1984 07 12 CC Minutes40712 -1 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN July 12, 1984 The City Council of the City of Baytown, Texas, met in regular session on Thursday, July 12, 1984, at 6:30 p.m. in the Council Chamber of the Baytown City Hall with the follow- ing attendance: Fred T. The invocation was offered by Councilman Dickens, afterwhich the following business was transacted: Consider Minutes for Council Meeting Held June 28, 1984 Councilman Philips moved for approval of the minutes for the meeting held June 28, 1984; Councilman Dickens seconded the motion. The vote follows: Ayes: Council members Philips, Simmons, Fuller and Dickens Mayor Cannon Nays: None Receive Petitions There were no petitions presented. City Manager's Report Sizzler Restaurant - The administration has received a letter from the management of Sizzler Restaurants International authorizing the city to act as their agent to remove any unauthorized persons from their property. 40712 -2 Minutes of the Regular Meeting - July 12, 1984 Mayor Cannon commented that on Saturday a couple of weeks ago, he had visited with individuals who are interested in opening a family restaurant at that location. They are interested in a beer license, but this will be only for their customers and the restaurant will only be open until 10:00 P.M. Industrial Revenue Bonds - Congress has acted on legis- lation that included some change in the regulations involving Industrial Revenue bonds. It doesn't affect the Wal -Mart bonds except for the period to issue bonds. The administra- tion has been contacted with a request to hold a public hearing on August 9; 14 days must be allowed for advertisement of the hearing. Also, it will be necessary to place an item on that agenda to consider designation of Baytown as an economically depressed area. Council was concerned with holding a public hearing and then considering an item to designate Baytown as an economically depressed area, because that could appear to those who appeared that Council was not giving due consideration to the matter. However, due to the time restraints, Council decided to conduct the hearing and include an item on the agenda to consider designating Baytown an economically depressed area. Council could always schedule a special meeting to consider the matter if necessary. 1984 Street Improvement Program - The contractor has begun work on the 1984 Street Improvement Program. Presently, the curb is being installed on Fleetwood. Rollingbrook Drive (West of Garth) - This project is about 96% complete, and the contractor should be able to give the city manager an idea of when the street will be completed next week. Mr. Lanham said that a ribbon cutting would be scheduled in accordance with Council's wishes and Council will be notified. Council requested that the area be in mint condition prior to the ribbon cutting. Rollingbrook Drive (East of Garth Road) - The contractor is installing the left turn lane, and the contractor will be shifting eastbound traffic to the new section. Drainage - On drainage work that is being performed by city crews, the project at Danubina and Fayle is about 55% complete. Sliplining - The contractor is working on Sunset. All the sliplining is complete and the contractor has 36 service connections to make. Bayway Drive /Baker Road Drainage - This project is about 98% complete. In response to an inquiry from Councilman Philips con- cerning the possibility of fencing the right of way along the Bayway Drive /Baker Road Drainage project, the adminis- tration will look into the possibilities, but this right of way belongs to the Harris County Flood Control District. The district has included hydro mulch in its contract for prevention of erosion. 40712 -3 Minutes of the Regular Meeting - July 12, 1984 Lift station Burnet Drive - The pump and motors have been ordered for several weeks, and construction will start on the North Burnet lift station on Monday, July 16. Special Legislative Session - During the special session, a number of bills were passed that affect cities. One bill broadens the sales tax provisions which will benefit municipalities, but at this point no one knows to what extent cities will benefit. The legislation also adopted laws changing regulations with regard to taxation of banks which amendment was necessary due to the lawsuit in Dallas County. House Bill 90 regarding unattended children in automo- biles was adopted; therefore, it may become necessary for the city to recind its ordinance if that ordinance is in conflict with state law. The legislation regarding child restraint was adopted. Legislation was also adopted that provided that the appraisal rolls must be delivered to appropriate entities within 30 days of the statutory deadline. This is the first year that the City of Baytown will be dependent on the appraisal district for its appraisal rolls. Since school districts need valuations earlier than cities, the staff feels that the appraisal district will have information available for budget purposes; however, the big question is whether the rolls will be ready in time to