June 6, 1979
The City Council of the City of Baytown, Texas, met
session on Wednesday, June 6, 1979, at 5:30 p.m. in the
of the Baytown City Hall. The following members were in

Mayor Hutto called the emergency meeting to order.
Consider Amendments to Retirement Plan for Employees of the City of
Baytown
Council was not ready to act on this item at this time.
Consider Amendments to Agreement and Declaration of Trust, City of
Baytown Retirement Fund
Council was not ready to act on this item at this time.
Recess and Reconvene
Mayor Hutto recessed the open meeting into executive session to
discuss pending litigation. When the open meeting reconvened, the
following business was transacted. Scott Bounds, City Attorney,
explained that the first two items on the agenda are not to be acted
on. Mr. Bounds noted that the Board of Trustees of the Supplemental
Retirement Plan are working toward amendments to the plan necessary
due to the adoption of the full- salaried method of the Texas Munici-
pal Retirement System. These amendments will be placed on a future
Council agenda for consideration.
Councilman Kloesel moved that the Council authorize the City to
make an offer to those remaining in the Supplemental Plan for final
settlement, but stipulated that litigation is omitted from the motion
and the purpose for omitting litigation is that there may be a need
for further negotiation and the decision to litigate can be made at
a later date; Councilman Philips seconded the motion. The vote follows:
Ayes: Council members Philips, Kloesel and Caffey
Nays: Mayor Hutto
Adjourn
With no further business to be transacted, Mayor Hutto adjourned
the meeting.
