MINUTES OF THE SPECIAL MEETING
OF THE CITY COUNCIL OF THE CITY OF RAYTOWN
December 21, 1972
The City Council of the City of Baytown met in special session Thursday,
5:00 p.m., with the following members in attendance:

Mayor Pro Tem Cannon called the meeting to order and the following business
was transacted:
Award Bid - Garth Road Improvement
Bids were received November 28 for Garth Road improvement:
Warren Brothers Company Durwood Green Construction Brown & Root, Inc.
$1,145,740.12 360 days $1,153,996.00 200 days $1,1561864.10 215 dayl
Although Warren Brothers was low bidder, Mr. Johnny Busch pointed out the
360 working days designated in their bid, as compared to the 200 working days of the
second low bidder, Durwood Green Construction. He explained a working day is
defined as exclusive of Saturdays, Sundays, legal holidays, and days that the weather
conditions do not permit work. There is a, maximum of approximately 250 working days
in one calendar year, weather permitting.
Mr. J. D. Stanley, representing Warren Brothers, stated the bid was in error
in that the 360 days was in reference to calendar days. He further stated it would
not be financially feasible to slow progress that length of time, and guaranteed
Council an early completion of Garth Road.if awarded the bid. *Councilman Cannon present.
Mr. Richardson explained that although Mr. Stanley has guaranteed an earlier
completion date of the project, if Council awards the bid to Warren Brothers, they may
legally utilize the full 360 working days.
Following discussion, Councilman Gentry moved to award the bid to Warren Brothers;
Councilman Pool seconded the motion:

ORDINANCE NO. 1320
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING
THE BID OF WARREN BROTHERS CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF
GARTH ROAD IMPROVEMENTS, AUTHORIZING THE CONTRACTING OF INDEBTEDNESS
BY THE CITY FOR THE SUM OF ONE MILLION ONE HUNDRED FORTY FIVE THOUSAND,
SEVEN HUNDRED FORTY AND 12/100 ($1,145,740.12) DOLLARS WITH REGARD TO
SUCH AGREEMENT.

Award Bid - Wye Drive
Two bids were received November 28 for Wye Drive. The tabulation follows:
Brown & Root, Inc. Warren Brothers
$37,730.05 30 working days $38,693.40 60 working days
As requested, Mr. Lanham prepared an estimated cost using city forces to
construct Wye Drive extension. Material cost is estimated at $12,192.00, and
labor and equipment - $18,000 making a total of $30,000. However, because of
the time factor in finishing the street, Mr. Lanham recommended accepting the low
bid of Brown & Root, Inc. Councilman Dander moved to award the bid as recommended:

ORDINANCE NO. 1321
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING
THE BID OF BROWN & ROOT, INC., FOR THE CONSTRUCTION OF WYE DRIVE EXTENSION
AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF
THIRTY -SEVEN THOUSAND SEVEN HUNDRED THIRTY AND 05 /100 ($37,730.05) DOLLARS
WITH REGARD TO SUCH AGREEMENT.

Retain Special Counsel - Conversion to Surface Water
As requested by Council, Mr. J. Wiley Caldwell of the law firs of Fullbright,
Crooker & Jaworski, was contacted in regard to conversion to surface water.
Mr. Richardson sexplained that Mr. Caldwell would represent the City in connection
with drafting and obtaining passage of legislation creating a Baytown Area Water
Authority; would assist in the initial organization of a board of directors of the
1010ft authority; would assist in issuance of revenue bonds - this would be on a separate
contract and is generally included in the fiscal agent contract; and would assist
in negotiations for obtaining a supply of surface water. The charges of Mr. Caldwell's
firm are:
a) $75 per hour for work done by senior partners;
b) $60 per hour for work done by attorneys with more than 5 years' experience;
c) $50 per hour for work done by all other attorneys
d) $15 per hour for administrative and clerical work to be done.
e) other actual expenses, such as travel, will be additional.
Proposed Ordinance No. 21221 -3 would approve the proposal and retain Mr. Caldwell and
his firm. Following discussion of Mr. Caldwell's services, Councilman Walker moved to
adopt the ordinance; Councilman Lander seconded the motion:
Ayes: Councilmen Lander, Pool, Walker and McWilliams

THE PROPOSAL OF THE HONORABLE J. WILEY CALDWELL OF THE LAW FIRM OF FULLBRIGHT,
CROOKER, AND JAWORSKI, DATED DECEMBER 19, 1972, ATTACHED HERETO AND MADE A
PART HEREOF, AND RETAINING SAID FIRM FOR PROFESSIONAL SERVICE TO BE RENDERED
IN THE FORMATION OF THE BAYTOWN AREA WATER AUTHORITY, CONSISTENT WITH THE TERMS,
40N� RATES, AND FEES SET FORTH IN SAID PROPOSAL, AND PROVIDING FOR AN EFFECTIVE
DATE HEREOF.
Award Bid - Repair Roof on Fire Station #2
Informal bids were received for re- roofing Fire Station #2 on Market Street:
Downing Roofing Company: $1739.00 AAA Industries $1890.00
Mr. Lanham recommended approval of the bid of Mr. Downing. Although guarantees were
not requested in the bids, Fire Chief Bailey noted Downing Company placed the original
roof on Station #2, which has lasted 19 years. Councilman Walker moved to award
the bid as recommended; Councilman McWilliams seconded the motion:

ORDINANCE NO. 1323
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING
THE BID OF DOWNING ROOFING COMPANY FOR THECONSTRUCTION OF A NEW ROOF ON
FIRE STATION NO. 2, AND AUTHORIZING THE PAYMENT BY THE CITY OF THE SUM OF
ONE THOUSAND SEVEN HUNDRED THIRTY NINE AND N01100 ($1,739.00) DOLLARS WITH
REGARD TO SUCH ACCEPTANCE.
Council meeting date
Upon the motion made by Councilman Walker and seconded by Councilman Gentry, {.-
Council voted unanimously that the next Council meeting will be the second
Thursday in January, which is the regular meeting day.
Adjourn
There being no further business to be transacted, Mayor Pro Tem Cannon
adjourned the meeting to an Executive Session.
