MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
January 8, 1981
The City Council of the City of Baytown, Texas, met
in regular session on Thursday, January 8, 1981, at 6:30
p.m. in the Council Chamber of the Baytown City Hall with
the following members in attendance:

The meeting was called to order, Mayor Hutto announced
a quorum to be present, and the invocation was offered by
Councilman Philips.

Councilman Johnson moved for the approval of the
minutes for the meeting held December 8, 1980; Councilman
Philips seconded the motion. The vote follows:

City Manager's Report
Building Activities Report - The Administration called
the Council's attention to a 20 -year report of Building
Inspection activities. In 1980, the City of Baytown issued
342 residential permits and prior to 1980, the most permits
issued were 300. In terms of residential start and total
value of construction in the city, 1980 is the best year that
the City of Baytown has experienced. This is not the case in
other parts of the country. Residential starts in Texas were
down 18% below the previous year and nationwide, they were
down 30%. Baytown continues to be an economically healthy
city.
West District Sewer Treatment Plant - Council has
10 approved plans and specifications for the West District Sewer
Treatment Plant. The city has been authorized by the state
and federal government to proceed with bids; therefore, the
Administration will be advertising to receive bids on Feb-
ruary 19, 1981. The bids will be presented to Council at
the first meeting thereafter.

Baker Road Project - The Administration has been in contact
with Commissioner Fonteno's office. The plans for Baker Road
project are now in the County Engineer's office and the county
expects to receive bids on that project in late February.
Public Utilities Regulatory Policies Act - Randy Strong,
City Attorney, explained that the public hearing that Council
had at the last meeting was for the purpose of having evidence
presented as to the various standards for gas utilities and
electric utilities. Although there were some time require-
ments concerning the hearings, there is no pressing time require-
ment to make determinations as long as the Council does so
before next November.
The Administration is recommending that the Council go
ahead and adopt the standards for the utilities as approved
by the Public Utilities Commission and the Railroad Commission.
The Railroad Commission has already acted on standards for
gas utilities; therefore, Council could adopt those standards.
The Public Utilities Commission will be holding PURPA hearings
in March and will probably within a month or two thereafter
make its determinations. Council has the option to wait for
that determination, hold another hearing to enter those findings
and evidence, and then make a decision. Mr. Strong explained
that Council findings may be appealed to the Public Utilities
Commission. Mr. Lanham stated that if Council waits until the
Public Utilities Commission makes a decision, then Council
would have the opportunity to incorporate those findings into
the public hearing which would probably mean less likelihood
of Council's decision being appealed. Mr. Strong concurred.
Drainage - The City has completed drainage work on Ashby
Street and Azaela Drive; 30% of the drainage work on East
Ward and Kilgore Project has been completed.
Drainage - Harris County Flood Control District has
completed the first phase of the ditch that they are con-
structing north of Massey Tompkins between North Main and
Barkuloo Road and the second phase is under construction
at this time. The Harris County Flood Control District crews
are continuing to work on Goose Creek north of Interstate 10
near the CINA Canal.
East District Projects - The contractors have made good
progress on the East District Sewer Projects. They have
completed the work on the 8 -inch gravity flow along Savell
Drive and the 24 -inch line along Cary's Bayou. Most of the
work on the 15 -inch line on East Baker Road has been com-
pleted and all of the work on the 8 -inch line on Crosby
Cedar Bayou has been completed. The work on the 10 -inch
gravity flow on Tumbleweed and Mesa Drive has been completed.
The work is continuing on the force main from Cary's Bayou
to the East District Plant. The contractor on the lift
station is continuing his work and is approximately 52%
complete on that phase of the project.
The Administration has put at the Council table, a
notice of a meeting that Congressman Jack Fields is having
on Monday, January 12, at which time he is inviting local
government officials to meet with him.
Harris County Mayors and Councilmen's Association - %
A copy of the notice for the Harris County Mayors and Council-
men's Association was placed at the Council table and the
Administration will be in touch with Council members to see
whether they will be attending.

