MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
November 22, 1982
The City Council of the City of Baytown, Texas, met in
regular session on Monday, November 22, 1982, at 6:30 p.m.
in the Council Chamber of the Baytown City Hall with the
following attendance:

The meeting was called to order with a quorum present
and the invocation was offered, afterwhich the following
business was transacted:

Councilman Philips moved for approval of the minutes for
the meeting held November 11, 1982; Councilman Johnson seconded
the motion. The vote follows:

Receive Petitions
The only petition received by the Administration is
covered by Item 13a on the agenda.
City Manager Report
Theft of Typewriters - The City Manager reported that
there had been a theft of ten (10) typewriters from the
City Hall over the weekend. It had been established that the
theft occurred after 4:00 p.m. on Saturday.
Butch Young Softball Tournament - Council had received
a petition requesting that a softball field at the Wayne Gray
Sports Complex be named for Butch Young. In lieu of that
some of the signers of the petition have suggested that a

softball tournament be named for Mr. Young and that the proceeds
from that tournament be utilized to establish a scholarship fund.
Christmas Parade - The City of Baytown Parks and Recreation
Department will host the annual Christmas Parade on December 2.
Line up will be at 5:30 p.m. and the parade will commence at
6:30 p.m. Council members will be contacted in this regard.
Craigmont /Ponderosa Water Line Replacement - The contractor
has completed approximately fifty -five (55 %) percent of the
contract. Most of the pipe is in the ground and the contractor
has begun cleanup in the subdivision. It is very difficult
to work this close to residences without causing some inconvenience
to the residents in the subdivision. The contractor's first
priority is to clean the mud off the streets.
Caldwell Street - The concrete portion of the street is
in place. The contractor is presently working on driveways
and the street should be open in a few days.
1982 Street Improvement Program - The contractor is
progressing on this project; however, on Aron Street city crews
were required to lower a water line so that the crown of the
street would not be too high. The contractor has been working
replacing curb and gutters. The old water line has been removed.
Glen Meadow Drainage Project - Work on this project will
begin after Thanksgiving.
Drainage - The drainage project on Cabaniss Street is complete.
Sliplining - The contractor working in the East Texas /Roseland
Oaks area has completed 2300 feet on East Texas and all the
eight inch line in Roseland Oaks. Work has begun in Roseland on
the 6 inch line. On the other sliplining project along Alexander
Drive, 87 feet of eight inch line has been completed and 275
feet remain on the east side of Alexander.
Questions and Comments of Council
Councilman Philips requested that the Administration check
the visibility at Highway 146 and Fayle (southeast corner), Highway
146 at Gulf and Highway 146 at Lobit.
Councilman Philips also commended the Street Department
for patching the potholes on Defee Street.
Councilman Cannon inquired if the drainage from the apart-
ment project on Nolan Road would add to the problems of an
already overloaded system. Norman Dykes, Director of Public
Works /City Engineer, stated that the Highway 146 system is
overloaded, but that area was included in the bond program for
improvements. Mr. Dykes indicated that the drainage profile
shows the run -off from that area going south and the total run -off
from the development would not affect the situation appreciably.
The ordinances concerning drainage state that development cannot
produce more water than normally could be expected from the
area in its original state.
Mr. Lanham did state that bonds should be sold as soon
as possible to get that drainage project underway.

Councilman Philips stated that he would be interested
in the cost to furnish fire protection service to county
residents and requested that the Administration calculate the
costs for 1982. He is interested in talking with the
county in terms of a formula which might reflect more
accurately the expenses involved with providing this service.
Receive ReAort of Clean City Commission
Leonard Stasney, Vice Chairman of the Clean City
Commission, reported that 1982 had been a very successful year
for the Commission. The report reflected that the city had
received $2.73 value for every dollar invested by the city
in the Clean City program. Four trash transfer days were
conducted which resulted in 200 tons of litter and garbage
being disposed. The schools have been involved with a
Clean Campus campaign and a pre - school kit has been developed
which has been used extensively by the kindergarten classes,
as well as nursery schools and day care centers. The Mayor's
Summer Job Program provided jobs for 17 youths and aided
the City of Baytown in the areas of litter removal, illegal
dump cleanup and park improvement. The photometric index
survey of litter accumulation indicates that the Clean City
Commission has achieved and sustained a sixty -one (61 %) percent
litter reduction since the program was certified by Keep
America Beautiful, Inc. in 1978.
Mr. Stasney ended his presentation by thanking Council
for its support and commending Jo Roosa, Clean City Coordinator,
for an excellent job.
Consider Proposed Ordinance, Establishing City of Baytown
Council Districts
The proposed ordinance was prepared based on the map
posted in the Council Chamber referred to as Revision II
and outlined in green. A copy of that map has been available
in the office of the Planning Department for 2 -3 weeks now.
A hearing was held to receive any input from citizens of
Baytown. No one elected to speak at the hearing. The
Administration recommended approval of the ordinance.

