1982 11 11 CC Minutes21111 -1 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN November 11, 1982 The City Council of the City of Baytown, Texas, met in regular session on Thursday, November 11, 1982, at 6:30 p.m. in the Council Chamber of the Baytown City Hall with the following attendance: Fred T. Hall Councilman Councilman Councilman Councilwoman Councilman Councilman Mayor City Manager Assistant City Manager City Attorney City Clerk The meeting was called to order with a quorum present and the invocation was offered, afterwhich the following business was transacted: Minutes Councilman Johnson moved to adopt the minutes for the Council meeting held on October 28, 1982; Councilman Simmons seconded the motion. The vote follows: Ayes: Council members Philips, Johnson, Simmons, Wilbanks, Fuller and Cannon Mayor Hutto Nays: None Receive Petitions There were no petitions presented, other than the petition related to Item No. 5 on the agenda. City Manager's Report Work Session - Council scheduled a work session for November 22, 1982 at 5 :30 p.m. with Pacer Development Company to discuss the formation of one or more municipal utility districts in the vicinity of San Jacinto Mall. Sign ordinance - The Legal Department has completed the draft of a very long sign ordinance which has been styled after the City of Houston ordinance. The Administration will forward a copy of that proposed ordinance to Council in advance of the November 22 meeting so that Council will have ample time for review. There will be an item on the agenda for November 22 to discuss the proposed ordinance. 21111 -2 Minutes of the Regular Meeting - November 11, 1982 Houston Lighting and Power Rate Request - Randy Strong, City Attorney, reported that from information which he had received, the hearing examiner had recommended an increase of about $188,000,00. The examiner was present throughout all hearings and reviewed all the documents filed. That report will be presented to the Commission for a final determination. The Commission does have the right to overrule the hearing examiner's recommendation and grant another figure. The Commission has overruled the examiner in other cases, but for the most part, the Commission normally abides by the recommendation of the hearing examiner. However, because of some of the issues involved in this case, the Commission may change some of the recommendations, for instance the treatment of the Allen's Creek Project. The $188,000,000 increase should be compared to the cities' recommendation of $181,000,000 (this figure includes no allowance for Allen's Creek Project), and the recommendation of the PUC staff of $191,000,000 without an allowance for Allen's Creek. The hearing examiner has allowed $200,000,000 to be written off on the Allen's Creek Project which is to be written off over a ten -year period. Therefore, the $20,000,000 will be included for this year. Without seeing the report, the City Attorney was uncertain if the $188,000,000 figure included the $20,000,000. The City Attorney should be receiving a copy of the hearing examiner's report within a day or so and will be able to give more complete information at that time. Halloween Carnival - The City of Baytown P Department sponsored a halloween carnival which Approximately 3,000 people participated in this plans are to expand this event in future years. this will become an event where people can take as an alternative to trick or treat activities. arks and Recreation was very successful. event and Hopefully, their children 1982 Street Improvement Program - This contract is seventy -five (75 %) percent complete. Caldwell Street - The contractor on this project has completed pouring the concrete street; however, the street is not open for traffic yet. It should be open in a few days. Ponderosa /Craigmont Water Lines - The contractor has completed about fifty -five (5576) percent of the work on this project. Sliplining - The sliplining contractor who is presently working along Alexander Drive has completed installation of about 1400 feet; about 360 feet of 8 -inch liner remains to be completed from the East side of Alexander Drive to Tenth Street. The Administration expects that to be completed by the end of November. On another sliplining project, approximately 1950 feet on East Texas Avenue from Alexander Drive east has been completed and about 350 feet remains to be sliplined in this area. After that is completed, this contractor will begin to work in Roseland Oaks. Drainage - Cabiness Street drainage work is about ninety - eight (98%) percent complete; McKinney ditch near South Main is completed; Katherine Street is about thirty -five (35 %) percent complete and Glen Meadow Subdivision drainage project is on the agenda for award of a contract. 