send tax statements on October 1. Status of bond market - In response to an inquiry from Council regarding the status of the bond market, Mr. Lanham stated that he had been in contact with the financial advisor who said that the rates are still high ranging from 10h% to 11%. In the budget preparation process, information is being developed for Council to use in making decisions on a bond sale. Councilman Simmons to Represent City - Councilman Simmons will represent the City of Baytown on Saturday as the City of Baytown's representative at the christening of the Exxon - Baytown tanker in Avondale, Louisiana. Tompkins Drive Slippage - A few weeks ago the consultant did tests on the ground, took soil samples and installed slope indicator tubes. The consultant has taken measures to establish some base line measurements. Next week the tubes will be checked to determine if there is any movement. If movement is indicated, the consultants will evaluate that movement and deliver the report along with a recommendation. However, if no movement is indicated, the consultants will continue to check until movement is indicated. Removal of tank - Mayor Cannon inquired concerning the removal of the remaining tank that was blown near the highway during Hurricane Alicia. The legal department is working on the problem. One more contact will be made before the city removes the tank. 40712 -4 Minutes of the Regular Meeting - July 12, 1984 The city manager commented that the City of Baytown has issued more than 35 new permits for drilling of oil wells in 18 months. Hold Public Hearings on Proposed Annexation of Cedar Trace Apartment Complex and /or Adjacent Property (7:00 p.m. and 7:15 p.m.) Mayor Cannon declared the public hearing on the proposed annexation of Cedar Trace Apartment Complex to be open. He informed those present that Texas law requires that two hearings on annexation be held. This hearing is the first of those two hearings. No request for an on site hearing was made; therefore, both hearings are to be held in the Council Chamber of the Baytown City Hall. Mayor Cannon allowed time for those present who desired to speak at the hearing to register. Since no one had signed the register, Mayor Cannon requested that Mr. Lanham describe the area to be annexed. The proposed annexation will consist of 41.33 acres of land, north of Baker Road, west of Garth Road and south of Houston Lighting and Power easement which is south of Lynchburg Cedar Bayou Road. Plans are to construct an apartment complex in this area. A service plan for this area is available on the registration table. This plan indicates that the City of Baytown plans to service this area with existing resources. There were no further comments or questions concerning the proposed annexation; therefore, Mayor Cannon declared the public hearing to be closed. Consider Proposed Ordinance, Deleting Paragraphs in the Subdivision Ordinance to Ensure that Townhouses Have at Least One Common Wall with another Unit to Conform with the Definition in Section 27 -33 (a) (i) The Planning Commission has recommended the deletion of paragraphs in the Subdivision Ordinance to ensure that town- houses have at least one common wall with another unit to conform with the definition in Section 27 -33 (a) (i). The administration concurred with that recommendation. Councilman Philips moved for adoption of the ordinance; Councilman Fuller seconded the motion. The vote follows: Ayes: Council members Philips, Simmons, Fuller and Dickens Mayor Cannon Nays: None ORDINANCE NO. 3899 All ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 27, "SUBDIVISIONS," BY AMENDING SECTION 27 -33 (b) (3), TO REQUIRE TOWNHOUSES TO HAVE AT LEAST ONE COMMON WALL WITH ANOTHER UNIT; REPEALING ORDIN- ANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PROVIDING A PENALTY CLAUSE; AND PROVIDING FOR THE PUBLICA- TION AND EFFECTIVE DATE HEREOF. 40712 -5 Minutes of the Regular Meeting - July 12, 1984 Consider Plans for Improvement of Signals at the Intersection of McKinney Road and North Alexander Drive The administration recommended that Council approve the plans of the highway department to improve signalization at McKinney and North Alexander Drive by providing for left turns off North Alexander onto McKinney. This matter has not been to the Traffic Commission because there has been no quorum to hold a meeting. Mayor Cannon commented that he would like for the state or the city to see that that area of roadway at North Alexander and McKinney is leveled. The highway department has notified the administration that in the fourth quarter of 1984, a contract will be let to construct the segment of Spur 201 from McKinney north to Cedar Bayou Bridge. Next year a contract will be let to construct the portion between Decker and McKinney. In response to an inquiry from Councilman Philips con- cerning the situation at Park Street and Decker where one is forced to make a blind turn, Bill Cornelius, Director of Planning and Traffic, said that that problem will be alleviated when the service roads are constructed for that area. Councilman Dickens moved to