1972 01 24 CC Minutes, Special}l�l MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN January 24, 1972 The City council of the City of Baytown, Texas, met in special session on Monday, January 24, 1972, at 5:00 o'clock p.m., in the Council Room of the Baytown City Hall with the following members in attendance: F Jody Lander Councilman Ted Kloesel Councilman Jim McWilliams Councilman C. 0. Walker Councilman Allen Cannon Councilman C. Glen Walker Mayor Howard F. Northcutt Acting City Manager Absent: Leonard Stasney Councilman Neel Richardson City Attorney The meeting was called to order by Mayor Walker and the following business was transacted: Ordinance - Contract with Realtors Mayor Walker introduced and read the caption of three ordinances authorizing the Mayor and City clerk to execute a contract with Carter H. Miller, Realtor, J. E. Rutter, Realtor, and Ray I. Harvey, Realtor, for appraisal services concerning acquisition of rights -of -way for sanitary sewer improvements, under the 1970 Bond Program. The terms of the proposals were discussed and approved. Councilman Kloesel moved to adopt the ordinance. Councilman Lander seconded the motion. MILLER REALTOR, FOR APPRAISAL SERVICES FOR USE IN ACQUISITION OF RIGHTS -OF- WAY INCIDENT TO CONSTRUCTION OF PERMANENT SANITARY SEWER IMPROVEMENTS UNDER THE 1970 BOND PROGRAM CONSISTENT WITH THE TERMS, RATES, AND FEES AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY CONSISTENT WITH THE TERMS AND FOR THE AMOUNTS AND RATES SET OUT IN SAID PROPOSAL AND PROVIDING FOR AN EFFECTIVE DATE HEREOF. ORDINANCE NO. 1160 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A CONTRACT WITH RAY I. RUTTER, REALTOR, FOR APPRAISAL SERVICES FOR USE IN ACQUISITION OF RIGHTS -OF -WAY INCIDENT TO CONSTRUCTION OF PERMANENT SANITARY SEWER IMPROVEMENTS UNDER THE 1970 BOND PROGRAM CONSISTENT WITH THE TERMS, RATES, AND FEES SET OUT IN THE PROPOSAL OF SAID REALTOR, DATED JANUARY 21, 1972, AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY CONSISTENT WITH THE TERMS AND FOR THE AMOUNTS AND RATES SET OUT IN SAID PROPOSAL AND PROVIDING FOR AN EFFECTIVE DATE HEREOF. Ordinance - Authorize Payment of Termination Benefits to D. R. Voelkel The Mayor introduced and read an ordinance authorizing payment of termination benefits to D. R. Voelksl, whose resignation was accepted by Council January 17, 1972. Councilman Cannon moved to adopt the ordinance. Councilman Walker seconded the motion. Discussion followed concerning the possibility of retaining Mr. Voelkel on a consulting basis, and what effect this would have on additional benefits. It was explained that this ordinance terminates any further obligation from the City. The vote follows: Ayes: Councilmen Lander, Kloesel, McWilliams, Walker, and Cannon Mayor Walker Nasy: None The caption of the ordinance follows: ORDINANCE NO. 1158 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING PAYMENT OF TERMINATION BENEFITS TO D. R. VOELKEL WHOSE RESIGNATION WAS ACCEPTED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN ON THE 17th DAY OF JANUARY, 1972, AND PROVIDING FOR AN EFFECTIVE THEREOF. Ordinance - Designate Mr. Voelkel as Special consultant for City Mayor Walker introduced and read the caption of an ordinance designating Mr. D. R. Voelkel as special consultant for the City, and authorizing payment of $4,100.00 for these services. The $4,100.00 is a round figure calculation, equivalent to three - months salary. Because Mr. Voelkel was paid $600 lump sum cost of living raise for the year of 1972, the portion of the year he will not be working has been deducted. Mayor Walker called for a motion on the ordinance. Councilman Cannon moved to adopt the ordinance. Councilman Lander seconded the motion. Further discussion followed as to how long Mr. Voelkel's services would be required. Councilman Walker suggested a period of sixty days, or until the City finds another Manager, or until Mr. Voelkel finds other employment. Councilman Kloesel suggested retaining Mr. Voelkel's services on a thirty -day basis to come up with a final report on the status of the Bond Program, Maintenance, etc. At the end of thirty days, the department heads could pick up these projects. Councilman Kloesel stated he was in favor of the severance pay, but because it might be illegal, did not think it wise to give the pay by calling it something else. Councilman Cannon felt Mr. Voelkel is entitled to the severance pay and suggested putting future professional employees on a contract basis to prevent further recurrences of this situation. He felt Mr. Voelkel's services were necessary to bring department heads up -to -date. Mayor Walker felt ialue could be arrived from Mr. Voelkel's knowledge, and that the Council had a degree of moral obligation to live up to its commitment. R. VOELKEL AS SPECIAL CONSULTANT FOR THE CITY OF BAYTOWN, AND AUTHORIZING PAYMENT OF FOUR THOUSAND AND NO 1100 ($4,100.00) DOLLARS IN THIS REGARD AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Adjourn There being no further business to come before the Council, the Mayor declared the meeting adjourned, as the Council has been invited to attend the Traffic Committee meeting with representatives of the Railroad. ////" C.
