1974 02 07 CC Minutes, Special5562 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN February 7, 1974 The City Council of the City of Baytown met in special session at 5:00 p.m., Thursday, February 7, 1974, in the Council Chamber of the Baytown City Ball. The following members were in attendance: • Jody Lander Councilman Fred Bednarski,Jr. Councilman Charles Pool Councilman Mary E. Wilbanks Councilwoman Henry Dittman Councilman Allen Cannon Councilman Tom Gentry Mayor Fritz Lanham City Manager Jon Pfennig Assistant City Attorney Edna Oliver City Clerk Howard Northcutt Assistant City Manager Mayor Gentry called the meeting to order and the following business was transacted. Recommendation from Baytown Area Water Authority Mr. Jack Kimmons, President of the Board of Directors of the Baytown Area Water Authority appeared to present the Board's recommendation concerning the future water supply for the Baytown area. The Board has given careful consideration to the feasibility study of a new water supply system for this area. This was studied from all aspects, with the assistance of the engineering firm of Lockwood, Andrews 6 Newnam, taking into consideration the availability of water, salt water encroachment in our ground water supply, land subsidence, and the availability of surface water. On behalf of the Board of Directors, Mr. Kimmons recommended that the surface water supply alternate be selected and that definitive steps be taken to develop this system, and that the conversion to surface water be pursued with as much haste as possible. There was some discussion on the availability of surface water, afterwhich Mr. Dan Clinton, consulting engineer, assured council that contracting with the San Jacinto River Authority would assure the Baytown area of a dependable water supply. Councilwoman Wilbanks moved to accept the recommendation and authorize the Board of Directors of BAWA to proceed with contractoral matters; Councilman Bednarski seconded the motion: Ayes: Council members Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays: None Disannexation - Industrial District No. 1 Proposed Ordinance No. 40207 -1A is the first reading on the disannexation of a portion of Exxon in accordance with the industrial district policy presently adopted by the City Council, whereby only 20 percent of an industry will be within the city limits. ( *Councilman Lander present) Councilman Cannon read a detailed comparative report on tax revenue the city would receive from the 20 %, and the revenue that could be received from a 24 -76 split. The figures Councilman Cannon compiled showed an eventual loss in sales tax revenue, franchise losses with the utility companies, possible loss on revenue sharing allocations, and a projected deficit of $1,196,000 by 1978, with the 20 -80 split -This would require an average 10- centtax increase to overcome this in a five year period. If the 24 -76 split were adopted, this projected deficit would be $214,000. Councilman Cannon moved to discontinue the disannexation proceedings and start over with annexing 24% of industry. However, in order to discuss this with council members, Councilman Cannon temporarily withdrew his motion. In discussion of the projected tax increase, it was pointed out that any increase would be shared by both industry and homeowners. Also, Mr. Lanham explained that the industries involved in the disannexation are being requested to give the city assurance that there will be no reduction in next year's payments to the city. 5563 February 7, 1974 Industrial District No. 1, continued Following discussion, Councilman Cannon moved to terminate the disannexation proceedings; Councilman Dittman seconded the motion: Ayes: Council members Cannon, Dittman & Wilbanks Nays: Council members Lander, Pool, Bednarski Mayor Gentry Mayor Gentry then declared the motion failed. Councilman Pool moved to adopt proposed Ordinance No. 40207 -1A, on first reading; Councilman Lander-seconded the motion: ORDINANCE NO. 1541_A AN ORDINANCE PROVIDING FOR THE ADJUSTEMENT OF CERTAIN BOUNDARY LIMITS IN THE CITY OF BAYTOWN, TEXAS, AND THE DISANNEXATION OF CERTAIN TERRITORY WITHIN THE PRESENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS. Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman Mayor Gentry Nays: Councilman Cannon Proposed Ordinance No. 40207 -1B is the first reading on the disannexation of a portion of Helmerich & Payne. Councilman Pool moved to adopt the ordinance on first reading; Councilman Lander seconded the motion: ORDINANCE NO. 1541 -B AN ORDINANCE PROVIDING FOR THE ADJUSTMENT OF CERTAIN BOUNDARY LIMITS IN THE CITY OF BAYTOWN, TEXAS, AND THE DISANNEXATION OF CERTAIN TERRITORY WITHIN THE PRESENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS. Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman Mayor Gentry Nays: Councilman, Cannon Proposed Ordinance No. 40207 -1C is the first reading on the disannexation of a portion of Ashland Chemical Company. Councilman Lander moved to adopt the ordinance on first reading; Councilman Bednarski seconded the motion: ORDINANCE NO. 1541 -C AN ORDINANCE PROVIDING FOR THE ADJUSTMENT OF CERTAIN BOUNDARY LIMITS IN THE CITY OF BAYTOWN, TEXAS, AND THE DISANNEXATION OF CERTAIN TERRITORY WITHIN THE PRESENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS. Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman Mayor Gentry Nays: Councilman Cannon February 7, 1974 5564 Exchange Easements - Vicinity of Gulf Coast Hospital Proposed Ordinance No. 40207 -2 will authorize an exchange of easements in the vicinity of Gulf Coast Hospital. The contractor for the Upper Goose Creek Interceptor has suspended construction on a portion of the line because of the unstable soil conditions in this area. The new easement will provide better working conditions, and a shorter distance required to construct the line, resulting in a savings to the City of approximately $5,000. Councilman Bednarski mvoed to adopt the ordinance, Councilman Pool seconded the motion: ORDINANCE NO. 1542 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RAYTOWN, TEXAS, AUTHORIZING THAT FRITZ LANHAM, CITY MANAGER, TO EXECUTE THE PROPER INSTRUMENTS TO EFFECT THE EXCHANGE OF EASEMENTS DESCRIBED IN THE ENACTING CLAUSE OF THIS ORDINANCE, AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays: None kPlans and Specifications - Construction of New Fire Station k6 Mr. Bitsy Davis, architect, presented the plans and specs for construction of the new fire station on Massey Tompkins Road. Funds for this project wi1l come from 1965 and 1970 bond funds. The plans presented were approximately 998 complete, requiring only minor modifications. The station as first proposed was to be constructed of pre - engineered metal; however, because of the size, shape, and height of the building, this will not be economically feasible, so the station will be constructed of wood. The basic buildling will be 2,000 square feet, with alternate bids being taken on a store room, two overhead doors, and a concrete drive to the rear of the building. Bids will be received on Tuesday, March 12, at 4:00 p.m. Councilman Lander moved to authorize advertising for bids for the construction of the new station based on the plans presented to council, with any minor modifications Mr. Davis feels necessary. Councilman Bednarski seconded the motion: Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays. None Emergency Item - Select Arbiter Mr. Lanham recommended that Mr. Jerry Moreau, President of Tidal Construction Company, be named as the City's arbiter, to arbitrate the claim of Bayshore Constructors for the extra work done on the twenty four inch gravity sewer line. Bayshore has named their arbiter effective February 1, and the City has ten days within which to name one. CouncilmanBednarski ;roved to accept the recommendation naming Mr. Moreau as the City's arbiter, Councilman Cannon seconded the motion. Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays: :None Mayor Gentry recessed the meeting into an Executive Session for discussion of litigation regarding the city's landfill site. Following a brief period of time, the council reconvened. Councilman Cannon moved to ratify the action of the city attorney in filing an Equitable Bill of Review in the 200th Judicial District Court, Travis County, Texas, in the Coady landfill case; also, to give Mr. Richardson authorization to proceed in trying the Equitable Bill of Review and authorization to file for an additional permit for a sanitary landfill on the Coady tract, if deemed necessary by Mr. Richardson.
