The City Council of the City of Baytown met in special session, Tuesday,
February 4, 1975 at 5:00 p.m., in the Council Chamber of the Baytown City Ball
with the following members in attendance:

Mayor Gentry called the meeting to order and the following items of
business were considered.
Agreement with Harris County for Funds ihder Title VI, C.E.T.A. - Ordinance
Mr. Lanham reported the favorable acceptance by the County of his request
for funds under Title VI, C.E.T.A. and the City has been allocated $88,898.00.
He has conferred with the supervisors of several departmnns and received
requests as follows:

Total number requested is thirteen (13) with a total expenditure for eleven
(11) myths including social security and workmen's compensation is estimated
at $87,825.00. Since the preparation of the agenda, however, Mr. Lanham stated
that he had received a request from Mrs. Rowe of the Baytown Housing Authority
for two additional people. He stated that those hired in the Public Works
department would be used mostly for street maintenance, including all phases.
In the Finance division, it is possible the position cannot be filled due to the
requirenents of the law. The present budget of the City provides for a Chief
Accountant but the position was vacated after the budget was prepared and no
one has been hired to fill the position but some of the moneys provided in the
budget are presently being used to cover part of the salary of a person whose
work is satisfactory but does not have the training and background to qualify
as a Chief Accountant. Mr. Lanham stated it was his understanding that the
City could get an amendment to the agreenent and establish another classification
if the position cannot be filled. This would require the filing of a modification
Plan. Mr. Pool proposed to amend the requests to increase the number in Public
' Works to seven (7), reduce Parks & Recreation by two (2) in the Neighborhood
Center Supervisory allocation and the remaining r ,+asts to remain as presented.
His reason for the reduction being that he felt the city would have to continue
with this type program after the Federal funds are expended thus increasing
the overall budget of the City. Councilwoman Wilbanks opposed the reduction
because she felt this was an opportunity for the Council to learn how many
extra hours are actually needed with a very small sum of money to serve a
concentrated part of Baytown's citizenry. After same further discussion,
Councilman Pool moved to amend the request to increase the Public Works additional

employees to seven (7); to reduce Parks & Recreation Neighborhood Center
Supervisor to one (1), and the other job titles approved as submitted, with
the adoption of an ordinance setting forth the acme c3ment. Councilman Dittman
seconded the motion. The vote follows:

EXECU`IE A CONTRACT WITH HARRIS COUNTY FOR FUNDS UNDER TITIR VI OE' THE
COMPREHENSIVE EMPLOYMENT AND TRAINING ACT (EMERGENCY JOBS AND UNEMPIAYMENT
ASSISTANCE ACT) AND PROVIDING FOR THE EFFEC'T'IVE DATE HEREOF.
ORDINANCE - Authorizing Emergency Sliplining Repair of Sewer Lines
Mr. Lanham reported emergency bids were sought for sliplini.ng sewer lines
on Woodlawn, from East Fayle to Dwinnell; in alley between Clayton and Raintree,
fresn Ivie Lee to Ward Road; and (3) Memorial Drive, from Decker 500 feet east.
Naylor Pipe Cleaning Company was the only bid received in the amount of $3.88
per foot and the total estimated cost of repairs including labor, materials
and equipment is $4,160. It was his recommendation that the ordinance declaring
the emergency and awarding the contract be adopted and expenditure be charged
to the 1970 Bond Fund as this was an improvement to the city's system. He also
stated that the Administration has begun to gather figures on the cost of buying
equipment so that the City can do this slip lining work without going through
this process. This type study will be completed in time for the Council to
give it consideration during the annual budget study. Following discussion,
Councilman Dittman moved to accept the reeamendation of the City Manager and
the ordinance be adopted. Councilman Lander seconded the motion. The vote
follows:

THE EMERGENCY REPAIR OF SANITARY SEWER LINES ON AN ESTIMTED FOOTAGE BASIS
AND AUTHORIZING THE CONTRACTING OF BY THE CITY FOR SAID
EMM4CY REPAIR WITH THE CCMPE M7TON TO BE PAID TO BE BASED UPON THE
AMOUNT OF SLIPLINING REQUIRED AND PROVIDING FOR THE EFFECTIVE DATE MM-
OF.
Report - Removal of West Baytown Sewage Treatment Plant
Mr. Lanham reported on the costs involved in the removal of the West
Baytown Sewage Treatment Plant by city forces as per agreement with Exxon
Company. The estimate totaled between $39,000.00 to $40,000.00. Exxon is
in the process of building a levee on Black Duck Bay and the contractor,
working for Exxon will remove the old plant for $38,500.00, and the city
would prefer that it be removed in this manner. Since the City is obligated
by contract, the Council instructed the City Manager to inform Exxon that,
conditioned upon Exxon agreeing that liquidated damages will be limited to
$38,500.00, the City of Baytown will not be able to immediately perform its
obligation to remove all these improvements and restore it to its condition
at the date of the referred to lease. This would in effect, be in breach of
the City's lease and upon the Company's release, the City could enter into an
agreement with Eamon Company to remove the plant.

Councilman Lander - Report Informal Hearing Board Groundwater Control District
Councilman Lander, representing the City Council at the informal hearing
in Austin on the groundwater control district, stated that same type of legis-
lation was favored as no one spoke in opposition to the bill, which was the
third draft of the original proposal. At the end of the hearing a motion was
made that the legislation be submitted to the Legislature on February 5. Frcm
this point it will be referred to another committee for further study and writing
the final draft which will be considered at another legislative hearing. He
stated that Attorney General John Hill supported the bill and has shown much
concern and great interest in seeing the bill is properly written. However, in
the bill presented at the hearing, Baytown had no representative on the Board.
Heretofore, the bill which had been considered included a representative frcm
Baytown on the Board and the Mayor and Council were greatly concerned about
Baytown being cmitted in this draft. Subsidence is a major problem in this
area and they were of the opinion that it was imperative for Baytown to have
this representation. Following some discussion, the City Manager was instructed
to contact Representative Joe Allen and stress that he use his influence in
amending the bill to give Baytown proper representation prior to its presentation
to the Legislature.

There being no further business to cane before the Council, the motion was
made by Councilman Bednarski, seconded by Councilman Dittman, to adjourn. The
Mayor declared the meeting adjourned.
