The City Council of the City of Baytown, Texas, met in
special session on Thursday, January 9, 1992, at 6:10 p.m. in the
Conference Room of the Baytown City Hall with the following

The meeting was called to order with a quorum present, after
which the following business was conducted:
Recess Into Executive Session to Discuss Land Acquisition
Mayor Hutto recessed the open meeting into executive session
to discuss land acquisition. When the open meeting reconvened,
Mayor Hutto announced that no action was necessary as a result of
the executive session.

Consider Approval of the Minutes for Special Session Held on
December 12, 1991
Councilman Swofford moved for approval of the minutes of the
special session held on December 12, 1991. Councilman Alfaro
seconded the motion. The vote follows:

Consider Plans and Specifications for Construction of Sanitary
Sewer Line in Abbe Subdivision, Sanitary Sewer System at Highway
146 and Massey Tompkins Roads, and Water and Sanitary Sewer Line
Along Tompkins Road from Kings Bend Subdivision to Highway 146,
and Authorize Advertisement for Bids
Kent Laza, City Engineer, provided council with a set of the
plans and specifications for the project. He pointed out that
the majority of the work will be performed in Abbe Addition to
install sanitary sewer system. Included in the plans is a
sanitary sewer system at Highway 146 and Massey Tompkins Road
which provided for installation of 750' of gravity sanitary
sewer, 700' of force main, and a lift station to provide service
along the east side of Highway 146 at its intersection with
Massey Tompkins. Also included in this project is a waterline
along Tompkins Road. Funds for this project are included in the
1991 bond program. The estimated total cost of the project is
$166,000. The administration requested approval of the plans and
specifications and authorization to advertise for bids.
Councilman Swofford moved to approve the plans and
specifications and authorize advertisement for bids. Councilman
Alfaro seconded the motion. The vote follows:

Norman Dykes, Assistant City Manager, mentioned that the
administration would need to acquire a site for the lift station
and would be coming to council at a later date with that item.

Consent Agenda
Council considered the Consent Agenda Items "a" through "h"
as follows:
a. Proposed Ordinance No. 920109 -4 awards the bid for the
annual masonry, lumber, paint and construction material
contract as follows:

Invitations to bid were mailed to six suppliers and we
received three bids.
We recommend approval.
b. Proposed Ordinance No.920109 -5 awards the bid for two
patrol cars for the Police Department to Knapp
Chevrolet in the amount of $24,046. Invitations to bid
were mailed to seven suppliers and we received four
bids.
We recommend approval.
C. We are not ready for this item as no bids were
received.
d. Proposed Ordinance No. 920109 -7 awards the bid for a
computerized calling system to Telecorp Systems, Inc.
in the amount of $3,124. This system is for our
Community Services Bureau (formerly Crime Prevention).
Invitations to bid were mailed to one supplier and we
received one bid. One of the uses for this system is
for calls to the Neighborhood Watch groups in Baytown
for notification of meetings and criminal activities in
or pertaining to the neighborhoods. This is being
funded by the Neighborhood Watch groups with the help
of the Baytown Community Services Bureau.
We recommend approval.

e. Proposed Ordinance No. 920109 -8 authorizes a lease
agreement with Fred C. Dittman, Jr. in the amount of
$500.00. Mr. Dittman is requesting a one year
extension to his lease. The new lease will expire on
December 31, 1992. He has agreed to not park any
motorhomes or boats on Wye Drive for any length of time
and especially during court hours. The land is used
for the operation of a bail bond business by Don Baker
and he will comply with the no parking condition of the
lease. A copy of Mr. Dittman's letter of request is
enclosed in the packet. Mr. Dittman has stated this
will be the last extension of the contract that he will
request.
We recommend approval.
f. Proposed Ordinance No. 920109 -9 approves a lease
agreement with American Telephone & Telegraph Company
and authorizes monthly payments in the amount of
$722.13 for 36 months totaling $25,996.68.
We recommend approval.

h. Proposed Resolution No. 1138, authorizes the City
Manager to sign and submit an application to the
Economic Development Administration for a Public Works
Grant. Resolution No. 1132 authorized the city manager
to submit an application to the Economic Development
administration for a Public Works grant. This
resolution will commit the City to provide $4.6 million
in Revenue Bond funds to this project. The total
amount requested is $5,916,000. This new resolution is
due to increased total project costs of the proposed
EDA Public Works Grant.

