MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
July 11, 1974
The City Council of the City of Baytown met in regular session, Thursday,
July 11, 1974, at 6:30 P. M., in the Council Chamber of the Baytown City Hall. The
following members were in attendance:

Mayor Gentry called the meeting to order. The invocation was offered
by Mrs. Edna Oliver.
Approve Minutes
The first item of business was consideration of the minutes of the council
meeting of June 26, and ratification of the actions taken at that meeting. Councilman
Pool corrected a sentence in the discussion of the multi- purpose sports field at
Peely Park, which should read: "In case there are legal problems that cannot be worked
out with the Central Little League regarding the field, it will still be used by
other groups for a sports field."
Councilman Cannon moved approval of the minutes as corrected; Councilman
Bednarski seconded the motion:

Mr. W. P. Smith presented a petition requesting a dog catcher patrol from
5:00 p.m. until 12:00 midnight. Mr. Smith explained the reason for the request is
because most people walk and ride bicycles after 6:00 p.m. , and this is the time
most dogs are turned loose. The petition was circulated by the Senior Citizens Club
of Baytown.
Mr. Charlie Caldwell stated that the purpose of the petition was not to
make anyone get rid of pets, but to ask for support of the city government and all
citizens to help eliminate the unpleasant problems caused by unwanted and uncared
for dogs and cats. Mr. Caldwell was of the opinion thatmost citizens would accept
an additional tax burden in order to employ more personnel for such a patrol.
Councilman Dittman moved to accept the petition and instruct the administra-
tion to determine what action is necessary to get the people to take care of the
situation as it is now, and to report back to Council; Councilwoman Wilbanks seconded
the motion:

Mr. Lanham presented a petition signed by thirty -four young people,
requesting a bicycle path be constructed on Bayway Drive, enabling them to
ride to school, church, Sears, and downtown Baytown.
Councilman Lander moved to accept the petition, and refer it to the
administration to determine the feasibility of this type of facility;
Councilman Pool seconded the motion:

Baker Road was recently changed to Hugh Echols Blvd by Harris
County Commissioner Bray. Councilman Dittman presented a petition signed by
seventy -nine people at St. James House, outlining the inconveniences this will,
and has has caused the residents, and suggesting that a street in a new
subdivision be named to honor Mr. Echols. Councilman Lander seconded
the motion:
In discussion, Mr. Lanham explained that State law places the
responsibility of naming streets, in incorporated - areas, with the city.
The Planning Commission approves the names of streets in new subdivisions.
Regarding the name change of existing streets, it has been the practice that
these be brought to the city council.
The vote on the motion was then called:

City Manager's Report
The Texas Highway Department has advised the Loop 201 and Spur 330
have been scheduled for September letting.
No decision has been made on Bayway Drive by the Highway Department;
however, no action was taken on other streets that were recommended at the
same time for improvement.
Work is scheduled to be done to alleviate the flooding under the
Loop 201 overpass at Highway 146.
A check from the EPA has been received in the amount of $945,100.
The first check received was $1,561,800. This is payment for the Central
District Sanitary Sewer Improvements.
At the last council meeting, the administration was requested to look
into the number and location of people living outside the City limits, but using
city water and sewer. There is no one living outside Baytown using the
city's sewer system. There are sixteen residents on Hardin Road, and one
resident on East Road north of the Sports Complex that use the city's water services
However, none of these locations are adjacent to the city on three sides of the
property, as Mr. Wright on Massey Tompkins, who requested water & sewer without
being annexed.
Water Bills for the month of June will be higher because people are
using more water. Total Ovate r pumped for June was 207 million gallons. Last
years, the June total was 174 million gallons. This averages to approximately
9 million gallons per day. Mayor Gentry suggested appealing to the citizens
to use water sparingly because this amount is taxing our source of water.

