1990 10 23 CC Minutes, SpecialW MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN October 23, 1990 The City Council of the City of Baytown, Texas, met in special session on Tuesday, October 23, 1990, at 6:00 p.m. in the Conference Room of the Baytown City Hall with the following attendance: Mario Delgado Jimmy Johnson Ray Swofford Pete C. Mayor Hutto announced that the open meeting would recess into executive session to discuss land and property acquisition. When the open meeting reconvened, Mayor Hutto announced that no action was necessary as a result of the executive session. Consider Minutes for the Regular Session Held on October 11, 1990 Councilman Swofford moved for approval of the minutes for the regular session held on October 11, 1990. The vote follows: Ayes: Council members Delgado, Johnson, Swofford, Alfaro, Credille and Pruett Mayor Hutto Nays: None Citizen's Communications: none im 901023 -2 Minutes of the Regular Meeting - Oct. 23, 1990 Consider Proposed Ordinance, Amending Chapter 17, Section 17 -15, "Fencing of Certain Man -made Pits, Holes, or Other Man -made Excavations The proposed ordinance will amend Chapter 17 of the Code of Ordinances to coincide with the requirements of Chapter 28 -1, "fencing of swimming pools ". Chapter 28 requires fences to have no openings wider than four inches. Presently, Chapter 17 allows for a six inch opening. The administration recommended approval of the ordinance. Councilman Pruett moved for adoption of the ordinance. Councilman Johnson seconded the motion. Councilman Johnson mentioned a problem at the old Gibson building site. The sump at that location is full of water and old tires. Howard Brister, Director of Health, stated that the staff has been working on this problem, and a letter was recently forwarded to the owner of the property giving the owner the option to fill the sump or have charges filed. The city has the option of having such areas filled and file a lien against the property. The vote follows: Ayes: Council members Delgado, Johnson, Swofford, Alfaro, Credille and Pruett Mayor Hutto Nays: None Ordinance No. 5676 AN ORDINANCE AMENDING CHAPTER 17, "MISCELLANEOUS PROVISIONS AND OFFENSES," OF THE CODE OF ORDINANCES TO AMEND CERTAIN FENCING REQUIREMENTS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF FIVE HUNDRED AND N01100 ($500.00) DOLLARS FOR THE VIOLATION THEREOF; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. IN 901023 -3 Minutes of the Regular Meeting - Oct. 23, 1990 Consider Proposed Ordinance, Authorizing Contract with the Baytown Area /West Chambers County Economic Development Foundation Adoption of the proposed ordinance will authorize an agreement with Baytown Area /West Chambers County Economic Development Foundation for the amount of $25,000. The foundation was formed for the purpose of promoting and encouraging the formation of new businesses, the expansion of existing businesses, the relocation of existing businesses, and the general diversification of the economy in Baytown and West Chambers County. Funds were included in the 1990 -91 budget for this purpose. The administration recommended approval of the ordinance. Councilman Credille moved for adoption of the ordinance. Councilman Alfaro seconded the motion. The vote follows: Ayes: Council members Delgado, Johnson, Swofford, Alfaro, Credille and Pruett Mayor Hutto Nays: None Ordinance No. 5677 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO A CONTRACT WITH THE BAYTOWN AREA /WEST CHAMBERS COUNTY ECONOMIC DEVELOPMENT FOUNDATION; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Resolution, Supporting the Week of October 21 -28, 1990, as Red Ribbon Week The proposed resolution supports the week of October 21 -28, 1990, as Red Ribbon Week. The City of Baytown and the Crime Prevention Center are joining the Texans' War on Drugs to promote a drug free and alcohol free community. The administration recommended adoption of the resolution. Councilman Alfaro moved for adoption of the resolution. Councilman Swofford seconded the motion. Consider Proposed Resolution, Supporting the City of La Porte In Its Efforts to Have the Texas Water Commission Reconsider and Withdraw its Action Approving the Application of Houston Chemical Services, Inc. The proposed resolution supports the City of La Porte in its effort to have the Texas Water Commission reconsider and withdraw its action approving the application of Houston Chemical Services, Inc. Councilman Swofford moved for adoption of the resolution. Councilman Johnson seconded the motion. Councilman Alfaro noted that a similar resolution had been adopted by the Houston - Galveston Area Council. The vote follows: Ayes: Council members Delgado, Johnson, Swofford, Alfaro, Credille and Pruett Mayor Hutto Nays: None Resolution No. 1103 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, SUPPORTING THE CITY OF LA PORTE IN ITS EFFORT TO HAVE THE TEXAS WATER COMMISSION