Three documents have been placed at the Council table.
One is the printed copy of the budget that was approved by
the Council in September. Another is the preliminary finan-
cial statements which were prepared by the city's accounting
department. These statements are unaudited. The auditor is
preparing his report to present to Council. The other docu-
ment is the annual audit of the Baytown Area Water Authority
records.
Questions or Comments Regarding the City Manager's Report
Councilman Johnson inquired if the rate structure on
ePIN water rates would be the same for commercial and residential
customers? Mr. Lanham responded that the rate structure
would be the same.
Councilman Cannon stated that at the Park Street inter-
section with Decker Drive there is a bottleneck early in the
morning. He asked that the Administration check to determine
if this is a permanent arrangement and if that is correct,
to inquire if the Highway Department will build a merge lane
into Decker Drive which would help the flow of traffic.
Councilman Philips stated that he received a complaint
about the southbound left turn light being too short to allow
good traffic flow at that intersection. The Administration
will check.
Councilman Cannon stated that recently the Baytown
Medical Center has made provision to assist rape victims
in the city. Councilman Cannon felt that this is a good
program because it will be giving assistance to rape victims
so they will not have to go into Houston and that the hospi-
tal should be recognized for its efforts. The Administration
will forward a letter to the hospital in this regard.
Councilman Philips commented that he had received some
calls about a rash of water line failures in Roseland Oaks.
He stated that some of these lines are 25 years old and
requested that the Engineering staff evaluate that problem.
Mayor Hutto stated in connection with the new water
rates, the Administration needs to review the city's policy
regarding the repairing of water leaks.
Becky Larkin Will Appear Regarding East Baker Road Drainage
Ditch
Mayor Hutto recognized Mr. Richard Heyer, representative
of the Chaparral Village Garden Club, who appeared to request
that the city cover a drainage ditch that runs through the
middle of Chaparral Village from the 1300 block of East Baker
Road to Lariat Street. Mr. Heyer explained that the ditch
is a health hazard, as well as an attractive nuisance with
regard to the children in the neighborhood. When the ditch
is filled with water, this makes the ditch a potential danger.
Council has been presented with a petition signed by 249
residents of that neighborhood requesting that City Council
take action in this regard.
Norman Dykes, City Engineer, and his staff had studied
the situation. Mr. Dykes and his staff have established that
there are at least three alternatives:

1. Let the ditch remain in its open state and keep
it mowed which will provide adequate drainage
for the 100 -year flood event.
2. Pipe the ditch which will provide adequate drain-
age to accomodate the 5 -year flood event at a
cost of $201,000.
3. Concrete line the ditch with the proper slope
which will provide adequate drainage to accomodate
the 100 -year flood event at a cost of $190,000.
Mayor Hutto suggested that this item be forwarded to the capital
improvements committee to be considered as part of the upcoming
bond program. Council concurred.
Councilman Cannon stated that this is just another indica-
tion that Council needs to review the policy of accepting sub-
divisions with open ditches. He also stated that if the capital
improvements committee elected to eliminate this project from
consideration, the Council would need to look at this at budget
time.
Consider Request of Village Developers, Inc. for Variance to
Drainage Requirements
Jim Moffatt with the firm of Putney, Moffatt & Easley
presented the findings of a report performed by that company
regarding Chambers County MUD No. 1 and Cedar Bayou Watershed.
As a result of the report, the consulting engineers for the
MUD recommended that a retention pond would serve no useful
purpose; however, a major drainage ditch, not only will bene-
fit the proposed development, but much needed drainage relief
will be made available to the residents of the area adjacent
to the ditch. Additionally, the Texas Highway Department
would be provided with the needed drainage capacity to serve
one of the major evacuation arteries of Baytown. Under present
conditions maintenance of the ditch is not possible because
of lack of ingress and egress easements. The proposed drain-
age ditch would correct this condition.
Council, after hearing the report, instructed Mr. Moffatt
to get with the Administration in this regard. Council felt
that the ordinance Council had adopted gave the Administration
the guidelines needed to respond to Putney, Moffatt & Easley's
recommendations.
Councilwoman Wilbanks explained to Council that the Drain-
age Study Committee had been reconvened by Council to study
the possibility of excluding Cedar Bayou Stream from drainage
requirements, but the Committee concluded that there was not
enough information to make a determination. When the represen-
tatives of the MUD appeared before the committee, the committee
requested that this report be developed and presented to Council.
This is the type information that can be utilized to form a
basis for a determination with regard to Cedar Bayou Stream.
At present, that stream is included in the drainage requirements.
Fritz Lanham, City Manager, pointed out that if at some
point the determination is made that the stream itself should
be excluded, some of the arteries might need to be included
due to their heavy flow.
In response to a question from Council, Mr. Moffatt
explained that there is an existing 25 -foot wide drainage
easement, but additional easement will be required which will
be incumbent upon the developer to obtain.
Council complimented Mr. Moffatt on the study.

