1985 11 07 CC Minutes, Special51107 -1 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN November 7, 1985 We, the undersigned officers of the City of Baytown, Texas (the "City "), hereby certify as follows: 1. The City Council of the City convened in special meeting on the 7th day of November, 1985, at the regular meeting place thereof, within the City, and the roll was called of the duly constututed officers and members of the City Council and the City Clerk, to wit: Emmett 0. Hutto Mayor Perry M. Simmons Councilman Roy L. Fuller Councilman Fred T. Philips Councilman Jimmy Johnson Councilman Gerald E. Dickens Councilman Ronald G. Embry Councilman Eileen P. Hall City Clerk and all of said persons were present, except the following absentees: , this consti- tuting a quorum. Whereupon, among other business, the following was transacted at said meeting: a written ORDINANCE AUTHORIZING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CITY OF BAYTOWN, TEXAS, CERTIFICATES OF OBLIGATION, SERIES 1985 (the "Ordinance ") was duly introduced for the consideration of the City Council and read in full. It was then duly moved and seconded that the Ordinance be adopted; and, after due discussion, said motion, carrying with it the adoption of the Ordinance, prevailed and carried by the following vote: AYES: All members of the City Council shown present above voted "Aye." NAYS: None SEE PAGE NO. 51107 -2 for Full Context of Ordinance NO. 4305 In connection with the sale of certificates of obli- gation and the fact that Thanksgiving is on November 28, Council scheduled the second meeting in November for Tuesday, November 26. 51107 -2 ORDINANCE NO. 4305 ORDINANCE AUTHORIZING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CITY OF BAYTOWN, TEXAS, CERTIFICATES OF OBLIGATION, SERIES 1985 THE STATE OF TEXAS COUNTIES OF HARRIS AND CHAMBERS CITY OF BAYTOWN § WHEREAS, the City Council of the CITY OF BAYTOWN, TEXAS (the "City "), deems it advisable to issue Certificates of Obligation of the City in accordance with the notice here- inafter set forth; therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct. Section 2. The City Clerk is hereby authorized and directed to cause to be published in the manner required by law and in substantially the following form, a notice of intention to issue Certificates of Obligation: M 51107 -3 Section 3. The notice set forth in Section 2 above shall be published in both English and Spanish once a week for two (2) consecutive weeks in a newspaper which is of general circulation in the City, the date of the first pub- lication to be not less than fourteen (14) days prior to the date tentatively set in said notice for the passage of the ordinance authorizing the issuance of such Certificates of Obligation. Section 4. The Mayor, City Clerk, and other officers of the City are hereby authorized and directed to do any and all things necessary or desirable to carry out the provisions of this ordinance. Section 5. This ordinance shall take effect immediately upon its passage. Section 6. It is hereby officially found and determined that the need of the City for such financing creates an emer- gency and an urgent public necessity for the holding, at the scheduled time, of the meeting of the City Council at which this ordinance is adopted and for the adoption of this ordi- nance; and the NOTICE OF MEETING relating to said meeting and heretofore posted by the City Clerk, and the posting thereof, are hereby authorized, approved, and ratified. ATTEST: City Clerk CITY OF BAYTOWN, TEXAS (SEAL) Mayor CITY OF BAYTOWN, TEXAS APPROVED: City Attorney 51107 -4 NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION NOTICE IS HEREBY GIVEN that the City Council of the City of Baytown, Texas (the "City "), will meet in the City Hall, City of Baytown, Texas, at 6:30 p.m. on the 26th day of November, 1985, at which time the City Council tentatively proposes to adopt an ordinance and take such other action as may be deemed necessary to authorize the issuance of the City's Certificates of Obligation, payable from City °ad valorem taxes, in the maximum aggregate principal amount of $250,000, bearing interest at any rate or rates, not to exceed the maximum interest rate now or hereafter authorized by law, as shall be determined within the discretion of the City Council, and maturing over a period of years not to exceed five (5) years from the date thereof, for the purpose of evidencing the indebtedness of the City for all or any part of the cost of purchasing land for public buildings for the City, and the cost of professional services incurred in connection therewith. Hall Secretari.o Municipal CIUDAD DE BAYTOWN, TEXAS (SELLO) 51107 -6 Minutes of the Special Meeting - November 7, 1985 Consider Proposed Resolution No. 925, Casting the City of Baytown's Vote for Directors, Harris County Appriasal District Councilman Fuller moved to adopt the resolution casting the City of Baytown's vote for Marta Greytok; Councilman Philips seconded the motion. The vote follows: Ayes: Council members Philips, Johnson, Simmons, Embry, and Fuller Mayor Hutto Nays: Councilman Dickens RESOLUTION NO. 925 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, CASTING ITS VOTE FOR THE OFFICE OF DIRECTOR, HARRIS COUNTY APPRAISAL DISTRICT, FOR THE TERM BEGINNING JANUARY 1, 1986. Economic Development Meetin Mayor Hutto requested that Councilman Philips report on the status of the economic development meeting that is being planned for November. Councilman Philips reported that the Mayor of Tucson, Arizona has agreed to have the City Manager, Joel Valdez and the Director of the Tucson Economic Development Board come and be with City of Baytown representatives on November 20. Also, the Director of the John Gray Institute, Dr. Philip Johnson, will be present. Councilman Philips is presently working with the City of Galveston in an effort to get the City Manager of Galveston, who has done extensive work with these Tax Increment Zones, to attend this meeting. There will be a very good slate of people here to talk about economic development; therefore, Councilman Philips encouraged Council to attend if at all possible. There is presently no set agenda, but the tentative plans are to meet in the morning, inviting as many people as possible from various spectrums of the community, plan on a lunch and adjourn somewhere around 2:00 p.m. to allow time for the visitors from Tucson to catch a plane back. Two vehicles that are being used successfully through- out the country for economic development are Tax Increment Zones and Enterprise Zones, and those vehicles will be explored at this meeting.