approve the plans for improvement of signals at the intersection of McKinney Road and North Alexander Drive; Councilman Simmons seconded the motion. The vote follows: Ayes: Council members Philips, Simmons, Fuller and Dickens Mayor Cannon Nays: None Hold Public Hearings on Proposed Annexation of Cedar Trace Apartment Complex and /or Adjacent Property (7:00 p.m. and 7:15 p.m.) Mayor Cannon declared the second public hearing on the proposed annexation of Cedar Trace Apartment Complex to be open, and he explained that the hearing was being held to receive public input on the proposed annexation. A register had been provided in the hallway, and the Mayor allowed time for any interested party to register to speak. He mentioned that a copy of the service plan was available on the table in the hallway. Since there were no signatures on the register, Mayor Cannon declared the public hearing to be closed. Consider Proposed Ordinance, Amending Urban Rehabilitation Standards Ordinance to Provide for Proper Maintenance of Apartment Complexes and to Add Definitions Council had discussed the proposed amendment to the Urban Rehabilitation Standards ordinance at a recent meeting, indicating that certain changes should be made. The proposed ordinance has been left blank where the annual fee is discussed. 40712 -6 Minutes of the Regular Meeting - July 12, 1984 Council had also discussed the possibility of allowing a 2 to 3 year period on new complexes prior to commencing in- spection, but the proposed ordinance does not address this. Therefore, if Council would like to include a provision such as this, the ordinance will need to be amended accordingly. The ordinance provides that all licenses will expire one year from the date of issuance. The ordinance also provides that the owner or owner representative report all trade names to the city, and there is a requirement that the license be displayed. The ordinance provides for a penalty of $1,000 since health, safety and welfare of citizens are involved. Herb McDonald, Executive Vice President of Gene Branscome Investments, spoke in opposition to the proposed ordinance. He made reference to information that had been provided to Council in June wherein Joe Bax, General Counsel of the Houston Apartment Association, had addressed the proposed ordinance. Mr. Bax pointed to state statues that regulate the apartment industry which he felt addresses all the concerns that are apparent in the proposed ordinance. Mr. McDonald stated that apartment complex owners pay their share of water, sanitary sewer connection fees, and taxes and in many other ways pay their fair share. He also pointed out that the ordinance does not address homes, townhomes or condominiums which may make the ordinance unconstitutional. Randy Strong, City Attorney, explained that the current provisions of the Urban Rehabilitation Standards Ordinance cover regulation of single family dwellings and numerous type of multi - family dwellings. Councilman Philips stated that he felt the ordinance would provide a measure of preventiveness to help Baytown keep its good image and prevent apartment complexes from becoming slums. In response to an inquiry from Council, Mr. Lanham ex- plained that when the ordinance was first discussed, the fee mentioned which would not cover the cost to provide inspection services was $1.00 per unit, with a minimum of $25.00 per multi - family dwelling which would produce about $7,400 yearly. Also, the city attorney, in response to Council, stated that although the ordinance would give the city the right to have each apartment in the city inspected, he felt that probably in practice a sampling would be made from each apartment complex throughout the year. Mr. Lanham stated that he felt this would require the hire of a full time person. Councilman Philips moved to adopt the proposed ordinance, including the fee of $1.00 for each apartment in the complex, with a minimum of $25.00 per multi - family dwelling. Councilman Fuller seconded the motion. The vote follows: Ayes: Council members Philips and Fuller Mayor Cannon Nays: Council members Simmons and Dickens 40712 -7 Minutes of the Regular Meeting - July 12, 1984 ORDINANCE NO. 3900 AN ORDINANCE AMENDING CH4PTER 33, "URBAN REHABILITATION STANDARDS," OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY ADDING A NEW ARTICLE VIII, "MULTI- FAMILY DWELLINGS "; REPEALING INCONSISTENT PROVISIONS; CONTAINING A SAVINGS CLAUSE; PROVIDING FOR A PENALTY OF $1,000.00; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. Consider Proposed Ordinance, Authorizing Signalization of Loop 201 at North Alexander at Two Locations The proposed ordinance pertains to the construction of service roads for Loop 201 on the east side of the city and will provide for signalization of the two northern intersections of Loop 201 with North Alexander. The first or south intersection is located between McKinney and Cedar Bayou Road. The second is located where Ferry Road presently intersects. The administration recommended approval of the ordinance. Councilman Dickens moved for adoption of the ordinance; Councilman