1977 01 24 CC Minutes, Special6138 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN January 24, 1977 The City Council of the City of Baytown, Texas, met in special session, Monday, January 24, 1977, at 5:30 p.m. in the Council Chamber of the Baytown City Hall. The following members were in attendance: Jody Lander Jack Kimmons Ted Kloesel Mary E. Wilbanks Allen Cannon Tom Gentry Fritz Lanham Neel Richardson Eileen P. Hall Dan Savage Councilman Councilman Councilman Councilwoman Councilman Mayor City Manager City Attorney City Clerk Assistant City Manager Mayor Gentry called the meeting to order, and Council can- vassed the results of the Special Election held on Saturday, January 15, 1977, on the following proposition: PROPOSITION SHALL THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS (THE "CITY "), BE AUTHORIZED TO ENTER INTO A "WATER SUPPLY CONTRACT -- TREATED WATER" WITH THE BAYTOWN AREA WATER AUTHORITY (THE "AUTHORITY "), AS THE SUCH CONTRACT SHALL BE AMENDED FROM TIME TO TIME, FOR THE PURPOSES OF (1) ACQUIRING SURFACE WATER SUPPLIES FROM SOURCES BOTH WITHIN AND WITHOUT THE BOUNDARIES OF THE AUTHORITY, (2) UNTREATED WATER, AND (3) DISTRIBUTING, SELLING, AND DELIVERING TREATED WATER TO THE CITY? Said canvass reflected the following results: For The Entering Into Of A "Water Supply Contract -- Treated Water" With The Baytown Area Water Authority 2,670 votes Against The Entering Into Of A "Water Supply Contract- - Treated Water" With The Baytown Area Water Authority 1,148 votes Councilman Cannon moved for the adoption of Resolution No. 560, officially canvassing returns and declaring results of the election; Councilwoman Wilbanks seconded the motion. The vote follows: Ayes: Council members Lander, Kimmons, Kloesel, Wilbanks, Hutto, and Cannon Mayor Gentry Nays: None RESOLUTION NO. 560 RESOLUTION CANVASSING RETURNS AND DECLARING RESULTS OF ELECTION. Councilwoman Wilbanks commented that the manner in which bilingual material was printed on the ballot was confusing. Since there is no provision in the Election Code for the manner in which the ballot is to be arranged as far as bilingual material is concerned, the administration will work closely with-the printer in future elections to eliminate confusion. 6139 Minutes of the Special Meeting - January 24, 1977 Councilman Kloesel commented that BAWA now had the authority to sell bonds without holding an election. Mr. Lanham, City Manager, explained that the voters in authorizing the contract had also authorized the sale of bonds. r There being no further business to transact, the motion was duly made and seconded to adjourn into a work session with repre- sentatives of Entex, Inc. regarding their Statement of Intent to increase the rate charged for natural gas consumption within the City of Baytown. ilet �P.
