The City Council of the City of Baytown met in regular session on Thursday,
June 8, 1972, at 6:30 p.m., in theBaytown City Hall with the following members in

Mayor Walker called the meeting to order and the invocation was offered by
Mrs. Edna Oliver.
Approve Minutes
Mayor Walker called for consideration of the minutes of the special meeting
of May 23, 1972. Councilman Lander moved to approve the minutes as submitted; Councilman
Gentry seconded the motion. The vote was unanimous in favor.

Mr. Lanham recommended these bids be thrown out, and authorization be given to

was made as a result of comparisons of bid prices received in other cities for
trucks of this size and smaller; in previous years, at least five companies have
submitted bids on fire trucks, as opposed to the two bids received on this particular
truck.
Also, specifications will be rewritten to keep in line with the more
conventional type of equipment, hopefully reducing the cost, and attracting more
bidders. Councilman Walker moved to accept the administration's recommendation
and re- advertise for bids. Councilman Cannon seconded the motion. The vote:

Consider Amending Chapter 4 of Code - Alcoholic Beverages
As instructed, Mr. Richardson prepared an ordinance amending the code, alcoholic
beverages, to include parks in the 300' requirement. After briefing the subject,
Mr. Richardson recommended Council not adopt the ordinance as it would be invalid
and in conflict with state law. State law gives Council the authority to deny the
sale of alcohol within 300' of a church, school, or public hospital= the law says
nothing about a park.
Councilman Lander moved to instruct Mr. Richardson to prepare a resolution
stating Council's opposition to granting licenses within 300' of a park. Councilman
Gentry seconded the motion. The vote follows:

Public Hearing - Annexation
Mayor Walker declared thepublic hearing open for the annexation of Kings Bend
Subdivision, Section III. Mr. Lanham briefed Council on the requirements of annexation
and the advantages and disadvantages:
A City may annex, at its will, not more than 10% of the area of the city per
year, and must be within the 2 -mile extraterritorial jurisdiction. A city may, however,
accrue up to 30 %.
A city may annex by request of the property owner; this is not involved in the 10 %.
Thus, the city may control the development in the area. The city is benefitted by
adding the area to the tax rolls; city services, i..e., fire &police protection, water,
must be provided within three years, and includes building permit services.
The annexations could also help prevent the development of water districts.
No one appeared in relation to the annexation of Kings Bend, Section III, and Mayor
Walker declared the public hearing closed.
Change in Plumbing Code
Upon the request of thePlumbing Appeals Board, Mr. Lanham asked Council to consider the
use of limestone aggregate concrete pipe with rubber gaskets as sewer lines for
residential use. Mr. Leo Frost, Building Inspector, stated this material would be
satisfactory. Councilman Gentry moved to adopt an ordinance allowing this change as
requested. Councilman McWilliams seconded the motion. The vote follows:

THE CITY OF BAYTOWN, TEXAS, BY THE AMENDMENT OF SECTION 12.1.4, MATERIALS
& USES, "SUGGESTED PLUMBING CODE.... PREPARED BY THE TEXAS MUNICIPAL LEAGUE
AND DISTRIBUTED IN THE MONTH OF JULY, 1971 ", INCORPORATED BY REFERENCE
IN ORDINANCE NO. 1117 OF THE CITY OF BAYTOWN, BY THE ADDITION OF LIMESTONE
AGGREGATE CONCRETE SEWER PIPE WITH RUBBER GASKET, BUILDING SEWER OUTSIDE,
PROVIDING A REPEALING CLAUSE, CONTAINING A SAVINGS CLAUSE, PROVIDING

Repeal Ordinance - left turns made by motor vehicle
Mr. Richardson explained this ordinance required all vehicles making left turns
at an intersection to pull over to the right of the road and wait until all vehicles
from the rear have passed before turning left. Although adopted in the original
codification, state law now makes this ordinance invalid. Councilman Cannon moved
to adopt an ordinance to repeal this ordinance. Councilman Gentry seconded the
motion. The vote follows:

