MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
December 13, 1974
The City Council of the City of Baytown met in regular session, Thursday,
December 13, 1973, at 6:30 p.m. The following members were in attendance:

Mayor Gentry called the meeting to order and the invocation was offered by
the Reverend Lester Campbell, Pastor of Central Assembly of God Church.
Approve Minutes
Councilman Pool moved to approve the minutes of the meeting Held November 20, 1973;
Councilman Bednarski seconded the motion:

City Manager's Report
The program for providing transportation to the elderly has been in operation for
one week. Approximately 72 people are on the eligibility list, with an average of two
People per day taking advantage of the service. However, this number is increasing.
The Administration has looked into the possibility of regulating the blowing
of train whistles at crossings; however, the State places a duty upon railroads to
blow their whistles at crossings.
Several months ago, a grant was received from the Texas Traffic Safety Administration
to establish a full -time traffic safety position for the City of Baytown. At that time,
the planning and traffic functions of the City were combined into one department.
Mayor of the activities of this department are now closely related to the work
program that was proposed for traffic safety. For this reason, the possibility of
making traffic safety one of the_ responsibili ties of the City's department of planning
6 fraffic was discussed with the State's field coordinator. The grant could be altered
to financially support a portion of the cost of operating the department of planning
and traffic.
Council offered no objection to pursuing this proposal.
Council concurred to meetin in a work session, Friday, December 21 at 6:30 p.m.,
to review the study of industrial districts which was compiled by the administration.
Drainage Work - City crews are presently working on Goose Creek Drive, enlarging
the inlets to storm sewers. Work is complete on the Inwood - Pamela Street ditch, with
the exception of some cleanup. Crews have completed work on Kilgore Road, from.the
flood control ditch, south from Ward Road to Cedar Bayou Road.
City crews have started work on the widening of Ward Road at Highway 146.
Waterlines to the newly annexed area is 998 complete; a recomaendation for final
payment to the contractor should be made at the next council meeting.

The contractor for the Tenth Street project is in the process of securing liens.
Sports Complex - very little work has been accomplished since the last council
meeting; the engineer has urged Wolfe Construction Company to complete the work.
N. C. Foote swimming pool - the parking lot and sidewalks remain to the
constructed.

East District Infiltration Analysis the hydrographs and exhibits for the
report is being prepared by the engineer.
West District Infiltration Analysis - the metering stations have been installed,
and flows and bypasses at the Lakewood Plant are being determined.
Another letter will be written to the railroad companies indicating the work
that needs to be done at certain crossings within the city.
The legal department has not yet received the information requested form
the Cable TV station in Baytown. Mrs. Grantham, the new manager of Baytown
Telepromptor, has indicated that this information would be supplied before the
next council meeting. The information requested was (1) type of programming
available in Baytown (2) a map of the areas in which service is available (3) a
list of Baytown customers, and (4) clarafication of Telepromptor's financial status.
Councilman Cannon suggested that if this information has not been received
by the next council meeting, that the city attorney begin steps to avoid
Telepromptor's franchise.
Museum Advisory Board
Mr. Albert Fanestiel, representing the Museum Advisory Board, related the
Board's desire to construct a museum adjacent to City Hall. Mr. Fanestiel
presented a report on theBoard's activities during the past three and one -half years,
and a brief sketch of the proposed building and location.
The Board's recommendation is that Council consider the proposed site, and
if approved, that appropriate steps be taken to bind future councils to that decision.
Mayor Gentry requested the administration look into this matter, and whether
or not a council may legally designate a future site for the museum.
A report will be made by the administration at the next council meeting, in
January.
Sewer Extension - Baker & Decker Drive area-and newly annexed area
Mr. Ivan Langford, consulting engineer, presented the detailed plans and
specifications for extending sewer service to the -area of Baker and Decker Drive,
and to the newly annexed area of theBaytown Sports Complex. Estimated cost for the
project is $800,000; this may be financed from the 1970 Capital_ Improvement
Program funds, and Mr. Lanham recommended approval and "authorization for bids:

Two bids were received for the installation of waterlines in the Stewart
Heights Addition:

Mr. Lanham recommended awarding the low bid of R. T. Bishop, and that this
be paid from 1965 Capital Improvements Program, Waterworks Systems Account.

(3) The two five -yard cab D chasses trucks be awarded to low bidder, Hugh Wood

(4) The van truck was to be used to replace the old police ambulance, however,mr. Lanham
recommended reapairing the old ambulance in order to give three or four years more
service, and not awarding this bid.
(5) The bid on the ten yard cab 6 chassis truck should not be awarded, but re -bid as a
single unit and with a diesel engine.

