1973 05 11 CC Minutes, Emergency5426 a1 " MINUTES OF THE EMERGENCY MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN May 11, 1973 The City Council of the City of Baytown met in emergency session, Friday, May 11, 1973, at 6:00 p.m., in theCouncil Chamber of the Baytown City Hall. The following members were in attendance: Jody Lander Councilman. Mary Wilbanks Councilwoman Henry Dittman Councilman Allen Cannon Councilman Tom Gentry Mayor * Fritz Lanham City Manager Neel Richardson City Attorney Belinda Bingham Deputy City Clerk Howard Northcutt Absent: Edna Oliver City Clerk Charles Pool Councilman Mayor Gentry called the meeting to order to consider the possibility of changing the base material for the parking area at the new Police & Court Building, from cement stabilized shell to crushed limestone. Mr. Delbert VanCleve, contractor for the police building, explained that the change in the base material is necessary because of the unavailability of cement stabilized shell. Although he has documented papers which guaranteed delivery of the shell base in April, the supplier, Highlands Shell Company, will not assure delivery for another month. Mr. Otts, sub- contractor for the driveway paving, has a supply of limestone available to him, and promised delivery of 2200 tons to the site by Saturday. Mr. VanCleve stated that to his knowledge, there would be no difference in cost of limestone and shell; the change in base material was requested in order to expedite completion of the police building site. Mr. Jim Hutchison, consulting engineer for this project, informed council that Mr Bitsy Davis, architect, has approved the change in base material with the condition that a letter of credit is given the city, because limestone is less expenssi•e than shell. From an engineering standpoint, the limestone and shell are of equal quality when certain specification are met, i.e., (1) the specifications of the driveway call j for a 7 -inch layer of cement stabilized shell; if limestone is used, proper engineering specifications would call for 8 inches. However, the subgrade is already in place and the curbs have been poured in preparation for the 7 inch layer. The driveway is guaranteed for one year in the contract with VanCleve Construction Company; and Mr. VanCleve assured Council he would honor that guarantee if the limestone is substituted, whether or not it meets specifications regarding equivalency to cement stabilized shell. Council discussed the feasibility of the contractor re- excavating the entire area to meet the specifications for limestone, or using a lesser amount than standard specifications require to be equal to the shell base. If limestone is not used, the possibility of a substantial delay in the completion of the police building exists. Mr. Hutchison advised that if council chooses to allow the contractor to substitute limestone for shell, whether it meets proper engineering specifications or not, the City is due a financial consideration from the contractor. ' Mr. Otts then offered to refund 200 per ton of limestone to the City. ( *Mr. Lanham present) Mr Hutchison cited figures given by Mr. Otts during earlier discussion. THe present cost of cement stabilized shell is $6.15 per ton; the present cost of crushed limestone is $5.10 per ton. Mr. Hutchison pointed this is a 'i.fference of $1.05 per ton. If the city agrees to pay 160 per ton for the extra labor required in working limestone, a difference of 900 still remains. Mr. VanCleve Stated he :: ould match the Mr. Ott's offer, for a total refund of 400 per ton of limestone to the City of Baytown; however, when questioned, Mr. VanCleve refused to make a higher offer. Counc.ilmariDittman moved to acdept the 400 per ton refund, and proceed with the project; Councilman Dittman seconded the motion: Ayes: Council members Lander, Wilbanks, Dittman and Cannon Nays: Mayor Gentry There being no further business to transact, Council voted unanimously to adjourn.
