MINUTES OF THE SPECIAL MEETING
OF THE CITY COUNCIL OF THECITY OF BAYTOWN
May 17, 1972
The City Council of theCity of Baytown met in special session on Wednesday,
May 17, 1972, at 600 p.m., in the Council Room of the Baytown City Hall with the
following members in attendance:

Mayor Pro Tem Allen Cannon called the meeting to order for the purpose of
discussion of Brownwood perimeter roads; Two hundred thousand dollars was voted
in the 1970 Capital Improvements Bond Issue for construction of roadways; Mr. Johnny
Busch and Mr. Jim Hutchinson, consulting Engineers for the City, presented three plans
for the roadways:
Plan I- Perimeter roads would be raised to seven feet, a width of twenty
feet and a shoulder width of five feet. The internal drainage would be
redirected at two points for run -off through the levee. Pumps are not
included at this time because of lack of funds. The new cost estimate
for this project is over $300*000.
Plan II- The same roadway structure would be built & driveways filled,
but the drainage would not be redirected; water would run through the
levee at approximately the same points it presently runs through. The
cost estimate is some $20,000 less, or $280,000.
Plan III The roadway would be built along, or just off the bayshore,
at a width of ten feet and height of seven feet. This would help prevent
flooding from wind - blown tides. The road would not be an access road
for home owners, and would probably be open only once a year. This road
would be cheaper and quicker to build; pumps, when installed, would cost
less at this location. A permit will have to be secured from the Corps
of Engineers and the Texas Parks & Wildlife Department, and will take
a minimum of 30 days.
A question and answer period followed with the Brownwood residents concerning the
proposed improvements. Also, because of the continued high tide flooding of certain
roadways, it was proposed that the sections presently below three feet mean sea level
be raised but the council was reluctant to make any decision on this proposal without
some estimate of cost. Mr. Morton, Director of Public Works, was directed to prepare
cost estimates for presentation to the Council prior to the next regular meeting on May
23.
Dr. W. 0. Finch, City Health Officer, presented results of bacteria tests made at
several locations in Brownwood, and concluded the pumps must be installed to prevent
contamination. Also discussed in relation to this was the breaking and seepage
of sewer lines during floods.
Counai_l:.found Plan III to be interesting, and one to be pursued. Mr. Busch will
apply for the permit as soon as possible. Mr. Richardson was directed to pursue
all legal aspects of building the roadway off the shore, and if possible present
his conclusions at the next meeting May 23.

Mr. LeFevre recommended accepting the low bid of James J. Stipe. Although
-Mr. Stipe did not enclose a bid bond with his bid, he has since provided one;
Mr. Richardson feels there will be no legal problem with accepting the bid. The
portion of the bid ralating to the fountain is approximately $500 over the
appropriations allowed for this project, and Mr. LeFevre requested the amount be
transferred from Council Contingency Fund. Councilman Gentry moved to accept the
bid of Mr. Stipe, and to authorize the City Attorney to prepare a resolution transferring
the $500. Councilman Walker seconded the motion. The vote follows:

SLAB FOR PARKS MAINTENANCE BUILDING, AND VARIOUS SIDEWALKS AS PART OF
THE CAPITAL IMPROVEMENTS PROGRAM, AND AUTHORIZING THE CONTRACTING OF
INDEBTEDNESS BY THE CITY FOR THE SUM OF SIXTEEN THOUSAND SEVEN HUNDRED
SEVENTEEN AND 92/100 ($16,717.92) DOLLARS WITH REGARD TO SUCH AGREEMENT.

Mr. LeFevre recommended accepting the low bid of Gene Hazelwood. Mr. Hutchinson
explained this was the second time bids had been taken, and that several modifications
in the specifications had been made to keep within monies available. Councilman McWilliams
moved to accept the bid of Hazelwood; Councilman Walker secon ded the motion. The
vote follows:

IMPROVEMENTS PROGRAM, AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY
FOR THE SUM OF FORTY THOUSAND SIX HUNDRED FIFTY -SEVEN AND N01100 ($40,657.00)
DOLLARS WITH REGARD TO SUCH ACCEPTANCE.

Mr. LeFevre recommended re- advertising this project as only one bid was received,
and he did not feel it competitive.

Mr. LeFevre recommended accepting the low bid of Riggs Construction Company. Council
Councilman Lander moved to award the bid as recommended and Councilman McWilliams seconded
the motion. The vote follows:

ACCEPTING THE BID OF RIGGS CONSTRUCTION COMPANY FOR THE ERECTION
OF A PARK MAINTENANCE BUILDING, JOB NO. 72-523, AS PART OF THE
CAPITAL IMPROVEMENTS PROGRAM, AND AUTHORIZING THE CONTRACTING OF
INDEBTEDNESS BY THE CITY FOR THE SUM OF FOURTEEN THOUSAND FIVE
HUNDRED AND 45/100 ($14,500.45) DOLLARS WITH REGARD TO SUCH AGREEMENT.