21111 -3 Minutes of the Regular Meeting - November 11, 1982 Questions and Comments of Council In response to an inquiry concerning the street sweeper, Gary Balmain, Assistant Director of Public Works, reported that the street sweeper is presently operating between 2:00 a.m. and 7:00 a.m. on the thoroughfares. Councilman Philips stated that he could see some of the results on the main thoroughfares, but one area that he noticed that needed more work is along West Main near Peoples Bank. Councilman Johnson stated that he has recently received two complaints on the cablevision, but Air. Johnson had just reported that problems are being resolved. Mr. Lanham responded that he had been receiving fewer calls in the last two months, but he would contact the company with regard to these two complaints. Councilman Cannon inquired if there were any plans concerning Nolan Road since this street is being damaged by the work being performed at the site of the apartments. Mr. Lanham stated that both the contractor and the city have placed fill in the bad places. Councilman Cannon inquired why the original plans included the rebuilding of Nolan Road with an extra lane and then after the developer had to include more parking area, the plans no longer included this. Mr. Lanham pointed out that there is no requirement that the developer do this. Bill Cornelius, Director of Traffic and Planning, verified that there were objections to the three lane street by residents of the area; therefore, the developer omitted the improvement. Councilman Cannon also inquired concerning drainage for this project. Norman Dykes, Director of Public Works /City Engineer, stated that the plans call for retention in parking lots. During construction, there are no drainage requirements to be met; however, the completed project must meet drainage requirements. Councilman Cannon explained that next to Mr. Hobbs' house where there is a ridge going down there, that will dump water from that onto that fence and all the way in back of those two houses. Mr. Dykes stated that the plans which had been approved should not dump water onto any other property. All the water would be retained on that site and would pass through a pipe to travel on. Councilman Cannon suggested that Mr. Dykes review these plans again to be certain. Consider Proposed Ordinance, Approval of Industrial District Contract with U. S. Steel Corporation The Industrial District Contract which was submitted to U. S. Steel Corporation has been properly executed. The contract is consistent with the Industrial District Policy adopted by City Council. The Administration recommended approval of the contract. 21111 -4 Minutes of the Regular Meeting - November 11, 1982 Councilman Philips moved for adoption of the ordinance; Councilman Fuller seconded the motion. The vote follows: Ayes: Council members Philips, Johnson, Simmons, Wilbanks, Fuller and Cannon Mayor Hutto Nays: None ORDINANCE NO. 3499 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF BAYTOWN TO EXECUTE AND THE CITY CLERK TO ATTEST TO AN INDUSTRIAL DISTRICT AGREEMENT WITH U. S. STEEL CORPORATION AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Consider Proposed Ordinance, Amending Section 17 -2(4) of the Code of Ordinances, "Firearms, and Target Ranges" to Provide for Certificate of Approval Issued by a Military Reserve or Junior Officer Training Corps Program The present ordinance requires that firearms and target ranges in order to be certified must have instructors who are certified by the Texas Commission on Law Enforcement Officers Standards and Education or National Rifle Association Certified Firearm instructors. This ordinance would amend that provision to include instructors that are certified by the Commandant of of Marine Corps. This is primarily for the ROTC Units at the two high schools. The Administration recommended approval of the ordinance. Councilman Johnson moved for adoption of the ordinance; Councilwoman Wilbanks seconded the motion. The vote follows: Ayes: Council members Philips, Johnson, Simmons, Wilbanks, Fuller and Cannon Mayor Hutto Nays: None ORDINANCE NO. 3500 AN ORDINANCE AMENDING SECTION 17 -2, "FIREARMS AND TARGET RANGES" OF THE CODE OF ORDINANCES PROVIDING FOR AFFIRMATIVE DEFENSES; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Consider Proposed Ordinance, Authorizing Removal of Signals Decker Drive at Baytown Olefins Plant and Authorizing Placement of Stop Signs Council, at a previous meeting had authorized the placement of signals on Decker Drive at the Olefins Plant on flashing as a trial period to determine if the signals were needed. The proposed ordinance would remove the signals and authorize the installation of stop signs. 