1974 01 10 CC Minutes5546 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN January 10, 1974 The City Council of the City of Baytown met in regular session, Thursday, January 11, 1974, at 6 :j0 p.m. in the Council Chamber of the Baytown City Hall. The following members were in attendance: Jody Lander Councilman Charles Pool Councilman Fred Bednarski,Jr Councilman Mary Wilbanks Councilwoman Henry Dittman Councilman Allen Cannon Councilman Tom Gentry Mayor Fritz Lanham City Manager Neel Richardson City Attorney Edna Oliver City Clerk Howard Northcutt Assistant City Manager Mayor Gentry called the meeting to order and the invocation was offered by Reverend J. L. Marbut, Pastor of Congretational Methodist Church. Approve Minutes Councilman Pool moved to approvethe minutes of the meeting held December 13, 1973, as printed; Councilman Bednarski seconded the motion: Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays: None Petitions Mayor Gentry called for presentation of petitions; however, none were presented. City Manager's Report A new state law requires all cities to have workman's compensation by July 1. The Texas Municipal League has plans to establish an "insurance company" composed of cities, to enable these cities to purchase insurance from the company operated by the TML. A seminar will be held in Austin on Friday, January 18, and Mr. LeFevre and Mr. Richardson will attend. The quarterly Revenue Sharing check has been received in the amount of $128,047; these funds have been appropriated. Commissioner Bray has requested the council consider entering into a joint project for the improvement of Bayway Drive from Spur 3JO to Baytown Junior High School. The county engineer has estimated the cast of resurfacing to be from $100 - $125,000; the City's portion would be $50 - $65,000. Although Baytown has made application for federal funds for Bayway improvement, two years could lapse before any funds are made available . For this reason, Mr. Lanham suggested the participation between the city and county would be a wise investment. Councilman Dittman moved to instruct the Administration to indicate to Mr. Bray the Council's interest in this project on a 50 -50- basis, and to begin finalizing plans for presentation to council; Councilman Pool seconded the motion. The 1973 -74 budget provides approximately $132,000 for Phase III of the 1974 Street Program. Mr. Lanham suggested council use a portion of these funds to pay for the Bayway project, and then replace the amount with the next Revenue Sharing allocation. Mayor Gentry then called the vote: Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays: None 5547 The Councy has indicated an interest in providing funds to the City of Baytown to assist in Sterling Library services. These funds could be -used to expand the service of the bookmobile, which has recently be reduced. Council offered no objection to this possibility. The possibility of county participation in the improvement of Park Street, (between Garth & N. Main), and West Main Street and also been discussed. Council offered no objection to pursuing this possibility. The engineering firm employed to make the feasibility study on Baytown's water needs will make their report to the Baytown Area Water Authority. on Tuesday, January 15. r Plans and specifications for the new fire station will be presented at the next council meeting. Bids have been advertised for the Central Sewer District,Contract #7, to be received on February 5. These are the lines that will serve the newly annexed area. A letter has been written to the Water Quality Board, requesting an increase in the EPA grant to cover a portion of the cost for this project. The state's traffic safety office has given verbal approval to Baytown's request for a revision in the grant approved several months ago, for a traffic safety adminis- trator. As discussed at the last council meeting, these funds will be channeled to the city's Department of Planning & Traffic. Bond fund projects - Garth Road - the contractor is presently securing an updated assessment roll. East -West Thoroughfare - the contractor is expected to receive enough limestone to complete the basework between Seventh Street and Highway 146. The contractor has begun work on the Roseland Park Bulkhead. The N. C. Foote Park swimming pool is 95% complete. The Sports Complex is virtually complete; cleanup remains. Plans for the League of Women Voters Park have been sent to the Parks & Wildlife Department for approval. Plans and specifications for the Glen Arbor waterline replacement should be presented at the next council meeting. Sanitary Sewer Improvement: West Main Plant - 