1972 07 18 CC MinutesIMF MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN July 18, 1972 The City Council of the City of Baytown met in regular session on Tuesday, July 18, 1972, at 6:30 p.m., in the Baytown City Hall with the following members in attendance: Jody Lander Councilman Tom Gentry Councilman Charles Pool Councilman Jim McWilliams Councilman C. 0. Walker Councilman Allen Cannon Councilman C. Glen Walker Mayor Fritz Lanham City Manager Neel Richardson City Attorney Edna Oliver City Clerk Howard Northcutt Administrative Ass't. Mayor Walker called the meeting to order and the invocation was offered by Dr. Robert B. Moore, Jr., Pastor of Grace Methodist Church. Approve Minutes Mayor Walker called for consideration of the minutes of the regular meeting of July 6, 1972. Councilman Walker moved to approve the minutes as submitted; Councilman Pool seconded the motion. The vote was unanimous in favor. Mayor Walker called for consideration of the minutes of the special meeting of July 13, 1972. Councilman Lander moved to approve the minutes as submitted. Councilman Walker seconded the motion. The vote was unanimous in favor. Police Reserve Force The Baytown Auxiliary Police Force was created in 1958. In 1971, State Law was passed and authorized cities to create such forces. Mr. Richardson has prepared an ordinance which will bring our reserve force in compliance with state law by the following items: - Membership within the force shall be at the discretion of the Police Chief; the City Council shall establish a maximum membership. - Members shall act only in a supplementary capacity to the regular police force, and in no case assume the full -time duties of the regular officers without first complying with all requirements of the regular officers. - Members must conform to all minimum training standards as do regular officers. -A member may not carry a weapon until he has been approved by the City Council, and then only when authorized by the Chief of Police. Probable need for the auxiliary would arise during civil defense emergencies, civil disorders, school carnivals, little league games, etc. The maximum membership has been designated in the ordinance as twelve (12). Presently, approximately ten (10) members have completed the minimum training required. Councilman Gentry moved to adopt the ordinance which will bring the auxiliary in compliance with state law. Councilman Lander seconded the motion. Following discussion of the limited membership, Councilman Lander moved to amend the ordinance to allow twenty (20) members. Councilman Walker seconded the motion. The vote on the amendment follows: Ayes: Councilmen Lander, Gentry, Pool, McWilliams, Walker and Cannon Mayor Walker Nays: None "- Councilman Cannon suggested the possibility of requiring a bond for each reserve policeman. Mr. Richardson indicated this would be advisable as the Chief of Police is responsible for the reserve force, and will look into the matter. Mayor Walker called for the vote on the motion to adopt the ordinance, as amended. Ayes: Councilmen Lander, Gentry, Pool, McWilliams, Walker and Cannon Mayor Walker Nays: None ORDINANCE NO. 1259 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF CHAPTER 2, ADMINISTRATION, SO AS TO REPEAL SECTION 201, AUXILIARY POLICE DEPARTMENT, CREATED; SUBJECT TO CHIEF OF POLICE, AS PRESENTLY CONSTITUTED AND TO SUBSTITUTE IN ITS PLACE A NEW SECTION 2 -1, POLICE RESERVE FORCE; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE. 5271 Regular Meeting, July 18, 1972 allowed. Following discussion of the summary, Councilman McWilliams moved to accept the recommendation of Mr. Davis. Councilman Gentry seconded the motion. Ayes: Councilmen Lander, Gentry, Pool, McWilliams and Cannon Nays: Councilman Walker Mayor Walker Sewage Treatment Capacity Fee - Rollingbrook Apartment Development On December 3, 1970, Council passed an ordinance requiring a fifty dollar fee for hook -ups to the sewage treatment system. At that time, there was some discussion before Council regarding projects which were pending at that time, and whether or not a project had final approval of the Planning Commission, or if it were such a project that did not require approval of the Commission, or whether