21111 -5 Minutes of the Regular Meeting - November 11, 1982 Mayor Hutto recognized Duane Pugh, representative of the Baytown Olefins Plant, who expressed the desire of the Olefins Plant to retain the flashing signals to be used in conjunction with the stop signs as an extra measure of protection for the approximately 400 daily workers of the plant. Mr. Lanham explained that the Administration would install a red flashing light on the Olefins plant side and flashing amber on Decker Drive side if this is Council's desire. He pointed to the fact that there would still be the need for Council to authorize the installation of the stop signs for Baytown Olefins at Decker Drive. Councilman Philips moved to adopt the ordinance providing for the removal of the signals on Decker Drive at the Baytown Olefins Plant and making a stop intersection for Baytown Olefins Plant entrance at Decker Drive and flashing lights be installed at that location. Councilman Cannon seconded the motion. The vote follows: Ayes: Council members Philips, Johnson, Simmons, Wilbanks, Fuller and Cannon Mayor Hutto Nays: None ORDINANCE NO. 3501 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS PROVIDING FOR THE REMOVAL OF THE SIGNALS ON DECKER DRIVE AT THE BAYTOWN OLEFINS PLANT AND MAKING IT A STOP INTERSECTION; REPEALING CONFLICTING ORDINANCES; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED & N01100 ($200.00) DOLLARS FOR THE VIOLATION THEREOF; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. Consider Granting Approval for Pacer Development to Place Trees Within the Right of Way of Texas Avenue Council had been furnished with a copy of a letter from Dan Sharp, representing Pacer Development, requesting that the company be permitted to place trees in containers within the right of way of Texas Avenue in the immediate vicinity of the old Sears building. The company has agreed to indemnify the city. The City Attorney has reviewed the proposed indemnification agreement which meets with his approval. The Administration recommended approval of this request. Councilman Fuller commended the company for its beautification efforts in that area and moved to grant approval for Pacer Development to place trees within the right of way of Texas Avenue in the vicinity of the old Sears building. Councilwoman Wilbanks seconded the motion. The vote follows: 21111 -6 Minutes of the Regular Meeting - November 11, 1982 Ayes: Council members Wilbanks, Fuller Mayor Hutto Nays: None Philips, Johnson, Simmons, and Cannon Hold Public Hearing on Proposed Redistricting Plan for City Council Districts (7:00 p.m.) Mayor Hutto called the public hearing to order and allowed ample time for those in attendance who desired to testify at the hearing to sign the register provided in the hallway. No one had indicated a desire to speak. Dina Stucker, Transportation Planner for the City of Baytown, explained that the maps posted in the Council Chamber represented the existing Council districts, as well as Revision II which is the plan being recommended by the Administration as the one that most closely complies with census data. Also, Revision II provides for close to equal population and fairly compact configuration. Fritz Lanham, City Manager, explained that the plans have been available for public inspection for several days and there has been newspaper advertisement, setting forth the public hearing schedule, as well as the fact that the plans were available for inspection. No one has been in to review those plans. Mr. Lanham emphasized that the Administration felt that Revision II is the most compact arrangement which provides for the preservation of most census information and falls within the ten (10%) percent deviation with regard to population. District No. 6 contains the smallest population (8,944) because that is the district with the most anticipated growth. District No. 2 is the largest district with 9,778 population. All other districts fall within those two population limits. There was no one present who desired to speak. Mayor Hutto declared the public hearing to be closed. The Administration will include an item for Council consideration on the agenda for November 22. Consider Request of Goose Creek Ski Club for City of Baytown to Request Corps of Engineers' Permit for Dredging Councilwoman Wilbanks had requested that the Administration report to Council concerning sanitary sewer system leaks that have occurred in the vicinity of Goose Creek over the past 3 -4 weeks. Mr. Lanham reported that over the past 3 -4 weeks there has been a leaking manhole near the West Texas Avenue bridge which has since been repaired. An old line that was taken out of service in the early 70's became