The City Council of the City of Baytown, Texas, met in
regular session on Thursday, October 13, 1988 at 6:30 p.m. in the
Council Chamber of the Baytown City Hall with the following

The meeting was called to order with a quorum present.
Councilman Embry offered the invocation, after which the follow-

Mayor Hutto recognized Tom Machala and Cub Scout Pack No.
83.
Citizen's Communications:
a. Mark Tiller, Chairman of the Board of the Chamber of
Commerce, will appear to discuss the 1988 -89 Budget for
the City of Baytown.
Mark Tiller, Chairman of the Board of the Chamber of
Commerce, on behalf of the Chamber extended the
Chamber's support and approval for the 1988 -89 City of
Baytown budget. He stated that it was apparent that
city management and city council had worked hard to
hold the line on costs associated with running the
city, especially in this current economic environment.
He pointed out that the budget was adopted without a
tax increase, without any personnel layoffs, and
without major cuts in service.
He noted that in the future it may not always be
possible to prevent a tax increase. In that regard,
the Chamber requested that due consideration be given
to projects that will improve and adequately maintain
the city's basic infrastructure, provide for major
recreational facilities, provide industrial development
sites and opportunities, and provide develop of pro-
grams aimed at aesthetic enhancement of major roadways
and waterways. As long as city management and city
government displays the type of due diligence and
continued concern for cost containment as evidenced by
the zero tax increase budget, the Chamber offers its
support of those projects and related expenditures that
enhance the city's ability to provide a quality of life
that attracts people to the community.
Mayor Hutto thanked Mr. Tiller for taking the time to
provide council with positive input. In the future the
city may need the Chamber's help and support of a bond
issue.

b. Receive petition concerning the barricade of Busch Road
All the residents along Busch Road with the exception
of one, had signed a petition requesting that council
barricade the entrance to Busch Road from Loop 201.
Council had no objections to the barricading of Busch
Road.
Councilman Philips noted that a no- outlet sign should
be posted.
Consider Proposed Ordinance, Amending Chapter b, "Auto Wreckers,"
of the Code of Ordinances
Randy Strong, City Attorney, previewed the proposed changes
for council. With the enactment of the Texas Tow Truck Act the
state entered regulation of tow trucks authorizing the Department
of Labor and Standards to administer that act. The state now
licenses and permits all tow trucks. Because of the changes in
state law, it is necessary to change the local ordinance to bring
it into compliance. The act provides for changes in terminology.
In the current ordinance reference is made to auto wreckers,
whereas the new state law refers to tow trucks. All standards
for size and equipment for tow trucks has been eliminated from
the proposed ordinance.
With the changes in state law, come changes in the rotation
list. The state law specifically provides that the
owner /operator of a vehicle involved in an accident has the right
to call any state permitted tow truck to haul the vehicle. The
ordinance still provides that the tow truck must arrive at the
scene of the accident within 20 minutes of being called. On non -
preference tows, that is when an individual is unable to make a
preference or has no preference, the police department will call
the next tow truck on the list. Anyone with a state permit may
be called on a consent tow. Also, anyone with a state permit may
be on rotation. However, to be on rotation, one must have a
storage yard within the city limits or within the designated
boundaries provided under the current ordinance.

The proposed ordinance provides for an increase in normal
tow from $45.00 to $55.00 and moves to a flat fee of $7.50 per
day for storage. The application fee has been dropped from
$125.00 to $25.00.
Councilman Simmons stated that prior to the meeting he had
contacted the Department of Labor and Standards and roughly
explained the current rotation procedure. Mr. Henry VelLaGomez
with the Department of Labor and Standards confirmed that as long
as tow trucks within the City of Baytown are registered under the
Texas Tow Truck Act, and are licensed under the Texas Storage
provisions, the Department of Labor and Standards has no interest
in the rotation. Councilman Simmons objection to opening the
rotation list to any state permitted tow truck is that the
owner /operator must have the state permitted storage facility
within the city limits or within the boundaries designated by the
ordinance. He feared that the City of Baytown would become a
city of junkyards.
Council members also expressed the concern that the citizens
of Baytown would ultimately suffer by opening the rotation up to
all tow truck owners with state permits. The present system
works very well to serve the citizens of Baytown.
Denzil Shirley, tow truck owner /operator, stated that he too
had conversed with the Department of Labor and Standards. The
person that he spoke with indicated that the city can do anything
they want to including operating its own tow truck.
Two auto wrecker committee members present, Jack Jungbluth
and William Stainer, indicated that they did not understand that
the rotation list would be affected by the proposed ordinance
changes.
Because of the confusion as to what the state statute
actually provides, Councilman Pruett moved to table the matter
and refer same to the Auto Wrecker Committee for further study
and recommendation to council. Councilman Fuller seconded the
motion. The vote follows:

Discuss Auto Wrecker Operators' Request For Rate Increase To Haul
Abandoned and City -Owned Vehicles
Council will consider this item along with proposed changes
to Chapter 6 of the Code of Ordinance.
Consider Proposed Ordinance, Amending Chapter 27, "Subdivisions,"
Section 73, "Water and Sewer System"
The present ordinance does not provide for use of many of
the materials that are commonly used today. It also provides for
use of asbestos cement water pipe which is no longer used. The
requested changes will allow the use of polyethylene sewer pipe
for force mains, steel, three types of concrete steel cylinder
pressure pipe, cast iron, and ductile iron for water lines.
Asbestos cement water pipe is deleted. The administration recom-
mended approval of the ordinance.
Councilman Pruett moved for adoption of the ordinance;

AMENDING SECTION 27 -73, OF CHAPTER 27, "SUBDIVISIONS," OF THE
CODE OF ORDINANCES BY ADDING SUBSECTION (a)(4)(d) AND SUBSECTIONS
(b) (1) (a -h): PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS
CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
Consider Proposed Ordinance, Authorizing Change Order No. 19 For
Contract No. 1, Enlargement of Central Sewer District Wastewater
Treatment Plant
Change Order No. 19 would provide for additional piping in
order to aerate the boxes and channels, thereby eliminating the
foam and reducing the odor problems that result. This is
currently being taken care of by means of temporary air lines.

Ordinance No. 5118
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING CHANGE ORDER NO. 19 WITH BASIC CONSTRUCTORS, INC. FOR
THE CENTRAL DISTRICT REHABILITATION PROJECT (CONTRACT NO. 1); AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
Consider Proposed Ordinance, Approving Contract With Baytown
Opportunity Center For Thoroughfare Litter Pickup and Park Clean-
ing and Mowing
Included in the current budget are funds to cover to con-
tract with Baytown Opportunity Center for thoroughfare litter
pickup, park cleaning and mowing in the amount of $37,349. This
is an increase of $3,788 over the current contract. Items
involved in the increase include:
1. Litter pickup: This increase requires the Baytown
Opportunity Center to pickup all bags along the road-
side and dispose of them at the Parks Maintenance
facility rather than leaving the bags for park workers
to gather.
2. Park Cleanup: This adds an additional month for park
cleanup.
3. Additional work at Sports Complex: Daily cleaning of
parking lot, tennis courts and all of the complex
property (in addition to the ballfield area which was
in the previous contract). Includes cleaning outside
public restrooms.

Funding for spot cleanups was reduced from $1,500 to $600 in
this contract. The administration recommended approval.

AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXE-
CUTE AND THE CITY CLERK TO ATTEST TO A CONTRACT WITH BAYTOWN
OPPORTUNITY CENTER FOR THOROUGHFARE LITTER PICKUP, PARK CLEANING
AND MOWING; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
Consider Proposed Ordinance, Adopting "Updated Service Credits"
in the Texas Municipal Retirement System for Increased Prior and
Current Service Annuities for Retirees and Beneficiaries of
Deceased Retirees' and Authorizing Increase in Rate of Deposits
to TMRS
Adoption of the proposed ordinance would provide for
increased prior and current service annuities for retirees and
beneficiaries of deceased retirees and will increase the
employees contribution rate to the retirement system to 6 %;
increasing the city's contribution rate to 11.22% for 1989. The
proposed changes become effective January 1, 1989. The adminis-
tration recommended approval.
Councilman Philips moved for adoption of the ordinance;

AN ORDINANCE OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND
ALLOWING, UNDER THE ACT GOVERNING THE TEXAS MUNICIPAL RETIREMENT
SYSTEM, "UPDATED SERVICE CREDITS" IN SAID SYSTEM FOR SERVICE
PERFORMED BY QUALIFYING MEMBERS OF SUCH SYSTEM WHO PRESENTLY ARE
IN THE EMPLOYMENT OF THE CITY OF BAYTOWN; PROVIDING FOR INCREASED
PRIOR AND CURRENT SERVICE ANNUITIES FOR RETIREES AND
BENEFICIARIES OF DECEASED RETIREES OF THE CITY; AND ESTABLISHING
AN EFFECTIVE DATE FOR SUCH ACTIONS; AND TO INCREASE THE RATE OF
DEPOSITS TO THE TEXAS MUNICIPAL RETIREMENT SYSTEM BY THE
EMPLOYEES OF THE CITY OF BAYTOWN.
Consider Request of Capital Youth Federation To Hold a Parade On
City Streets
The Pathfinders of Capital Cities Youth Federation, a
Seventh Day Adventist Youth Group, is requesting permission to
conduct a parade Saturday, October 29, 1988 at 3:00 p.m. A map
was enclosed in the packet indicating the proposed route. Police
assistance is being requested at the intersections of Pruett and
Defee and Pruett and Sterling. The administration recommended
approval. However, in the future if more parade requests are
made requiring police assistance, the administration may develop
a policy for council consideration.
Councilman Simmons moved to grant permission to Pathfinders
of Capital Cities Youth Federation to conduct a parade as
requested. Councilman Johnson seconded the motion. The vote
follows:

Consider Proposed Drainage List for 1988 -89 and Authorize Adver-
tisement For Bids
Norman Dykes, Director of Public Works /City Engineer, stated
that the recommended drainage projects for 1988 -89 are a result
of heavy rains experienced on the east side of the city recently.
However, the administration will not need authorization to adver-
tise for bids since city crews will perform this work. Mr.
Dykes reviewed the proposed projects as follows:
1. Install larger diameter crossing under Cedar Bayou Road at
McKinney. This work is necessary to take water to the other
side of the road to alleviate flooding at that location.
2. Install box culvert under Highway 146 at Crosby Cedar Bayou
Road. Highway Department assistance is required for this
project. There will need to be an open cut on Highway 146
to perform this work. The water flows through a flood
control ditch that crosses Elvinta just south of the Animal
Clinic. The administration will ask the Highway Department
to perform this project. However, if the Highway Department
will not perform the project, $40,000 is included to do this
work.
3. Proposed street and drainage improvements to Massey Tompkins
Road would need to be included in a future bond program.
Right of way was included in the last bond program.
However, funds for the drainage structure would be built in
conjunction with the construction of Massey Tompkins which
funds would be included in a future bond program.
Councilman Johnson indicated that Ms. Hanna had contacted
him stating the ditch across the street had very little
water while they were flooded. Therefore, Councilman
Johnson requested that a pipe be installed under the roadway
near Ms. Hanna's home.
Mr. Dykes said that city crews would install the pipe at a
cost of approximately $5.000. He emphasized that this would
provide very little relief because major drainage work is
required to alleviate the problem.

4. Reshape back yard to channel water away from house on Edge -
wood Drive and add grate inlets to large drainage system on
East Texas. This will channel water away from a home that
is actually draining a large area. The water is sheet
draining across the yard. The property owner will give
permission to the city to remove some dirt to create a
natural swaie through the yard. No expenditure is required
other than the labor.
Also, grate inlets will be added to help with the flooding
of some homes on Edgewood. The cost for this is $2,000.
5. Install box culvert bridge under Roseland Drive. Roseland
Drive goes into the park and crosses the flood control
ditch. Therefore, flood control permission will be required
to perform this project. An additional pipe there will
channel some of the water out of Roseland Oaks. If the tide
water is up, existing pipes are about half full with little
capacity left to handle rain water. In a very heavy rain,
the water runs over the road and when it gets that deep, it
backs up into existing drainage.
6. Install another street crossing under Tri Cities Beach Road
for more outfall capacity from East Texas Avenue. There was
a home on the corner of Tri Cities Beach Road that got water
in it. This will allow more outlet space down at the
outfall .
Councilman Philips suggested shaping of the drainage ditch
to cause water to flow to the west from Woodside to feed
into the new line. At the crest of the hill the water
splits and collects, trying to find a way to move. Between
Woodside and Tri Cities Beach Road needs sloping.
7. Regrade ditch on Hunnicutt Street. A house on Hunnicutt got
water in the garage. The only work necessary is to regrade
a ditch. A home on Cedar Bayou Road west of Highway 146
near the railroad flooded. To solve that problem the city
would need to perform the Mabry Flood Detention Project.
That project will cost approximately $100,000, plus the
donated land. The city has no indication of when this might
occur.
In response to an inquiry from council, Mr. Dykes stated
that the county still plans a detention pond in the Goose Creek
Watershed.

