1975 02 27 CC Minutes5769 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN February 27, 1975 The City Council of the City of Baytown met in regular session, Thursday, Approve Minutes Councilman Lander moved approval of the minutes of themeeting held February 13, 1975, and ratification of actions taken at that meeting; Councilman Bednarski seconded the motion: Ayes: Council members Lander, Bednarski, Pool, and Wilbanks _ Mayor Gentry Nays: None City Managers Report Fire Station No. 6 has been inspected by the architect and a punch list was prepared. All work should be completed by March 6, and a final inspection has been scheduled for that date at 2:00 P. M. Of the three slip lining jobs underway, Clayton Street has been completed, work is in progress on Memorial, and work will begin on Woodlawn next. The administration has been approached by the contractor that will be working on Spur 201 regarding the possibility of the city being willing to accept material that will be dredged from Goose Creek Stream near the proposed Goose Creek Park. Fill material is needed for the park site, and the contractor has offered to pump the material to that site. Mr. Lanham recommended this offer be accepted if the Texas Highway Department, or the contactor, secures the necessary approval from the Corps of Engineers, and with the understanding that if any problems arise, this process will be discontinued. Council offered no objection. The engineer has advised that the contractor will complete pouring the concrete on Garth Road from the bridge, north to Baker Road, contingent upon the weather. Work has begun to prepare the area south of the bridge for excavation. With regard to the downtown improvements, the shelters have been completed, and work is underway on the planters. Mr. Lanham referred to a map showing the truck routes within the city, and recommended that additional routes be designated in an ordinance at the next council meeting. One would be Park Street, and upon completion of paving, Baker Road and Garth Road would be added. February 27, 1975 at 6:30 P. M. in the Council Chamber of the Baytown City Hall. One would be Park Street, and upon completion of paving, Baker Road and Garth Road would be added. 5770 February 27, 1975 Authorize Sale - $750,000 Junior Lien Water and Sewer Revenue Bonds In order to proceed with the enlargement of the East District Sewaage Treatment Plant, additional bonds must be sold amounting to $750,000. Mr. Tom Masterson, the city's fiscal advisor, explained that the only way to obtain those funds is to sell $750,000 in Junior Lien Water and Sewer Revenue Bonds. The bonds would be issued and dated April 1, 1975 and bear interest at five percent for a two -year period, or until April 1, 1977. During this two years, the bonds would be optional for redemption at the city's pleasure. After the two year period, the interest rate would escalate, on April 1, 1977, to nine percent. However, Mr. Masterson was confident that the bonds would be refunded well within the two years. The city's depository has indicated it will purchase $450,000 in bonds, and another bank has agreed to complete the purchase with $300,000 in bonds. If council approves, the advertisement will appear in the Baytown Sun and a trade publication on Monday. Bids will be considered at the next council meeting - March 13. Following discussion with Mr. Masterson, Councilman Lander moved to authorize the fiscal agent and administrative staff to advertise for bids as recommended. Councilman Bednarski seconded the motion: Ayes: Council members Lander, Bednarski,Pool, and Wilbanks Mayor Gentry Nays: None Proposed Industrial Waste Ordinance This ordinance will be considered at a future meeting. Increase Water Tapping and Sewer Tapping Fees Proposed Oridnance No. 50227 -1 will increase the water tapping and sewer tapping fees as follows. Water Sewer Current Proposed Current Prop. 111 3/4" tap - $75 $100 4" tap - $35 $70 1" tap - $125 $160 6" tap - $50 $100 The current water tap fees were established in 1968, and the current sewer tap fees in 1958. The increases