1990 04 26 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN April 26, 1990 The City Council of the City of Baytown, Texas, met in regular session on Thursday, April 26, 1990, at 6:30 p.m. in the Council Chamber of the Baytown City Hall with the following attendance: Mario Delgado Jimmy Johnson Ray Swofford Pete C. Councilman Johnson offered the invocation, after which the following business was conducted: Consider Minutes for the Regular Meeting Held on April 5, 1990 Councilman Alfaro moved for approval of the minutes for the regular meeting held on April 5, 1990. Councilman Credille seconded the motion. The vote follows: Ayes: Council members Alfaro, Credille Mayor Hutto Nays: None Delgado, Johnson, Swofford, and Pruett 900426 -2 Minutes of the Regular Meeting - April 26, 1990 Consider Minutes for the Special Meeting Held on April 19, 1990 Councilman Pruett moved for approval of the minutes for the special meeting held on April 19, 1990. Councilman Alfaro seconded the motion. The vote follows: Ayes: Council members Delgado, Johnson, Alfaro, Credille and Pruett Mayor Hutto Nays: None Abstained: Councilman Swofford Citizens's Communications: a. Joellen Scott, 411 E. Republic, will address council concerning drainage problems and other problems along East Republic. Ms. Scott was not in attendance; however, the administration had addressed Ms. Scott's areas of concern in a memorandum to council. b. Mrs. A.J. Matthews Presents Donation to Establish Canine Unit. Mrs. Matthews presented Chief Henscey with a check for $5,000 to help establish a Canine Unit for the City of Baytown Police Department. Mrs. Matthews presented the gift on behalf of her family to recognize members of the Baytown Police Department, and specifically, Robert Huron, for their diligence and concern at the time of her husband's death. The family also extended recognition to the people of Baytown and friends at Exxon. Ms. Matthews requested that the dog be named A.J. Consider Proposed Ordinance No. 900426 -1, amending the Code of Ordinances Section 17 -4.1, Parks, Parkways, Playgrounds and Other Public Places for Public Recreation, By Deleting Reference to the Baytown Community Building Adoption of the proposed ordinance will delete any reference to consumption of alcoholic beverages at the Community Building. The administration recommended approval of the ordinance. 900426 -3 Minutes of the Regular Meeting - April 26, 1990 Councilman Pruett moved for adoption of the ordinance. Councilman Credille seconded the motion. The vote follows: Ayes: Council members Delgado, Johnson, Swofford, Alfaro, Credille and Pruett Mayor Hutto Nays: None Ordinance No. 5515 AN ORDINANCE AMENDING CHAPTER 17, "MISCELLANEOUS PROVISIONS AND OFFENSES," OF THE CODE OF ORDINANCES; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND N01100 ($200.00) DOLLARS FOR THE VIOLATION THEREOF; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. Consider Proposed Ordinance, Second and Final Reading On Annexation of Highway 146 Right -of -Way Adoption of the proposed ordinance will annex that section of Highway 146 that could not be included in the original annexation, because it is less than 1,000 feet in width and is bounded by the municipal utility district. Completion of this annexation will place all of Highway 146 north to Interstate 10 in the city limits. Councilman Swofford moved for adoption of the ordinance. Councilman Johnson seconded the motion. Included in the motion is that the annexation is in the best interests of the citizens of Baytown in order to provide emergency services along Highway 146. Also, it would be too burdensome for the citizens of Baytown to acquire the debt of the municipal utility district. The vote follows: Ayes: Council members Alfaro, Credille Mayor Hutto Nays: None Delgado, Johnson, Swofford, and Pruett 900426 -4 Minutes of the Regular Meeting - April 26, 1990 Ordinance No. 5490 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF PROPERTY ADJACENT TO THE HIGHWAY 146 RIGHT -OF -WAY; WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS FOR THE CITY OF BAYTOWN, TEXAS. Consider Proposed Ordinance, Adding Highway 146 Right of Way Annexation to Proper Council District Adoption of the proposed ordinance will add Highway 146 right -of -way annexation to Council District No. 4. Councilman Johnson moved for adoption of the ordinance. Councilman Credille seconded the motion. The vote follows: Ayes: Council members Delgado, Johnson, Swofford, Alfaro, Credille and Pruett Mayor Hutto Nays: None Ordinance No. 5516 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN ADDING CERTAIN PROPERTY TO COUNCIL DISTRICT NO. 4; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. Consider Proposed Ordinance, Amending Industrial District No. 3, By Deletion of Certain Annexed Properties Adoption of the proposed ordinance