July 26, 1990
The City Council of the City of Baytown, Texas, met in
regular session on Thursday, July 26, 1990, at 6:30 p.m. in the
Council Chamber of the Baytown City Hall with the following
attendance:

The meeting was called to order with a quorum present.
Councilman Swofford offered the invocation, after which the
following business was transacted:
Consider Minutes for the Regular Session Held on July 12, 1990
Councilman Alfaro moved for approval of the minutes for the
regular session held on July 12, 1990. Councilman Pruett
seconded the motion. The vote follows:

Several hundred people attended those meetings, but at that time,
the time was not right for a bond proposal. Now it seems the
people of Baytown are anxious to move ahead.
Therefore, Mayor Hutto suggested that the city manager and
his staff develop a needs study for the next five years. That
study should reflect infrastructure and capital needs, as well as
R /UDAT recommendations. Baytown has had no bond program since
1981; however, at a recent meeting with rating firms on a
certificate of obligation sale, the mayor was informed that at a
time when the trend has been to lower ratings, the City of
Baytown has one of the highest bond ratings in the state.
Councilman Credille restated the motion to include adoption
of the resolution, but with the understanding that the
administration is authorized to draw necessary data together to
hold a bond program in 1991; Councilman Alfaro seconded the
motion. The vote follows:

Resolution No. 1091
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
ADOPTING RECOMMENDATIONS OF THE REGIONAL AND URBAN DESIGN
ASSISTANCE TEAM STEERING COMMITTEE; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
Barbara Hinds, Chairperson of the Goose Creek Stream Committee,
Has Requested to Address Council
Barbara Hinds, Chairperson of the Goose Creek Stream
Development Committee, a committee appointed by Bobby Rountree,
City Manager, introduced several members of that seven member
committee, along with Jo Roosa, Staff Coordinator. Ms. Hinds
pointed out that the committee is in its very early stages of
planning. One of the first tasks is to identify the property
owners up and down the stream and to contact these property
owners. The paperwork has been completed to acquire a tax exempt
status for the committee, with the hope in the future of
establishing a Goose Creek Stream Development Foundation.

Hopefully, there may be property owners along the stream who
will donate land to beautify the creek. With the property, the
committee could go to the Texas Parks and Wildlife Department to
apply for grants to help with funding. The committee plans to go
to the community to ask for support as well. Many people have
expressed an interest in the beautification of the stream, but
any organization just beginning needs some seed money.
Therefore, Ms. Hinds requested that council consider including
$5,000- $10,000 in the 1990 -91 budget to get the project going.
She emphasized that Loop 201 has opened up the view of Goose
Creek Stream to more people, and when the Fred Hartman Bridge is
completed, visitors to Baytown could see a beautiful green belt
area with landscaped banks, jogging trails, benches, picnic
tables, and beautiful view to look down on as one drives on Loop
201. This is the goal of the committee.
Consider Proposed Resolution No. 1092, Amending Tax Abatement
Guidelines and Criteria
The city manager mentioned that Items 5 and 6 on the agenda
were related. Amendment of the tax abatement guidelines and
criteria is a recommendation of the Economic Development
Foundation Board of Directors. Proposed amendments include:

The proposed amendments are based upon experiences gained in
working with companies considering Baytown sites. These
amendments have been approved by the School District and Lee

