MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
January 24, 1974
The City Council of the City of Baytown, met in regular session, Thursday,
January 24, 1974, at 6:30 p.m., in the Council Chamber of the Baytown City Ball.
The following members were in attendance:

Mayor Gentry called the meeting to order. The invocation was offered by
Reverend E. H. Domonigue, Pastor of Mount Rose Missionary Baptist Church.
Approve Minutes and Ratify Actions Taken
Councilman Lander moved to approve the minutes of the meeting held January 10, 1974,
and to ratify actions taken at that meeting; Councilman Cannon seconded the motion:

Recognize Civics Class
Mayor Gentry formally recognized a government class from Sterling High School
present at the council meeting.
City Manager's Report
The administration has reached an agreement with Western Refuse Company of
Pasadena for paper reclamation, which was discussed at the last council meeting.
Western Refuse will deliver three, twenty -seven cubic yard containers, Tuesday, which
will be placed at the fire stations on Bayway, Market and Ward Road. The company
will pay the city twenty five cents per one hundred pounds of paper. This will be
a sixty -day experimental program. The two main interests in negotiating an agreement
were that of conservation and preserving the city's landfill. Periodic reports will
be made to council on the progress of the program.
Mr. Lanham referred to a map indidating the progress of the 1973 Street Improvement
Program. Although some work has been slowed by the rains, the contractors appear to
be making good progress.
Bids will be received February 8 for Phase I of the 1974 Street Program. Because
of the difficulty in getting delivery of limestone, Mr. Lanham suggested the bidders
be allowed to bid black base as an alternate to limestone . Council -' offered no
objection.
Council has received copies of the Lockwood,Andrews 6 Newnam study on Baytown's
water needs; the Board of the Baytown Area Water Authority will meet next week to
discuss the report, and a recommendation will be made very soon.

The contractor employeed by the county to construct a bridge on fpinr2eel Street
should finish this week, at which time thecity's contractor will begin the street improvement.
The city crews will begin drainage work in the ditch next to Whitehall Apartments
tomorrow. After completion, the crews will begin drainage work on Bayway Drive near St. James
House.
The first heavy trash pick -up is scheduled for Wednesday, January 30. Included in
the items to be picked up aye applicances, mattresses, & furniture; however, this does
not include building materials.
The contractor for Garth Road will begin securing liens next week.
Very little progress has been made on the sewer contracts since the last council
meeting because of rain.
The contract for the upper Goose Creek Interceptor has suspended construction
on 382 -feet of .. line in back of Gulf Coast Hospital because of the unstable soil
condition in this area. The contractor is presently working with the engineer to
determine the appropriate construction procedure for this area.
The final draft of the East District infiltration /inflow analysis will be sent to the
Texas Water Quality Board tomorrow.
The materials for the public works service center were delivered last week and the
building is now entirely enclosed. The garage expansion is being held up by soil conditions.
Public Hearing - Disannex portions of Industries - 7:00 p.m.
At 7:00 p.m., Mayor Gentry declared in session the public hearing on the
disannexation of portions of Exxon, Helmerich & Payne, and Ashland Chemical, which are in
Industrial District #1. This is in accordance with the new industrial district policy
adopted by Resolution 460, whereby only 20% of an industry will be inside the city
limits. Mr. Lanham referred to a map showing the areas that will be disannexed.
There was no one present at the council meeting desiring to speak to this matter,
and Mayor Gentry declared the public hearing closed.
City Manager's Report , continued
Council discussed the many areas of the city that were flooded by the rain last
weekend, and if this could have any relation to the new developments in these areas.
Councilman Cannon inquired if the city may, and should, require a developer to solve
any drainage problems that he might create. Mr. Lanham explained that the administration
is presently working on some suggested revisions to the subdivision regulations, not
only 4s it relates to residential development, but also commercial, i.e., shopping centers,
with large parking areas. Other cities do require a developer to take care of his own
drainage. Mr. Lanham was hopeful that recommendations concerning these changes could
be presented to the council within thirty days.
Councilman Dittman moved to rescind the portion of the trash ordinance pertaining
to cutting up limbs into three -foot lengths and tieing them into bundles. This motion
died for lack of a second.
Councilman Dittman then requested the administration study the feasibility of a
one -month period during Spring when the chipper could be used, as this is� the time
of year most people trim their trees. Council offered no objection to a feasibility
study.
Amend Code - Establish Load Limit on Bridges
Proposed Ordinance No. 40124 -1 will amend the Code of Oridnances and establish
a load limit on two bridges and one street within the city:
(1) the West Texas Avenue bridge over Goose Creek Street -5,000 lb (2-Is ton) limit;
(2) the Elvinta Street bridge over Pond Gully - 5,000 1b (21fton) limit;
(3) the portion of Civic Drive from Civic Circle to Market Street - 6,000 1b
(3 ton)limit.
Councilman Cannon moved to adopt the ordinance; Councilman Dittman seconded the motion:

