1975 07 18 CC Minutes, Emergency5864 MINUTES OF THE EMERGENCY MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN July 18, 1975 The City Council of the City of Baytown met in emergency session, Friday, July 18, 1975 at 8:30 A. M. in the Council Chamber of the Baytown City Hall. The following members attended: Jody Lander Councilman a Charles Pool Councilman Mary E. Wilbanks Councilwoman \ ■r Emmett O. Hutto Councilman Tom Walmsley Councilman Tom Gentry Mayor Fritz Lanham City Manager Neel Richardson City Attorney Absent: Fred Bednarski, Jr. Councilman Edna Oliver City Clerk Mayor Gentry called the meeting to order and the following business was transacted Designate Architect for the 1975 Capital Improvements Program and Authorize Mayor to Execute Contract for Architectural Services Proposed Orddnance No. 50718 -1 will authorize a contract for architectural service, for the design and building of the new library addition. The contract, for the most part, is standard; however, there are other conditions placed in the contract by the architect as a result of discussions with council. (1) The architect agrees to retain a qualified library consultant acceptable to the City Council. (2) The architect will retain qualified consulting engineers for electrical, plumbing, and mechanical & structural services, all of whom are to be acceptable to the City Council. (3) The architect will retain a cost consultant to assist and advise with cost estimates for the project as it is developed. (4) The architect will provide a scale model and a three - dimensional colored prospective to described the project. (5) The architect willpay for the four services listed above from the stated architect's fee of 7%. Certain provisions in the contract have been deleted. Article 6 - Payments to the Architect. (1) Delete provision regarding initial pyament. (2) Delete provisions regarding compensation if the contract time initially established in the construction contract is exceeded by more than thirty days. Article 9 - Ownership of Documents (1) The drawings andspecificaitons will remain the property of the architect. However, the article states that they are not to be used by the owner on other projects or extensions to this project. If there were to be another expansion in the future, this could be prohibitive, so the phrase "or extensions to this project" has been deleted. Councilman Pool moved to adopt proposed Ordinance NO. 50718 -1, entering into a contract with Davis & Burge Architects & Planners, Inc., under the terms of the contract as amended and recommended by the City Attorney; Councilman Lander seconded the motion: Ayes: Councilmembers Lander, Pool, Wilbanks, Hutto and Walmsley Mayor Gentry Nays: None ORDINANCE NO, 1828 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYT06N,TEXAS, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY OF BAYTOWN TO EXECUTE AND ATTEST TO A CONTRACT BETWEEN DAVIS & BURGE, ARCHITECTS- PLANNERS, INC., AND THE CITY OF BAYTOWN WITH REGARD TO PROVIDING ARCHITECTURAL SERVICES UNDER THE 1975 CAPITAL IMPROVEMENTS PROGRAM FOR ADDITIONS TO THE STERLING MUNICIPAL LIBRARY, BAYTOWN, TEXAS, AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. 5865 July 18; 1975 Designate Engineer for the 1975 Capital Improvements Program and Authorize Mayor to Execute Contract for Engineering Services Proposed Ordinance No. 50718 -A will authorize a contract with the engineering firm of Busch, Hutchison & Associates to handle the water, streets, drainage, and parks portions of the Capital Improvements Program. Councilman Hutto moved to adopt the ordinance; Councilman Walmsley seconded the motion: Ayes: Council members Lander, Pool, Wilbanks, Hutto and Walmsley Mayor Gentry Nays: None ORDINANCE NO..1829 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY OF BAYTOWN TO EXECUTE AND ATTEST TO A CONTRACT BETWEEN BUSCH, HUTCHISON & ASSOCIATES, INC., AND THE CITY OF BAYTOWN WITH REGARD TO ENGINEERING SERVICES UNDER THE 1975 CAPITAL IMPROVEMENTS PROGRAM FOR CONSTRUCTION OF A WATER DISTRIBUTION SYSTEM, BRIDGES AND STREETS, DRAINAGE IMPROVEMENTS, AND IMPROVEMENTS TO CITY PARKS AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Proposed Ordinance NO. 50718 -B will authorize a contract with the engineering firm of Langford Engineering, Inc., for the sanitary sewer portions of the.-Capital Improvements Program. Councilman Pool moved to adopt the ordinance; Councilman Lander seconded the motion: Ayes: Council members Lander, Pool, Wilbanks, Hutto and Walmsley Mayor Gentry Nays: None ORDINANCE NO. 1830 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY OF BAYTOWV TO EXECUTE AND ATTEST TO A CONTRACT BETWEEN LANGFORD ENGINEERING, INC., AND THE CITY OF BAYTOWN WITH REGARD TO ENGINEERING SERVICES UNDER THE 1975 CAPITAL IMPROVEMENTS PROGRAM FOR CONSTRUCTION OF IMPROVEMENTS TO THE CITY OF BAYTOWN'S SANITARY SEWER SYSTEM AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. For clarification, Mr. Lanham explained that because there are no plans for expenditures of the signalization portion of the CIP, it was not deemed timely to employ a consulting service at this time. With regard to the fire equipment approved by the voters, the fire cheif should submit specifications to council in approximately 60 days for approval.