Resolution No. 1092
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
REVIEWING THE CURRENT GUIDELINES AND CRITERIA FOR GRANTING TAX
ABATEMENT IN A REINVESTMENT ZONE CREATED IN HARRIS COUNTY OR
CHAMBERS COUNTY; RENEWING SUCH GUIDELINES AND CRITERIA; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
Consider Proposed Resolution No. 1093, Amending the Industrial
District Policy
Adoption of the proposed resolution will amend the
Industrial District policy to provide that an industry qualifying
for tax abatement must choose to participate in either the tax
abatement program or in the Industrial District Program. The
administration recommended approval of the resolution.
Councilman Credille moved for adoption of the resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
REPEALING RESOLUTION NO. 1015 DULY ADOPTED BY THE CITY COUNCIL OF
THE CITY OF BAYTOWN AND DECLARING SAID RESOLUTION TO HAVE NO
FORCE AND EFFECT; FINDING, DECLARING AND ESTABLISHING THAT
MANUFACTURING INDUSTRIES NEAR THE CORPORATE LIMITS OF THE CITY OF
BAYTOWN RARELY USE BAYTOWN'S MUNICIPAL SERVICES TO THE SAME
EXTENT AS DO PRIVATE CITIZENS AND, CONSEQUENTLY, SUCH
MANUFACTURING INDUSTRIES AS A WHOLE SHOULD COMPENSATE THE CITY OF
BAYTOWN PROPORTIONATELY AS TO THEIR USE AND ENJOYMENT OF SUCH
MUNICIPAL SERVICES.
Consider Proposed Resolution No. 1094, Supporting and Encouraging
the Construction of the Grand Parkway Segment from Interstate 10
to the Fred Hartman Bridge
Since adoption of the resolution supports and encourages the
construction of the Grand Parkway Segment from Interstate 10 to
the Fred Hartman Bridge, and construction of this segment has
such an impact on Baytown, the administration recommended
approval of the resolution.
Councilman Pruett moved for adoption of the resolution.

Consider Proposed Ordinance Authorizing the Purchase of Pinehurst
Water and Sewer Systems
Councilman Swofford moved for adoption of the ordinance.
Councilman Credille seconded the motion. The city manager
explained that the purchase of Pinehurst Water and Sewer Systems
is part of the annexation process along Highway 146.
Certificates of Obligation were sold to provide funding for this
purchase. The administration recommended approval of the
ordinance. The vote follows:

Ordinance No. No. 5587
AN ORDINANCE AUTHORIZING AND APPROVING THE EXPENDITURE OF FUNDS
FOR THE PURCHASE OF PROPERTY AND PAYMENT OF TAXES AND ASSESSMENTS
ON A WATER AND SEWER SYSTEM IN PINEHURST SUBDIVISION IN CHAMBERS
COUNTY, TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
Consider Proposed Ordinance Accepting Proposal of J.E. Stone For
Medical /Dental Insurance Program
The administration went out for proposals as a means of
doing a better job of providing medical and dental insurance
coverage to City of Baytown employees. The administration is
recommending acceptance of J.E. Stone's proposal through Alta for
a cost of $178,574 plus claims. J.E. Stone (Alta) will be
responsible for claims administration, utilization review,
individual and aggregate stock loss coverage, and administration
of Section 125 -Pre Tax Program. This represents about a $95,000
savings and the administration recommended acceptance of the
proposal of J.E. Stone (Alta). The administration feels that
after the city gets into the program there may be more savings.
Councilman Credille moved for adoption of the ordinance.

received the contract and was unable to review it. The vote

Ordinance No. 5588
AN ORDINANCE AWARDING TO J.E. STONE AND ASSOCIATES, INC., THE
CONTRACT FOR THE ADMINISTRATION OF THE MEDICAL AND DENTAL
INSURANCE PROGRAM OF THE CITY OF BAYTOWN; AUTHORIZING AND
DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO
SAID CONTRACT; AUTHORIZING PAYMENT OF ONE HUNDRED SEVENTY -EIGHT
THOUSAND FIVE HUNDRED SEVENTY -FOUR AND N01100 ($178,574.00)
DOLLARS PURSUANT TO THE TERMS OF SAID CONTRACT; AND PROVIDING FOR
THE EFFECTIVE DATE THEREOF.
Consent Agenda
Council considered the Consent Agenda as follows:
a. Proposed Ordinance No. 900726 -3, awards the annual tire
and tube contract to General Tire Service for the
amount of $87,360.56. Invitations to bid were mailed
to eight vendors and we received four bids.
We recommend approval.
b. We recommend the bids for the annual water meter
contract be rejected. We would like to revise the
specifications and readvertise for bids. Invitations
to bid were mailed to ten vendors and we received eight
bids and one no bid. The two low bids did not meet our
specifications.
We recommend rejection of the bids and authorization to
readvertise.