Consider Proposed Ordinance, Including Newly Annexed Territory
in Council District No. 2
The proposed ordinance will place the newly annexed property
in Council District No. 2. There are no people living in these
areas, but it is necessary that the areas be included in the proper
Council district. The Administration recommended adoption of
the ordinance.

Consider Proposed Ordinance, Second and Final Reading on
Annexation of West District Wastewater Treatment Plant
and I -10 Rest Stop
Public hearings were held on the proposed annexation of
the West District Wastewater Treatment Plant and I -10 Rest
Stop. No one appeared to express opposition. None of the
property in question is taxable property. The Administration
felt that it would be best to have the city's wastewater
facility inside the city limits and since the rest stop is
in very near vicinity to the facility that it too should
be annexed. The Administration recommended adoption of
the ordinance.
Councilman Simmons moved for adoption of the ordinance;
Councilman Fuller seconded the motion.
Councilman Cannon expressed some concern with policing
the rest stop and the problems that that area may present
with persons utilizing it for overnight use.
The City Attorney explained that this area is a rest
stop and not a city park; therefore, persons would be allowed
overnight usage. Mr. Lanham pointed out that the location
of the rest stop to the city facility would make it advantageous
to have that area inside the city limits. Councilman Philips
suggested that General Telephone be contacted with regard
to installing a telephone in the rest area. The vote follows:

Consider Proposed Ordinance, Authorizing Approval of Industrial
District Agreement with Stauffer Chemical Company
Approval of the proposed Industrial District Agreement with
Stauffer Chemical Company will conclude renewal of all industrial
district agreements for 1982. The next contract is due for
renewal in 1984. Payment under the formula will be $30,292.36.
The Administration recommended adoption of the ordinance.

ORDINANCE NO. 3514
AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY
OF BAYTOWN TO EXECUTE AND THE CITY CLERK TO ATTEST TO AN
INDUSTRIAL DISTRICT AGREEMENT WITH STAUFFER CHEMICAL CO. AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
Consider Proposed Ordinance, Authorizing Change Order No. 5
to Contract No. 2 with Naylor Industries, Inc. for Rehabilitation
of West District Sewage Collection System, Sewer Line Grouting
and Manhole Repair
The proposed change order involves extensive changes in the
contract, but does not represent a great amount of monetary change.
The original contract Included sewer line grouting, manhole repair
and other rehabilitation to the old sewer line, but did not include
extensive sliplining. The change order represents a change in
scope of work to slipline 18 line segments which was determined
to be the most cost effective method to rehabilitate the line.
Both Environmental Protection Agency and the Texas Department
of Water Resources have approved this major change which will
be eligible for seventy -five (75%) percent federal funding.
However, Mr. Lanham did point out that eighteen line segments
do remain that the two entities found would not be cost effective
to slipline; therefore, if the City of Baytown elected to do so,
the City would be responsible for payment. Approximately 6500
feet of sliplining was added to the contract, but a large amount
of repair work was deleted which results in a revised contract
amount of $313,423.35 versus the original contract amount of
$307,209.30. The Administration will be talking with Council in
the future about the 18 remaining line segments. The amount of
Change Order No. 5 is $6,214.65 which will conclude the Naylor
Contract. The Administration recommended approval.