will delete the recently annexed territory along Highway 146 from Cedar Bayou Bridge to Interstate 10 from Industrial District No. 3. Property within the corporate limits of Baytown is not eligible for participation in the city's industrial district policy. The administration recommended approval of the ordinance. Councilman Alfaro moved for adoption of the ordinance. Councilman Johnson seconded the motion. The vote follows: 900426 -5 Minutes of the Regular Meeting - April 26, 1990 Ayes: Council members Delgado, Johnson, Swofford, Alfaro, Credille and Pruett Mayor Hutto Nays: None Ordinance No. 5517 AN ORDINANCE AMENDING ORDINANCE NO. 899 TO EXCLUDE CERTAIN AREAS LOCATED WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF BAYTOWN FROM INDUSTRIAL DISTRICT NO. 3; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance, Approving the Execution of Third Amendment to the Contract Between Baytown Area Water Authority and Harris County Fresh Water Supply District No. 1 -A (McNair) The BAWA Board has approved a contract amendment with Harris County Fresh Water Supply District 1 -A to increase the minimum take -or -pay amount to .1652 million gallons per day from .1250 million gallons per day. Harris County Fresh Water Supply District No. 1 -A requested the amendment to comply with Subsidence District requirements. The administration recommended approval of the ordinance. Councilman Swofford moved for adoption of the ordinance. Councilman Pruett seconded the motion. The vote follows: Ayes: Council members Delgado, Johnson, Swofford, Alfaro, Credille and Pruett Mayor Hutto Nays: None Ordinance No. 5518 AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION OF A THIRD AMENDMENT TO THE CONTRACT BETWEEN HARRIS COUNTY FRESH WATER SUPPLY DISTRICT NO. 1 -A AND THE BAYTOWN AREA WATER AUTHORITY; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 900426 -6 Minutes of the Regular Meeting - April 26, 1990 Consider Proposed Ordinance, Authorizing Interlocal Agreement with Harris County for Oversizing Bush Road Water Line During the construction of Bush Road, Harris County is planning to relocate an existing 4 -inch water line from Stonehedge Drive to Cedar Bayou - Lynchburg. The City of Baytown has recommended an 8 -inch water line to replace the existing line. If the City of Baytown provides the additional funds totaling $17,396, Harris County will issue a Change Order to install the 8 -inch line. Adoption of the ordinance will authorize the Interlocal Agreement with Harris County to oversize this water line. The administration recommended approval of the ordinance. Councilman Alfaro moved for adoption of the ordinance. Councilman Swofford seconded the motion. The vote follows: Ayes: Council members Delgado, Johnson, Swofford, Alfaro, Credille and Pruett Mayor Hutto Nays: None Ordinance No. 5519 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO AN INTERLOCAL AGREEMENT WITH HARRIS COUNTY FOR OVERSIZING THE BUSH ROAD WATER LINE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance, Awarding Bid for Demolition at 1302 -1306 Cherry Street The City of Baytown will allow a bid to be withdrawn if a mistake has been made in the bid, the bidder has given timely notice of the mistake, and the following conditions have been met: 1. The mistake is of so great a consequence that to enforce the contract would be unconscionable. 2. The mistake relates to a material feature of the contract. 3. The mistake must not have resulted from culpable negligence or the legal violation of a positive legal duty. 900426 -7 Minutes of the Regular Meeting - April 26, 1990 4. Relief must not result in prejudice to the City other than the loss of its bargain. Mr. Chatham submitted a letter which met those conditions. The administration recommended that the bid be awarded to the next low bidder, Don Hill, Inc. for the amount of $8,700. Councilman Johnson moved to allow Magnolia Demolishing to withdraw its bid for the amount of $2,274. Councilman Pruett seconded the motion. The vote follows: Ayes: Council members Delgado, Johnson, Swofford, Alfaro, Credille and Pruett Mayor Hutto Nays: None Councilman Swofford moved to adopt the ordinance awarding the bid for demolition at 1302 -1306 Cherry Street to Don Hill, Inc. for the amount of $8,700. Councilman Johnson seconded the motion. The vote follows: Ayes: Council members Delgado, Johnson, Swofford, Alfaro, Credille and Pruett Mayor Hutto Nays: None Ordinance No. 5520 AN ORDINANCE ACCEPTING THE BID OF DON HILL, INC. FOR THE DEMOLITION OF STRUCTURES; AUTHORIZING EXECUTION OF A CONTRACT FOR THE SUM OF EIGHT THOUSAND SEVEN HUNDRED AND N01100 ($8,700.00) DOLLARS; MAKING VARIOUS FINDINGS AND PROVISIONS RELATED TO THE SUBJECT. For bid tabulation, see Attachment "A." 900426 -8 Minutes of the Regular Meeting - April 26, 1990 Consent Agenda Council considered the Consent Agenda