ORDINANCE NO. 1235
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, REPEALING
SECTION 18-42 OF THE BAYTOWN CODE OF ORDINANCES AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
Location of proposed Public Works Facility
The Bond Program provided $200,000 to build the new Public Works facilities.
Several possible sites were studied. Mr. Lanham recommended building on the present
location, 2.75 acres on Lee Drive. The facilities would front on Lee Drive in
order to provide parking space. The site of the City Hall and the Civic Center had
been considered, but because of the amount of truck traffic and the deterrent it would
have on the wooded surroundings, this would not be advantageous. Preliminary approach
has been made to the state highway depa -tment for the use of the area underneath
Spur 201 for storage. In working with the architect, Mr. Lanham will emphasize
outside storage for most of the equipment, and utilize funds for small office space
and storage and work areas for the meter shop, traffic signal repair shop & city
equipment. Councilman Gentry moved to accept the Administration's recommendation.
Councilman Cannon seconded the motion. Discussion followed concerning the feasibility
of substations for storage of trucks and heavy equipment. Mayor Walker called for a
vote on the motion:

Animal Shelter Facilities & Report on Study of Recommendations of Baytown Kennel Club
As per the request of the Baytown Kennel Club, the animal wardens have been
instructed to notify owners of tagged dogs, if they can be located, when their
dogs have been picked up. Concerning better enforcement of the dog ordinance
and longer hours at the shelter, these will require additional manpower and
Mr. Lanham suggested these be studied for the next budget.
Ten thousand dollars has been budgeted for an animal shelter. This building
can be constructed next to the existing one. Repairs to the old building amount to
$1700 if it is to be used in conjunction with the new building. The new building
will need 1100 square feet with 800 square feet of outside paved runs; this will
meet the specifications and sanitation facilities required by the committee on the
Animal Control Ordinance, but will cost $8300. This is $4,000 more than budgeted,
and Mr. Lanham recommended this be taken from surplus; also, our building inspector,

Mr. Frost, could act as the general contractor and take bids on the various parts,
i.e., fencing, foundation and the building. Councilman Gentry moved to accept the
Administration's recommendation. Councilman McWilliams seconded the motion.
Mrs. Arthur Miller of Baytown Kennel Club requested a Council member visit
the animal shelter in Pasadena which is operated by the Health Department. Mayor
Walker indicated he would accept this responsibility. Also requested was a
dispatcher for the Humane Department; Mr. Lanham stated the funds for a dispatcher
and radio equipment could not be provided from the present budget.

Signalization at intersection of Oak and Carver Streets
Mr. Lanham reported on his study of the request for a traffic light at the intersection
of Oak and Carver Streets. A 24 -hour volume traffic count showed a light- was not
Justified; however, Mr. Lanham recommended a light be installed on a trial basis at
a cost of approximately $2200.
The residents in this area contend that motorists do not observe the 4 -way stop
sign at this intersection, and feel a traffic light would help protect their children
crossing the street. Although the Traffic Committee has recommended this request be
granted, Councilman Cannon, chairman, expressed his personal opinion that a light would
hinder the situation. When approaching a stop sign, a motorist knows he must stop;
when approaching a traffic light, he will often surge to get through before the light
changes. Councilman Cannon moved to reject the Administration's recommendation and
deny the request for a traffic light, and encourage -the police department to provide
strict enforcement at this intersection. Councilman Walker seconded the motion.
Police Chief Wilkinson indicated the patrol has been increased and arrests have been
made. The vote on the motion follows:

COMMITTEE REPORTS.........
Mown Ambulance - Increase rate for second patient
Councilman Cannon referred to the recently increased rates for Baytown Ambulance
Service. Before the increase was granted, the charge for the second patient was one -half
the charge for the first. Through an oversight, this was not discussed; the contract
now provides $20 for the first patient and $7.50 for the second. Councilman Cannon
moved to increase the rate for the second patient to $10.00. CouncilmanGentry seconded
the motion. The vote follows:

UNFINISHED BUSINESS...........
City Clerk - Certification Program
Mayor Walker called attention to a letter informing Council that Baytown's City Clerk,
Edna Oliver, has completed a four -year Texas Municipal Clerks Certification Program.
The course included 200 hours of instruction in addition to many hours of home study.
Councilman McWilliams moved to adopt a resolution commending Mrs. Oliver for her
accomplishment. Councilman Walker seconded the motion. The votefollows:

Harris County Community Action Association - Board of Directors
The term of Mr. Ted Kloesel as a member of the Board of Directors of the Harris
County Community Action Association expired June 5, 1972. Mayor Walker requested Council
be considering an appointment for the next regular meeting, June 20.