91% complete. Lift Stations - 77% complete. The contractor has been instructed to have the lift station on Texas Avenue completed by February 1. Sewer Mains Central District, 92% complete. Middle Goose Creek Interceptor, 69% complete. Upper Goose Creek Interceptor, the contractor has laid 2500 -feet of 21 -inch line in the area 6f the Exxon building; progress has been slow with the 27 -inch gravity line near Gulf Coast Hospital, due to bad soil conditions. Lines in various parts of the city is about 52% complete. The infiltration inflow study on the East Sewer District has 1?een completed, and a report in being prepared. The study on the West District is now in progress. Construction on the municipal service center has been delayed by weather. Paper Reclamation Study_ _ The Administration was requested to look at the feasibility of collecting, or having collected, used newspapers, cardboard boxes, etc. Two cities were contacted- that are in the paper reclamation business - Fort' Worth and Deer Park. Fort Worth has been experimenting with this for eighteen months, with a city crew that picks up on regular routes. This is a voluntary program, whereby the citizens place their used paper at the curb; however, only 30% cooperation has been experienced. At the beginning of the program, the city lost $9.00 per ton because of equipment and labor cost. However, since the-recent price of paper has increased, they are now realizing $6.68 oer ton. January 10, 1974 Paper reclamation, continued 5548 Deer Park has an agreement with Western Refuse of Pasadena, whereby two, thirty -yard containers are provided at the city hall and the city barn. The citizens deposit their papers in the containers, on a voluntary basis, when the containers are full, Western Refuse picks the up, and pays the city 30P per 100- pounds. Although the program was slow getting underway, the citizenry is responding, 'and Deer Park plans to expand the program. Of the companies that were contacted, Western Refuse is the only one that was sincere about coming to Baytown. They would provide two or three containers (these could be placed at the fire stations on Bayway, Market and Ward Road), and will help with the publicity to inform Baytown citizens of this program. The Administration reco:mnenda3authorization to negotiate a contract, on an experimental basis, to see how this program will be received by Baytown citizens. Mayor Gentry has been contacted by a business firm in Baytown that indicated an interest in discussing an arrangement for transporting used paper from Baytown. Councilman Dittman moved to instruct the Administration to negotiate the best deal on paper reclamation, on an experimental basis; Councilman Cannon seconded the motion: Ayes. None Award Bid - Purchase Tractor for Parks & Recreation Department Two bids were received for the purchase of a tractor for the Parks & Recreation Department. International Harvester: $2,055 Jim Ball $1,995 Mr. Lanham recommended accepting the low bid of Jim Ball Motor Company. Councilman Bednarski moved to accept the reconmiendation; Councilman Lander seconded the motion: Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays: None ORDINANCE NO. 1524 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF JIM BALL.INTERNATZONAL FOR THE PURHCASE OF ONE TRACTOR TO BE UTILIZED BY THE PARKS & RECREATION DEPARTMENT OF THE CITY OF BAYTOWN AND AUTHORIZING PAYMENT BY THE CITY OF THE SUM OF ONE THOUSAND NINE HUNDRED NINETY -FIVE AND N01100 ($1,995.00) DOLLARS WITH REGARD TO SUCH ACCEPTANCE. Hear Report on Placement of the Proposed Baytown Museum At the last council meeting, the Administration was requested to check into the legal ramifications of Council designating a site for the proposed Baytown Museum. Mr. Richardson explained that a site may be designated, but it must be done by resolution set ting forth the policy of the council. Any policy is subject to change, so this will not be binding upon future councils_ It is not possible for the Museum Advisory Board to have exclusive dominion and control over property owned by the city, nor would it be possible, if this board were separate and apart from the City, for the City to donate land for this purpose. Councilman Cannon moved to instruct the Legal Department to prepare such a resolution, designating the site for the propose Baytown Museum to he that of the City Nall -Civic Center complex, Councilman Dittman seconded the motion: Ayes: Council members Lander, Pool, Bednarski, Wilbanks, Dittman and Cannon Mayor Gentry Nays: None Establish City's Industrial District Policy Proposed Resolution No. 460 will establish a new industrial district policy, which council