RECONSIDER AND WITHDRAW ITS ACTION APPROVING THE APPLICATION OF HOUSTON CHEMICAL SERVICES, INC. Consent Agenda a. Proposed Ordinance No. 901023 -3 awards the contract for fencing of the softball f ields at the Wayne Gray Sports Complex to Brooks Fence Co. in the amount of $50,987.20. Item 7 of the "additional funds" has been deleted. Therefore, this item was not considered in evaluating the bids. ia 901023 -5 Minutes of the Regular Meeting - Oct. 23, 1990 Five bids were received. Funds are available from the 1981 Parks and Recreation Bond Fund. The Engineering Department will provide the inspection services for this project. A copy of the bid tabulation is enclosed. We recommend approval. b. Proposed Ordinance No. 901023 -4 awards the contract for the 1990 Sanitary Sewer Sliplining Project to Jalco, Inc. for the amount of $53,290. Three bids were received. A bid tabulation is enclosed. Funds are available from the 1989 sale of certificates of obligation. The Engineer Department will provide the inspection services for this project. We recommend approval. C. Proposed Ordinance No. 90123 -5 awards the annual fuel conditioner contract to Apache Oil Company. The bid tabulation reflects the estimated amount of fuel to be purchased and treated in a one year period. The vendor's price per gallon of treated fuel is determined by calculating their dilution ratio and price per gallon of fuel conditioner product. This is an interlocal agreement with the City of Seabrook. Their estimated purchase is $1,975.05. Our estimated purchase is $4,668.30. Invitations to bid were mailed to 7 vendors and we received two bids and two no -bids. We recommend approval. d. Proposed Ordinance No. 901023 -6 awards the bid for PVC pipe for waterlines to the following: Item 1 - Golden Triangle - $2,250.00 Item 2 - Aqua Utility - 5,036.00 Total $7,286.00 la 901023 -6 Minutes of the Regular Meeting - Oct. 23, 1990 Invitations to bid were mailed to five vendors and we received 4 bids. We recommend approval. e. Proposed Ordinance No. 901023 -7 accepts the proposal for copiers. Proposals were mailed to 10 vendors and we received 5 bids and 2 no -bids. The process of sealed competitive proposals does not allow for pricing offered to be revealed to the public until after the contract is awarded. A tabulation sheet was given to council at the meeting. The copiers will be used by the Planning and Traffic and Community Development Department and the Health Department. We recommend approval. f. Proposed Ordinance No. 901023 -8 awards the bid to lease vehicles for the Harris County Organized Crime and Narcotics Task Force. Proposals were mailed to 10 vendors and we received 2 bids and 3 no -bids. The process of sealed competitive proposals does not allow for pricing offered to be revealed to the public until after the contract is awarded. A tabulation sheet was given to council at the meeting. We recommend approval. g. Proposed Ordinance No. 901023 -9, amends Section 1.5a of the Code of Ordinances to increase the maximum penalty for a violation of the Code of Ordinances from $200 to $500. State law was amended to allow cities to raise the maximum penalty to $500. This would authorize the Judge to levy a fine up to the new maximum amount. The amount of the fine would be at the judge's discretion. We recommend approval. W 901023 -7 Minutes of the Regular Meeting - Oct. 23, 1990 Council considered the Consent Agenda as follows: Since items "e" and "f" were proposals, council was provided with a copy of the bid tabulation and the ordinance for each. The low bidder on the proposal for copiers is Minolta Business Systems for the amount of $26,933.76. The low bidder for the lease of vehicles to Harris County Organized Crime and Narcotics Task Force is I.L.S. Auto Leasing for the amount of $23,350. The vote follows: Ayes: Council members Delgado, Johnson, Swofford, Alfaro, Credille and Pruett Mayor Hutto Nays: None City Manager's Report Gander Booster Club - The Gander Booster Club has requested permission to paint a logo of the school mascot on the incoming lanes of Market Street to Lee High School, beginning at the church west of the administration building, and ending west of the bridge. There will be a maroon and white gander two feet by three feet painted every 100 feet. Councilman had no objections. Capital Improvements Committee - Lisa Urban, Co -Chair of the 1991 Capital Improvements Committee has requested that the Kick - Off Breakfast be rescheduled to November 8. Council had no objections. Texas Municipal League - Corpus Christi - The city manager reminded council and the audience that the Texas Municipal League Conference is scheduled in Corpus Christi October 24 -27. Questions /Comments From Council - In response to an inquiry from council concerning the recent activation of the siren system, the city manager responded that the accidental activation of the system was a software problem.