CITY MANAGER'S REPORT...........
QMress Street - Drainage, Street Condition, & -Sewer Stoppage
Mr. Lanham made the following recommendations concerning the petition presented
Council from Cypress Street residents at the meeting of June 8:
(a) The north portion of the street is in poor condition, however, the base is
still good. Mr. Lanham suggested authorization to include surfacing this street in
Phase II of the Street Improvement Program, cost approximately $5,000 for two blocks.
(b) To solve the drainage problem, a deep ditch could be created, but would
eliminate parking. He recommended constructing 560 feet of storm sewer at a cost
of $2,750 using city forces. 7
(c) Concerning sewer line stoppage, infiltration abatement crews will be sent
in to clean the lines.
Councilman Gentry moved to accept the Administration's recommendations. Councilman
McWilliams seconded the motion. The question of priorities concerning streets and
drainage was raised by several council members, afterwhich Councilman Cannon requested
the Administration make a list of drainage needs in the-City, thus enabling priorities
to be determined. He noted that prior to Mr. Lanham's employment, the Traffic
Committee had requested the Administration study the needs for walks along busy streets
for school children which will require storm sewers. Mayor Walker called for a
vote on the motion:

Country Club Oaks - Craigmont
Because of the number of water main breaks in this area, lines will be
replaced on St. Andrews Drive, Country Club View, and Hazel Street with cement
asbestos. The work will be done by city forces, except for the road boring, and
with existing funds in the budget.
Holloway Addition - Drainage
Mr. Jack Morton, City Engineers, explained the solutions to relieving
the drainage problem in Holloway Subdivision. The subdivision is located between
Bob Smith Road and Massey Tompkins, immediately east of the railroad track. In
order to cut a ditch that would flow, it would mean deepening the ditches in front
of the homes, northward to Massey Tompkins. This is limited by the Harris County
Flood Control outfall ditch on the west side of the railroad. This ditch is not deep
enough to carry the water if the ditches in Holloway are deepened. Mr. Tom Langford
has been approached; but would not give - -a date for the deepening.
One alternate to the problem; rather'than going down the roadside
ditches -in the subdivision, is to find a easement from - McPhail Street - over to the

railroad ditch and get permission from the railroad company to deepen their ditch up
to Massey Tompkins. This would eliminate-the-Very deep- ditches in front of the
residences; however, would not solve the drainage problem on Massey Tompkins Road.
Councilman Cannon moved to send an official communication from the City
Council to Mr. Tom Langford requesting expedition of deepening the ditch; also, the
Administration approach the railroad from the possibility of deepening 'their ditch.

Perimeter Roads
Bids will be received for perimeter roads in Brownwood on June 28; Mr.
Lanham requested a special meeting for June 29, 5:00 p.m., to consider the bids.

Texas Highway Commission
The Commission has approved funds for a feasibility study for projects in our
application for TOPICS money. This study will also include our request to make Bayway
Drive a spur.
The Commission has approved the surfacing of Highway 146, from Alexander
Drive to Cedar Bayou Road, with a non-skid material. Mr. Dale Marvel indicated bids
would be taken within the next two months.
Houston Legal Foundation
The Houston Legal Foundation has requested the City of Baytown support their
request for a full -time attorney for Baytown for the disadvantaged. This is sponsored
by the OEO, and will require no monetary support for the City.
Proposed Budget Schedule
Mr. Lanham plans to present the proposed budget to Council July 30 and begin
work session by August 10. Hopefully it will be adopted and the tax rate set at the
first meeting in September, thus enabling the budget to be in the hands of the people
by October 1.
Executive Session
An Executive Session will follow adjournment of this meeting for discussion
of right -of -way.
Certificates of Obligation
In regard to the certificates of obligation needed to finance the remainder--- of
the construction of the jail for the new police building, all necessary steps will be
taken when required, and all necessary documents will be presented.
Initiate method to record complaints-
Councilman McWilliams requested the Administration to initiate a method of
recording requests and complaints of citizens in order for Council to see what the
needs and concerns of the people are.
Mr. Lanham indicated this might possibly be done throx;gh' revisions of the
monthly report Which Council receives.

Councilman Gentry moved to adjourn= Councilman Lander seconded the motion.
The vote was unanimous in favor and the meeting adjourned to an Executeve Session.
