1977 11 10 CC Minutes71110 -1 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN November 10, 1977 The City Council of the City of Baytown, Texas, met in regular session Thursday, November 10, 1977, at 6:30 p.m. in the Council Chamber of the Baytown City Hall. Wilbanks Neel Richardson Councilman Councilman Councilman Mayor City Manager Assistant City Manager Assistant City Attorney City Clerk Councilman Councilman Councilwoman City Attorney Mayor Gentry called the meeting to order and the invocation was offered by Reverend Lile Calhoun, Pastor of Northside Baptist Church. Approve Minutes Councilman Cannon moved that the word "dispensing" on Page 71027 -9 of the minutes from October 27, 1977, be corrected to read "suspension ", and with that correction that the minutes be approved and to ratify actions taken concerning each of the matters listed on the agenda of said meeting; Councilman Hutto seconded the motion. City Manager's Report Sliplining - The City has been sliplining sewer lines through- out the City for several years and a number of contracts have been awarded throughout the years. Prior to the use of contractors, City employees did most of the sliplining work. Since the beginning of sliplining, a total of 17 miles of sewer lines have been sliplined and the cost of work, which includes the estimate of time the City crew spent in this process, is $1,400,000.00. Drainage Equipment - The new piece of drainage equipment was delivered this week which was delivered much earlier than antici- pated. Two Person Garbage Truck - The two person garbage truck has been in operation for about a month and the Administration is very pleased with the results of its operation. Several employees in the Solid Waste Division have indicated that they would like to have the opportunity to work on this type of equipment. The cost savings in using this type of equipment in lieu of the three person garbage truck is about $3,000.00 per year per unit. The current budget includes funds for two more of these units. The Administration requested Council's approval to advertise for bids for two more two person garbage trucks. Council had no objections to the Administration advertising for bids for the two person garbage trucks. 71110 -2 Minutes of the Regular Meeting - November 10, 1977 Mr. Lanham commented that the Administration is working on specifications to advertise for bids for plastic bags which would be purchased by the City for sale to the citizens at the City's cost. This will be done in hopes that citizens will be encour- aged to use plastic bags for disposal of their garbage. Fire Equipment - The Administration expects to advertise for bids for the new fire equipment, the pumper truck and the mini - pumper, next week. The bids would come in later in December. Bayway Drive Water Line - The contractor has installed 10,200 feet of water line which is approximately 75% of the total job. The contractor will be clear of the refinery this week. Market Street Bridge - All of the piling with the exception of three have been driven and the abutment on the east side has been framed and poured. Two lanes of concrete have been placed from Stadium Drive to the school parking lot. The Administration hopes that these two lanes of traffic can be opened into the school parking lot in about 2 weeks. In response to a question from Councilman Kimmons, Mr. Lanham commented that completion of this project should be in late January or early February if weather conditions permit. All of the dirt work has been done and the contractor will start pouring concrete in the next few weeks. Street Improvement Work - Eight of the streets under the contract have been finished and four streets are underway which are Bayliss, Newman, King and Illinois Streets; only one has not been started -- North Burnett. The reason for the delay on North Burnett is that work is being done in this area by the County Flood Control Contractor and the City did not want to block this street at the same time other areas were blocked. Sliplining - The contractor is finishing up one of the contracts which is the 10 -inch line on Burnett Drive and has begun the 6 -inch line on Rosewood. No work on the latest contract has been performed. Planning Commission - A copy of the revised subdivision regu- lations has been placed at the Council table. The staff and the Planning Commission have been working on this for several months and this item will be placed on the agenda for the next Council meeting. Mr. Lanham commented that copies of the revised subdivision regulations will be available in the Planning Department for distri- bution to the public. Questions or Comments Regarding the City Manager's Report Councilman Hutto commented that the people in the Lakewood Area are well pleased with the fine job the city crew is doing on the drainage work on Greenbriar Street. Councilman Hutto expressed his concern about the continued burglaries that are occurring in the residential areas. Council- man Hutto commented that he hoped the Administration could get with the Police Department and see if there is anything that Council could do in the way of helping the Police Department to combat these burglaries. Mayor Gentry commented that there should be some type of program that could help alleviate this problem even if it took some additional overtime work on the part of the law enforcement people. Because more residential daylight burglaries are occurring, Mayor Gentry expressed a willingness to consider some additional expense if a program could be designed to put a strong emphasis on protection, even it it would be established on a trial basis. Mr. Lanham commented that he would get with Chief Turner and come back to Council with further information. 