or not a building permit had been issued. The Rollingbrook Apartment Project (TIPCO) did not have to have Planning Department approval, in that a master plan for the entire project, including the shopping center and residential units, had been approved. Through research by James Sanders, Assistant Planner, it has been determined that an application for a building permit was on file at the time Council passed the ordinance. Therefore, the developer of this project, TIPCO, feels they were intended to be exempt from the fifty dollar fee. Following a presentation by Mr. William Laughlin, attorney representing TIPCO, Councilman Cannon, a member of the Council when the ordinance was passed, indicated that Council would have excluded TIPCO project had they known it was pending. Councilman Cannon moved to determine this project did not come within the terms of the Ordinance and was not covered thereby, and was not intended to be covered thereby. Ayes: Councilmen Lander, Gentry, Pool, McWilliams, and Cannon Mayor Walker Nays: None Signalization of Spur 330 and San Jacinto Several months ago, the Highway Department installed a traffic signal at the intersection of Spur 330 and San Jacinto Street, and the City was requested to assume responsibility of maintenance, operation, and power costs of the signal. Since then new equipment has been installed, and Mr. Lanham recommended adopting Ordinance No. 20718 -4, which will authorize the City to enter into an agreement with the Department. Councilman Gentry moved to accept the Administration's recommendation and adopt the ordinance. Councilman Cannon seconded the motion. Ayes: Councilmen Lander, Gentry, Pool, McWilliams, Walker and Cannon Mayor Walker Nays: None ORDINANCE NO. 1257 AN ORDINANCE PROVIDING FOR THE APPROVAL OF THE AGREEMENT DATED JULY 18, 1972, BETWEEN THE STATE OF TEXAS AND THE CITY OF BAYTOWN, TEXAS, FOR THE INSTALLATION, CONSTRUCTION, EXISTENCE, USE, OPERATION, AND MAINTENANCE OF HIGHWAY SIGNAL PROJECTS AT THE LOCATION IN THE CITY OF BAYTOWN SHOWN ON EXHIBIT 1 OF SAID CONTRACT, ATTACHED HERETO AND MADE A PART HEREOF; PROVIDING FOR THE EXECUTION OF SAID AGREEMENT. Committee Reports Councilman Walker reported a meeting of the Mobile Home Review Board held Thursday, July 13, in which revenue from mobile homes was discussed. There is some question that revenue received is on a fair and equitable basis; the legal department is presently researching the Pasadena and LaPorte ordinances. 7 Councilman Lander called a meeting of the Wrecker Committee for Wednesday, on July 26, at 5:00 p.m., provided the City Manager and City Attorney can attend. An nal ordinance has been prepared for approval. Regular meeting, July 18, 1972 5272 City Manager's Report -Work has been completed on the water well on East James Street. Samples are being taken and sent to the Health Department; the well should be back in service in a few days. The contractor has returned to work on the well in the Polly area, and this well should be back in service shortly. -Mr. Lanham met with the business people surrounding the traffic circle regarding the plan Council has reviewed. Copies of the plan were given to the businessmen; for their study and opinions. -Mr. Lanham has met with the Downtown Merchants regarding the proposed improvements to Defee and Sterling, and they endorse making the streets one -way from Decker to Hiway 146 Other plans reviewed for improvements to Texas Avenue are (1) removing parking and having two lanes traffic in each direction, (2) one lane traffic in each direction, with parking and left turns lanes, and (3) permitting parking to remain with one lane traffic in each direction and eliminating left turns off Texas. The Merchants preferred the latter proposal, and also favored sidewalk and street improvements. -The State Highway Department has assumed the responsibility of signalizing the intersection of Spur 330 and Airhart Drive. Left turns off Spur 330 onto Airhart will not be permitted; however, turns may be made to the Ramade Inn and restaurant. Adjourn Councilman Cannon moved to adjourn to an Executive Session; Councilman Lander seconded the motion. The vote was unanimous in favor and the Mayor declared the meeting adjourned. Approved: ✓ C.