Consider Authorizing Reduction of Retainage on Garth Road
Water and Sewer Line Project
In November, Council authorized reduction of the retain -
age on Garth Road Water and Sewer Line Project to $50,000
with the understanding that the Administration would bring
the matter back to Council within 30 days. The line has not
been tested, but the Administration hopes to be able to test
the line within a couple of weeks depending on when the BAWA
line is in service.
Mr. Bishop, the contractor, has requested that 1% of
the total contract be retained -- $10,500.
The Administration recommended that $10,500 be retained
until the job has been completed and accepted.
Councilman Philips moved to accept the Administration's
recommendation; Councilman Johnson seconded the motion. The

Consider Proposed Ordinance, Adopting New Water Rates
In order to convert to surface water it is necessary
that water rates be increased. The public has been informed
over the last few years that this would be necessary and with
the completion of the BAWA plant, it is now a reality. During
budget sessions, the Administration presented various possibil-
ities to the Council and indicated that the one that would be
recommended would increase the minimum from $3.50 to $5.00 for
the first 2,000 gallons and $1.60 for each 1,000 gallons over
that. The budget that was approved was based on the revenue
that would be derived from this proposed rate. The BAWA plant
is completed and operational. The line that will convey the
water to the City of Baytown is being tested and hopefully
the test will indicate that the line is serviceable. Some
of the costs associated with this have been on going since
October 1, such as principal and interest requirements on the
bonds. Costs such as the purchase of raw water from Houston
began on January 1. Major energy costs will not begin until
the plant is in full operation. Therefore, the Administration
recommended that the rate increase be effective with the bills
that will go out in February. The recommendation also included
that the deposit for single family residential users be increased
from $20.00 to $35.00. This would not apply to persons who
already have deposits established even in the event those indi-
viduals should move from one place in the city to another.
The BAWA line along Lynchburg -Cedar Bayou south along the
railroad into the central part of the city will be completed
within the next few weeks. The Administration recommended
approval of the ordinance.
Councilman Simmons moved for adoption of the ordinance;
Councilman Philips seconded the motion.
Council reiterated that the Administration needs to re-
consider the policy on repair of water leaks in order to
conserve the water that has become a premium.

Mr. Lanham explained that recently there have been more
breaks due to the work being performed in the city by contrac-
tors. He also informed Council that a crew would be working
over the weekend to repair water leaks. The vote follows:

ORDINANCE NO. 3054
AN ORDINANCE AMENDING CHAPTER 31, "UTILITIES," OF THE CODE
OF ORDINANCES OF THE CITY OF BAYTOWN BY AMENDING SECTION
31 -54, WATER DEPOSITS AND REFUNDS; AMENDING SECTION 31 -56,
WATER RATES; PROVIDING A REPEALING CLAUSE; CONTAINING A
SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND
EFFECTIVE DATE HEREOF.
Consider Proposed Ordinance, Amending Chapter 21 of the Code
of Ordinances to Provide Regulations for Purchase of Used
Jewelry Other Than by Pawnbrokers
Council delayed action on this matter to allow time for
the Chamber of Commerce to study the ordinance and respond.
Mr. R. E. Peterson, President of the Baytown Chamber of Com-
merce, explained that the Chamber endorsed the proposed
concept. The Chamber requested that Council consider prior
to adoption of the proposed ordinance possibly modification
of the ordinance to provide specific peace officer categories
under Section 21 -1l,c; add a retention period of the goods by
the buyer and provide a sunset provision in the event the
desired effect of the proposed ordinance is not achieved. The
Chamber suggested that in order for the adoption of an ordinance
in this regard to be effective, neighboring communities and
perhaps those throughout the entire state should have similar
provisions.
Council expressed a desire to adopt an ordinance to deter
the criminal element, but at the same time a relunctance to
place undue restrictions on the reputable dealers in the city.
Councilman Philips expressed the feeling that the Chamber
has the right idea, i.e. that these requirements should be
statewide.
Mayor Hutto recognized Jerry Don Smith who pointed out
that to have a retention period in the ordinance would be
harmful to those dealers who deal in the exchange of coins
due to the rate the market fluctuates. He suggested that
perhaps the ordinance could be drafted to exclude bullion
type transactions.
Councilman Cannon inquired how the ordinance had worked
in other areas and the Chief of Police explained that this
ordinance was patterned after the ordinance adopted by Beaumont
and representatives of that city stated the ordinance is very
effective. Councilman Cannon suggested that this might be a
matter that the Harris County Mayor and Councilmen's Associa-
tion might want to consider, as well as the County in order
to provide uniform enforcement.
Council referred the ordinance to the Administration,
requesting more specific definitions regarding peace officers
and to concentrate on wording that would apply to jewelry and
silverware, excluding bullion transactions. Mayor Hutto
called a ten - minute recess.