ORDINANCE NO. 3515
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
AUTHORIZING CHANGE ORDER NO. 5 TO THE CONTRACT WITH NAYLOR
INDUSTRIES, INC. FOR REHABILITATION OF THE WEST DISTRICT
SEWAGE COLLECTION SYSTEM SEWER LINE GROUTING AND MANHOLE
REPAIR.
Discuss Proposed Sign Ordinance
Mr. Lanham explained that Council had been furnished
with a copy of a very lengthy document (proposed sign
ordinance) which was not in the final form for adoption
because the Administration needed to know if this document
contained what Council wanted in the form of a sign
ordinance.
Danny Jackson, Assistant City Attorney, was present
to answer any questions that Council might have. He
mentioned that the Administration would need guidance from
Council concerning the document. In response to an inquiry
from Council concerning wind velocity, Mr. Jackson explained
that the standards used in the ordinance are those set forth
in the Southern Standard Building Code. He also mentioned
that the Engineering Department had helped to develop
the ordinance.
Mayor Hutto stated that he could see that one or two
more employees would be needed to administer the sign
ordinance. Councilman Philips stated that the ordinance
should be developed so that permits for establishment of
signs would pay for administration.
Council scheduled a work session for December 9 at 5:00
p.m. to discuss the draft of the sign ordinance.
Rob Schmerier, public relations manager for Foster and
Kleiser, a billboard company that conducts business in
Baytown, appeared to state that basically the ordinance
being proposed is of good structure and is something that
would be good for the city to have. He mentioned that
signs fall into three categories (1) on- premises (2) off -
premises and (3) portable. He mentioned that if the city
had any areas designated as scenic or historical, his
company would certainly avoid placing signs in those areas.
One of the things that the ordinance would prohibit is
space extensions which would hurt the billboard business.
The extensions are temporary displays which help with a
campaign by emphasizing the product. Mr. Schmerier requested
that that particular provision of the draft ordinance
be adjusted to provide for space extensions for a temporary
period. He also pointed out that the city would have to
add personnel to administer this ordinance.
The draft ordinance provides for 20 foot setback for
billboards in areas where the building line is closer. Mr.
Schmerier requested that Council not single out billboards
for special setbacks. He endorsed the spacing provisions
that are proposed in the draft ordinance and stated that
the spacing is similar to that of other areas. Mr. Schmerier
mentioned that the ordinance requires that when application

is made to construct a sign, an affidavit must be presented to the
Inspection Department verifying that the company has a valid lease.
He had no problem with this procedure, but did have a problem
with the fact that after three years, another affidavit is
required from the landowner. In many cases, it is difficult
for the company to have a new affidavit executed by the owner.
The owner may be absentee and checks for lease of the property
are forwarded. He suggested that an affidavit from the company
should be acceptable after the initial affidavit of the landowner.
The height limit listed in the draft ordinance met with
Mr. Schmerier's approval with the exception of elevated roadways.
He stated that the ordinance would need to be amended to provide
for erection of signs on elevated roadways or perhaps a waiver 11"NI
process could be included.
Mr. Schmerier stated that he felt the provision of the
ordinance that provided once a sign was removed, the sign could
not be rebuilt would encourage vandalism. He also felt that
the provision which dealt with the removal of a sign after
non - compliance for six years was unjust. He felt that the company
should be given just compensation for the sign.
Mr. Schmerier felt that it is very important that
organizations within the community are made aware of the proposed
ordinance, especially the Chamber of Commerce. Another represen-
tative of a sign company stated that he would like to talk with
Council concerning the draft ordinance. Council suggested that
he obtain a copy of the ordinance and arrange to meet with the
attorneys to discuss the various provisions.
Consent Agenda
Councilman Philips had an inquiry concerning Item 13a,
abandoning portion of right of way for North Second Street.
The Administration explained that when the owner of the
property had the property surveyed to sell, he discovered
an encroachment of about five feet into the right of way.
Second Street right of way is a dead end street and no further
development is expected in that area. The owners have agreed
to pay the $350 appraised value.
Council considered the consent agenda as follows:
a. Proposed Ordinance No. 21122 -8, will abandon a
portion of right of way for N. Second Street. As
previously mentioned we have received a petition
signed by eight individuals requesting the abandonment
of this right of way. Enclosed in the agenda
packet is a copy of that petition as well as a map
of the area to be abandoned. Individuals who
signed the petition are the abutting property
owners. All utility companies have been contacted
and report no objections to this abandonment.
We recommend approval of Proposed Ordinance No.
21122 -8.

