1974 10 24 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN October 24, 1974 The City Council of the City of Baytown met in regular session, Thursday, October 24, 1974, at 6:30 P. M. in the Council Chamber of the Baytown City Hall. The following members were in attendance: Jody Lander * Fred Bednarski Charles Pool Mary E. Cooper, Trinity Episcopal Church. Approve Minutes Councilman Dittman moved approval of October 10 and 16, and ratification of actions Lander seconded the motion: Ayes: Council members Lander, Pool, Mayor Gentry Nays: None City Manager's Report the minutes of the meetings held taken at those meetings; Councilman Wilbanks, Dittman and Walmsley 5710 Mr. Lanham presented a letter from Exxon Annuitants and Senior Citizens of Baytown, expressing their appreciation for council's action in increasing the tax exemption for persons over 65 to $4,000. Mr. Lanham referred to a letter from Mr. Joe P. Smith of Western Refuse in Pasadena, explaining that the market for recyclable paper has continued to decline and that the service to Baytown will either have to be discontinued, or subsidized by the City. This subsidy would cover the operating costs for the drive to Baytown, from Pasadena, although no amount was mentioned. Following discussion, Council concurred that a letter be written to Mr. Smith, thanking him for doing business with Baytown, and discontinuing the paper pickups. 7 If the market for reclyclable paper improves,. council could consider this project again. ( *Councilman Bednarski present) The League of Women Voters has requested city officials sponsor a "State of the City" meeting, where problems and progress of Baytown might be reported and discussed. However, since there will be a Capital Improvements Committee working within the next few weeks, the League may sponsor a public meeting, in cooperation with the citizens committee, prior to the bond election so the proposals could be discussed by interested citizens. It is possible that next summer or spring, the council and administration could gima some type of presentation. 5711 City Manager's Report, continued i October 24, 1974 Mr. Al Chappell, General Manager of General Telephone, has requested an opportunity to meet with council at an informal meeting to give a report on the operations of the telephone company. Council concurred to meet November 14 at 6:00 P. M. Since the second council meeting in November falls on Thanksgiving Day, Council concurred to have the second meeting on Tuesday, November 26. The city employees have voted to take the "floating holiday" for this year on the day after Thanksgiving. Council offered no objection. The contractor on Garth Road has made good progress. He has paved 3100 feet of 24 -inch wide pavement on the west side, and has the remainder of the subgrade on the west side prepared for concrete. He will begin work on the east one -third of the roadway, north of the bridge next week. All of the water lines in Glen Arbor are in place. Approximately 400 service connections have been;mad = and cleanup work is continuing. League of Women Voters Park - the contractor is having difficulty getting limestone, so work on the tennis courts has been delayed. Jenkins - Hollaway Park - the hike & bike trails have been completed; the subgrade for the tennis courts, parking lot, and drive has been stabilized with lime. Pelly Park - work on the shelter and concession stand is substantially complete. Sanitary Sewer Projects: Contract #1 - A punch list will be made next week of those items that need to be done to finalize this project. Contract #2 - The lift stations are all complete; the entire contract is 98% complete. Contract #3 - No progress has been made since the last report, although equipment has been moved onto the site. The surety for Bayshore Constructors has been asked to assume and complete the contract. Contract #5 - The contractor is pumping the water from the 36" line in preparation for cleaning. Contract #7 - This project is essentially ready for final inspection, with the exception of the lift station near Sterling High School. At the council meeting on September,26 , council was requested to consider establishing a Baytown American Revolution Bicentennial Commission. The necessary information for applying for federal funding has been gathered. Following discussion, Council concurred to authorize setting up a commission of 25 members. The council will submit names of citizens in the community to Mr. Lanham, and after approximately 30 days, a recommendation will be made to council. Councilman Dittman introduced a resolution supporting Mr. Jon'. Lindsay for Harris County Judge, and moved adoption. Mayor Gentry declared the motion dead for lack of a second. Councilman Dittman introduced a resolution urging people to vote,Nov. 5, and moved adoption; Councilman Walmsley seconded the motion: Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Walmsley Mayor Gentry Nays: None 5712 October 24, 1974 Chamber of Commerce Flood Protection Committee Mr. Lanham gave a brief report on the activities of the Chamber of Commerce Flood Protection Committee. The last report was July 25, at which time council adopted a resolution urging the Corps of Engineers to re- evaluate the benefit -cost ratio for the Baytown flood protection