has reviewed previously in a work session. The major points of the resolution are (1) it recognized that orderly economic growth raises the standard of living for the citizens, (2) there are a number of large industries in our area, (3) it is to the mutual 5549 January 10, 1974 advantage of industries and municipalities to cooperate whereever possible, (4) the large industries in our area make limited use of municipal services, (5) the City Council is: of the opinion that manufacturing industries should compensate the City of Baytown proportionately, but recognizing their limited use of municipal services (6) industries derive certain benefits, directly and indirectly from municipal services. Section I establishes policy whereby manufacturing industries should pay a fair share of the tax revenue of the City. Section II will establish the percentage of fair market value of the property of the industry to be annexed. Section III will create an industrial district which must be within the city's extraterritorial jurisdiction and will include those areas that wem not annexed to the City. This section also states that contracts with industries within the City's extraterritorial jurisdiction will be uniform. Section IV provides the formula that "would be used in determining the total payment to the City, taking into account their tax payment, plus their industrial district payment. This resolution provides that additions or expansion to industries would not be exempt from taxation for a period of years as was provided in the 1963 resolution establishing industrial district policy. However, a new industry will be exempted from taxation for a period of five years. Councilman Bednarski moved to adopt Resolution No. 460, with the following percentages to be used in determining total payment to the City: Tax payment: Tax Rate x Assessment Ratio x (20 %) of fair market value of entire industrial facility. Industrial District•Payment: Tax Rate x(80%) of fair market value of total industrial facility x (6%). Councilman Lander seconded the motion: Ayes: Councilmefnbers Lander, Bednarski, Pool, Wilbanks and Dittman Mayor Gentry Nays: Councilman Cannon RESOLUTION NO. 460 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, FINDING DECLARING AND ESTABLISHING THAT MANUFACTURING INDUSTRIES NEAR THE CORPORATE LIMITS OF THE CITY OF BAYTOWN RARELY USE BAYTOWN'S MUNICIPAL SERVICES TO THE SAME EXTENT AS DO PRIVATE CITIZENS AND CONSEQUENTLY, SUCH MANUFACTURING INDUSTRIES AS A WHOLE SHOULD COMPENSATE THE CITY OF BAYTOWN PROPORTIONATELY E) THEIR USE AND ENJOYMENT OF SUCH MUNICIPAL SERVICES. Establish Disannexation Procedure Proposed Ordinance No. 40110 -2 will establish a disannexation procedure for the City of Baytown. In accordance with the resolution council just passed establishing industrial district policy, it will be necessary to annex, and disannex parts of industries. This ordinance will set forth a policy for disannexation, utilizing the present procedure for annexation. Councilman Dittman moved to adopt the ordinance; Councilman Bednarski seconded the motion: Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays: None ORDINANCE NO. 1525 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, SETTING FORTH A PROCEDURE FOR DISANNEXATION AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. January 10, 1974 5550 Call Public Hearing for Disannexation of Areas Within Industrial District#]. Proposed Ordinance No. 40110 -3 will call a public hearing for the disannexation of portions of certain industries presently in Industrial District #1. This is in accordance with Resolution No. 460, providing that 20% of the fair market value of an industry will be annexed to the city. Three industries presently have more than 20% of their value within the City - Exxon, Helmerich & Payne and Ashland Chemical. Councilman Dittman moved to adopt the ordinance; Councilman Bednarski seconded the motion. The hearing is scheduled for 7:00 p.m., January 24, 1973. ORDINANCE NO. 1526 -B (Helmerich & Payne) AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED DISANNEXATION OF CERTAIN PROPERTY BY THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF SUCH PUBLIC HEARING AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ORDINANCE NO. 1526 -C (Ashland Chemical) AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED DISANNEXATION OF CERTAIN PROPERTY BY THE CITY OF BAYTOWN, TEXAS; AUTHORIZING AND DIRECTING.THE CITY CLERK TO PUBLISH NOTICE OF SUCH PUBLIC HEARING AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Proposed Ordinance No. 40120 -4 will amend the Code of Ordinances, Insurance Advisory committee, by adding a provision. that any