are based on the average cost of installation at the present time. Larger size taps would be determined by the utility office manager and the director of public works, based on the cost of installation. All the residents of the newly annexed area nad Decker Drive have not yet tied onto the city's sewer and water. The water and sewer extensions to these areas were recently completed. Mr. Lanham suggested that the residents be notified by letter that the lines are ready for tie -ins, and that the tapping fees will be increased, effective April 1. By law, the residents are required to tie onto the city's sewer system, but they are not required to use the city's water. Councilman Pool moved to accept the recommendation; Councilman Bednarski seconded the motion: Ayes: Council members Lander, Bednarski, Pool, and Wilbanks Mayor Gentry Nays: None ORDINANCE NO. 1752 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 31, "UTILITIES," ARTICLE IV, WATER SERVICE, SECTION 31 -55, WATER TAPPING FEES, AND AFTICLE V, SEWER SERVICE, SECTION 31 -67, SEWER TAPPING FEES, TO REPEAL THE PROVISIONS OF SUCH SECTIONS AS PRESENTLY CONSTITUTED AND TO SUBMIT IN THEIR PLACES NEW SECTIONS 31 -55 AND 31 -67; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. February 27, 1975 5771 Authorize Payment - Fulbright & Jaworski for Legal Services Proposed Ordinance No. 50227 -2 will authorize payment to the law firm of Fulbright & Jaworski for legal services to the Baytown Area Water Authority. These services were rendered principally in connection with our application to the Texas Water Development Board for water rights, The amount due the law firm is $5,517.58, and the Baytown Area Water Authority Board of Directors has recommended approval. Councilman Bednarski moved to adopt the ordinance; Councilman Lander seconded tle.motion: Ayes: Council members Lander, Bednarski, Pool, and Wilbanks Mayor Gentry Nays: None ORDINANCE NO. 1753 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING AND ACCEPTING LEGAL SERVICES RENDERED BY FULBRIGHT & JAWORSKI; RECEIVING AND ACCEPTING THE STATEMENT FOR SAID LEGAL SERVICES; AUTHORIZING AND DIRECTING PAYMENT OF SAID FEES; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Reschedule Council Meeting Because the municipal election on April 1 must be canvassed on April 9, Councilman Lander moved that the first regular council meeting in April be held April 9; Councilwoman Wilbanks seconded the motion: Ayes: Council members Lander, Bednarski, Pool, and Wilbanks Mayor Gentry Nays: None i Set Date for Hearing of Benefits for Improvement to Post Oak Drive Proposed Ordinance No. 50227 -3 will set the date for the hearing of benefits i1 for improvement to Post Oak Drive. Councilwoman Wilbanks moved to adopt the ordinance, setting the date for the hearing as April 9 at 7:00 P.M.; Councilman Bednarski seconded the motion: Ayes: Council members Lander, Bednarski, Pool, and Wilbanks Mayor Gentry Nays: None ORDINANCE NO. 1754 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, RATIFYING AND CONFIRMING ACTION HERETOFORE TAKEN IN THE MATTER OF THE PERMANENT IMPROVEMENT OF POST OAK DRIVE WITHIN THE LIMITS HEREINBELOW SET OUT; APPROVING AND ADOPTING THE WRITTEN STATEMENT OF THE CITY'S CONSULTING ENGINEERS SHOWING THE ESTIMATED COSTS OF IMPROVEMENLSON SAID STREET, INCLUDING ESTIMATES OF THE AMOUNTS PER FRONT FOOT PROPOSED TO BE ASSESSED AGAINST THE PROPERTY ABUTTING UPON SAID STREET TO BE IMPROVED AND THE OWNERS THEREOF, AND OF OTHER COSTS AND MATTER RELATING THERETO, ORDERING THAT A HEARING BE HELD AND GIVEN TO ALL OWING OR CLAIMING INTERESTS IN PROPERTY ABUTTING SUCH PROPOSED IMPROVEMENTS AS TO OTHER MATTERS RELATING THERETO, SETTING AND FIXING THE TIME AND PLACE OF SAID HEARING AND DIRECTING THAT NOTICE THEREOF BE GIVEN AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Award Bid - Service Monitor for Police Department Bids were received for a service monitor for a high frequency radio at the police department. The tabulation follows: DIVERSITY COMMUNICATIONS ANDERSON ASSOC. GENERAL ELECTRIC CUSHMAN ELECTEDNICS $5,495.00 $7,000.00 $7,050.00 $7,063.00 Thelow bid of Diversity Communications did not meet specifications; therefore, Mr. Lanham recommended awarding the second low bid of Anderson Associates in the amount of $7,000. This is about $600 over the estimate. Councilman Pool moved to accept the recommendation; Councilman Bednarski seconded the motion: Ayes: Council members Lander, Bednarski, Pool and Wilbanks Mayor Gentry Nays: None :)//L February 27, 1975 ORDINANCE NO. 1755 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF ANDERSON ASSOCIATES, INC., FOR THE PURCHASE OF ONE SERVICE MONITOR AND AUTHORIZING THE PAYMENT BY THE CITY OF THE SUM OF SEVEN THOUSAND AND N01100 ($7,000.00) DOLLARS. Set Date for Public Hearing - Annexation Certain Properties owned by Gulf Oil Corp. Proposed Ordinance No. 50213 -11 will schedule a public hearing on the annexation of certain properties owned by Gulf Oil Corporation for March 13 at 7:00 P. M. This is necessary to implement our Industrial District Policy. Councilman Bednarski moved to adopt the ordinance; Councilman Pool seconded the motion: Ayes: Council members Lander, Bednarski, Pool and Wilbanks Mayor Gentry Nays: None ORDINANCE NO. 1756 AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF CERTAIN PROPERTY BY THE CITY OF BAYTOWN, TEXAS; AUTHORIZING AND DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF SUCH PUBLIC HEARING AND PROVIDING FOR THF.EFFECTIVE DATE TiEREOF. Authorize Agreement with Chambers County for Spur 55 Right of Way Proposed Ordinance No. 50227 -6 will authorize the Mayor to execute an agreement with Chambers County with regard to right of way for spur 55. The cost of relocation of pipelines and other utilities within this right of way is estimated to be $200,000. Baytown has agreed to provide half of this cost, and will issue Certificates of Obligation to finance this project. Councilman Bednarski moved to adopt the ordinance; Councilman Lander seconded the motion: Ayes: Council members Lander, Bednarski,Pool, Wilbanks Mayor Gentry Nays: None ORDINANCE NO. 1757 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO AN AGREEMENT WITH CHAMBERS COUNTY, TEXAS, FOR THE JOINT PARTICIPATION BY THE CITY OF BAYTOWN AND CHAMBERS COUNTY FOR THE ACQUISITION OF RIGHT OF WAY FOR SPUR 55 INCLUDING THE ADJUSTMENT, REMOVAL OR RELOCATION OF EXISTING UTILITY FACILITIES WITHIN SAID RIGHT OF 14AY AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Authorize Change Order - East /West Thoroughfare Project When the East /West Thoroughfare was constructed, several blocks of Sterling and Defee were reconstructed, including base material. About one and one -ha one -half blocks of Sterling, between Fourth and Sixth Streets, was not reconstructed, however, because the base material appeared to be in good condition. The traffic on Sterling has increased substantially, and as a result this section was damaged. Brown and Root has agreed to rebuild this section of Sterling at the prices which were quoted in the original contract. The estimate for this project is y $2,570, and willbe paid from 1970 Capital Improvement Funds, and Mr. Lanham recommended approval of thechange order. Councilman Pool moved to accept the recommendation; Councilman Lander seconded the motion: Ayes: Council members Lander, Bednarski,Pool, and Wilbanks Mayro Gentry Nays: None ORDINANCE NO. 1758 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOW, TEXAS, AUTHORIZING A CHANGE ORDER TO THE CONTRACT WITH BROWN & ROOT, INC., FOR THE CONSTRUCTION OF THE EAST -WEST THOROUGHFARE (DEFEE AND STERLING STREETS), JOB NO. 72 -524, AND PROVIDING FOR THE EFFECIVE DATE HEREOF. February 27, 1975 Committee Reports 5773 Councilwoman Wilbanks brought to Council's attention the hesitancy of commissioners court to concur with the Governor's designation of the Houston - Galveston Area Council as the planning agency for this region for the Waste Treatment Management Plan. The city council approved this at the meeting of February 13. Mayor Gentry requested Mr. Lanham to contact Baytown 'a commissioner and find out what stand commissioners court is taking on this matter.