Consider Proposed Ordinance, Approving Selection of Baytown
Area Water Authority Depository
The Baytown Area Water Authority received bids for
depository with four banks bidding. The high bidder is
Peoples State Bank with a bid of the treasury bill rate
plus .76. The BAWA Board has recommended that the bid of
Peoples State Bank be approved.
Councilman Cannon moved for adoption of the ordinance;
Councilman Johnson seconded the motion. The vote follows:

ORDINANCE NO. 3055
AN ORDINANCE APPROVING THE BAYTOWN AREA WATER AUTHORITY'S
SELECTION OF DEPOSITORY FOR THE AUTHORITY'S FUNDS.
Consider Proposed Ordinance, Adopting New Wrecker Service
Fees
The Council Wrecker Committee has met in the last 30
days twice. They have considered a request from the wrecker
association for increase in the base charge from $35 to
$45 and an increase in the maximum from $65 to $85, plus
other minor increases. The Committee recommended approval
of the request. The last increase was approved in June, 1979,
but was requested in December, 1978.
Councilman Philips expressed concern that the fee for
storage will be increased from $3 to $4 with no maximum.
Chief Turner explained that the police department will
be handing out an information sheet for the public which will
state what charges are permissible and how to file a complaint.
Mr. Denzil Shirley, wrecker owner /operator, was present.
Mr. Shirley explained that the storage fee is necessary in
order to encourage the owner to move the vehicle. The vote
follows:

Consent Agenda
Prior to considering the consent agenda, Councilman Cannon
inquired on what basis these recommendations were being made?
Mr. Lanham responded that the Chief of Police had studied the
recommendations and traffic accidents had been studied for the
last two years.
The consent agenda was considered as set forth in the agenda
packet as follows:
a. At its December 22, 1980 meeting, the Traffic Com-
mission approved increasing the speed limit from
30 to 45 mph on Baker Road between St. James House
and Bayway Drive. Proposed Ordinance No. 10108 -5,
authorizes this speed limit change. An analysis by
the Planning and Traffic Department showed that the
85th percentile speed on this stretch of Baker Road
is 45 mph during non -peak hours. Over 40% of the
traffic during this study period exceeded 40 mph.
The Administration recommended approval of proposed
ordinance.
b. The Traffic Commission has approved a recommendation
to increase the speed limit on Garth Road between Park
Street and Scenic Drive to 40 mph. The present speed
is 30 mph. The 85th percentile speed is 37 mph. About
4% of the traffic exceeded the 40 mph pace during the
study period. Proposed Ordinance No. 10108 -6 approves
this change in speed limit. The Administration rec-
ommended approval of the proposed ordinance.
c. At its December 22, 1980 meeting, the Traffic Com-
mission approved increasing the speed limit on Bob
Smith Road between North Main and Highway 146 from
30 mph to 40 mph. The 85th percentile speed on this
segment of Bob Smith Road is 48 mph. Fifty percent
of the vehicles clocked during the study period
exceeded 40 mph. Proposed Ordinance No. 10108 -7
raises the speed limit on Bob Smith Road from 30 to
40 mph between North Main and Highway 146. The
Administration recommended approval of the proposed
ordinance.
d. The portion of Bayway Drive between the Exxon pipe
rack and Market Street used to be a school zone
for Baytown Junior School. Proposed Ordinance No.
10108 -8 increases the speed limit from 30 to 40
mph. The 85th percentile speed on this stretch of
Bayway Drive is 38 mph. Eighty percent of the
vehicles included in this study exceeded the 40
mph speed limit. The Administration recommended
approval of the proposed ordinance.
e. The speed limit on Market Street between West Main
Street and the Missouri Pacific Railroad Crossing
is 30 mph. The Traffic Commission has recommended
increasing the speed limit to 40 mph. The 85th
percentile speed on this stretch of Market Street
is 38 mph. Twenty -one percent of the vehicles
exceeded 40 mph during the study. Proposed Ordi-
nance No. 10108 -9, increases the speed limit on
Market Street between West Main Street and Missouri
Pacific Railroad Crossing. The Administration
recommended approval of the proposed ordinance.