unplugged and was discharging sewage into the creek. There was a power outage at the Texas Avenue lift station for a few hours that contributed to the count, as well as the failure in the controls at the Craigmont lift station. These are some of the kind of problems that will develop from time to time. The Administration could give no assurance that similar types of problems will not occur in the future. There are over 40 lift stations in Baytown and there will be sewer leaks from time to time. The Administration does make 21111 -? Minutes of the Regular Meeting - November 11, 1982 every effort to prevent these type problems and once problems of this nature are discovered, appropriate repairs are made. These type situations contribute to the choloform level of the creek. There are other factors which also contribute to that, some of which the Administration has little or no control over. For one thing, Goose Creek Watershed is quiet large and covers an extensive area outside the city limits of Baytown. There are two wastewater treatment plants outside the City limits that discharge into the creek, plus a number of homes that are served by septic tanks. There is run off from farm lands, stock pens, streets, roadside ditches, etc. Another factor that contributes to the pollutants in the stream is that this is not a flowing stream; therefore, it is not flushed out except in the event of heavy rain. The temperature can change pollution levels. Mr. Lanham reported that he had a number of reports covering a two year period which reflect a great amount of variation in choloform levels. This indicates that this is the type stream where there will continue to be a great amount of change in the chloform levels. The City has been requested to act as sponsor for application to the Corps of Engineers for the ski club to dredge the stream and build structures to be used for skiing. Mr. Venegas has indicated that the city will not be asked to expend any money, either in terms of engineering that might be necessary for the application, nor for the cost of dredging or other improvements that would be needed. Mr. Lanham pointed out that in reviewing the document furnished by the Corps of Engineers for making application, he could find no prohibition against private interests making application for Corps of Engineers permit. However, the Corps has advised Mr. Vanegas that it would be better for a municipality or corporation to make the application. Mr. Lanham stated that it would be fair to state that there is some public interest to be served by Goose Creek being used as a recreation area, but there are risks inherent with the city being the permittee: 1. The question of limiting the use of a public body of water to ski club members. 2. The question of ownership of subsided land. 3. The possibility of erosion of shorelines caused by the wakes that might be created by the ski activities 4. The close proximity of the cemetery to the proposed ski area. 5. The question of safety of the water for contact sports. Would the public look to the city to solve these and other problems related to this activity? 21111 -8 Minutes of the Regular Meeting - November 11, 1982 Council expressed a general concern with liabilities that the city may face as sponsor of the application before the Corps of Engineers. Mayor Hutto suggested that Mr. Vanegas' group make application on its own before the Corps of Engineers and then if the Corps requested a definite commitment on the part of the City of Baytown in the form of a letter or resolution, Mr. Vanegas could come back to Council. Councilman Fuller stated he appreciated the interest that the group had shown in the area and felt that this was a very positive approach to an area that could be an asset to the city. Councilman Philips stated that he could subscribe to what Councilman Fuller was saying as long as the project did not become a financial burden to the City of Baytown. Mr. Vanegas addressed water quality of the stream and stated that he hoped that the two issues could be kept separate. He suggested that the City of Baytown continue to work with the Texas Water Resources Board in an attempt to change the ill repair of the drainage system along Goose Creek. He mentioned that representatives of the Texas Water Resources Board had indicated that they would be making a trip, by boat, up Goose Creek as far as possible to inspect city facilities. Mayor Hutto requested that Mr. Vanegas let Mr. Lanham know the desire of the Corps of Engineers with regard to the application. Hold Public Hearing on Application for Beer On- Premise License at 1228 Harbor Street (7:30 p.m.) Mayor Hutto called the public hearing to order and notified all those in attendance