1991 11 07 CC Minutes, SpecialMINUTES OF THE SPECIAL SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN November 7, 1991 The City Council of the City of Baytown, Texas, met in special session on Thursday, November 7, 1991, at 8:00 a.m. in the Council Chamber of the Baytown City Hall with the following attendance: Mario Delgado Councilman * Ray Swofford Councilman Bobby J. Credille Councilman Rolland J. Pruett Councilman Emmett O. Hutto Bobby Rountree Norman Dykes Eileen P. Hall Absent: Jimmy Johnson Pete C. Alfaro Mayor City Manager Assistant City Manager City Clerk Councilman Councilman The meeting was called to order with a quorum present, after which the following business was conducted: Consider Proposed Resolution No. 1130 Canvassing Results of Special Election Held on November 5, 1991 Council held the official canvass of the results of the Special Election held on November 5, 1991 which reflected 2,654 votes cast for sale or exchange of McElroy Park; 1,957 votes cast against the sale or exchange of McElroy Park. Total ballots cast equaled 4,674. At the conclusion of the official canvass, Councilman Credille moved for adoption of Resolution No. 1130. Councilman Pruett seconded the motion. The vote follows: Ayes: Council members Delgado, Credille and Pruett Mayor Hutto Nays: None 911107 -2 Minutes of the Special Session - Nov. 7, 1991 RESOLUTION NO. 1130 A RESOLUTION CANVASSING THE RETURNS OF THE SPECIAL ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 5TH OF NOVEMBER, 1991, FOR THE PURPOSE OF AUTHORIZING THE SALE OR EXCHANGE OF THE McELROY PARK LOCATION ON DECKER DRIVE AND BAKER ROAD FOR A NEW PARK OF GREATER OR EQUAL VALUE; DECLARING THE RESULTS OF SAID SPECIAL ELECTION; FINDING THAT NOTICE OF SAID SPECIAL ELECTION WAS DULY AND PROPERLY GIVEN AND THAT SAID SPECIAL ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS. City Manager's Report H.E.B. Park Exchange Proposals - H.E.B., after reviewing the results of the election, will need to decide if it wishes to proceed. Two proposals have been discussed. One entails the sale of McElroy Park for an exchange park in the nearby vicinity. The other proposal includes development of a park at Pumphrey School. * Ray Swofford Present Council felt that if H.E.B. is interested in proceeding, the firm should proceed with the original proposal. The original proposal would eliminate two unsightly buildings in the area and the park would truly be a neighborhood park. If Pumphrey School were developed, there are concerns about access during school hours and the fact that the park would be a school, rather than a neighborhood park. City Employee Ill - Brent Barnes, Community Development Coordinator, has a rare form of cancer and will be undergoing several treatments of chemotherapy. Busch Terrace - City crews have been actively involved in the Busch Terrace area. There is one area reported by residents for its emission of foul odors. Upon checking, the Public Works Department discovered a heavy concentration of fecal coliform at that point in the drainage system. The area was cleaned but a few days later began to emit the same foul odor. It appears that someone may be dumping at that particular site. The administration plans to report on the activities in Busch Terrace at the next council meeting. 911107 -3 Minutes of the Special Session - Nov. 7, 1991 Blue T Corporation - A meeting is scheduled with representatives of Nebraska, Blue T Golf Corporation at 1:30 p.m. tomorrow. Massey Tompkins Road Acquisition - At the next council meeting the administration will update council on the Massey Tompkins Road right of way acquisition. There are 149 known owners along Massey Tompkins Road. Norman Dykes, Assistant City Manager, has developed letters to mail to owners making an offer for purchase of right of way along with a schedule. Justice Department - The City Attorney and his staff are working on the Justice Department submission on redistricting Baytown. Marina /Hotel - On October 25, proposals were received for a Marina /Hotel development. Presently, the committee is checking references and an item will be on the next agenda in this regard. Highway 146 Water Connections - Pinehurst Subdivision was converted to the City of Baytown water system last Friday and the remainder of the conversion will take place today. Sale of Treated Water - The administration will be meeting with representatives of Exxon today concerning the sale of about 600,000 to 1,000,000 gallons per day of treated water. Harris County Tax Abatement - Mayor Hutto has received a letter from Judge Jon Lindsay. There is no intent to change the county's tax abatement policy.