71110 -3 Minutes of the Regular Meeting - November 10, 1977 Councilman Hutto commented that there is a gentleman who had contacted him regarding the possibility of receiving Council authorization to cut down a dead tree in the park on Schreck Street. Scott Bounds, Assistant City Attorney, explained that certain procedures for the sale of city property must be met; Council determined that this matter should be left to the City's legal authorities. Ordinance - The First Reading of a Franchise Agreement with Entex This ordinance has been prepared in accordance with Council's instructions to provide for a three percent gross receipt tax for all residential and commercial, both small and large commercial users. It is a 40 year franchise and it includes a Most Favorable City Clause which would enable Baytown to ask for increases in the franchise fee if any other municipality within our District negotiates a higher franchise fee. The Administration recommended approval of the ordinance. Councilman Kimmons moved for the adoption of the ordinance; Councilman Cannon seconded the motion. Mayor Gentry asked Mr. Richard DeSalme, Division Manager for Entex, if he felt that this document would be acceptable to his company. Mr. DeSalme indicated that he picked up a copy of the proposed ordinance which his company reviewed and found acceptable. The Administration recommended approval of the ordinance. Councilman Hutto moved for the adoption of the ordinance; Councilman Cannon seconded the motion. Councilman Cannon inquired about the requirements the person operating this piece of equipment must meet. Bo Turner, Chief of Police, explained that the person must be an investigator for five years, must make a certain grade on the police I.Q. test, and must be sent to a state approved school for training which will cost approximately $1,800.00. Chief Turner commented that there are 3 or 4 men in the Police Department that would qualify for this position. Chief Turner explained that the Police Department plans to contract with the man selected for this position to encourage him to stay a few years after he completes training, plus that man will be on an internship for a year. In response to a question from Councilman Hutto, Chief Turner explained that the man in this position will also handle misdemeanor investigations along with his polygraph duties. As his polygraph duties increase, his case work load will decrease. Chief Turner explained that if the individual assigned to this position, breaks the contract - -that is, if he quits the first year, the person must pay the full schooling money back to the City, plus the salary he was receiving while attending school. This purchase would provide the City with the third vehicle of this type. The two that the City presently operates have speeded up the brush loading process. Uniflex, Inc. did not meet specifications in several respects, including the amount of hose bid. Hugh Wood Ford did not meet specifications with regard to tire size, and Bob Hamric, Inc. did not meet specifications because the bid form itself was incomplete. The bidder, who submitted all specifications, was Baytown Motors, Inc. for the amount of $24,911.43. The Administration recommended approval of the ordinance. Councilman Hutto moved for the adoption of the ordinance; Councilman Kimmons seconded the motion. Councilman Cannon commented that in drawing up specifications, the Administration needs to work with everyone they can, particu- larly when going out for bids on big pieces of equipment. He expressed concern that the City might lose some of the local bidders and felt that the Administration should be general in specifications where possible and work with the supplier so that the City can get the most competitive bids. Mr. Lanham explained that the Administration has been trying to work with the suppliers, and that many times, it is just an oversight on the part of the bidder when a bid form is filled out incorrectly. This purchase is for two small tractors that will be used in repairing water and sewer lines in confined areas, such as fenced -in backyards, where conventional type tractors cannot be used. Alvin Implement & Supply Company submitted the low bid in the amount of $10,235.08. This company bid on a Kubota Tractor which is made by a Japanese manufacturer. The Administration has conversed with representatives of this company concerning the availability of parts. There is a supply of parts on hand in Alvin and there is a major warehouse in Dallas, Texas. The Administration recommended approval of the ordinance. Councilman Kimmons moved for the adoption of the ordinance; Councilman Cannon seconded the motion. Mr. Lanham explained that the only other bid was on a Ford model which probably is a much larger unit because of the price difference. The vote follows: Ayes: Council members Kimmons, Hutto and Cannon Mayor Gentry Nays: None ORDINANCE NO. 2363 AN ORDINANCE OF THE CITY TEXAS, ACCEPTING THE BID COMPANY FOR THE PURCHASE AND AUTHORIZING THE PAYM TEN THOUSAND TWO HUNDRED DOLLARS. COUNCIL OF THE CITY OF BAYTOWN, OF ALVIN IMPLEMENT & SUPPLY OF TWO BACKHOE TRACTOR LOADERS LNT BY THE CITY OF THE SUM OF THIRTY -FIVE AND 08/100 ($10,235.08) Resolution - Authorizing the City Manager to Execute Certification Statements for City Participation in Railroad Crossing Signal The Administration has received a letter from Mr. Omer F. Poorman, District Manager for the State Department of Highways and Public Transportation, regarding the 1978 Off Federal System Rail- road Signal Program. In his letter, Mr. Poorman indicated two grade crossings have been selected for signalization during the 1978 Program. These include Oak Street at the Missouri Pacific tracks and Main Street near Lobit at the Southern Pacific tracks. These were taken from a priority list that the City submitted several years ago. The federal government will provide 908 of the cost, the State of Texas must furnish 58 and the local political subdivision must pay 58. The estimated cost to Baytown would be $4,550.00. Mr. Poorman indicated that it takes approximately 2 71110 -8 Minutes of the Regular Meeting - November 10, 1977 years from inception to installation of these crossing devices. This resolution would authorize the City Manager to execute Certification Statements indicating that the City is interested in participating in the Railroad Crossing Signal Program. The Administration recommended approval of the resolution. Councilman Cannon moved for the adoption of the resolution; Councilman Hutto seconded the motion. In response to a question from Councilman Cannon, Mike Weaver, of the Planning Department, responded that some of the projects that are done by the Railroad are done by their own people and some of the projects are contracted out. Councilman Cannon also inquired about the cost of installation of the railroad crossings on Cedar Bayou, Massey Tompkins Road and Bob Smith Road. Mr. Lanham commented that he thought the cost of installation was $20,000.00 for each crossing, but since that time the cost of materials have increased. Councilman Cannon asked that the Administration obtain the cost figures for the installation of crossings on Cedar Bayou, Massey Tompkins, and Bob Smith Road. The vote follows: Ayes: Council members Kimmons, Hutto and Cannon Mayor Gentry Nays: None RESOLUTION NO. 599 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE CERTIFICATION STATEMENTS FOR CITY PARTICIPATION IN A RAILROAD CROSSING SIGNAL PROGRAM AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Resolution - Recommending Final Payment for 1976 Community Development Program This work has been completed, and representatives of the City, Harris County and H. T. Holland Construction Company have conducted final inspection. Upon inspection, the work was found to be completed and satisfactory in accordance with the specifications. The Administration recommended approval of the resolution in which Council recommends to the County that final payment be authorized. Councilman Kimmons moved for the adoption of the resolution; Councilman Cannon seconded the motion. The vote follows: Ayes: Council members Kimmons, Hutto and Cannon Mayor Gentry Nays: None RESOLUTION NO. 600 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING THE CONSTRUCTION OF 1976 COMMUNITY DEVELOPMENT PROGRAM BY H. T. HOLLAND CONSTRUCTION COMPANY, INC.; RECOMMENDING THAT THE HARRIS COUNTY COMMISSIONER'S COURT AUTHORIZE FINAL PAYMENT TO THE SAID H. T. HOLLAND CONSTRUCTION COMPANY, INC.; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. 71110 -9 Minutes of the Regular Meeting - November 10, 1977 Consider Proposed Procedures for Selecting Employees for Exemplary Performance Increases Council approved the amount of $10,000.00 in the 1977 -78 Budget for exemplary performance increases. Up to ten percent of the non -Civil Service employees who are not in open salaried positions could be awarded these increases. The process which the Administration proposes to use to determine who should be selected for exemplary performance increases follows: 1. Department Heads will develop guidelines for evaluating employee performance in relation to job classification. 2. Department Heads will solicit nominees for consideration from their supervisory personnel. 3. Department Heads shall evaluate the nominees against the established guidelines for the various positions. 4. Department Heads shall select employees for exemplary performance increases and document their reasons for selecting these employees. The Administration felt that this can be a good program and it is important that the Department Heads evaluate their employees as objectively as possible in determining who should be given these increases. The Administration recommended approval of the proposed process of selecting employees for exemplary performance increases. Councilman Hutto moved for the adoption of the proposed process of selecting employees for exemplary performance increases; Council- man Cannon seconded the motion. Councilman Hutto inquired if the Administration and the majority of the staff felt that this is the best way to go about giving these increases. Mr. Lanham explained that the staff is not 100 percent in favor of this process, but the majority is. He also commented that the Department Heads do not have to give these increases. Councilman Hutto inquired if this will be done on a trial basis? Mr. Lanham replied that Council will decide whether or not to continue this procedure when studying next year's budget. Recess and Reconvene Mayor Gentry recessed the open meeting into executive session to discuss personnel matters.