f. The Traffic Commission has recommended increasing
the speed limit on Highway 146 between the Cedar
Bayou Stream and Crosby Cedar Bayou Road to 50
mph. The present speed limit is 40 mph. The 85th
percentile speed on this stretch of Highway 146 is
48 mph. Almost 9% of the vehicles included in
this study exceeded the 50 mph pace. Proposed
Ordinance No. 10108 -10, increases the speed limit
on Highway 146 between Cedar Bayou Stream and
Crosby Cedar Bayou Road from 40 to 50 mph. The
Administration recommended approval of the proposed
ordinance.
g. Traffic Commission recommended increasing the
speed limit on South Main extension between South
Alexander and Highway 146 from 30 to 40 mph. There
was insufficient traffic to study actual speed of
travel on this stretch of South Main Street. Pro-
posed Ordinance No. 10108 -11, authorizes increasing
the speed limit on this stretch of South Main Street
to 40 mph. The Administration recommended approval
of the proposed ordinance.
h. The Goose Creek Independent School District is using
the first Baptist Church facility to hold kinder-
garten classes during the current school year because
of the fire damage to San Jacinto Elementary School.
Proposed Ordinance No. 10108 -12 would establish a
school speed zone adjacent to the First Baptist Church
for the remainder of the school year. The ordinance
provides for a 20 mph school zone during the period
from 7:15 a.m. through 9 :15 a.m. and from 2:00 p.m.
to 4:00 p.m. The Administration recommended approval
of the proposed ordinance.
i. Proposed Ordinance No. 10108 -13, authorizes the
establishment of a 30 mph construction speed limit
on Garth Road between Baker Road and Interstate 10
during the construction period. After construction
the ordinance restores the speed limit to 45 mph.
The Administration recommended approval of the pro-
posed ordinance.
j. On December 16, 1980, two bids were received for the
purchase of three 3/4 ton pickup trucks for various
City departments. The Water Distribution Division
requests one 3/4 ton pickup with warning light. The
low bid of Baytown Motors was $7,891.13. Joe Camp,
Inc. bid a total of $8,271.76. The 3/4 ton pickup
for the Animal Control Division included air - conditioning.
The total bid of Baytown Motors was $8,231.45. Joe
Camp, Inc. bid $8,581.25. The 3/4 ton pickup for
the Public Yorks Garage included a deduct for manual
transmission, a warning light, a utility bed and a
tailgate lift. The low bid was submitted by Baytown
Motors at a total cost of $10,670.23. The bid of
Joe Camp, Inc. totaled $11,077.96. Estimated
delivery time for these vehicles is 75 days. Ten
companies were mailed specifications and were con-
tacted by phone. Proposed Ordinance No. 10108 -14,
awards the bid for the three 3/4 ton pickup trucks
to Baytown Motors, Inc.. This represents an 11.3%
increase over last years bid. The Administration
recommended approval of the proposed ordinance.
k. The 1981 Revenue Sharing Budget includes $15,000
to fund the operation of the van for the Senior
Citizens Nutrition Program for a second year.
Proposed Ordinance No. 10108 -15, authorizes the

Administration to enter into an agreement with First
Prebysterian Church for operation of the van. The
proposed contract will cover the 1981 calendar year.
The $15,000 can be used for the operation, maintenance,
insurance of the van and salary of the driver. The
Administration recommended approval of the proposed
ordinance.