ORDINANCE NO. 1531
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING
THE CODE OF ORDINANCES BY THE AMENDMENT OF CHAPTER 18, "MOTOR VEHICLES
AND TRAFFIC," SECTION 18 -42.1, DESIGNATION OF GROSS WEIGHT, SO AS TO REPEAL
THE PROVISION OF SUCH SECTION AS PRESENTLY CONSTITUTED AND TO SUBSTITUTE IN
ITS PLACE A NEW SECTION 18 -42.11 REPEALING ORDINANCES INCONSISTENT HEREWITH;
CONTAINING A SAVINGS CLAUSE; PROVIDING A MAXIMUM PENALTY OF TWO HUNDRED
DOLLARS FOR EACH OFFENSE; AND PROVIIDNG FOR THE PUBLICATION AND EFFECTIVE
DATE HEREOF,
Amend Code of Ordinances - "U- Turns"
Proposed ordinance No. 40124 -2 will amend the Code of Oridnances con cerning
U- turns. The Code as presently written prohibits U -turns throughout the City.
The proposed change would prohibit U -turns at 33 signalized intersections, (2) allow
U -turns at 177 signalized intersections, (3) allow U -turns at stop signs within the
city, (4) prohibit any U -turn unless it can be made in safety and without interfering
with other traffic.
This ordinance is the recommendation of the traffic committee. Signs will be
posted where U -turns are illegal.
Councilman Cannon moved to adopt the ordinance; Councilman Pool seconded the

ORDINANCE NO. 1502
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RAYTOWN, TEXAS, AMENDING THE

PROVIDING A MAXIMUM PENALTY OF TWO HUNDRED DOLLARS FOR EACH OFFENSE; AND
PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF.
Councilman Cannon requested the administration to request the State to remove
the striping at the north end of Alexander Drive to permit the residents there to
turn across Alexander into their subdivisions.
Councilwoman Wilbanks requested the traffic committee to look at the timing of
the light on Decker Drive at the entrance to the Exxon Building, to see if turning
into the parking area could be speeded up.
Designate site for proposed Baytown Museum
Resolution No. 461 will designate the site for the proposed Baytown Museum
as was discussed at the last council meeting. Councilman Lander moved to adopt the
resolution, Councilwoman Wilbanks seconded the motion:

RESOLUTION NO. 461
• RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DESIGNATING
• SPECIFIC LOCATION FOR FUTURE USE AS A MUSEUM SITE.
Order Municipal Election
Proposed Ordinance No. 40124 -3 will order a municipal election for April 2, 1974,
for the purpose of electing councilmen to Positions 1, 4, and 5. Councilman Dittman
moved to adopt the ordinance; Councilman Pool seconded the motion:

ORDINANCE NO.1533
AN ORDINANCE ORDERING THE MUNICIPAL ELECTION TO BE HELD ON THE 2ND
DAY OF APRIL, 1974, FOR THE PURPOSE OF ELECTING THREE (3) COUNCILMEN
FROM THE RESPECTIVE DISTRICTS MOS. ONE (1) , FOUR (4) , AND FIVE (5) ;
PROVIDING FOR ELECTION OFFICERS; DESIGNATING THE PLACES AND MANNER
OF HOLDING SAID ELECTION; PRESCRIBING THE HOURS; PROVIDING FOR A
CANVASSING BOARD FOR ABSENTEE BALLOTS; AND PROVIDING FOR THE POSTING
AND PUBLICATION OF NOTICE.
In the event a run -off election is necessary, Council concurred to designate
the date as April 23.
Plans and Specifications for Fire Station X16
The plans and specifications for the new fire station on Massey Tompkins Road
have not been completed.
Council concurred that upon completion of the plans, Mr. Lanham will call a
special council meeting one afternoon at 5:00 p.m.
Authorize Bids - Gasoline Storage Tank for Police Department
The Police Department is still getting gasoline from the pump located at the
Fire Administration Building, however, this tank is old and needs to be replaced.
In order to have proper control and reduce travel between locations in the City,
the most economical solution is to have gas pumps at the public works building and
the police building, where theCity has the largest number of vehicles. The
estimated cost of a gas pump & storage tank for thepolice department is $3,000.
This item was not budgeted; however, with the $2,000 remaining in the capital
account of the police budget, and transfers within their budget, this amount could
be made available.
Mr. Lanham recommended authorization to advertise for bids for a storage
tank & primp for the police department.
Most of the police department vehicles do not use premium gas, so this type
will not be put into the new tank. This will present a problem for the fire
department when the old tank is discontinued, because most of its trucks require
premium gas. Several solutions to this situation are being considered.
CouncilmanDittman moved to accept the recommendation and authorize bids
to be received; Councilman Lander seconded the motion:

Appointments to Electrical Board
Postions 1, 2, and 3 of the Elctrical Board need to be filled. Councilman
Lander moved to re- appoint Mr. Joe Crumpler to Position 1, appoint Mr. Paul Cantrell
to Portion 2, and appoint Mr. Ted Kloesel to Position 3.• Councilman Pool seconded
the motion:
Ayes: Council members Lander, Pool, Wilbnaks, Dittman and Cannon

The administration was requested to write letters to Messrs. Joe Phelps and
Billy Trousdale thanking them for the past service on this board.
Request of Texas Highway Department to Tie Into Baytown's Water System
The Texas Highway Department has requested permission to tie into Baytown's
water system to serve the Baytown -La Porte Tunnel. The administration has determined
that this will have no appreciable effect on the water pressure in this area, and
Mr. Lanham recommended approval of the request.
Councilman Cannon moved to accept the recommendation; Councilman Dittman
seconded the motion:

Homestead Exemption to Single Persons over Sixty-Five
Proposed Ordinance No. 40124 -4 will allow single persons over 65 years of age
to Gleam a $3,000 homestead exemption on their taxes. The ordinance also specifies
that the claim must be made between January 1 and April 30 of each year.

Award Bid - Develop Polly Park

Two bids were received for the development of Pelly Park:
Chatham 6 Holzaepfel: $23,515.80 Bill Lavender, Gen Contr: $25,027.13
The origAnal appropriation for this park was $26,725. With the purchase of
playground equipment A shelters, $19,905.75 remains for development of the park.
Mr. Lanham recommended that the penalties on Westwood, Duke Hill A Tejas Parks be applied
to this amount, and that the remainder be re- appropriated from the remaining 1970 Capital
Improvements Program Land Acquisition Account, and that the bid be awarded to Chatham A
Holzaepfel in the amount of $23,515.80.
Councilman Dittman moved to accept the recommendation; Councilman Lander seconded
the motion:

ORDINANCE NO. 1535
AN ORDINANCE OF THE CITY OCUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING
THE BID OF CHATHAM A HOLZAEPFEL FOR THE DEVELOPMENT OF PELLY PARK AND
AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF
TWENTY -THREE THOUSAND FIVE HUNDRED FIFTEEN AND 80 /100 ($23,515.80) DOLLARS
WITH REGARD TO SUCH AGREEMENT.
Resolution No. 462 - Accept Local Sponsorship of Corps of Engineers' Burnet, Crystal
and Scott Baus Proiect
The report of the Corps of Engineers on the Burnet, Crystal A Scott Bays project
provides for the complete evacuation of the Brwnwood area. In order to submit this
report to the Congress, a local sponsor must be designated to provide twenty percent
of the funding for evacuating and relocating the residents.
Resolution No. 462 is an expression of the city council's intent to provide the
local cooperation requirements, and at the appropriate time the council will make an
effort to furnish, or cause to be furnished, the necessary local funds for the project.
Local funding could include county or state funds.
Following discussion of the proposed evacuation, Councilman Dittman moved to
adopt the resolution) Councilman Lander seconded the motion:

LOCAL SPONSORSHIP OF CORPS OF ENGINEERS' BURNET, CRYSTAL AND SCOTT BAYS PROJECT.

Award Bid - Retrievable Files for Police Department
Two bids were received for retrievable files for the police department:

Eighty -five percent of the cost of these files will be paid with Criminal
Justice Funds. Mr. Lanham recommended awarding the low bid of Matherne's.
Councilman Pool moved to accept the recommendation; Councilman Cannon
seconded the motion.
Mr. Jerry Johnson, representing Sperry - Remington, stated that although
Matherne's was low on the total bid price, his company was low bidder on one
of the items. The City of Baytown does have the right to purchase one or more
items in the bid of each company. Mr. Johnson explained that his firm's
equipment has safety features that exceed the bid specifications, and for these
reasons, requested the Council to award the entire bid to Sperry - Remington.
Mr. Don Cooke, purchasing agent, explained to council that both types of
equipment do meet specifications and parts & service for both brands is located
in Houston. Also, both files do not have to be the same brand.
Since Sperry- Remington was low bidder on the first item, Councilman Cannon
withdrew his second.

ORDINANCE NO. 1536
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING
THE BID OF MATHERNE'S, INC., FOR THE PURHCASE OF RETRIEVABLE FILES AND
AUTHORIZING THE PAYMENT BY THE CITY OF THE SUM OF SEVEN THOUSAND TWO
HUNDRED FIFTY -ONE AND 901100 ($7,251.90) DOLLARS WITH REGARD TO SUCH
ACCEPTANCE.
Unfinished Business - Ward _Road at Highway 146
Concerning the Ward Road - Highway 146 intersection, the administration is
presently gathering estimates on the cost of installing a protected left -turn traffic
signal for Ward Road traffic turning onto Highway 146.

There being no further business to transact, Mayor Gentry declared the
meeting adjourned.
