1980 04 30 CC Minutes, Special00430 -1 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN April 30, 1980 The City Council of the City of Baytown, Texas, met in special session on Wednesday, April 30, 1980, at 5:00 p.m. in the Council Chamber of the Baytown City Hall with the following members in attendance: Fred T. Resolution No. 731 - Canvassing Results of Municipal Run -Off Election Held On April 22, 1980 Council canvassed the returns of the Municipal Run -Off Elec- tion held on April 22, 1980, for the purpose of electing a coun- cil member from Council District No. 1, which reflected the following: FOR COUNCIL DISTRICT NO. 1 Francis Portis 719 votes Perry M. Simmons 915 votes Councilman Kloesel moved for adoption of the resolution; Councilman Cannon seconded the motion. The vote follows: Ayes: Council members Philips, Kloesel and Cannon Mayor Hutto Nays: None RESOLUTION NO. 731 A RESOLUTION CANVASSING THE RETURNS OF A SPECIAL RUNOFF ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 22ND DAY OF APRIL, 1980, FOR THE PURPOSE OF ELECTING A COUNCILMAN FROM DISTRICT NO. ONE (1) TO SERVE A REGULAR TWO -YEAR TERM; DECLARING THE RESULTS OF SAID ELECTION; FINDING THAT NOTICE OF SAID ELECTION WAS DULY AND PROPERLY GIVEN AND THAT SAID ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS. Swear In New Council Member Judge Raymond Donnelly administered Oath of Office to the newly elected Council member Perry M. Simmons. *Councilman Johnson present. 00430 -2 Minutes of the Special Meeting - April 30, 1980 Resolution No. 732 - Formally Recognizing and Thanking Councilman Ted Kloesel For His Service to the Community as Councilman From District No. 1 Councilman Cannon read proposed Resolution No. 732, formally recognizing and thanking Councilman Ted Kloesel for his service to the community as Councilman from District No. 1 beginning April, 1976 through April, 1980, and recognizing some of the accomplishments he was instrument in bringing about during his tenure of office. Councilman Cannon moved for adoption of the resolution; Councilman Philips seconded the motion. The resolution was adopted by unanimous vote of Council. Mayor Hutto presented Councilman Kloesel with a plaque for his service as Councilman from District No. 1. RESOLUTION NO. 732 A UNANIMOUS RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAY - TOWN, TEXAS, FORMALLY RECOGNIZING AND THANKING TED KLOESEL FOR HIS SERVICE TO THE COMMUNITY AS COUNCILMAN FROM DISTRICT NO. ONE BEGINNING APRIL, 1976, THROUGH APRIL, 1980, AND RECOGNIZING SOME OF THE ACCOMPLISHMENTS HE WAS INSTRUMENTAL IN BRINGING ABOUT DURING HIS TENURE OF OFFICE. Consider Proposed Schedule Change by Texas Bus Lines to ?flake Schedule Changes in the Baytown - Houston Division Mr. Lanham explained that on Monday, the Administration received a notice of this proposed change from the Railroad Commission indicating that Runs 304 and 300 from Baytown to Houston will be suspended and Runs 301 and 305 from Houston to Baytown will be suspended. If the City desires to appear in opposition to this application, notice of protest must be filed with the Director of Transportation of the Railroad Commission within 10 days from the date of this notice. This notice is dated April 24. If the City chooses to oppose the application, the protest must be filed within 10 days of April 24. The Admin- istration has received some information from the Texas Bus Lines indicating passenger service in Baytown is at a very low level in terms of riders. Statistics for the months of September, Octo- ber, November and February indicate an average for those four months is 4.2 passengers per run. The one -way fare is $3.30. Three dollars and thirty cents times 4.2 passengers is $13.86 per run. Mr. Lanham explained that he had spoken with ?sir. Keller, the owner of this company, who indicated that his company cannot pay the rent and pay salaries with that type of return. The company also has freight revenues, but the Administration had not received very meaningful statistics on freight revenues. For the month of February, freight revenues are listed at $2,367 but that does not include inter -lines payment. For instance, if someone puts something on the bus in Baytown to go to Chicago, the reve- nue would be collected in Baytown which would show up in the of $2,367, but the payment to another line to take it from Houston to Chicago is not reflected. Councilman Philips pointed out that even if the full amount were retained, that is not a significant amount of money to run a bus line. Mr. Lanham felt that to eliminate the freight service would inconvenience more people than the elimination of passenger service. However, Mr. Keller had indicated part of the problem is the competition for the freight business. Mr. Lanham explained that in order to oppose the applica- tion, the City of Baytown would have to attend the public hearing and prepare a case. Mr. Lanham stated that Scott Bounds, City Attorney, had 00430 -3 Minutes of the Special Meeting - April 30, 1980 pointed out that the law does not state that the bus company must make a profit because there are cases where common carriers are required to operate by the regulatory authority even though they may not be making money. Mr. Bounds stated that the bus company is going to be guaranteed a profit on its overall operation even though the Bay- town branch may not be making a profit. Other branches of the line may need to subsidize the Baytown route in order to have public service for those Baytown passengers using the bus service. In response to an inquiry from Council, Mr. Lanham explained that no public notice has been given of this proposed change in service. Council expressed concern that the bus service be eliminated without public notice and Councilman Cannon suggested that the City go on record as being in opposition and ask the Baytown Sun to run an article in the newspaper to see what kind of feedback will be received; Council concurred. Councilman Johnson moved that the Council go on record to protest closing of the two bus routes; Councilman Philips sec- onded the motion. The vote follows: Ayes: Council members Philips, Johnson, Simmons and Cannon Mayor Hutto Nays: None Adjourn With no further business to be transacted, Mayor Hutto adjourned the meeting.