person making a false statement on his application for membership will be disqualified, and by deleting the requirement that an applicant own a fee interest in real property within the city limits. This is the recommendation of the InsuranceAdviscry Committee, and Mr. Lanham concurred with the recommendation. Authorize Final Payment - Waterline to Newly Annexed Area The engineers have advised that the installation of waterlines to the newly annexed area has been completed, and commended the contractor for the workmanship and expediency with which the job was completed. The amount remaining to be paid the contractor is $10,543.35. Mr. Lanham recommended authorization to make the final payment. C. CONSTRUCTION COMPANY; FINDING THAT THE IMPROVEMENTS ARE IN ACCORDANCE WITH THE TERMS OF THE CONTRACT; ACCEPTING THE ENGINEERS' CERTIFICATE OF FINAL ACCEPTANCE; AUTHORIZING THE FINAL PAYMENT TO THE SAID A. C. CONSTRUCTION COMPANY, AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Authorize Bids - Phase I of the 1974 Street Improvement Program Mr. Lanham presented the plans and specifications for Phase I of the 1974 Street Improvement Program, and recommended approval for advertising for bids. Estimated cost for this phase of the program is $189,800, and will be paid with Revenue Sharing Funds. Councilman Pool moved to authorize advertising for bids; Councilman Lander seconded the motion: Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays: None Approve Request of Texas Highway Department for Spur- 330 Median The City of Baytown had originally requested a continuous left -turn lane on the extension of Spur 330, from Park Street to Garth Road. However, the Texas Highway Department has recommended that a sixteen -foot grass median be constructed in this portion, with only one cut in the median. This recommendation has been made because Spur 330 will be a six -lane highway, and a continuous left turn lane would be hazardous. The Department also feels that it would be hazardous to have this opening between the bridge and Park Street, because (1) the bridge will be elevated three & one -half to four feet above the present height, (2) there are three lanes of traffic on either side, and (3) the frontage road to Spur 330 will eventually tie in near Airhart Drive creating another potential hazard. THe possibility of relocating this frontage road has been discussed, however, this road is a part of the Spur 201 plans, which have already been approved at the federal level of the government. If the grass median is constructed as recommended by the Texas Highway Department, this will create a problem for one of Baytown's businesses, Hugh Wood Ford Company, whose driveway is located between the bridge and Park Street. The city administration has been in contact with the Highway Department, in trying to locate the median cut as close to this business as possible, without creating a severe traffic hazard. Mr. Lanham explained that the representatives of the highway department are very sincrer in trying to find a workable solution to this problem, and that they have indicated fihey will contact Mr. Wood personally in regard to this situation. The Highway Department has'requested council approval of the preliminary plans for the median. However, these plans are preliminary, and council will have an opportunity to approve final plans at a future date. Councilman Pool moved to approve plans for the median on Spur 330; Councilman Cannon seconded the motion: Ayes: Council members Lander, Wilbanks, Pool, Bednarsk.i, Dittman and Cannon Mayor Gentry Nays: None Consider Request of Texas Highway Department to Tie into Baytown's Water System The Texas Highway Department has requested permission to tie into the Baytown's water system at the intersection of Misaouri Street and Loop 201, because the water well which serves the Baytown - LaPorte Tunnel is beginning to fail. The Highway Department will pay- the entire cost of the ling, the meter and the tap. Because the tunnel is outside the city limits, the montly rate will be 14 time the regular rate charged Baytown citizens. Councilman Pool questioned if the proposed six -inch line would place too much pressure on the present lines. City Engineer Jack Morton explained that most of the usage would be in washing down the tunnel, which is done at 9:00 or 10:00 o'clock at night when the demand is low. Mr. Lanham suggested action on this request be delayed until the administration can determine how the six -inch line would affect the present water system. 