C. Proposed Ordinance No. 900726 -4, awards the bid for a
telephone maintenance agreement for City Hall and Parks
Service Center to Inter -Tel Communications for the
amount of $4,280. Invitations to bid were mailed to
three vendors. We received one bid and two no bids.
There is a thirty day cancellation clause in the
agreement to provide for cancellation upon installation
of the new CentraNet System.
We recommend approval.
d. Proposed Ordinance No. 900726 -5, awards the bid for the
purchase of micro computer hardware for engineering to
Texas Micro Products for the amount of $3,350. At its
meeting on May 24, 1990, council awarded a bid for
purchase of micro computer hardware for the fire
department to Texas Micro Products. Engineering is in
need of computer hardware and the vendor's bid is still
valid.
We recommend approval.
e. Proposed Ordinance No. 900726 -6, authorizes waiver of
the penalty and interest on the bankruptcy -tax claim
against The Fair. During the pendency of bankruptcy of
The Fair, Inc., 1989 taxes on the two Fair stores in
Baytown went delinquent. The City of Baytown filed a
claim in the bankruptcy proceeding, and has since been
paid the taxes due on the real property. However,
there is a total of $4,872.90 in personal property
taxes on the inventory of the two stores still
delinquent.
The attorney's for The Fair and the City of Baytown
have tentatively agreed that if the City will waive the
penalty and interest on the delinquent personal
property taxes, the city's claim will be allowed as a
Class 3 priority claim. Under the terms of the
reorganization of The Fair, a Class 3 priority claim
may be paid monthly over a six year period, with 10%
interest. As there is a dispute over whether a taxing
entity can assess penalty interest on a tax claim after
bankruptcy has been filed, the administration would
recommend that the City waive the $482.90 in penalty
and interest.

City Manager's Report
Random Drug Testing in the Police Department - In the past
City Council has adopted a policy of a drug free workplace. In
support of that policy, the Police Chief and his staff have
implemented random drug testing for the Police Department. To
indicate his support of the program, Chief Henscey has stated
that he will take the test each month. Random drug testing has
been endorsed by both police associations. No action by council
is necessary.
In response to an inquiry from council, the city manager
stated that as the city moves forward in this area, other areas
of the organization will be included in random testing. There is
presently a drug policy in place. However, it does not include
random testing.
Response to Jo Ellen Scott Request - The administration has
reviewed the request of Ms. Scott to barricade the dead end
street at Fifth Street and Republic. The street does not meet
the criteria to place a barricade. There is a red sign posted to
give notice of the dead end street.
Engineering Reports on Extension of Water and Sewer Lines to
Newly Annexed Highway 146 Area - Norman Dykes reported that
engineering companies retained for Highway 146 water and sewer
line extensions have both indicated plans are almost complete and
will be presented to the State Highway Department soon for permit
approval. The engineers feel that plans and specifications will
be ready for presentation to council at the first meeting in
September. Plans on the water line will include the area from
the railroad south, and on the sewer line all area north of the
pipeline corridor. There will be a Phase 1 and a Phase II on
each project.
In response to council inquiry, the city manager stated that
there are particular problems with the sewer line in the south
and with the water line in the north. The engineers feel that
the sections free of problems could be advertised for bids and
while work is in progress on those sections, the engineers can
address the problems with the other sections.
1990 -91 Budget - The city manager announced that plans are
to deliver the 1990 -91 Proposed Budget to city council on July
31.

Works Sessions - Council indicated a need for thirty minutes
to hold a work session on the voting plan before the next council
meeting. The city manager requested 15 minutes to update council
on the siren system for the city.