who desired to testify that a register had been provided in the hallway. Mayor Hutto administered the oath to those desiring to testify. Afterwhich, Mr. J. M. Rodriguez was recognized. Mr. Rodriguez explained that in consideration of the Cirelli family, he had made application for beer on- premise license which provides for a 12 o'clock closing. He stated that this business and the other alcoholic beverage establishments which he owns are not his main livelihood, but it was necessary to maintain the business in order to take care of his indebtedness on the building. Mr. Rodriguez acknowledged that there have been disturbances in the form of shots being fired at the Sports Hall, but these type problems exist when one is in this type business. He mentioned that he had expended $15,000 toward remodeling of the section of the building to be used as the Sports Center and that he had decided to reopen the building because it was deteriorating. He had attempted to use another door, but the Alcoholic Beverage Commission had advised him that according to their regulations, he would not be allowed to do this. Mr. Rodriguez reminded Council that beer had been sold on that street for as long as he could remember. He mentioned that he had considered building apartments at that location, but in that vicinity there would be few prospects. Mr. Michael A. Cirelli stated that what he had to say for the most part was furnished in the petition, but he would speak to the fact that Mr. Rodriguez claimed to have expended $15,000 toward refurbishing of the structure. He stated that Mr. Rodriguez 21111 -9 Minutes of the Regular Meeting - November 11, 1982 really didn't have to expend any money, because Mr. Cirelli had spoken to him when the remodeling began and told him that if he intended to put another bar at that location, he would protest. Mr. Cirelli explained that he had been trying to get something done for two years, but was told that the only time anything could be done would be at the point of application for license. Mr. Cirelli explained how his family had to leave the television on until early morning hours in order to sleep. He stated that the situation with the patrons of the bar urinating in the alley became so bad, that he, at his own expense, closed off the alley. Mr. Cirelli stated that perhaps conditions at the bar would be better if Mr. Rodriquez ran the operation himself, but this was not the case. Past managers have been slow to call the police in the event of disturbance and in the not so distant past, a man was shot and killed at the Sports Hall. Mr. Cirelli ended his presentation by pleading to Council for justice. He explained that both he and his wife were under a doctor's care and problems with the bar being located there continue to escalate. Since there were no others present who desired to testify, Mayor Hutto declared the public hearing to be closed. Councilman Simmons moved to recommend that the application for Beer On- Premise License be denied; Councilman Johnson seconded the motion. The vote follows: Ayes: Council members Philips, Johnson, Simmons, Wilbanks, Fuller and Cannon Nays: None Abstained: Mayor Hutto Consent Agenda In response to an inquiry from Council, the Administration explained that at the request of the school no parking restrictions on the east side of North Fourth between East James and East Wright Avenues was brought to the attention of the Traffic Commission. The commission recommended removal of the no parking restrictions. The property at 150 Mapleton is not the demolition contract on which the contractor reneiged; however, the City Manager and City Attorney had been discussing what might be done to encourage bidders on these projects to be certain of performance of the contract prior to bidding. The possibility of requiring a Cashier's Check for a certain percentage of the contract was discussed. The city would hold the Cashier's Check until all work was satisfactorily completed and should the contractor reneige on the contract, the Cashier's Check would be deposited to the General Fund. Councilan Philips suggested that on certain of these projects, the city may want to include several items of work, along with the demolition. 21111 -10 Minutes of the Regular Meeting - November 11, 1982 Mayor Hutto inquired if perhaps Council would want to remove Item J, the resolution expressing City Council's opposition to automatic fuel pass through, and forward the resolution after January to the new Governor. Councilman Philips suggested that the resolution, not only be forwarded to the Public Utility Commission, but to Governor -Elect White. Council considered the Consent Agenda as follows: a. Proposed Ordinance No. 21111 -4, will establish school bus loading zones for the St. Joseph Elementary and Junior Schools. This ordinance would establish the following zones: 1. On Carolina Street - northside from a point 478' east of its intersection with Kentucky Street for a distance of 120 feet. 2. On Virginia Street - southside 100' west of its intersection with New Jersey. 