1974 05 09 CC Minutes5618 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN MAY 9, 1974 Mr. Lanham presented a petition from property owners abutting Caldwell Street, requesting that it be paved under the assessment paving program, from Robin Road to Post Oak Drive. THe administration will proceed with determining the percentage of property owners that signed the petition, and the percentage of property represented by the petition. Councilwoman wilbanks moved to accept the petition pending this determination by the administration; Councilman Dittman seconded the motion: Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays: None Mr. Lanham presented a copy of a petition addressed to the Harris County Flood Control District, requesting that the erroding HCFC ditch backing Inwood and Columbia Streets and running through the back portion of properties there, be replaced with a concrete trough as was promised in January. This has been discussed with the County Flood Control Engineer, and is a project that will be done by Harris County. Recognize Scout Troop Mayor Gentry recognized members of Boy Scouts, Troop #93, sponsored by Cedar Bayou Methodist Church, attending the council meeting. The boy scouts of Baytown were commended for their efforts to beautify the city's thoroughfares several weeks ago. Also, the junior and senior high schools will be embarking on:a project on Saturday, to clean up and beautify the thoroughfares. The invocation was offered by Reverend Douglas E. Meyer, Pastor of St. John's Methodist Church. Also, the junior and senior high schools will be embarking on:a project on Saturday, to clean up and beautify the thoroughfares. 5619 City Manager's Report Notification has been received from the Secretary of the Treasury that the Revenue Sharing allocation for the next entitlement period - July 1,'74 thru June 30,175, will be in the amount of $500,897.00. This is approximately $25,000 less than the amount received for the current period. It is necessary to submit the Planned Use Report to the federal government by June 24; the administration is now in the process of developing recommendations for this. The official opening of the N. C. Foote Park swimming pool _-_ will be held Friday, May 25, at 11:00 a.m. At the last meeting, Council selected a date for the presentation of the report by the Corps of Engineers on the flood plain study of Goose Creek, however, the Corps has notified the administration that they will not be able to meet with council on this date. Following discussion, Council concurred to re- schedule the meeting for 6:30 p.m., Wednesday Mazy 29. The city is required to have Workmen's Compensation for employees beginning in July. The Texas Municipal League has established a Workmen's Compaseation Fund, and the time is nearing when a decision must be made on whether to participate in the TML's program, or to purchase coverage from a private agent. Several local insurance representatives have requested an opportunity to present what they can offer the city in private coverage. Council.: concurred to meet at 6:30 a.m., May 14, with the local representatives. There has been a significant increase in building activity in Baytown. The monthly report from the Inspections Department shows that through April of this year, building permits have been issued totaling $6.6 Million Dollars. Last year at this time the permits totaled $1.7 Million Dollars. The attorney requesting council approval of the formation of Harris County Municipal Utility District #80 has requested this item be reconsidered. Council concurred to place this on the agenda of the next council meeting. Work is nearing completion on the Baker- Bayway drainage work. Work should be completed next week on Cedar Bayou, Elvinta and Kilgore Roads. City crews have installed 900 -feet of waterline on Garth Road. Councilman Cannon moved to formally commend Doug Lunceford and his department for the way the workload was handled during the time that the city's landfill was closed; Councilman Bednarski seconded tle- motion: Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman & Cannon Mayor Gentry Nays: None Capital Improvements -- Revised plans for Fire Station #6 will be presented at the next meeting. The public works service center should be completed early next month. Sewer System Improvements— Final cleanup is underway at the West Main Plant.. Cleanup is underway at the lift stations on Texas Avenue, Spur 201, and Missouri Street; no progress has been made on West Main and Craigmant. Until the interceptor lines coming into these lift stations are complete, these stations could not be put into service. Contract #3 - equipment has been moved onto the job site near city hall. No work has been done along Spur 201 right of way. The contractor has been notified that the city expects progress within the next few days. Contract #4 is complete; finaj inspection will be made within the next week. Contract #5 is 82% complete; the contractor is installing 21 -Inch line on the Branscome