Drainage Work

The storm sewer and ditch work has been completed in the Lakewood,
Pin Oak Drive area, the entire project is about 85% complete.
work is about 70% complete on Crosby -Cedar Bayou Road and Highway 146.
Work on East Texas is 65% complete.
Work on the ditch near North Main and Cedar Bayou Road will begin tomorrow.
Bond Fund Projects
The utility companies are still moving lines on Garth Road. The paving
contractor expects to begin work next week.
Waterlines in Glen Arbor is 40% complete. The contractor is installing
the twelve -inch line on Garth Road.
Progress on the League of Women Voters Park has been slowed by difficulty
in getting delivery of limestone.
The tricycle freeway at Pelly Park has been poured.
The contractor is still waiting for delivery on one part in order to
complete work at the West Main Treatment Plant. Contract #2 is 90% complete.
Contract #3 Is 94% complete - the contractor has installed the 18 -inch gravity
sewer line that parallels 201 near West Main. Contract #5 is 91% complete- the
contractor has experienced more problems in the vicinity of Gulf Coast Hospital,
and is preparing the line for internal inspection. A report will be made at the
next council meeting, or before that time in a special meeting. Contract #7 is
30% complete; the contractor has installed the 12 -inch line on Baker Road, and is
in the process of boring across Decker at Baker.
Congratulations were extended to City Clerk Edna Oliver for being named
First Chairman of the Board of the Graduate Institute of Registered, Certified
City Clerks of Secretaries of Texas.
Bid for N. C. Foote Park Swimming Pool Lockers
One bid was received for the purchase of lockers for the swimming pool
at N. C. Foote Park. Councilman Cannon moved to open the bid; Councilman Dittman
seconded the motion:

VAUGHAN & ASSOC: $1,657.87
The bids was given to Mr. Rountree for evaluation, to be considered later
in the meeting.
Chamber of Commerce Flood Protection Committee
Proposed Resolution No. 474 will pledge the city's support and cooperation
with the Chamber of Commerce Flood Protection Committee, as discussed at the last
council meeetng.
Councilman Bednarski moved adoption, Councilman Lander seconded the motion.

RESOLUTION NO. 474
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ENDORSING AND PLEDGING THE SUPPORT AND COOPERATION
OF'THE CITY OF BAYTOWN TO THE BAYTOWN CHAMBER OF COMMERCE
FLOOD PROTECTION COMMITTEE IN ITS EFFORTS TO DEVELOP A
DEFINITIVE PLAN TO PROTECT BAYTOWN AGAINST FLOODING.

ADDITION OF A NEW COUNCIL DISTRICT NO. 5 IN ORDER THAT THE NEWLY ANNEXED
TERRITORY IN THE VICINITY OF CHAPARRAL DRIVE MAY BE INCLUDED IN THE PROPER
COUNCIL DISTRICT; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF.

This material will be used for the outfall ditch behind Griffin Enterprises on
North Main. Mr. Lanham recommended awarding the low bid of Wyatt, Division, U.S.I.;
Seventeen Thousand Dollars will be paid from 1973 Revenue Sharing Funds, and the additional
will have to be paid from 1974 Revenue Sharing Funds earmarked for drainage projects.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING
THE BID OF WYATT DIVISION, U.S.I. FOR THE PURCHASE OF CORRUGATED GALVANIZED
METAL PIPE AND AUTHORIZING THE PAYMENT BY THE CITY OF THE SUM OF NINETEEN
THOUSAND NINE HUNDRED AND N01100 ($19,900.00) DOLLARS WITH REGARD TO SUCH
ACCEPTANCE.
Award Bid - Central Air & Heat
Bids were received June 26 for installing central air conditioning and heat
in Fire Station No. 4.

Two of the bids were submitted by city employees; it is a violation of the
City Charter to award bids to persons employed by the City. For this reason,
Mr. Lanham recommended awarding the bid to Moore Air Conditioning. One Thousand
Dollars was encumbered from the 1972 -73 budget for this, and the remaining $265
will be paid from the present budget. CouncilmanDittman moved to award the bid as
recommended; Councilman Bednarski seconded the motion:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING
THE BID OF MOORE AIR CONDITIONING FOR THE INSTALLATION OF CENTRAL AIR AND
HEAT AT FIRE-STATION NO. 4 AND AUTHORIZING THE PAYMENT BY THE CITY OF THE
SUM OF ONE THOUSAND TWO HUNDRED SIXTY -FIVE AND N01100 ($1,265.00) DOLLARS
WITH REGARD TO SUCH ACCEPTANCE.
Award Bid - Lockers for N. C. Foote Park Swimming Pool
The bid opened earlier during the council meeting for lockers for the swimming
pool at N. C. Foote Park has been evaluated, and is approximately $100 higher than
last year's bid. Mr. Lanham recommended awarding the bid. Councilman Lander moved
to accept the recommendation; Councilman Bednarski seconded the motion:

N. C. FOOTE PARK SWIMMING POOL AND AUTHORIZING THE PAYMENT BY THE CITY OF
THE SUM OF ONE THOUSAND SIX HUNDRED FIFTY -SEVEN AND 871100 ($1,657.87) DOLLARS
WITH REGARD TO SUCH ACCEPTANCE.
