1975 12 23 CC Minutes, Special5995 MINUTES OF THE SPECIAL SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN December 23, 1975 The City Council of the City of Baytown, Texas, met in special session, Tuesday, December 23, 1975, at 7:00 A. M. in the Council Chamber of the Baytown City Hall. The following members were in attendance: own Jody Lander Charles Pool Mary E. Wilbanks Emmett 0. Call Public Hearing on Improvements to Decker Drive There will be a hearing of benefits for the assessment of the cost of curb and gutter to the property owners abutting Decker Drive from 80.45 feet southeast of the center line of Garth Road to the south right of way of Defee. The hearing will be held on Thursday, February 12, 1976, at 7:00 p.m. Councilman Pool moved to adopt the ordinance calling the public hearing; 71 Councilman Hutto seconded the motion. Councilwoman Wilbanks moved to adopt the ordinance; Councilman Hutto seconded the motion. The vote follows: Ayes: Council members Lander, Pool, Wilbanks, Hutto and Walmsley Mayor Gentry Nays: None ORDINANCE NO. 1931 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF FLOYD BUSBEE CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF ROBIN ROAD DRAINAGE IMPROVEMENTS AND AUTHORIZING THE CONTRACTING OF IN- DEBTEDNESS BY THE CITY FOR THE SUM OF ONE HUNDRED SEVENTY -FIVE THOUSAND NINE HUNDRED TEN AND NO /100 ($175,910.00) DOLLARS WITH REGARD TO SUCH AGREEMENT. B. LeFevre, Jon Pfennig and Bryan James was formed to consider the group insurance bids. Massachusetts Mutual's bid is only 1% higher than our current rates; however, on the bid for accidental death and dismemberment insurance Massachusetts Mutual excluded the Police and Fire Department employees while on duty. This does not meet the specification supplied by the City. Blue Cross' bid on the Comprehensive Major Medical is financially the best plan they submitted, but it does not meet the exact specifications and it is $12,000.00 over and above the amount budgeted for the remainder of the fiscal year. The third alternative considered was the bid of Republic National. Under Plan I their bid was the lowest cost plan submitted that met the specifications exactly. The cost for this plan was $17,000.00 over the amount budgeted for the remainder of the fiscal year. Because the bids did not meet specifications or because of the financial cost, the Administration recommended to reject all bids and go out for bids again next month in order to try to have a new carrier by February 1. In order to do this, it is necessary that the City accept the new rates of American National, the present carrier, for the month of January, 1976. This would cost the City approximately $2,000 to $2,500 for January and the employees' cost increase would be increased 45% for that one month. Mayor Gentry suggested that the City pay both the employees' share and the City's share of the insurance for January; however, Council did not feel that this would be feasible. Councilman Lander moved to reject all bids, to advertise for new bids, and to authorize the additional cost for the City's share of the medical insurance for the month of January. Councilman Pool seconded the motion. The vote follows: Ayes: Council members Lander, Pool, Wilbanks, Hutto and Walmsley Nays: Mayor Gentry Changing the Name of Thunderbird Drive to Quail Hollow Drive The renaming of Thunderbird Drive was considered at the last Council meeting and was delayed in order to give the change some publicity so that people might make their wishes known. Mr. Lanham received only one call regarding this matter from Mrs. Hines, President of the Country Club Civic Association, who stated that she had been under the impression that she would have more time to complete a telephone survey of the members of the Civic Mass. In view of the fact that this organization will not have a regular meeting until January, Councilman Hutto moved to delay action on this matter until the January 8 meeting; Councilwoman Wilbanks seconded. The vote follows: Ayes: Council members Wilbanks and Hutto Nays: Councilmen Lander and Walmsley Mayor Gentry Abstained: Councilman Pool Since the above motion failed, Councilman Walmsley moved to adopt Resolution 525; Councilman Lander seconded the motion. The vote follows: Ayes: Councilman Lander, Pool and Walmsley Mayor Gentry Nays: Councilman Hutto Abstained: Councilwoman Wilbanks RESOLUTION NO. 525 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, CHANGING THE NAME OF THUNDERBIRD DRIVE LOCATED IN COUNTRY CLUB OAKS SUBDIVISION, SECTION III, TO QUAIL HOLLOW DRIVE AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Request from U. S. Steel Regarding Property Valuations Mr. Lanham received a letter from U. S. Steel indicating that they wish to protest the value placed on their property by the Equalization Board. Under the provisions of the Industrial District Contract, the Equalization Board is charged with the responsibility for arriving at these values. The rendition statement on their property was not sent to U. S. Steel until after October 1; therefore leaving no chance to issue protest prior to September 1. Since U. S. Steel did not have the opportunity to protest this value before September 1, they are asking that they be allowed to protest it at this time. The contract provides that, if protest is issued before September 1, then the Equalization Board may negotiate the values with the party. If protest is issued after September 1, then the next step would be arbitration. After this step, the matter would go to court. Since September 1, or the time for negotiation, has passed Mr. Lanham recommended that the City proceed with arbitration on this matter. In arbitration, the two parties can agree on one arbitrator or if not they can each select one arbitrator and these two arbitrators would select a third arbitrator. Councilman Pool moved to give U. S. Steel the right to arbitrate and authorize the City Administration to select an arbitrator. Councilman Hutto seconded the motion. The vote follows: Ayes: Council members Lander, Pool, Wilbanks, Hutto and Walmsley Mayor Gentry Nays: None Committee Reports None Unfinished Business The Administration feels that it may be necessary to televise some sanitary sewer lines on Cedar Bayou Road between Alexander Drive and McKinney Road to determine if sliplining is necessary since there have been cave -ins in this area. Also, there is a line near the traffic circle 5999 Minutes of the Special Session - December 23, 1975 that has had some problems and may require sliplining. Since these surfaces will be resurfaced soon, the Administration feels that these lines should be televised in order to check their condition so that sliplining can be completed before resurfacing or rebuilding. The cost for televising is approximately $1.00 to $1.25 per foot; the cost for sliplining is $15.00 per foot. Mr. Lanham requested approval to televise these lines and report back to the Council at a later date. Council concurred. Recess Mayor Gentry recessed the open meeting into an executive session for discussion of personnel matters. Reconvene When the meeting reconvened, Mr. Lanham recommended the appointment of Lawrence Gill Patterson as Personnel Director effective January 15. Councilman Hutto moved to appoint Mr. Patcerson as Personnel Director; Councilman Lander seconded the motion. The vote follows: Ayes: Council members Lander, Pool, Wilbanks, Hutto and Walmsley Mayor Gentry Nays: None There being no further business to transact, Councilman Walmsley moved to adjourn; Councilwoman Wilbanks seconded the motion.
