1983 04 05 CC Minutes, Special30405 -1 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN April 5, 1983 The City Council of the City of Baytown, Texas, met in special session on Tuesday, April 5, 1983, at 5:30 p.m. in the Council Chamber of the Baytown City Hall with the following attendance: Fred T. Philips Jimmy Johnson Perry M. Simmons Mary E. Wilbanks Roy L. Fuller Allen Cannon Emmett 0. Hutto Fritz Lanham Larry Patterson Randy Strong Eileen P. Hall Councilman Councilman Councilman Councilwoman Councilman Councilman Mayor City Manager Assistant City Manager City Attorney City Clerk The meeting was called to order with a quorum present and the following business was transacted: Consider Proposed Resolution, Canvassing Results of Municipal Election Held on April 2, 1983 Council canvassed the results of the Municipal Election held April 2, 1983, which reflected the following: FOR MAYOR (FROM CITY AT LARGE) Emmett 0. Hutto 1,209 votes Ted L. Kloesel 631 votes Allen Cannon 742 votes FOR COUNCILMAN DISTRICT NO. 2 Roy L. Fuller Joe Roeder, Sr. 1,652 votes 1 vote FOR COUNCILMAN DISTRICT NO. 3 Fred T. Philips Quitlan Carter 1,809 votes 571 votes FOR COUNCILMAN DISTRICT NO. 6 Mary Elizabeth Wilbanks 2,006 votes 30405 -2 Minutes of the Special Meeting - April 5, 1983 The City Clerk did note that during absentee voting eight (8) votes were cast by voters punching two cards. The problem was averted at the polling places by the judges placing a small number of cards out for voter selection. In response to an inquiry from Council, Mrs. Hall stated that if the eight votes would have been critical to the election, Council's only authority would be to act as a canvassing board. However, the candidates most affected by that critical vote could pursue the matter by filing a contest of the election. Councilwoman Wilbanks moved for adoption of Resolution No. 835; Councilman Johnson seconded the motion. The vote follows: Ayes: Council members Philips, Johnson, Simmons, Wilbanks, Fuller and Cannon Mayor Hutto Nays: None RESOLUTION NO. 835 A RESOLUTION CANVASSING THE RETURNS OF THE REGULAR MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 2ND DAY OF APRIL, 1983, FOR THE PURPOSE OF ELECTING A MAYOR FROM THE CITY AT LARGE AND THREE (3) COUNCILMEN FROM THE RESPECTIVE DISTRICTS NOS. TWO (2), THREE (3), AND SIX (6) TO SERVE REGULAR TWO YEAR TERMS; DECLARING THE RESULTS OF SAID ELECTION; FINDING THAT NOTICE OF SAID ELECTION WAS DULY AND PROPERLY GIVEN AND THAT SAID ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS. Administer Oaths of Office to Newly Elected Council Members Assistant Judge Roy Fuller administered oaths of office to the newly elected Council members -- Mary Elizabeth Wilbanks, Roy L. Fuller and Fred T. Philips. Consider Proposed Ordinance, Calling a Run -Off Election for April 23, 1983 Council had tentatively agreed that should a run -off election be necessary, the election would be held on Saturday, April 23, 1983. Since no candidate in the Mayor's race had received fifty -one (51%) percent of the votes cast for that race, the proposed ordinance provides for a run -off election between Mayor Hutto and Councilman Cannon. The Charter of the City of Baytown provides that a run -off election shall be held not less than 10 nor more than 20 days after the results of the regular election have been declared. Councilman Philips moved for adoption of the ordinance; Councilman Johnson seconded the motion. The vote follows: Ayes: Council members Philips, Johnson, Simmons, Wilbanks, Fuller and Cannon Mayor Hutto Nays: None 30405 -3 Minutes of the Special Meeting - April 5, 1983 ORDINANCE NO. 3590 AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD ON THE 23RD DAY OF APRIL, 1983, FOR THE PURPOSE OF ELECTING A MAYOR FROM THE CITY AT LARGE; PROVIDING FOR THE ELECTION OFFICERS; DESIGNATING THE PLACES AND MANNER OF HOLDING SAID ELECTION; PRESCRIBING THE HOURS; ESTABLISHING THE CENTRAL COUNTING STATION; PROVIDING FOR A SPECIAL CANVASSING BOARD FOR ABSENTEE BALLOTS; AND PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE. In connection with the run -off election, Mrs. Hall had presented a proposed list for ballot distribution which is attached to the minutes as Attachment "A."