5552 January 10, 1974 Appointments - Parks & Recreation Advisory Board Mayor Gentry requested council approval of the appointment of Mr. Charles Washington to the Parks & Recreation Advisory Board. Mr. Washington has been a Baytown resident for seven years. Councilman Dittman moved to approve the appointment; Councilman Bednarski seconded the motion: Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays: None Appointments - Electrical Board The Electrical Board presently has three vacancies: Position 1 -an electrical engineer employed by a public utility company within the city; Position 2 -an electrical contractor; Position 3 -a journeyman electrician. Mayor Gentry suggested postponing these appointments until the administration can contact the people that have served in thse positions, to see whether or not they would have an interest in continuing to serve. Traffic Channelization - Ward Road at Hi hw 146. The Public Works Department is in the process of widening Ward Road at its intersection with Highway 146. Mr. Lanham presented the plans for traffic channelization when the widening is completed, and recommended approval. Councilman Cannon moved to approve the recommendation; Councilman Pool seconded the motion. Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays: None Authrrize Final Payment for McElroy Park Play Slab Busch, Hutchison & Associates, consulting engineers, have recommended that final payment be made to Wolfe Construction Company for the McElroy Park play slab. Final payment is in the amount of $362.00. -Mr. Lanham concurred with the recommendation. CouncilmanPOOl moved to authorize final payment; Councilman Bednarski seconded the motion: Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays: None ORDINANCE NO. 1529 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING AND ACCEPTING CONSTRUCTION OF THE MCELROY PARK PLAY SLAB, JOB NO. 72 -538, BY WOLFE CONSTRUCTION COMPANY; FINDING THAT THE IMPROVEMENTS ARE IN ACCORDANCE WITH THE TERMS OF THE CONTRACT; ACCEPTING THE ENGINEERS; CERTIFICATE OF FINAL ACCEPTANCE; AUTHORIZING THE FINAL PAYMENT TO THE SAID WOLFE CONSTRUCTION COMPNAY, AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Direct Brown & Root to Proceed with Improvements to Tenth Street Proposed Ordinance No. 40110 -7 will direct Brown & Root to proceed with the improvements to Tenth Street, whh is an assessment paving project. The ordinance states than any liens Brown & Root cannot secure will be assumed by the City. This indebtedness will be paid directly to the contractor for the amount of each instance. The city will then place a lien on these properties for the amount of the assessment. If the ordinance is adopted, the City will assume an obligation of $11,805.46, which is the total of the assessments to four parcels of land, of which the owners have refused to sign a lien. Councilman Pool moved to adopt the ordinance; Councilman Lander seconded the motion: Ayes: Council members Lander, Bednarski, Pool, Wilbanks, Dittman and Cannon Mayor Gentry Nays: None 5553 ORDINANCE NO.1530 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DIRECTING BROWN & ROOT, INCORPORATED, CONTRACTOR, TO PROCEED WITH THE IMPROVING OF CERTAIN PORTIONS OF TENTH STREET FROM THE NORTH RIGHT OF WAY LINE OF FAYLE STREET TO THE SOUTH RIGHT OF WAY LINE OF WARD ROAD, IN THE CITY OF BAYTOWN, TEXAS, AGREEING UPON THE COMPLETION OF SAID IMPROVEMENTS AND THE ACCEPTANCE THEREOF BY SAID CITY IN ACCORDANCE WITH THE TERMS OF THE CONTRACT BETWEEN SAID CITY AND SAID CONTRACTOR, DATED JULY 24, 1973, THE CITY OF BAYTOWN WILL PAY THE CONTRACTOR FOR THE CONSTRUCTION OF SAID IMPROVEMENTS AND APPROPRIATE FUNDS TO COVER SUCH ADDITIONAL COSTS NOW PROVIDED BY THE TERMS OF SAID CONTRACT. Appointment to Civil Service Commission The appointment of a Civil Service Director will be made at a future meeting. Cable TV - Report to Council Mrs. Donna Grantom, manager of the cable TV company in Baytown, appeared to make a report on the progress of installing and providing cable service to all citizens of Baytown. Referring to a map, Mrs. Grantom pointed out the areas where new cable will be replaced with overhead cable. Work is expected to begin in the Country Club area shortly. Mrs. Grantom presented a list of customers, totaling 453 to date. Regarding Telepromptor's financial status, Mrs. Grantom explained that there are no anticipated cutbacks in expendutures in Baytown. Capital expenditures, other than capitalized labor, i.e., material in real estate purchased since the first of September is $105,963.00. A similar outlay of this type is expected for the year of 1974. Mrs. Grantom was requested to begin supplying council with a quarterly report on the operations and progress of Telepromptor in Baytown. This could accompany the quarterly franchise payment.
