1973 02 08 CC Minutes5370 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF RAYTOWN February 8, 1973 The City Council of the City of Bayta met in regular session, Thursday, February 8, 1973, in the Council Chamber of theeaytown City Hall; the following members -were in attendance: Jody Lander Councilman Tom Gentry - Councilman Charles Pool Councilman C. Glen Walker Mayor Fritz Lanham City Manager Neel Richardson City Attorney Edna Oliver City Clerk Howard Northcutt Absent: Jim McWilliams Councilman Mayor Walker called the meeting to order and the invocation was offered by the Reverend Bob McCreary, Pastor of Eastside Baptist Church. Minutes of January 25, 1973 Mayor Walker called for consideration of the mintues of January 25, 1973. Councilman Pool moved to approve the minutes as printed; Councilman Walker seconded the motion: The vote was unanimous in favor. Minutes of January 26, 1973 Mayor Walker called for consideration of the minutes of January 26, 1973. Councilman Lander moved to approve the minutes as printed; Councilman Pool seconded the motion. THe vote was unanimous in favor. City Manager's Report Revenue Sharing Funds - The data used by the Treasury Department in determining allocation of Revenue Sharing Funds was checked by the City's finance department; there appears to have been errors made in two of the factors. (1) Adjusted Taxes - Data used was for the fiscal year ending September 30,1070 instead of 1971. This results in a difference of one -half million dollars, partly because 1971 generated a full year of sales tax, and 1970 did not. (2) Intergovernmental Transfers (federal funds) A difference of $22,000 has been determined, although this is not a significant amount. A letter was sent to the Treasury Department pointing out the discrepancies; there is a possibility that industrial district payments may be included in the adjusted tax factor, and clarification of this has been requested also. HUD - An application was submitted to HUD for funds to develop Goose Creek, Polly and eayland Parks; however, because many federal programs have been substantially reduced, funds are not anticipated this year of next year. In compliance with criteria established by the Texas Highway Commission, the city's Department of Planning and Traffic is making Changes in standards for traffic signs and street striping. All changes must be compiled with by 1977. Utility Advisory Council - The Texas Municipal League recently met with representatives of cities for the purpose of organizing cities in their plights to deal effectively with the rate - making problems of utilities. This was prompted by the proposal of the Legislature to introduce Legislation for state -wide control of certain utilities. Most representatives at the meeting indicated preference that control remain with the cities rather than a branch, or commission, of the state. 5371 A-2 - 73 The TNL could act as a central figure in assisting cities in the zeta. making process, by hiring personnel who would deal with nothing but this problem, or by dissiminating information between various cities. The representatives requested to seek guidance, or suggestions, from their respective governing bodies as to what extent they would like to participate. In order to .give Council time to formulate opinions and ideas, this will be considered at the next meeting. Street improvement - Bids will be received March 1 for streets to be improved with Revenue Sharing Funds. Capital improvements - West Main Sewage Treatment Plant expansion - most of the concrete for the aeriation basin and lift station is in place; the clarifier floor is in place and forms have been set for the walls. Sanitary Sewer improvements, Contract #2 - Lift Stations - The contractor began work February 51 and is presently excavating for the West Texas lift station. Sanitary Sewer Improvements, Contract R3 - a work order has been issued and work will begin February 19. Police arld Court Building - Work inside the building is continuously progressing; site work has been delayed by rain. Perimeter Road - The contractor is placing lime on West Bayshore; the waterline is 50% complete. Water Well - A line break at Decker and Baker Drive has delayed putting the well in service; the contractor is repairing the line. Westwood Park - the wading pool concrete has been poured & clearing has begun Duke Rill Park - clearing and site work has begun Tejas Park - work has not started Roseland Park - construction is underway on the boat ramp and bulkhead. Wye Drive - construction is underway Preliminary plans for the public works building should be presented at the next Council meeting. - Mr. Doug Lunsford, new Director of Public Works, briefed Council on the various sewer line collapses, and what repairs are being made. Mr. L. D. Knox, a resident of 600 Pearl Street in Baytown, requested - consideration