facilities. The Committee has made on site inspections of the flood protection facilities in Port Arthur, Texas City and Freeport. They have met with Congressman Eckhardt to review the status and plans, and have received his endorsement with an appropriate letter from him to the Corps of Engineers. Twenty -four presentations have been made by the Committee to Baytown civic and social groups to communicate the threat of hurricane and tidal flooding. Baytown and surrounding area was fortunate in 1974 to have suffered no storm effects; however, the Committee wants to guard against a lessening of interest in flood protection facilities because statistically, we are more due for a hurricane next year. On October 3, a subgroup of the Committee met with the Corps of Engineers, who have been authorized and funded to undertake the Baytown study, and rev iewed all of our data on subsidence, elevations, flood protection and facility alternatives. Another meeting is scheduled prior to Thanksgiving. The targeted completion date of the Corps' study is March, 1975. The key part of the Committee's work is defining to -cost flood protection facilities that will protecting a high population density in low -lying areas. The next major piece of work for the Committee is a definition of the most appropriate manner for turning this flood protection work over to a governmental agency. The Corps insists in dealing with one agency only, so this agency must be recognized as having legal status as being the representative of the local citizenry. This is necessary if federal funding is to be involved. Several possibilities will be explored, i.e., city, county, drainage district, Baytown Levee District, or a new agency. The Committee has requested informal suggestions from Council as to what type of agency should shoulder this responsibility. The next status report should be made about mid - December. Consider Plans and Specifications - Downtown Improvement�Project In August, Council authorized preparation of plans and specifications for the.downtown improvement project, with the estimated cost for the City's share to be $45,500, to be financed with Revenue Sharing Funds. In addition, the downtown merchants have raised almost $20,000 to cover their portion of the cost of plannings and shelters. Mr. Jack Morton presented the plans, which have been reviewed by Mr. Jack KimmonR and Mr. Guy Hays, representatives of the downtown merchants. In discussing the plans, the question was raised about resurfacing sidewalks. Mr. Morton explained that this was considered, however, was not included in the plans because of the cost. Councilman Lander moved to authorize advertising for bids; Councilman Bednarski seconded the motion: Ayes: Council members Lander, Bednarski, Wilbanks, Dittman and Walmsley Mayor Gentry Nays: Councilman Pool Renew Contract for Hospitalization & Life Insurance Proposed Ordinance No. 41024 -1 will renew the contract for hospitalization and life insurance coverage for city employees and dependents. The City was advised in August that Fidelity Bankers Life had sold our contract to American National Insurance Company of Galveston. The contract with this carrier expires December 1, and they have advised that they are willing to continue to provide coverage at our present rates. The employees' insurance committee has recommended that the contract be renewed with American National, and Mr. Lanham concurred. The bid of Sears did not meet the specifications; - and the other bid is exceeds the money available. The specifications will probably be rewritten to specify cedar, and then readvertised. Council offered no objection to the recommendation. This fence is for storage of abandonedu vehicles at the police station. A letter was received from a representative of Pak Mor Manufacturing Company, requesting the bid opening date be extended, and the specifications be re- written to allow his company to bid. Mr. Doug Lunceford explained that the Pak -Mor unit is driven by a chain, and persons contacted regarding this type equipment have indicated that they have experienced problems with the chain driven units. Texas Utility Advisory Council Several months ago, the matter of becoming a member of the Texas Utility Advisory Council was discussed, and council was asked to indicate if it might be interested in joining such an organization. This organization has now been established and the city attorney serves as chairman of one of the subcommittees. The city is now being asked to participate to the extent of paying dues, in the amount of $660 for a city of our size. Based on the situation today with utilities, Mr. Lanham recommended becoming a member of this Council. If a state commission should be established by the Legislature, it would be at least a year before it would be in operation. Councilman Dittman moved to join the Texas Utility Advisory Council for one year; Councilman Lander seconded the motion. Mr. Richardson gave a brief summary of the purpose of the Council, which is to assist cities in the regulation of utility rates. There is always a controversy as to what assets of the company should be included in the rate base, and what is a fair rate of return. This organization would hire a rate consultant to assist the cities in making these determinations.