b. Proposed Ordinance No. 21122 -9, will award the bid
for a rotary cutter, flail mowers and box blade.
We received six bids on each of the three items.
Regarding Item no. 1, the rotary cutter, Jim Ball
International submitted the low bid which meets
specifications at $1,914.20. Regarding Item No.
2, the course cut flail mower, Jim Ball International
and Lansdowne -Moody submitted the same bid of
$6,243.00. Jim Ball International indicates a
delivery time of 30 days while Lansdowne -Moody
indicates a delivery time of 60 days.
In reference to Item No. 3, the low bid that met
specifications was submitted by Jim Ball International
for the sum of $1,168. The total of the three
bids is the sum of $9,325.20. Council has budgeted
$10,000 for the purchase of these items.
We recommend the low bidder, Jim Ball International
be awarded the bids in regards to the rotary
cutter, the flail mowers and the box blade.
C. Proposed Ordinance No. 21122 -10, will award the
bid for the purchase of industrial tractors. We
received seven (7) bids. The low bid which met
specifications was the bid of Trinity Valley
Tractor for the sum of $20,669. Council has
budgeted $24,000 for this purchase.
We recommend the low bidder, Trinity Valley
Tractor, be awarded this contract.
d. Proposed Ordinance No. 21122 -11, will award the
bid for the purchase of community building furniture.
This bid consisted of two items. Item No. 1 was
250 stackable Chairs and Item No. 2 was 10 Table
Trucks. Concerning Item No. 1, the low bid was
the bid of Matherne's for the sum of $5,787.50.
In regards to Item No. 2, neither bid met specifications.
They bid on a removable handle while our specifi-
cations indicated a non - removable handle.
We recommend on Item No. 1 the low bidder, Matherne's
be awarded this contract, and on Item No. 2 we
recommend that this item be rebid.
e. Proposed Ordinance No. 21122 -12, will award the
bid for the purchase of selective herbicides. We
received eight (8) bids. Houston Spraying &
Supply, Inc. submitted the low bid of $12,088.
Council has budgeted $12,500 for this purchase.
We recommend the low bidder, Houston Spraying &
Supply, Inc. be awarded this contract.

f. Proposed Ordinance No. 21122 -13, will award the
bid for the purchase of a 1/2 ton pickup truck
for the Parks and Recreation Dept. Nine (9) bids were
received. Bayshore Toyota submitted the low bid
of $7,069. Council has budgeted $8,000 for this
purchase.
We recommend the low bidder, Bayshore Toyota, be
awarded this contract.
g. Proposed Ordinance No. 21122 -14, will award the
bid for the purchase of a tractor and long reach
boom mounted hydraulic mower. Ten (10) bids were
received. The low bid which met specifications
was submitted by Hyco Equipment, Inc. for the
amount of $30,585. Council has budgeted $30,000
for this item.
We recommend the low bidder Hyco Equipment, Inc.
be awarded this contract.
h. Proposed Ordinance No. 21122 -15, will award the
bid for the purchase of a striping machine. Four
(4) bids were received. The low bidder which met
specifications was Roadrunner Traffic Supply for
the amount of $3,245. Council budgeted $3,000 for
the purchase of this striping machine.
We recommend the low bidder Roadrunner Traffic
Supply be awarded this contract.
i. Proposed Ordinance No. 21122 -16, will award the
bid for the purchase of a four door sedan for the
Inspection Dept. Ten (10) bids were received.
Bob Robertson Chevrolet submitted the low bid of
$6,327.21. Council budgeted $7,500 for the purchase
of the vehicle.
We recommend the low bidder Bob Robertson Chevrolet
be awarded this contract.
j. Proposed Ordinance No. 21122 -17, will award the
bid for the purchase of soft body armor. We
received three (3) bids. The low bid which met
specifications was that of Longhorn Police Supply.
Longhorn's bid indicates a range of prices varying
on size and whether it is male or female soft body
armor. Council has budgeted the amount of $4,000
for the purchase of this type of equpment during
fiscal year 82 -83.
We recommend the low bidder, Longhorn Police
Supply, be awarded this contract.

Councilman Philips moved to adopt the Consent Agenda
Items a through j; Councilman Cannon seconded the motion.
In response to an inquiry from Council, Pat Tobin,
Director of Finance, stated that the local auto dealerships
have failed to bid on several items and this could be
happening because the larger dealers have more staff to
handle bidding and the capability to make a profit. The
vote follows:

BY THE CITY OF BAYTOWN OF THE SUM OF TWELVE THOUSAND EIGHTY

Councilman Fuller moved to appoint Bob Boyd to the
position of homebuilder on the Urban Rehabilitation Standards
Review Board; Councilman Johnson seconded the motion. The
