1976 05 05 CC Minutes, Special.1St MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN May 5, 1976 The City Council of the City of Baytown, Texas, met in special session, Wednesday, May 5, 1976, at 6:00 p.m. in the Council Chamber of the Baytown City Hall. The following members were in attendance: Jody Lander Jack Kimmons Charles Pool Emmett Hutto Tom Gentry Fritz Lanham Neel Richardson Eileen P. Hall Dan Savage Absent: Mary E. Wilbanks Allen Cannon Councilman Councilman Councilman Councilman Mayor City Manager City Attorney City Clerk Assistant City Manager Councilwoman Councilman Mayor Gentry called the meeting to order and Council canvassed the results of the Special Run -Off Election held on Tuesday, April 27, 1976 to elect a Councilman from District No. One (1) which reflected the following: Robert W. Parker 727 Ted Kloesel 890 Councilman Lander moved to adopt Resolution No. 534; Councilman Pool seconded the motion. The vote follows: Ayes: Council members Lander, Kimmons, Pool and Hutto Mayor Gentry Nays: None RESOLUTION NO. 534 A RESOLUTION CANVASSING THE RETURNS OF A SPECIAL RUNOFF ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 27TH DAY OF APRIL, 1976, FOR THE PURPOSE OF ELECTING A COUNCILMAN FROM DISTRICT NO. ONE (1) TO SERVE A REGULAR TWO YEAR TERM; FINDING THAT NOTICE OF SAID ELECTION WAS DULY AND PROPERLY GIVEN AND THAT SAID ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS. Resolution Commending Councilman Charles Pool After reading Resolution No. 535, commending Councilman Charles Pool for his service to the City as Councilman from District No. One, Councilman Lander moved the adoption of said resolution. Councilman Kimmons seconded the motion. The vote follows: Ayes: Council members Lander, Kimmons, and Hutto Mayor Gentry Nays: None Abstained: Councilman Pool RESOLUTION NO. 535 A UNANIMOUS RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, FORMALLY RECOGNIZING AND THANKING CHARLES POOL FOR HIS FOUR YEARS OF DEVOTED SERVICE AS COUNCILMAN OF DISTRICT NO. ONE AND RECOGNIZING SOME OF THE ACCOMPLISHMENTS HE WAS INSTRUMENTAL IN BRINGING ABOUT DURING HIS TENURE OF OFFICE. Minutes of the Special Meeting - May 5, 1976 Plaques Presented to Councilmen Charles Pool and Fred Bednarski, Jr. Mayor Gentry presented plaques to Councilmen Charles Pool and Fred Bednarski, Jr. on behalf of the City Council and City Administration for their devoted service to'the City of Baytown. Oath of Office Judge Steve Hebert administered the Oath of Office to Mr. Kloesel. The new Council member was seated. Respect for Law Enforcement Week Mayor Gentry commended the members of the Baytown Optimist Club for their service to the community. The Optimists are asking that emphasis be placed on "Respect for Law Enforcement Week." Each year the Optimists formally recognize law enforcement personnel and are asking that the community join them in that regard. Ordinance - Final Payment - Rehabilitation of Sanitary Sewer Lines Channel Construction Company has completed the rehabilitation of sanitary sewer lines at the following locations: Decker Drive, Cedar Bayou Road, the railroad ditch in the vicinity of Bob Smith Road, and the Pamela -Glen Arbor Easement. The original contract price was Eighty -Five Thousand Three Hundred Fifty -Six and No /100 ($85,356.00) Dollars. The final contract price is Seventy -Three Thousand Nine Hundred Sixty -Eight and 73/100 ($73,968.73) Dollars for an underrun of Eleven Thousand Three Hundred Eighty -Seven and 77/100 ($11,387.77) Dollars, which is due to fewer service connections and the use of less grout and stabilized sand. The Engineering Department and Public Works Department have inspected and approved the work. The Administration recommended approval of the ordinance. Councilman Hutto moved to adopt the ordinance; Councilman Lander seconded the motion. The vote follows: Ayes: Council members Lander, Kimmons, Kloesel and Hutto Mayor Gentry Nays: None ORDINANCE NO. 1995 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING AND ACCEPTING THE SLIPLINING OF SANITARY SEWER LINES BY CHANNEL CONSTRUCTION COMPANY, INC. FINDING THAT THE WORK HAS BEEN PERFORMED IN ACCORDANCE WITH THE TERMS OF THE CONTRACT; ACCEPTING THE CITY ENGINEER'S CERTIFICATE OF FINAL ACCEPTANCE; AUTHORIZING THE FINAL PAYMENT TO THE SAID CHANNEL CONSTRUCTION COMPANY, INC. AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. 1976 Conference for Mayors, Councilmen and Commissioners Mr. Lanham informed Council that the 1976 Conference for Mayors, Councilmen and Commissioners would be held May 22 through 25 and if all Council members desiring to attend would notify him, reservations would be made accordingly. 6090 Minutes of the Special Meeting - May 5, 1976 Adjourn There being no further business to transact, Councilman Kimmons moved to adjourn; Councilman Hutto seconded the motion.