tract, and work will begin next week behind Gulf Coast Hospital. May 9, 1974 5620 Contract #7, in the vicinity of Sterling High School is 15% complete. The contractor is installing a 12 -inch line on Baker in front of the Creative Arms Apartments; work has been slow in this area because of bad soil conditions and the existing storm sewer. The contractor has also installed the 18 -inch line from the lift station, near Sterling High School, to East Road. Garth Road - All but forth feet of the storm sewer has been installed. Tenth Street - work is complete with the exception of connecting the new pavement with Fayle Street. Waterlines in Glen Arbor - Eleven Hundred feet of 8 -inch line, and Eight Hundred feet of 6 -inch line has been installed. Clearing work is complete and shaping the fish pond is underway at the League of Women Voters Park. The parking lot has been completed for Pelly Park. Public Hearing - Annexation At 7:00 p.m., Mayor Gentry directed the public hearing to begin for the annex- ation of the following properties: a) Certain area north of Massey Tompkins and east of Chaparral Drive; b) Chaparral Village, Section 3, c) Certain area north of Massey Tompkins ans west of Chaparral Drive. .Although no one appeared before council regarding theproposed annexations; Mr. Lanham reported that Mr. C. A. Wright, owner of the property in Item C, has requested that annexation proceedings be discontinued on his property, as he has withdrawn his request for city water & sewer service. Mayor Gentry then declared the public hearing closed. Street Improvement Mrs. Murrie Kinney was scheduled to appear to discuss street improvements; however, was not prsent. Grant Easements to Texas Eastern Transmission:: Corporation Proposed Orddnance No. 40509 -1 will grant easements across three city -owned tracts of land to Texas Eastern Transmission Corporation. Two of the smaller tracts of land are located at .the Craigmont.. Treatment Plant site, and the city will receive $330 and $440 for these. The larger tract is along the east side of theCoady landfill site, outside the actual permit area, The city will receive $3850 for this tract. Councilman Cannon moved to adopt the ordinance; Councilwoman Wilbanks seconded the motion: ORDINANCE NO. 1593 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CONVEYANCE OF RIGHTS OF WAY AND PIPELINE EASEMENTS UNDER, UPON, OVER, AND THROUGH LANDS OWNED BY THE CITY OF BAYTOWN AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST INSTRUMENTS GRANTING RIGHTS OF WAY AND PIPELINE EASEMENTS TO TEXAS EASTERN TRANSMISSION CORPORATION AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays: None 5621 May 9, 1974 Baytown Ambulance Company, Inc. Proposed Ordinance No. 40509 -2 will authorize the City Manager to enter into a lease agreement with Baytown Ambulance Compayy. This contract is required by the Federal Communications Commission because Baytown Ambulance operates on one of the city's radio frequencies. The city owns the radio equipment, and leases it to Baytown Ambulance for a token fee. Councilman Lander moved to adopt the ordinance; Councilman Bednarski seconded the motion: ORDINANCE NO. 1594 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER OF THE CITY OF BAYTOWN TO EXECUTE AND THE CITY CLERK TO ATTEST TO A LEASE AGREEMENT WITH BAYTOWN AMBULANCE COMPNAY, INC., AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Ayes: Council members Lander, and Cannon Mayor Gentry Nays: None Rate Adjustment - General Telephone Bednarski, Pool, Wilbanks, Dittman Proposed Ordinance No. 40509 -3 will grant a rate adjustment to General Telephone regarding their key system. Mr. Br-Bride, representing the telephone company, explained that the rate adjustment will involve only the key system users, and will not affect the primary rates. This will offer a more flexible price arrangement, and will result in a decrease in rates to some key system customers. Councilman Dittman moved to adopt the ordinance; Councilman Bednarski seconded the motion: ORDINANCE NO. 1595 AN ORDINANCE AMENDING ORDINANCE NO. 1500, ADOPTED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN ON THE 8th DAY OF NOVEMBER, 1973, WHICH ESTABLISHED THE RATES OF GENERAL TELEPHONE COMPANY OF THE SOUTHWEST IN THE CITY OF BAYTOWN, BY REPEALING EXHIBIT "C "-, NONSWITCHED SYSTEMS, THEREOF AS PRESENTLY CONSTITUTED AND SUBSTITUTING.IN.ITS PLACE THE PROVISIONS OF A NEW EXHIBIT "C ", NONSWITCHED SYSTEMS; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE;. BAY VENDING, INC.: 15% of gross income This bid is lower than last year's contract; however, Mr. Lanham recommended award- ing the bid. Councilman Dittman moved to accept the recommendation. Councilman Bednarski seconded the motion: ORDINANCE -.NO. 1596 AN ORDINANCE OF THE CITY COUNCIL OF TM-CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER OF THECITY OF BAYTOWN TO EXECUTE AND THE CITY CLERK TO ATTEST TO A CONTRACT WITH BAY VENDING, INC., FOR THE CONCESSION AT VARIOUS LOCATIONS OF THE PARKS AND RECREATION DEPARTMENT AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman & Cannon Mayor Gentry Nays: None May 9, 1974 School Zone Speed Limit Signs The Council's Traffic Committee has recommended that the variable school speed limit signs at Robt. E Lee High School, Carver Jones and M. B.Lamar Elementary Schools, be replaced with standardized signs which will be 20 miles per hour from 7:15 a.m. until 4:00 p.m. The current signs are sub- standard, and the times in which these signs operate do not correspond with the speed limit times at the other schools. Councilman Dittman moved to approve the change; Councilwoman Wilbanks seconded the motion: Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman 6 Cannon Mayor Gentry Nays: None Close Felton Street at _K -Mart parking lot Proposed Ordinance No. 40509 -5 will authorize the closing of Felton Street at the entrance to the K -Mart parking lot. Presently, one -half of this entrance is barricaded!.to prevent traffic from entering Felton from the parking lot; however, the traffic continues to drive around this barricade, thus entering Felton on the wrong side of the street. This has caused some hazardous situations, and Mr. Lanham recommended approving the ordinance to completely close this entrance. Mr. E. C. Chauviere, a resident of Graywood, urged council to approve the ordinance, and commended the Traffic Committee for making this recommendation. Councilman Dittmarmoved to adopt the ordinance; Councilwoman Wilbanks seconded. the motion. ORDINANCE NO. 1597 5622 AN ORDINANCE OF THE CITY COUNCIL 0F3)E CITY OF BAYTOWN, TEXAS, CLOSING FELTON STREET TO INGRESS OR EGRESS AT THE K -MART PARKING LOT; PRESCRIBING A MAXIMUM PENALTY OF TWO ..HUNDRED AND N01100 ($200.00) DOLLARS FOR THE VIOLATION THEREOF; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman 6 Cannon Mayor Gentry Nays: None - Councilman Dittman requested the administration look at the ditch between Park Street and the K -Mart parking lot, to determine the cost of installing culvert. -Mayor Gentry recognized Mr. Bill Smith, representative of the Senior Citizens Group, attenting the council meeting. Amend Code - Motor Vehicles and Traffic Proposed Ordinance No. 40509 -6 will amend the Code of Ordinances, to make the following changes in speed limits on various city streets: (a) Lee Drive: from Gentry St to West Main - 30 MPH (b) West Main St: from Civic Drive to Market St - 30 MPH (c) Market St: from Missouri Pacific RR to West Main St - 30 MPH (d) North Main St: from Baker Rd to Lynchburg -Cedar Bayou Rd - 35 MPH (e) Lynchburg -Cedar Bayou Rd: From Harris County Flood Control Ditch to N. This is a recommendation of the Traffic Committee. Councilwoman Wilbanks, moved to adopt the ordinance; Councilman Bednarski seconded the motion: ORDINANCE NO. 1599 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOAW, TEXAS, DESIGNATING THE EAST SIDE OF GAILLARD BETWEEN STERLING AND DEFEE STREETS AS A THIRTY MINUTE PARKING ZONE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND N01100 ($200.00) DOLLARS FOR THE VIOLATION THEREOF; AND PROVIDING FOR THE PUBLICTION AND EFFECTIVE DATE HEREOF. Ayes: Counct members Lander, Bednarski, Pool, Wilbanks, Dittman & Cannon Mayor Gentry Nays: None Traffic Signal - Texas Avenue & Whiting Street Recently there were three intersections where the traffic signals were sacked and stop signs installed on a trial basis. Council has passed an ordinance eliminating lights at two of these intersections; the third intersection was Whitjng and Texas Avenue. Counters have been placed at this intersection, and at this time, a traffic signal is not warranted. Proposed Ordinance No. 40509 -8 will authorize the removal of the signal, at and installations of stop signs on Whiting Street. This is the recommendation of theTraffic committee. councilman Lander movedtW adopt the ordinance; Councilman Pool seconded the motion - Several councilmen reported calls thay have received from citizens who oppose removing the traffic light. Mr. Larry Shanks, manager and owner of Baytown Boats, Inc., on Texas Avenue, expressed his opinion that this will hinder downtown shopping because it will be very difficult to cross Texas Avenue from. `Whiting, :the_ removal of the light will hinder pedestrian traffic, parking, and will encourage speeding. called: Following discussion, the vote on the motion to adopt the ordinance was Ayes: Council members Pool and Cannon Nays: Council members Lander, Bednarski, Wilbanks, Dittman Mayor Gentry Mayor Gentry delcared the motion defeated; the light will be put back into operation at this intersection. Consider Establishing Regulations on Electrically Charged Fences For several council meetings, Council has discussed regulating and controlling electrically charged fences in Baytown. An ordinance has been prepared providing that electrical fences will be permitted in places where livestock is permitted, 1.e., not within one hundred feet of a residence other than the owner of the livestock. Livestock does not include dogs. The fences will be permitted as long as they are UL