be given to the repair of Sixth Street and Pearl Street. Mr.. Lanham presented an estimate for citizen participation paving, based on the maximum allowed for participation paving: $16.95 per front foot on Sixth Street and $14.68 per front foot on Pearl; this includes curb and gutter. If the residents of the areas are in favor an an assessment paving project, this could be put in petition form. February 8, 1973 5372 Public Hearing - Annexation area of Sterling High School Mayor Walker declared the public hearing open for the annexation of land in the vicinity of Sterling High School and the Baytown Sports Complex. Mr. Billy Angel, a property owner on North Main Street, questioned the cost of water and sewer service to the residents of the area. Mr. Lanham reviewed the tap charges fox water and sewer as follows: Water 314" tap - $75 Sewer Residential Commercial - 1" tap - $150 111" tap - $275 $1.50 per front foot, plus $35 tap, plus $50 sewage treatment capacity expansion fee 10 per square foot, plus $35 tap, plus $50 sewage treatment capacity expansion fee Mr. Lanham noted these fees do not include extending the lines onto the private properties. Mr. Calvin Broussard explained that Teleprompter Cable TV may erect a tower in the center of 211 acres in this area. There will be a garage for company trucks with one bathroom facility. Mr. Broussard questioned if his company would have to pay approximately $1,000 for this one facility. Mr. Richardson pointed out a provision in the sewer ordinance pertaining to small building on large, undeveloped tracts of land; however, each case would have to be considered separately. Mr. Doug Green, a resident of Dent Drive, stated he is opposed to being annexed by the City of Baytown. Mr. Angel suggested Council give the residents of the area in question a special, or reduced, reate for water 6 sewer extension. There being no one else to speak in favor or opposition to the proposed annexation, Mayor Walker declared the public hearing closed. Change Fire Zones Mr. Lanham reviewed the proposed changes in the fire zones, and recommended approval of proposed Ordinance No. 30125 -5, adopting the change. Residents and property owners in the areas of the change have offered no response whatsoever since the last Council meeting. ORDINANCE N0. 1356 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 7, "BUILDINGS," BY AMENDING ARTICLE I, IN GENERAL, SECTION 7 -1, THEREOF, SO AS TO REPEAL THE PROVISION OF SUCH SECTION AS PRESENTLY CONSTITUTED, AND TO SUBSTITUTE IN ITS PLACE NEW PROVISIONS, REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Offshore Operations Committee Mr. Ronald Baker, Engineering Manager for Exxon's Production District Office near Lee College, appeared to request Council's support in pursuading the U. S. Department of Interior to proceed with sale of oil 6 gas leases on 129 federal tracts Of submerged lands in the Gulf of Mexico, off Texas and Louisiana. A public hearing will be held February 21 in Houston by the Bureau of Land Management where opinions will be heard on offshore operations. Mr. Baker stressed the improtance to Baytown and the entire country that the government proceed with the leasing; approximately .� 25% of our current petroleum consumption is imported from mideastern countries and by 1985 this will increase to 60% if the present government policies are continued. Following discussion with Mr. Baker, Councilman Gentry moved to instruct Mr. Richardson to prepare a resolution supporting the lease sale; Councilman Cannon seconded the motion: Ayes: Councilmen Lander, Gentry, Pool, Walker and Cannon Mayor Walker Nays: None 441-y 5373 LE February 8, 1973 Cable TV - Teleprompter Corporation Mr. Calvin Broussard, Systems Manager for Teleprompter Corporation, appeared to give Council a report on progress being made to rebuild the City's cable system. Funds have been allocated for construction in all physically developed areas of the city, for a 32- channel capacity, and for two -way service for all public buildings, hospitals, and all schools. A contract for the construction, or rebuilding, should be let by March 1; the contractor will then have eight weeks to complete the stran - mapping and design the system, afterwhich actual construction will begin. Preliminary engineering readings are being made on three possible sites to locate the 150- microwave tower; local origination will begin February 19. Mr. Broussard indicated he would present another report when construction on the system begins. Award Bid - Fire Department Uniforms - Ordinance No. 30208 -1 Two bids were received for uniforms for the fire department: Edelman's - $1,740.00 Factory Sales Company - $2,185.00 Mr. Lanham recommended accepting the low bid of Edelman's. Councilman Pool moved to adopt the ordinance awarding the bid as recommended; Councilman Lander seconded the motion: Ayes: Councilmen Lander, Gentry, Pool, Walker and Cannon Mayor Walker Nays: None ORDINANCE NO. 1357 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF EDELMAN'S FOR THE PURCHASE OF UNIFORMS FOR THE FIRE DEPARTMENT OF THE CITY OF BAYTOWN AND AUTHORIZING THE PAYMENT OF THE SUM OF ONE THOUSAND SEVEN HUNDRED FORTY AND NO 1100 ($1,740.00) DOLLARS WITH REGARD TO SUCH AGREEMENT. Proposed Ordinance No. 30208 -3, Prohibit Posting Placecards, Bills, etc. on public Property As authorized at the last Council meeting, an ordinance was prepared to prohibit posting all advertising matter and signs, which currently requires a permit and bond, on all public property. This does not include charitable organizations that are not required to post bond. Confirm Appointments to Firemen's and Policemen's Civil Service Commission The term of office for the three members of the Civil Service Commission is three years, however, there is no record of appointments for the past several years. In order to put the appointments back on schedule, one each year, Mr. Lanham recommended Mr. Robert Beeman be reappointed for a term to expire December 31, 1974, and Mr. Sam Alford be appointed for a term expiring December 31 of this year. Councilman Cannon moved to confirm the.appointments; Councilman Lander seconded the motion: . Ayes:. Councilmen Lander, Mayor Walker Nays: None Gentry, Pool, Walker and Cannon Proposed Ordinance No. 30208 -4, Amend Code, Garbage and Trash As requested by Council at a recent meeting, a study was made of the rates charged private haulers for use of the city's landfill. The actual cost to bury garbage at the landfill is 440 per cubic yard; private haulers from outside the city are charged 500. Haulers from inside the city limits are charged 250 per cubic yard; it has been determined this is a reasonable charge because it would be more expensive to the City to assume the responsibility of commercial collections within the city. However, because the-County recently closed its Crosby area landfill, approximately one-third of the persons using the City's landfill are Harris County residents. Mr. Lanham recommended Council adopt proposed Ordinance No. 30208 -4, which will prohibit persons, who are not residents of Baytown, from dumping at the City's landfill, unless approval is given by the City Manager and City Council. Councilman Gentry moved to adopt the ordinance; Councilman Cannon seconded the motion.. Mr. Refugio Martinez stated his opposition to Council's having recently raised the residential garbage rates, and now proposing to leave commercial rates the same. Mr. Clarence Johnson of the Texas Water Quality Board, urged Council to consider the problems that will arise if County residents are not allowed to use Baytown's landfill. There are only two other county dumps - one in Laporte, and one in the vicinity of Highway 90 owned by American Refuse. Mr. Johnson suggested Baytown has some obligation to its ex.territorial. jurisdiction; he urged Council to inform Harris County Commissioners if the proposed ordinance is passed, in an effort to encourage them to.provide a.county dump as soon as possible. Councilman Lander moved to amend the motion and have the ordinance become effective thirty days aft e r passage; Councilman Walker seconded the motion. The vote on the motion as amended follows: Ayes: Councilmen Lander, Gentry, Pool, Walker and Cannon Mayor Walker Nays: Councilman Walker 5375 February 8, 1973 ORDINANCE NO. 1359 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF RAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 14, "GARBAGE AND TRASH ", BY AMENDING SECTIONS 14- 13,14 -14, AND 14 -15 TO REPEAL THE PROVISIONS OF SUCH SECTIONS AS PRESENTLY CONSTITUTED AND TO SUBMIT IN THEIR PLACES NEW SECTIONS; MAKING IT UNLAWFUL FOR ANY PERSONS TO DEPOSIT OR DUMP GARBAGE, TRASH, OR REFUSE COLLECTED OUTSIDE THE CITY LIMITS OF THE CITY OF BAYTOWN, OR AREAS WHICH ARE NOT DESIGNATED BY THE CITY MANAGER AND APPROVED BY THE CITY COUNCIL IN ANY LANDFILL OWNED OR OPERATED BY THE CITY; REPEALING ORDINANCES INCONSISTENT HEREWITH, CONTAINING A SAVINGS CLAUSE, AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. 