3. On New Jersey - 41 ' east of its intersection with Virginia. These zones to be in effect between: 7:15 a.m. and 8:30 a.m. 2:15 p.m. and 3:45 p.m. School Days Only. This is a recommendation of the Traffic Commission. We recommend approval of Proposed Ordinance No. 21111 -4. b. Proposed Ordinance No. 21111 -5, will establish speed zone for the San Jacinto Elementary. This ordinance will establish a 20 mph school speed zone between the hours of 7:15 a.m. to 9:15 a.m., and 2:00 p.m. to 4:00 p.m. on School Days. The areas in which this school speed zone will apply are as follows: 1. Virginia Street - 125' west of Georgia to New Jersey. 2. New Jersey - from Virginia to W. Main. 3. Georgia - 150' south of Kentucky to 125 feet north of Virginia. This is a recommendation of the Traffic Commission. We recommend approval of Proposed Ordinance No. 21111 -5. 21111 -11 Minutes of the Regular Meeting - November 11, 1982 C. Proposed Ordinance No. 21111 -6, will remove the No Parking restrictions on the east side of North Fourth between East James and East Wright Avenues. This is a recommendation of the Traffic Commission. We recommend approval of Proposed Ordinance No. 21111 -6. d. Proposed Ordinance No. 21111 -7, will award the contract for the demolition of structures at 150 Mapleton. Five bids were received. Reginald Cook, General Contractor, submitted the low bid of $1,225. Mr. Cook called and requested that his bid be withdrawn. The second low bidder is the bid of Frank Lockhart for the sum of $2,750. The Urban Rehabilitation Standards Board recommends this contract be awarded to Frank Lockhart. e. Proposed Ordinance No. 21111 -8, will award the contract for the demolition at 1110 Harbor. Five bids were received. A & B Home Improvements submitted the low bid of $6,250.75. The Urban Rehabilitation Standards Board recommends the contract be awarded to the low bidder, A & B Home Improvements. f. Proposed Ordinance No. 2111 -9, will award the contract for the Glen Meadow Subdivision Drainage Improvements and add an alternate 6 inch water main. Thirteen bids were received. Tidal Construction submitted the low bid of $112,081.50. This is broken down with a base bid of $105,331.50 and an alternate bid of $6,750. We recommend the low bidder, Tidal Construction be awarded this contract. g. Proposed Ordinance No. 21111 -10, will award the contract for the 1982 -83 Sanitary Sewer Sliplining Phase I. Five bids were received. Channel Contruction Co., Inc. submitted the low bid of $19,800. We recommend the low bidder, Channel Construction Co., Inc. be awarded this contract. h. Proposed Ordinance No. 21111 -11, will award the contract for Sanitary Sewer on Garth Road (East Side) from the lift station to 750 feet south. Six bids were received. McKinney & James Co., Inc. submitted the low bid of $23,675.40. We recommend the low bider, McKinney & James Co., Inc. be awarded this contract. 21111 -12 Minutes of the Regular Meeting - November 11, 1982 i. Proposed Ordinance No. 21111 -12, will authorize the final payment for 10 inch sanitary sewer at I -10 and Thompson Road. The Engineering Department has inspected this project and it has been installed in accordance with the plans and specifications. The amount of the final payment is $34,450. The developer for Love's Truck Stop funded this project. We recommend approval of Proposed Ordinance No. 21111 -12. J. Proposed Resolution No. 821, will express the City Council's opposition to the automatic fuel pass through. k. Proposed Resolution No. 822, will declare that the City of Baytown no longer desires to maintain a fire station, public meeting hall or business office at 6105 Bayway Drive. This action will release the ownership of this property to its original owners. We recommend approval of Proposed Resolution No. 822. Councilman Philips moved to adopt the Consent Agenda, Items "A" through "K"; Councilman Simmons seconded the motion. JOSEPH SCHOOL; CONTAINING A SAVINGS CLAUSE; PROVIDING A REPEALING CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND N01100 ($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. (Proposed Ordnance No. 21111 -4) ORDINANCE NO. 3503 AN ORDINANCE ESTABLISHING SCHOOL SPEED ZONES FOR SAN JACINTO ELEMENTARY; CONTAINING A SAVINGS CLAUSE; PROVIDING A REPEALING CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND N01100 ($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF.
