OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
April 30, 1975
The City Council of the City of Baytown met in special session, Wednesday
April 30, 1975, at 7:00 A. M. in the Council Chamber of the Baytown City Hall.

Mayor Gentry called the meeting to order and the following business was
transacted.
Canvass Special Run -Off Election and Declare Results
Mayor Gentry directed the canvassing of the April 22 Special Run -Off Election
for Council Representative of District U2 to begin. The canvass proved all
tabulations to be in order, with the results being:

RESOLUTION NO. 508
A RESOLUTION CANVASSING THE RETURNS OF THE SPECIAL MUNICIPAL
ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 22ND DAY OF
APRIL, 1975, FOR THE PURPOSE OF ELECTING A COUNCILMAN FROM
DISTRICT NO. TWO (2) TO SERVE A REGULAR TWO YEAR TERM; FINDING
THAT NOTICE OF SAID ELECTION WAS DULY AND PROPERLY GIVEN AND
THAT SAID ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF
MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE
STATE OF TEXAS.
Oath of Office.
Judge Steven Hebert administered the oath of office to Emmett 0. Hutto,
Council Representative of District No. 2. Congratulations were extended
to Mr. Hutto.

Ordinance Calling Municipal Bond Election

Proposed Ordinance NO. 50430 -1 will call a municipal bond election for the City
of Baytown, to be held May 27. The city attorney was directed to prepare this ordinance
at the last council meeting.
One of the items that council voted to have listed on the ballot was $250,000 for
the purchase of fire equipment. The Attorney General has ruled, however, that a city
cannot issue bonds for the purchase of equipment only. In the past, bond issues have
provided for construction of a fire station and equipping that station. Council may
issue certificates of obligation for the purchase of the equipment. For this reason,
and because of the recommendation of the Capital Improvements Committee, Mr. Lanham
recommended that there be a straw vote on this one item. When a person goes to the
polls to cas his vote on the other nine propositions, he would also be handed a paper
ballot which could be worded - "For or Against the Issuance of $250,000 in Certificates
of Obligation for the Purchase of Fire Equipment."
Councilman Pool moved that the nine propositions be placed on the ballot in the
order determined at the last council meeting, and that in addition, there be a straw
vote ballot regarding the purchase of fire equipment; Councilman Bednarski seconded
the motion.

There is one other problem that could arise concerning this bond election. There
is a Bill that has passed the Legislature and is on the Governor's desk for his
signature. The Bill would require that counties with over five percent of the population
having Spanish surnames, present the propositions to the voters in bilingual form.
There is an attempt to recall the Bill; however, should the Governor sign the Bill,
or wait ten days afterwhich it becomes law without his signature, Council may have to
repeal the ordinance calling the bond election and start the procedure over again.
Following discussion with Mr. Tom Masterson, fiscal advisor, Mayor Gentry called the
vote to adopt the ordinance.

WHEREAS, the City Council (the "City Council ") deems it necessary to call
the election hereinafter described and, subject to the results of the election,
to authorize the issuance of bonds;

Each presiding judge shall appoint not less than two or more than the
maximum number of election clerks specified above to serve at the polling place
under his jurisdiction.
Mrs. Edna Oliver is hereby appointed as the clerk for absentee voting, and

is hereby designated as the place for absentee voting for said election. During
the lawful absentee voting period said clerk shall keep said place for absentee
voting open for absentee voting from 8:00 a.m. to 5:00 p.m. on each day except

By approving and signing this ordinance the Mayor of the City officially
confirms his appointment of the aforesaid election officers to serve at the election,
and by adopting this ordinance the City Council approves and concurs in the appointment
of the aforesaid election officers.
Section 2. At said election the following PROPOSITIONS shall be submitted
in accordance with law:

BEARING INTEREST AT ANY RATE OR RATES NOT TO EXCEED THE MAXIMUM INTEREST RATE NOW

Each elector using voting machines and desiring to vote in favor of a proposition
shall moved the votiigpointer so as to indicate "FOR" the proposition, ane each
elector desiring to vote against a pooporition shall move the voting pointer so
as to indicate "AGAINST" the proposition. Each absentee elector using a paper
ballot shall vote on each proposition by placing an "X" or other clear mark in the
square beside the statement indicating the way such elector wishes to vote on the
proposition.
Section 4: It is hereby officially found and determined that certain decision
of the Supreme Court of the United States of America may have created uncertainty
as the lawful manner of calling and conducting said election; therefore, said
election shall be called, held, and conducted as two separate but simultaneous
elections, to -wit: one election at which only the resident, qualified electors
of the City who own taxable property within the City and who have rendered the
same for taxation shall be entitled to vote on the PROPOSITIONS and another
election at which all other resident, qualified electors of the City shall be
entitled to vote on the PROPOSITIONS. The votes cast at each of said separate
but simultaneous elections shall be recorded, returned, and canvassed separately.
Section 5: Notice of the election shall be given by posting a substantial
copy of this ordinance in a public place within the City and also at the City Hall
not less than fifteen days prior to the date set for the election, and by
publication thereof on the same day in each of two successive weeks in a newspaper
published in the City, the date of the first publication to be not less than
fourteen days prior to the date set for the election.
Section 6: It is hereby officially found and determined that the probable
period of usefulness of each of the projects described in the foregoing
PROPOSITIONS is forty years.
Section 7: All or any portion of the bonds described in the aforesaid
PROPOSITIONS 1 through 9 and the issuance of which is approved at the election
may be combined and issued as one or more issues or series of bonds.

Section 8: This issuance of the bonds described in the aforesaid PROPOSITIONS
1 through 9 is hereby authroized subject to approval at the election as hereinabove
set out; and, subject to said approval at the election and during each year while
any of the bonds described in the aforesaid PROPOSITIONS 1 through 9 are outstanding
and unpaid, the City Council shall compute and ascertain a rate and amount of ad valorem
tax which will be sufficient to raise and produce the money required to pay the interest
on the bonds as such interest comes due and to provide and maintain a sinking fund
adequate to pay the principal of such bonds as such principal matures but never less
than 2% of the original principal amount of said bonds as a sinking fund each year;
and said tax shall be based on the latest approved tax rolls of the City with full
allowance being made for tax delinquencies and the cost of tax collection. Said rate
and amount of ad valorem tax are hereby levied, and are hereby ordered to be
levied, against all taxable property in the City for each year while any of said
bonds or interest coupons appertaining thereto are outstanding and unpaid; and said
tax shall be assessed and collected each such year. Said ad valorem tax sufficient
to provide for the payment of the interest on and principal of said bonds, as such
interest comes due and such principal matures, is hereby pledged irrevocably for
such payment within the limit prescribed by law.
Section 9: This ordinance was read once by the City Council and shall take effect
immediately.
Section 10. It is hereby officially found and determined that the need of the
City for such financing creates an emergency and an urgent public necessity for the
holding, at the scheduled time, of the meeting of the City Council at which this
ordinance is adopted and for the adoption of this ordinance; and the NOTICE OF MEETING
relating to said meeting and heretofore posted by the City Clerk,and the posting thereof,
re hereby authorized, approved,adopted and ratified.

Consider Emergency Repairs to Water Well No. 3A

Support Increase in Community Development Funds
Proposed Resolution No. 509 will support an increase in funding for the
Community Development Block Grants. The Housing and Community Development Act
of 1974 which passed the U. S. Congress did not have sufficient appropriations
to fund all the programs;specifically, cities in the category of under 50,000
population will not receive funding because of the deficiencies in the Bill.
This resolution urges additional appropriation for this fiscal year so that
Baytown, and other cities in our category, may receive benefits from the Act.
The resolution also urges that in future years, the Act be properly funded.
Mr. Lanham recommended approval of the resolution;
Councilman Walmsley moved to accept the recommendation; Councilma lednarski
seconded the motion:

RESOLUTION NO. 509
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
SUPPORTING CURRENT EFFORTS TO SECURE ADDITIONAL APPROPRIATIONS
FROM THE CONGRESS OF THE UNITED STATES OF AMERICA TO SUPPLEMENT
FUNDING OF TITLE I OF THE HOUSING ANDCOMMUNITY DEVELOPMENT ACT
OF 1974.
Mr. Lanham informed council of the resignation of Mr. Howard Northcutt,
assistant city manager, to accept the position of City Manager of the City of
Liberty. Mr. Northcutt's resignation will be effective May lb, 1975.