4 Mr. Lanham recommended the residents of the area between the City limits and Interstate 10 be allowed to use the Coady landfill at a rate of 500 per cubic yard. Councilman Cannon moved to accept the recommendation; Councilman Lander seconded the motion: Ayes: Councilmen Lander, Gentry,.POOl, Walker and Cannon Mayor Walker Nays: None Proposed Ordinance No. 30268 -5, Agreement with State Proposed Ordinance No. 30208 -5 will authorize entering into an agreement with the Texas Highway Department for maintenance of the traffic signal at Airhart Drive and Decker Drive, which the state will install. This is a standard agreement, whereby the City will assume all operational costs and maintenance. The city will also provide for interconnection with the signal at Park and Decker Drive. Authorize Testing of Plastic Refuse Bags Council previously authorized a test using paper bags for garbage . collection, however, after some investigation of other cities, and comparison of cost of plastic bags vs. paper bags, Mr. Lanham recommended proceeding with the test using plastic bags. Mr. Northcutt explained the test will determine if the City should convert to use of plastic bags for garbage collection, if the residents will accept use of the bags, if the bags will provided for cleaner streets and a neater City, and many major problems related to use of plastic bags. The areas to be tested are Craigmont Place, Pondersos, Lantern Park, Xountry Xlub Village, Country Club Oaks, Denny Acres, Wooster Terrace, Wooster Terrace Extension, Sterling Baytown, Brown and Iddings, and Sweeny No. 1; this represents approximately 850 -950 residents, or 1,900 garbage containers on a normal pickup day. Residents will be provided with four bags per week for twelve weeks; time sheets will be kept to determine the efficiency of using bags. Following conclusion of the twelve weeks, a questionnaire will be sent to the residents. Their response, along with the time records, will be evaluated and a recommendation will be made to Council. Councilman Lander moved to proceed with the test; Councilman walker seconded the motion: Ayes: Councilmen Lander, Gentry, Pool, Walker and Cannon Mayor Walker Nays: None 6E Yebruary 8, 1973 5376 Consider Plans and Specifications - Central District Sanitary Sewer Contract #4 Cnetral District Snaitary Sewer Contract #4 includes gravity sewer and force main lines from West Texas Avenue to Sp r 201 right -of -way; estimated cost is $409,447.50. Council reviewed the plans and specifications for this project with Mr. Ivan Langford; Councilman Gentry moved to authorize bidding on the project; Councilman Pool seconded the motion. Bids Will be advertised to be received March 13. Ayes: Councilmen Lander, Gentry, Pool, Walker and Cannon Mayor Walker Nays. None Proposed Ordinance No. 30208 -6, Retirement Plan Mr. J. B. LeFevre explained proposed Ordinance No. 30208 -6 will implement the optional retirement plan for employees earning more than $500 per month, and employees currently not enrolled in the Texas Municipal Retirement System. Contributions will be based on 5% earnings in excess of $500, and 5% of full salary for those not in TMRS. The City's contribution will be 5.6 %. The retirement benefit is the total amount accumulated in cash or in various settlement options. Retirement age is same as TAW. Vesting will be credited at 10% per year following five years' service, or 100% vested at 15 years' service. Past service credit will be given for determination of years of service. The disability or death benefit is the employee's accumulated contribution or the vested amount of employee's contribution. Resolution No. 427 - Apply for Grant - League of Women Voters Park Resolution No. 427 will authorize an application for grant for development funds for the League of Women Voters Park, to the Texas Parks & Wildlife Department - Bureau of Outdoor Recreation. February 8, 1973 Proposed Ord. No. 30208 -7, Contract with City of Houston Sometime ago, Council agreed to allow the City of Houston to erect a radio antenna atop the water tower at James and North Seventh Streets. Proposed Ordinance No. 30208 -7 will formalize the agreement by contract. Councilman Gentry moved to adopt the ordinance; Councilman Lander seconded the motion. Mr. Jack Morton explained that the antenna will not be detrimental to the tower or surrounding citizens, such as television interference; a repeater building, 12'x20' will be constructed in the northwest corner of the fenced area around the tower, which the City does not plan to occupy. Since the antenna will be used for area -wide radio surveillance, the City of Houston has indicated that Baytown will be allowed use of the antennat however, this was not provided in the contract. Councilman Gentry moved to amend his motion to have the contract include use of the antenna by the City of Baytown, and a provision whereby Baytown may terminate the contract at such time the antenna is determined to be a nuisance to the citizens; Councilman Pool seconded the motion: Ayes: Councilmen Lander, Gentry, Pool, Walker and Cannon Mayor Walker Nays: None The vote on the motion as amended follows: Ayes: Councilmen Lander, Gentry, Pool, Walker and Cannon Mayor Walker Nays: None ORDINANCE NO. 1362 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY OF BAYTOWN TO EXECUTE ANDATTEST TO A CONTRACT WITH THE CITY OF HOUSTON TO INSTALL AND OPERATE A RADIO REPEATER FACILITY ON TOP OF THE WATER TOWER AT JAMES AND NORTH SEVENTH STREETS IN THE CITY OF BAYTOWN, TEXAS, AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