Restrict Turning Movements - Wisconsin Street and Market Street
The Council Traffic Committee has recommended that signs be placed to restrict right
turns on Red for Wisconsin Street traffic entering Market Street near Louisiana;
Mr. Lanham concurred with the recommendation;

An appointment will be made at the next meeting to replace Mr. Vincent Canalas on the

Authorize Final Payment - North Main Street Storm Sewer
Construction of the North Main Street storm sewer has been completed; Mr. Lanham
recommended final payment be authorized to B & B Utility Contractors in the amount of
$5,821.40.

ACCEPTING CONSTRUCTION OF THE NORTH MAIN STREET STORM SEWER BY B & B UTILITY
CONTRACTORS, FINDING THAT THE IMPROVEMENTS ARE IN ACCORDANCE WITH THE TERMS
OF THE CONTRACT,ACCEPTING THE ENGINEER'S CERTIFICATE OF FINAL ACCEPTANCE,
AUTHORIZING THE FINAL PAYMENT TO THE SAID B & B UTILITY CONTRACTORS, AND

Request for Water Service Outside City Limits
Mrs & Mrs. W. K. Dunn, of 5512 East Road, have requested City of Baytown water
service. Mr. Lanham recommended council approve the request, as per the policy established
by council requiring that the person requesting the service will pay for the
installation of the service line and taps, plus pay a monthly water bill based on one
and one -half times the rate that city residents pay.

Designate Representatives B Alternates to the Houston Galveston Area Council
The Executive Director of the Houston Galveston Area Council has requested the
city council appoint one of its members to serve as a representative to the general
membership body and one representative to the executive committee; council is also
requested to appoint an alternate to these positions.
Councilman Pool moved to appoint Councilwoman Wilbanks to the general membership
body, and Councilman Cannon to the executive committe, and Councilman Dittman as alternate.

The Goals for Baytown Steering Committee has requested each of the three govern-
mental bodies that appointed it to donate $250 for operating expenses. Mr. Lanham

Accept Terms of Texas Highwag Commission Minute () der - Spur 330
The Texas Highway Commission has asked that council accept the provision of their
Minute order No. 68225 in regard to Spur 330. The minute order provides that the city will
furnish all required right of way (additional right of way is not needed, however) adjustment
of utilities, construction of curb a gutter where none now exists, storm sewer, driveways
and sidewalks as may be required. The Highway Department will provide grading, structures,
and surfacing, at an estimated cost of $593,600. The cost to the city is estimated to be
$82,100 for storm sewers, $12,900 for curb 6 gutter, and $2,000 for relocation of 200 feet
of a 2 -inch waterline.
Mr. Lanham recommended council approve the provisions of the minute order, and
suggested that the storm sewer construction be paid from bond funds, and that property
owners be assessed for curb 6 gutter; however, this decision will be made at a later date.

ORDINANCE NO. 1520

Consider Bid for Development of Polly Park
One bid was received for the development of Polly Park, and was approximately
$6,000 above the estimate. After reviewing the bid, the consulting engineer and Parks
director has recosmended that the bid be rejected, and that plans be revised and
readvertised in order to stay within the estimate; Mr. Lanham concurred with the
recommendation.

Rescind Ordinance No. 1505, Award Bid for Playground Equipment for Pelly &
Central Heights Park
Ordinance No. 1505 was adopted at the last council meeting, awarding the
bid ofor playground equipment for Pelly & Central Heights Parks. However, the caption
of the ordinance contained an error, in that the amount appropriated for the
purchase was only for one park. Proposed Ordinance No. 31213 -12 will rescind that
ordinance, and appropriate $11,382.55 for the purchase of equipment for both parks.

Grant Office Space in Police Administration Building to Harris County
The District Clerk of Harris County has requested that the Baytown Police &
Municipal Court Building be designated as a Harris County Courthouse annex for the
purpose of recording the filing of felonies and county court misdemeanors. Under
this system, an assistant district attorney is present in the intake section to
work with police officers in filing criminal charges. Office space will be provided
for the attorney, and this agreement may be terminated at any time by the City.
Proposed Ordinance No. 31213 -13 will designate certain office space as a
Harris County Courthouse Annex; Mr. Lanham recommended approval.

Abandon and accept dedication of Utility Easements - Corner of Hiway 146 & Defee St.
Mr. W. L. Jones, Jr., owner of Lots 6 & 5, Danubina Acres, has requested
the city abandon a 10 -foot utility easement which runs between these lots, and
that it accept dedication of a 10 -foot easement along the rearof Lot 5, so that
the adjoining property may be served with natural gas.
The easement that Mr. Jones has requested thecity to abandon has never
been utilized. Mr. Lanham recommend this request( be approved.

Garth Road Project
Mayor Gentry requested the Council indicate its desire to either have the
contractor for Garth Road to proceed with the improvements, or to change the design
of the project so as to include the raising of Garth Road bridge.