Fuller seconded the motion. The vote follows: Ayes: Council members Philips, Simmons, Fuller and Dickens Mayor Cannon Nays: None ORDINANCE NO. 3901 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AUTHORIZING THE INSTALLATION OF TRAFFIC- CONTROL SIGNALS ON LOOP 201 AT STATE HIGHWAY 146 (EAST INTERSECTION) AND LOOP 201 AT STATE HIGHWAY 146 (WEST INTERSECTION); PROVIDING FOR THE APPROVAL OF AN AGREEMENT BETWEEN THE STATE OF TEXAS AND THE CITY OF BAYTOWN FOR THE INSTALLATION, CONSTRUCTION, EXISTENCE, USE, OPERATION, AND MAINTENANCE OF HIGHWAY SIGNAL PROJECTS AT THAT LOCATION IN THE CITY OF BAYTOWN; PROVIDING FOR THE EXECUTION OF SAID AGREEMENT; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRE- SCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND N01100 ($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. Consider Proposed Ordinance, Authorizing the Installation of Signals at the Intersection of Park Street and Baytown Avenue Exxon has requested authorization for installation of signals at the intersection of Park Street and Baytown Avenue to facilitate the safe movement of materials and equipment in the construction phase of the upgrading of the flexicoking unit. The signal will conform to all applicable city and state regulations. The control device will allow demand controlled operations of the signal while maintaining the city- approved timing sequence. The vote follows: Ayes: Council members Philips, Simmons, Fuller and Dickens Mayor Cannon Nays: None ORDINANCE NO. 3902 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, AUTHORIZING THE INSTALLATION OF TRAFFIC- CONTROL SIGNALS ON PARK STREET AND BAYTOWN AVENUE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND N01100 ($200.00) DOLLARS; AND PROVIDING, FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. Consider Proposed Ordinance, Awarding Contract for Widening of Garth Road at Lynchburg Cedar Bayou Road Award of this contract will provide for the installation of left turn lanes on Garth Road at Lynchburg Cedar Bayou Road. Four bids were received. Angel Brothers Enterprises, Inc. is low bidder for the amount of $79,970. The contract provides for 45 working days. The Administration recommended approval of the ordinance. Councilman Fuller moved to adopt the ordinance; Council- man Simmons seconded the matter. FOR THE WIDENING OF GARTH ROAD AT LYNCHBURG CEDAR BAYOU ROAD; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. For bid tabulation, see Attachment "A." The city manager mentioned that a temporary construction speed zone of 30 mph will be established and the contractor will need to utilize the outside lanes of traffic when per- forming shoulder work. 40712 -9 Minutes of the Regular Meeting - July 12, 1984 Consider Proposed Ordinance, Authorizing Final Payment for The Community Development Block Grant Program, Street and Drainage Improvements to Beech and Oakwood Streets The contractor, Buffalo Excavating and Paving Company, Inc. has completed the street and drainage improvements to Beech and Oakwood Streets in accordance with the plans and specifications for an underrun of approximately $5,000. The proposed ordinance authorizes final payment for the amount of $17,413.03. Payment will be made from Community Devel- opment funds. The administration recommended approval of the ordinance. Councilman Dickens moved for adoption of the ordinance; Councilman Simmons seconded the motion. FOR THE 1982 COMMUNITY DEVELOPMENT PROGRAM, STREET AND DRAINAGE IMPROVEMENTS TO BEECH AND OAKWOOD STREETS; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Consider Proposed Ordinance, Awarding Bid for Purchase of Tractor Bids were mailed to eleven vendors and five proposals were received. Trinity Valley Tractors submitted the low bid of $7,611.32. Case Power & Equipment submitted the low bid of $5,650. The administration recommended approval of the ordinance. Councilman Philips moved for adoption of the ordinance; Councilman Dickens seconded the motion. Consider Request of Ronald Ewell for Water Service at 5011 Sjolander Road Ronald Ewell, 5011 Sjolander Road, has requested water service to that location because his water well has become inoperable. Water service is available to that location. The administration recommended approval of the request. Councilman Fuller moved to approve the request of Ronald Ewell for water service to 5011 Sjolander Road; Councilman Dickens seconded the motion. The vote follows: Ayes: Council members Philips, Simmons, Fuller and Dickens Mayor Cannon Nays: None Consider Specifications for Bids on Bank Depository Each two years the administration brings specifications to Council before inviting bids on the city depository. The specifications are the same as those approved two years ago, except that last year there was a provision that if the law changed to allow banks to pay on demand accounts, the banks would do so. This year the administration is recommending that that provision be deleted since if the city includes interest be paid on demand accounts, this could possibly lower the interest that the banks will be willing to bid on time deposits.