Consider Confirmation of City Manager's Appointments to Civil
Service Commission
The city manager requested confirmation of the reappointment
of Ken McNulty to a three year term and the appointment of Ron
Embry to fill the unexpired term of Spencer Daniels.
Councilman Credille moved to confirm the appointments of the
city manager to the Civil Service Commission. Councilman
Swofford seconded the motion. The vote follows:

Consider Appointments to Electrical Board
Councilman Swofford moved to reappoint Bill Harrison to the
position of electrical contractor, and Robert Cooling to the
position of journeyman electrician, and to appoint Jim Laughridge
to the position of graduate electrical engineer. Councilman
Johnson seconded the motion. The vote follows:

Consider Appointments to Community Development Advisory Committee
Councilman Pruett moved to appoint Bob West to the Community

City Manager's Report
Seized Funds - Recently, the Police Department was awarded
$180,000 in seized funds. The administration is recommending
that these monies be expended toward the purchase of ten police
cars; to purchase additional computer equipment, including
additional lap tops and to outfit the Mobile Command Post to be
self- sufficient. The Mobile Command Post would be utilized
during hazardous materials spills; pipeline explosions, or as the
Emergency Management Center in the event the area around City
Hall is flooded. Council had no objections.
H.E.B. (Park Exchange) - The administration has received a
letter from H.E.B. forfeiting their interest in the relocation of
the existing McElroy Park at Baker Road and Decker Drive.
Highway 146 Light Synchronization - Crews have been
experiencing cable problems with the Highway 146 Synchronization
Project. The project should be completed a week from tomorrow.
Massey Tompkins Road - The administration will soon begin
the process of acquiring right of way along Massey Tompkins Road
for expansion of that roadway. The city manager asked that the
Baytown Sun make people aware that the city would like to hear
from any interested homeowners. Interested homeowners should
contact Norman Dykes, Assistant City Manager.
Tire Problem - The administration has been checking on
regulations regarding the storage of old tires around town. As
long as the tires are spaced properly in a building, there is no
prohibition. However, the administration will be looking at an
ordinance to prohibit the stacking or storage of these tires
outdoors because of the mosquito breeding problem.
Herb Thomas - Emergency Appendectomy - Herb Thomas, Public
Works Director, had an emergency appendectomy over the Christmas
holidays. He is recuperating at home.
Mulch - Public Works has picked up about 6,000 Christmas
trees which will be chipped into mulch. That mulch will be
available free to the public at Jenkins - Holloway Park the last
week in January.
DARE Program - Various schools are holding DARE Program
ceremonies. Council was provided with a schedule.

Municipal Court Judge - The term for the Municipal Court
Judge expires January 26. The judge is appointed for a two -year
term. Anyone interested should apply through the Mayor's office
at City Hall.
Next Regular Council Meeting - Council rescheduled the next
regular council meeting to January 21 at 6:00 p.m. There will be
a work session prior to the council meeting concerning the
problem with gangs.
Fire Chief - Interviews for the position of Fire Chief have
begun, and the city manager expects to have a recommendation for
appointment by the end of the month.
Questions /Comments From Council - Councilman Johnson
mentioned water problems on Center and South Streets. The
culverts in that area are small and leaves have plugged the
culverts, restricting the flow. A homeowner has experienced
water in his home. Another problem in that area is that the
streets are in a state of disrepair.
The city manager concurred that because of the recent rains
many street repairs are necessary. He stated that the
administration will look at the problem.
Voting Plan Submission - In response to Councilman Alfaro,
the city manager stated that the sixty days for response from the
Justice Department on the city's submission is January 20.