approved, and are operated in accordance with the Manufacturer's specifications. The administration does not recommend that permits and inspections be required because this could expose the Cty to some liability. Also, there is no provision requiring that these fences be reported to the city. Mr. Jack Hester, explained that the steps to prohibit electrical fences was begun because oflis fence. Mr. Hester stated that he had originally installed the fence to confine two dogs; however, he no longer has the dogs and the electricity is no longer in operation. Mr. Hester urged council not to pass the ordinance prohibiting the fences in residential areas. Houston has an ordinance prohibiting electrically charged fences altogether, and the administration was requested to inquire about their history with these fences. Council concurred to refer this back to the administration for more study. 1 May 9, 1974 East District Sanitary Sewer Improvements 5624 In July of 1973, the city received notification from the EPA that Baytown was being offered $1,058.250 for a Step 2 -3 Wastewater Facilities Project, which would be enlargement of the East District Sewage Treatment Plant. One of theconditions of that grant was than an Infiltration /Inflow Analysis be completed prior to the first scheduled payment of the grant, and prior to approval of the plans and specifications. The offer had six items that must be included in the analysis, one of them being that if it is more cost effective to rehabilitate the system than to provide capacity in the system, a remedial plan of action to correct the infiltration must be submitted for approval. r The EPA advised that if the analysis was made of theEast District, in accordance with these conditions, and if the analysis was made of theEast District, in accordance with these conditions, and if the analysis was accepted, that Baytown would be permitted r to go ahead with the construction:. This analysis was made, and submitted to EPA, and it appears that it meets their requirements. However, the EPA has notified Baytown last week that due to a change in the guidelines, Baytown will not be able to go ahead with construction as previously advised. There are several options available, one being to "descope," or ask for a change in the grant from a Step 2- 3(construction), to a Step 1 -EPA grant to make a thorough study of the system. Another option is to appeal the decision, or talk with EPA about an approach being used in several other cities, which is to locate the points of the greatest amount of inflow and correct these, and then proceed with the grant. Mr. Lanham suggested that he and Mr. Ivan Langford go to Dallas and talke with EPA regarding the latter option; council concurred with this. -Councilman Cannon leaves. Authorize Application - Intergovernmental Personnel Act Resolution No. 469 will authorize application for a grant under the Intergovernmental Personnel Act, which was discussed at the meeting of April lo. The total grant being requested is $14,067, of which $3,517 will be "in- kind" contributions by Baytown. The grant will be used to contract with the Civil Service Commission for the preparation of a classification and compensation plan, and for a plan of recruitment /► procedures to meet the regulations of the EEO. Following discussion, CouncilmanBednarski (f■ moved to adopt the resolution; CouncilmanLander seconded the motion: RESOLUTION NO. 469 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN TO MAKE APPLICATION UNDER THE INTERGOVERNMENTAL PERSONNEL ACT OF 1970 FOR FEDERAL FUNDS TO PROVIDE TECHNICAL ASSISTANCE FOR THE DEVELOPMENT OF A PERSONNEL PROGRAM FOR THE CITY OF BAYTOWN, TEXAS. Ayes: Council members Lander, Bednarski, Pool, _Wilbanks & Dittman Mayor Gentry Nays: None Final Payment - Roseland Park Bulkhead Proposed Ordinance No. 40509 -o1 will authorize final payment for construction of the Roseland- Park Bulkhead, in the amount-of $4,451.29. Total contract price is $36,088.94. Councilman Pool moved to adopt the ordinance; Councilman Bednarski seconded the motion: ORDINANCE NO. 1600 AN ORDINANCE OF THE CITY COUNCIL CFTIECITY OF BAYTOWN, TEXAS, APPROVING AND ACCEPTING CONSTRUCTION OF THE ROSELAND PARK BULKHEAD AND LEVEE, JOB NO. 73 -554, BY MARINE, INC.; FINDING TWAT THE IMPROVEMENTS ARE IN ACCORDANCE WITH THE TERMS OF THECONTRACT; ACCEPTING THE ENGINEERS' CERTIFICATE OF FINAL ACCEPTANCE; AUTHORIZING THE FINAL PAYMENT TO THE SAID MARINE, INC.; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Section 2, Item 4: Continue to enforce current land use regulations and participate in the National Flood Insurance Program for the unevacuated portions of the proposed project area in conformance with the National Flood Insurance Act of 1968 and the Flood Disaster Protection of 1973. Councilman Pool moved to adopte the resolution; Councilman Bednarski seconded the motion: RESOLUTION NO. 470 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING LOCAL SPONSORSHIP OF CORPS OF ENGINEERS' BURNET, CRYSTAL, AND SCOTT BAYS PROJECT.
