowance of $300.00 per month. Mr. Mercer has served as finance director for the City of Burleson since 1990. Prior to that he was comptroller for the City of Denton and the Chief Accountant and Internal Auditor in the Finance Department of the City of Arlington. He is a Certified Public Accountant and a graduate of Texas Wesleyan College. He is married and has two elementary school age children. Council member Pruett moved to confirm the city manager's appointment. Council member Swofford seconded the motion. The vote follows: Ayes: Council members Benavides, Hullum, Swofford, Alfaro and Pruett Mayor Credille Nays: None City Manager's Report Bayland Park Marina and Hotel Development - The Bayland Park Marina and Hotel Development Advisory Committee has recommended that the agreement granting Miller Brown Development Corporation the right to negotiate a contract for the development of a hotel /marina be extended for sixty days. The committee felt that with the additional time their work could be completed and a recommendation could be presented to council. Council had no objections to allowing sixty more days. Single Member District Lawsuit - Included in the council packet was a copy of the amended judgement executed by Judge Singleton in the Single Member District Lawsuit. Texas Department of Highways and Public Transportation - The city manager made reference to an article in the Houston Chronicle on Monday, May 25, 1992, addressing a mandate from the legislature for the department to re- evaluate its list of priority projects and a federal transportation bill passed last year which added new regulations on highway construction. 920526 -13 Minutes of the Regular Session - May 26, 1992 The changes brought on by the federal bill restrict the amount that can be spent for doing added capacity work. Spur 330 and Loop 201 funding fall in that category. Added capacity work means that there is a roadway there which is being expanded to carry additional load. There is a meeting Friday morning with the Chamber of Commerce Transportation Committee to work out a strategy when meeting with Milton Dietert and John Holzwarth. There is a meeting scheduled in June and also in July. The problem is that at this point they don't know what the criteria will be for the new roadways. Fritz Lanham and Rick Peebles are co- chairs of the Chamber of Commerce Transportation Committee and they plan to stay on top of the situation. If localities don't respond to requests by the department for relocation of utilities and purchases of rights of way, they will move on to another area. The city manager said that one of the things those working on behalf of the City of Baytown will emphasize with Highway Department representatives is the opening of Fred Hartman Bridge and the fact that it will dump a lot of traffic onto Loop 201, making the need for the overpasses even greater. Hurricane Preparedness Meeting - The Annual Hurricane Preparedness Meeting is scheduled for 7:30 p.m. on June 9 at 7:30 p.m. at the Community Building. Dr. Neil Frank and Mr. Bill Reed, Meteorologist -In- Charge of the Houston Area National Weather Service will be speakers for that meeting. Government Today Newsletter - An article on the council /manager form of government taken from the Government Today Newsletter was included in the packet. Over 230 cities in the State of Texas are council /manager forms of government. Baytown Area Gang /Youth Task Force - The Gang Task Force has requested that the City of Baytown open the city pools two days a week for free swimming. The Parks Board and staff are recommending Tuesdays and Thursdays at Roseland, Tuesdays at N.C. Foote, and Thursdays at N.C. Foote and the Sports Complex. This would impact revenues by approximately $2,900 - $3,000 for the summer. There is no limit on age because it is too difficult to determine age. Council had no objections. The city manager mentioned that the City of Houston has experienced some problems with free pools because of disciplinary problems, but the staff is willing to try this program as a deterrent to gang activity. Another activity of the Task Force was the painting of graffiti in the West Baytown area. Paint and brushes were donated and there were many volunteers from the West Baytown Civic Association, as well as others. 920526 -14 Minutes of the Regular Session - May 26, 1992 Another area of participation was the Ashbel Smith area. The cleanup was very successful. Channel 13 was commended for their coverage of the cleanup efforts. Mayor Pro Tempore - An item will be included on the next agenda for election of the mayor pro tempore. A.W. Henscey Retirement - Last Saturday a banquet was held in honor of retiring Police Chief A.W. Henscey. There were people present from throughout the state which was a tribute to the chief. Today, about 100 youngsters from Travis Elementary visited City Hall. Council member Alfaro spoke to the group and Chief Henscey had the new chief present to reaffirm his oath of office. Mayor's Report to the Citizens Mayor Pro Tempore criteria was established he would like to discuss Mayor Pro Tempore. The would provide council wi- days. - The Mayor mentioned that in 1989 a for selection of Mayor Pro Tempore, and that criteria prior to the election of a city manager indicated that the staff th that information within the next few Jane Howard, Baytown Sun Reporter - Jane Howard will be covering other areas and a new reporter will be assigned to City Council.
