1989 04 04 CC Minutes, SpecialMINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN April 4, 1989 The City Council of the City of Baytown, Texas, met in special session on Tuesday, April 4, 1989, at 5:00 p.m. in the Council Chamber of the Baytown City Hall with the following attendance: Fred T. Philips Councilman Jimmy Johnson Councilman Roy Fuller Councilman Rolland J. Pruett Councilman Emmett 0. Hutto Fritz Lanham Randy Strong Bobby Rountree Eileen P. Hall Absent: Perry Simmons Pete C. Al f aro Mayor City Manager City Attorney Assistant City Manager City Clerk Councilman Councilman The meeting was called to order with a quorum present. After which the following business was conducted: Consider Proposed Ordinance, Repealing Ordinance No. 5196, and Calling a Municipal Election Under a Court Ordered Interim Plan Randy Strong, City Attorney, explained that Judge Singleton had signed an agreed order for an interim election. Since the election will be an interim election no terms have been set. The judge approved a 5 -1 -1 Plan consisting of five single member districts to be elected by majority vote, one at -large council place to be elected by majority vote, and the mayor to be elected by majority vote. Those filing for position in the single member district must reside within the district. The usual sixteen polling places will be utilized. 890404 -2 Id Minutes of the Special Meeting - April 4, 1989 Based on conversations with the Justice Department, the court agreed to move the date for the Municipal Election to May 20. This will allow a longer period for filing. The Justice Department must preclear the plan in order for the election to be held. Therefore, the Legal Department will be requesting expedited consideration. The plantiff's have agreed to the plan and will support the plan before the Justice Department. However, the Justice Department has not indicated that the plan will be approved. Adoption of the proposed ordinance will repeal Ordinance No. 5196 which called an election under a 5 -3 -1 Plan for May 6 and sets forth the schedule adopted under the court order for holding the election. Under the order adopted, the filing period is somewhat reduced and the election date is not a uniform date. However, absentee balloting will be conducted for the same period as required by state law. The city attorney mentioned that one of the reasons that the city has been attempting to hold an election in May is so that the budgeting process will not be disrupted. If a new council is elected in May, this would be prior to the budgeting process or if no election is held the old council would be involved in the budgeting process. Therefore, the attorneys on both sides have agreed that should the Justice Department fail to preclear the election for May 20, neither side will ask for an election prior to November, 1989. Councilman Johnson moved for adoption of the ordinance: Councilman Philips seconded the motion. The vote follows: Ayes: Council members Philips, Johnson, Fuller, and Pruett Mayor Hutto Nays; None The City Clerk reviewed some of the dates with council including the fact that the run -off, if one is necessary, would be scheduled for June 3. ArN 890404 -3 Minutes of the Special Meeting - April 4, 1989 Ordinance No. 5243 AN ORDINANCE ORDERING THE MUNICIPAL ELECTION TO BE HELD ON THE C 20TH DAY OF MAY, 1989, FOR THE PURPOSE OF ELECTING FIVE (5) COUNCILMEN FROM THE RESPECTIVE DISTRICTS NOS. ONE (1), TWO (2), THREE (3), FOUR (4), AND FIVE (5); ELECTING ONE COUNCILMAN FROM THE CITY AT LARGE; AND A MAYOR FROM THE CITY AT LARGE; PROVIDING FOR THE ELECTION OFFICERS; DESIGNATING THE PLACES AND MANNER OF HOLDING SAID ELECTIONS; PRESCRIBING THE HOURS; ESTABLISHING THE CENTRAL COUNTING STATION; PROVIDING FOR AN ABSENTEE BALLOT BOARD FOR ABSENTEE BALLOTS; AND PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE.