ESTABLISHING A PRIMA FACIE SPEED LIMIT OF 40 MILES PER
HOUR FOR MOTOR VEHICLES ON A PORTION OF BOB SMITH ROAD

Currently, Mary Elizabeth Wilbanks is serving as the
City of Baytown's representative and Vice Chairperson to
the General Assembly of the Houston - Galveston Area Council
and Councilman Allen Cannon is alternate.

Councilman Johnson moved to adopt the resolution, desig-
nating Councilwoman Wilbanks as the city's representative and
Councilman Cannon as alternate to the General Assembly of the
Houston - Galveston Area Council. The vote follows:

RESOLUTION NO. 756
A RESOLUTION APPOINTING MARY ELIZABETH WILBANKS AS THE
REPRESENTATIVE OF THE CITY OF BAYTOWN TO THE EXECUTIVE
COMMITTEE AND THE GENERAL MEMBERSHIP BODY OF THE HOUSTON -
GALVESTON AREA COUNCIL FOR THE YEAR 1981 AND ALLEN CANNON
AS VOTING DELEGATE SHOULD MARY ELIZABETH WILBANKS BECOME
INELIGIBLE OR RESIGN.
Councilwoman Wilbanks invited all Council members to
attend the annual banquet which will be held on January 23.
Councilwoman Wilbanks reported that the nominating committee
had recommended that the current slate of officers be con-
sidered for 1981.
Review Plans and Specifications and Authorize Advertisement
for Bids on 1979 -80 Community Development Program - Street
and Drainage Improvements to Cherry and Pine Street
Ed Shackelford, Engineering Department, presented plans
and specifications for the 1979 -80 Community Development Pro-
gram - Street and Drainage Improvements to Cherry and Pine
Streets. There is $350,000 available to fund this project.
The engineers estimate for the street and drainage work is
$310,000. Some water line work will be bid as an alternate --
1600 feet of 2 -inch water line work needs to be done. There
will be approximately 1900 feet of drainage pipe to be laid
and approximately 3,000 feet of street work. The street will
be 29 feet wide concrete with curb and gutter. The 29 foot
width is the standard width for residential streets.
In response to a question from Council, Mr. Shackelford
explained that the long range plan is to completely rework
the subdivision. HUD has encouraged the city to concentrate
within a small area.
Mr. Shackelford pointed out that both the streets will
have 4 -foot wide sidewalks on both sides. None of the
intersections will have wheelchair ramps at this time because
these intersections will be going into areas that are not fully
developed. The sidewalks can be sloped into the existing pave-
ment. The City of Baytown will have complete control of this
project. The Administration recommended approval of the plans
and specifications and requested authorization to advertise
for bids.
Councilman Johnson moved to accept the plans and specifi-
cations and to advertise for bids; Councilman Philips seconded
the motion. The vote follows:

Councilman Johnson stated that he was concerned that
perhaps the Chrysler Corporation's present status might
effect the recent bid award. Mr. Lanham responded that
the Administration would attempt to check into this matter.
Recess and Reconvene
Mayor Hutto recessed the open meeting into executive
session to discuss pending litigation, personnel matters
and land acquisition. After the open meeting reconvened,
the following business was transacted:
Appointments to Electrical Board
Two members of the Electrical Board's appointments
have expired. Mr. George Saphos, who can either be a
Master Sign Electrician or a Master Electrician, has not
missed any meetings. Mr. H. L. Bridges is the citizen
not in the building industry and he has missed only one
of ten meetings. One other person whose term has not
expired, but who has moved out of the city and intends to
resign is Mr. Johnny Miller who has not attended the last
three to four meetings. Council requested a copy of the
journeyman's list. Mr. Lanham will be in contact with
these three individuals prior to next Council meeting.
Community Development Advisory Committee
Mrs. Edna Oliver and Mrs. Woodrow Lewis's terms
have expired. Both ladies have good attendance records.
Mrs. Oliver is from Council District No. 6 and Mr. Lewis
is from Council District No. 3. Council asked Mr. Lanham
to contact both ladies to inquire if they would like to
continue to serve.
Baytown Cultural Arts Council
Kim Martin has resigned from the Baytown Cultural
Arts Council and his term expires February, 1982. Council-
woman Wilbanks nominated Mrs. Glena Pfennig to serve out
the term of Mr. Martin. Councilman Johnson seconded that
nomination. The vote follows:

Wilbanks and Cannon