Items "a" through 111." The city manager pointed out that the administration was not ready on the award of bids for demolition at 1205 Bookertee Street and recommended rejection of all bids. The Consent Agenda follows: a. Proposed Ordinance No. 900426 -8, awards the bid for the purchase of ammunition for the Crime Prevention Unit to Black Hills Ammunition in the amount of $6,655. The bids from National Shooting Supplies and GT Distributors do not meet specifications. Invitations to bid were mailed to 14 vendors and we received 5 bids. We recommend approval. b. Proposed Ordinance No. 900426 -9, awards the bid for the annual oil and grease contract to Jones Oil, Inc. in the amount of $23,040.99. Invitations to bid were mailed to 14 vendors and we received 8 bids and one no- bid. We recommend approval. C. Proposed Ordinance No. 900426 -10, authorizes an interlocal agreement with the City of Seabrook. The contracts will include oil and grease, limestone, pipe, liquid chlorine, hot mix -cold lay asphalt, malathion, gasoline, fire hydrants, and water meters. This agreement will be for the balance of this fiscal year, beginning April 27, 1990 and ending September 30, 1990. We recommend approval. d. We are recommending bids for the storage tanks be rejected. We would like to rebid the item and bid a tank that is insulated and heated to maintain the temperature above 40 degrees. We recommend rejecting the bids. 900426 -9 Minutes of the Regular Meeting - April 26, 1990 e. Proposed Ordinance No. 900426 -11, awards the annual fly ash stabilized calcium base course, calcium sulfate fill and cement calcium base to Gulf States Materials in the amount of $48,750. Invitations to bid were mailed to 2 vendors and we received one bid. We recommend approval. f. Proposed Ordinance No. 900426 -12, awards the annual installation of traffic signal equipment contract to Traffic Maintenance in the amount of $34,874. Invitations to bid were mailed to 4 vendors and we received 1 bid and one no -bid. We recommend approval. g. Proposed Ordinance No. 900426 -13, awards the bid for installation of carpet for City Hall to Sherwin Williams in the amount of $8,550. The bid received from Thomason Interiors did not meet specifications. Invitations to bid were mailed to 5 vendors and we received 3 bids. We recommend approval. h. Proposed Ordinance No. engine replacement for Tractor in the amount of were mailed to 3 vendors We recommend approval. 900426 -14, awards the bid for a Ford tractor to Conroe Ford $4,374.88. We recommend rejection of these bids. k. Proposed Ordinance No. 900426 -17, authorizes the purchase of the Solesbee Water System. Mr. Solesbee has agreed to sell his water system consisting of the water well, pumps, tanks, meters, and water lines to the city for $20,000. This system furnishes water to the Cedar Bayou subdivision in the newly annexed area in Chambers County. Once purchased by the city Division in the Public Works and maintain the system and ou billing the 35 customers. Proposed Ordinance No. 900426 -18, awards a construction contract for renovation of the Amphitheater in Bicentennial Park to Chatham Construction Company in the amount of $6,800. Councilman Swofford seconded the motion. The vote follows: Ayes: Council members Delgado, Johnson, Swofford, Alfaro, Credille and Pruett Mayor Hutto Nays: None Consider Appointments to Baytown Traffic Commission Councilman Alfaro moved to appoint Linda Cottar and Thomas P. McLaughlin to another term on the Baytown Traffic Commission. Councilman Credille seconded the motion. The vote follows: Ayes: Council members Delgado, Johnson, Swofford, Alfaro, Credille and Pruett Mayor Hutto Nays: None City Manager's Report Media Training - Council was reminded of the Media Training Session that will be held on May 17 at the Community Building. Earth Day Celebration - An Earth Day Celebration will be held at the Republic of Texas Plaza on April 27 at 1:30 p.m. Annual Disaster Drill - The Annual Disaster Drill will be held on Saturday, April 28 from 9:00 to 12:00 noon. Bridge Oil Company - The gas well being drilled by Bridge Oil Company is at 5,627 feet; however, no gas has been discovered. 900426 -14 Minutes of the Regular Meeting - April 26, 1990 R/UDAT - Councilman Credille commented that the R /UDAT has been postponed to June. Since the national convention is being held in Houston in May, the thought was that it would be better to delay Baytown's R /UDAT to June. Voting Plan - Mayor Hutto requested that a work session be held prior to the next council meeting on May 10 to give the administration some guidelines toward development of a voting plan for Baytown. He indicated that the council needed to aggressively seek input from all segments of the community. Adjourn There being no further business to be transacted the meeting was adjourned. Eileen P.