Councilman Philips moved to approve the 1988 -89 Drainage
List. Councilman Embry seconded the motion.
In response to George Simon, 3231 Crosby Cedar Bayou Road,
Mayor Hutto stated that the solution to Mr. Simon's problem is
included in the drainage list. The vote follows:

The proposed drainage projects list for 1988 -89 is attached
to the minutes as Attachment "A."
Consent Agenda
Council considered the Consent Agenda Items "a" through "1"
as follows:
a. Proposed Ordinance No. 81013 -6, authorizes an inter -
local agreement with Goose Creek Schools for the pur-
chase of copier paper in the amount of $20.10 per
carton.
We recommend approval.
b. Proposed Ordinance No. 81013 -7, awards the bid for the
annual chemical contract as follows:

Hunter Chemical Items #3 & #6 39288.36

g. Proposed Ordinance No. 81013 -11, awards the rehabili-
tation contract for 1106 Carver to Uranus Palton in the
amount of $11,600. Six bid packages were picked up and
three bids were received.

h. Proposed Ordinance No. 81013 -12, awards the rehabili-
tation contract for 3116 Indiana to Nolasco's Carpentry
in the amount of $11,985. Six bid packages were picked
up and one bid was received.

i. Proposed Ordinance No. 81013 -13, awards the house
leveling contract for 3116 Indiana to Accurate Con-
struction and Foundation Repair in the amount of
$2,200. Three bid packages were picked up and two bids

j. Proposed Ordinance No. 81013 -14, authorizes payment to
Lansdowne- Moody, Inc. for repairs to the Parks and
Recreation mowing tractor in the amount of $2,105.60.
The tractor was picked up by Lansdowne -Moody for
repairs to the clutch and transmission. Repairs were
not expected to exceed $2,000. Additional repair work
to the PTO system was required, causing final repair
cost to exceed $2,000.

Consider Appointments to Clean City Commission
These appointments will be made at a later date.
Consider Appointments to Community Development Advisory Board
Council recently adopted Ordinance No. 5083, which changed
the terms of members of the Community Development Advisory
Committee from 3 years to 2 years, providing five members are to
be appointed in odd numbered years and four members in even
numbered years.
In order to move the committee in that direction, Councilman
Philips moved to appoint Martin L. Griffith to replace Edna
Oliver and to reappoint Sue Gillette. Both these appointees will
serve to January 1, 1990. Marie Auzenne and Kenneth Simon would
be appointed to serve through January 1, 1991. Councilman John-
son seconded the motion.
Councilman Philips noted that those currently serving who
were not reappointed are not eligible for reappointment under the
new ordinance. The vote follows:

City Manager's Report
Report on Retirement Benefits - The report that Councilman
Johnson had requested on increase in retirement benefits was
furnished to council.

meeting, the contract for demolition of the building at 115 -117
West Texas was awarded. Since that time, one of the property
owners has requested a demolition permit which was granted.
There is a limitation on the permit. The structure must be
removed within 60 days. The property owners signed an affidavit
certifying that the property will be completely cleaned up. All
debris, buildings, etc. will be removed within that 60 -day
period and demolition must begin by October 15, 1988.
Quarterly Economic Development Report - Council was
furnished with a copy of the Quarterly Economic Development
Report.
Senior Olympics - The Senior Olympics will be held October
17 through October 21. Council is invited to attend the
activities. Angela Swart should be notified by those council
members interested in attending the luncheon.
Halloween - Parks and Recreation will provide activities for
Halloween on Saturday, October 29.

Elm Street Community Development Project - All of the paving
is complete. All the curb has been installed, along with the
driveways. The contractor is now constructing sidewalks.
Central District Wastewater Plant - This project is 97%
complete. All the concrete work has been completed. The
contractor is working on painting and landscaping. Council will
be furnished with a report on the proposed landscaping.
Sewer Main Line Leaks - Since the last report, there have
been 38 service line repairs for a total of 111, which is about
22% of the total necessary repairs.
Employee Picnic - The Employee Picnic is scheduled for
October 14.
Oil Well - The drilling rig was moved on site today.
Recess and Reconvene
Mayor Hutto recessed the open meeting into executive session
to discuss land acquisition and sale of city property. When the
open meeting reconvened, Mayor Hutto announced that no action was
necessary as a result of the executive session.

There being no further business to be transacted, the meet-
ing was adjourned.

PROPOSED DRAINAGE PROJECTS
1988 - 1989
1. Install larger diameter crossing under
Cedar Bayou Road at McKinney.
2. Install box culvert under Hwy. 146 at
Crosby /Cedar Bayou Road.
3. Proposed street and drainage improvements
to Massey- Tompkins.
4. Reshape back yard to channel water away from
house on Edgewood Drive and add grate inlets
to large drainage system on East Texas.
5. Install box culvert bridge under Roseland
Drive.
6. Install another street crossing under Tri- Cities
Beach Road for more outfall capacity from
East Texas Avenue.
7. Regrade ditch on Hunnicutt Street.
* Complete Mabry Road Detention Project and
install pipe on Cedar Bayou Road.
This project is dependent on detention pond
land being donated to the City.
